Arizona judge rejects bid to nix death penalty for Jodi Arias

(Reuters) - An Arizona judge has again turned down a bid by convicted murderer Jodi Arias to be spared the death penalty during her sentencing retrial for killing her ex-boyfriend in 2008, court documents showed on Friday.

In a written ruling, Judge Sherry Stephens dismissed claims made by attorneys that the case was compromised when a key member of Arias’ defense team was temporarily barred from visiting Maricopa County jails.

“The defendant has failed to establish she suffered any prejudice as a result of the incident involving the mitigation specialist,” Stephens said in a ruling logged by the court on Friday but dated May 27.

Mitigation specialist Maria De La Rosa, who helps gather information to spare defendants a death sentence, was barred in March from the jail system after being accused of smuggling one of Arias’ drawings out of a facility.

The ban by sheriff’s officials was lifted a week later and she was again allowed to visit Arias, who faces a September retrial of the penalty phase of her case.

PHOENIX, May 27 (Reuters) - An Arizona judge has rejected media requests to allow live broadcasts of court proceedings to determine if convicted killer Jodi Arias should receive the death penalty for murdering her ex-boyfriend in 2008, documents showed on Tuesday.

Judge Sherry Stephens ruled that the penalty phase may be recorded but that any resulting audio or video recordings may not be made public until after a verdict has been reached, according to court papers.

The judge also said that in the unlikely case she opts to change course and allow limited live broadcasts, such airings would be subject to a 15-minute delay.
 
A new sentencing phase jury will be selected in September following months of delays in the sensational case, which had been live-streamed on the Internet and attracted tens of thousands of viewers across the nation.

Since then, further proceedings have been argued mostly in closed-door proceedings, including the request to broadcast the penalty phase. Stephens made her ruling in an entry logged by the court on Tuesday but dated May 21. She did not make public her reasons for the decision.

PHOENIX -- Family and friends of Travis Alexander gathered Wednesday to mark the sixth anniversary of his death.

Alexander was 30 years old when his ex-girlfriend, Jodi Arias, shot and stabbed him inside his Mesa home on June 4, 2008.

Alexander's siblings gathered at his grave in California, and a small group of Arias trial watchers, who have come to know the Alexander family, gathered at the Maricopa County Superior Courthouse.

"We're just here in support of the Alexander family," trial watcher Pamela Jones told 3TV.

The group lit candles and released balloons in Alexander's memory.

Hi tamikosmom

Long time since I have been here. I'm on my 2nd chemo round! 4th blood transfusion on Tuesday. Lost my hair this time around! But thank you Jesus, for the strength to fight for my life! I'm actualy feeling better in someways! It mastecised to the liver! What a way to get my figure back huh! Lost tons of weight! But I've not lost the will to live! I'm not worried, scared nor depressed! I have faith and that keeps me going. Death! All I can say! Ain't no one got time for that lol! Seriously.

I am probably going to get booted out of here -- but I am going to say it.  We have been praying for loca and wish her strength during this time.  But this is not the thread -- Janet you know this all too well.  Kindly direct loca to the appropriate thread.    You had already responded to her May 23rd post.  When I come here, with the limited time I have, I want to read about the topic.  Is it too much to ask that you follow the rules like the rest of us or are you the exception to the rules?  Again, it has nothing to do with loca or praying or wishing her well.

For over a year in Travis's thread, I have bitten my tongue (slapped my fingers) so as not to address this very situation for fear of ME being off-topic, but I have to agree with Sister, now that it has been brought out into the open. We all have limited time to devote to Travis's thread and to come here and find prayers and updates on a fellow member's trying health issues is just not fair to us. There are many other avenues in this forum to express our concern for our fellow members than in a Criminal-Murdered thread. We all wish our fellow member the very best and I for one, would like to express that concern, but in the appropriate thread, not in this one. I know I am talking out of turn and off-topic, but so has everyone else here who has been discussing our fellow member's health issues for over a year now and they have not been called out for it.

I apologize for my off-topic post and await my reprimand.

hi Monks and Mods...been a while for me, but SM is still my 'first' love.  Life has gotten in the way of my computer time...but hopefully that is in the past.  I have continued to follow hoping to eventually see that the Alexander Family receive justice for his horrible murder.  I am so disappointed that the judge has banned camera coverage, but it doesn't surprise me. IMO her ineptness was highlighted in the trail that she probably doesn't want taxpayers viewing it again Monkey Devil! Hope everyone is well and just hanging on to faith that justice will prevail.

Above all, the hard, sharp click of the metal door unlocking was the sound I was longing to hear! By then the Court Pio had stopped by and we both jumped up and made our way into the hearing. I couldn’t believe we were actually getting in! What’s happened in the past is they would unlock the door and the hearing was over so I wasn’t sure what I would really get to hear. As I took my seat Judge Stephens asked Jodi Arias if she wanted to address the court. My neck snapped toward Jodi wondering what she would say! This was going to be good I could tell. She whispered in Maria De La Rosa’s ear and then looked at the Judge. Jodi’s appearance hasn’t changed much since her trial began over a year ago. Her hair is long, she still wears glasses and her build is still thin. Jodi began to speak very softly and I had to strain to hear from all the way in the back of the courtroom. She stated ” I’m not ready to represent myself at this time, I need more time to prepare.” Judge Stephens peered at her through her glasses and responded “There will be no delays. This trial is on schedule and will begin on September 8th.” Jodi then whispered to her lawyers Kurt Nurmi and Jen Willmott along with Maria De La Rosa. I had to take a breath and take it all in, Jodi was planning on representing herself? The visuals of how this trial would go swirled through my head as I saw Juan vs. Jodi and how the objections from both tables would be flying! What a trial that would be! As smart as Jodi thinks she is, she isn’t a match for Juan Martinez and he proved that with her on the stand during the first trial. As Judge Stephens made another hearing date of July 30th at 8:30am, she asked Jodi one more time if she had anything else to say. Jodi conferred with her counsel and said “no.” With that the hearing was concluded, and while it didn’t last long it was very interesting to learn that maybe while we have been locked out of hearing after hearing Jodi has been fighting to be in charge of her own re-trial.

PHOENIX -
The re-sentencing phase of the Jodi Arias trial is ramping up again.

The convicted killer and her lawyers were back in court Wednesday morning.

Video cameras were not allowed in but still photographs show Arias back in her black-and-white prison jumpsuit and wearing her plastic glasses.

Procedural matters were discussed with another court date set up. A status conference is set for Aug. 8 at 8:30 a.m. No TV cameras will be allowed.

The penalty phase is set to start on Sept. 8.

At Wednesday's hearing, Arias' defense team claimed prosecutor Juan Martinez has not been forthcoming about potential witnesses for the sentencing retrial.

Prosecutors are seeking the death penalty.
