Day 22 of Jodi Arias trial: Judge won't release transcripts of Arias testimony
Posted: Jan 08, 2015 7:21 AM CST Updated: Jan 08, 2015 2:54 PM CST
PHOENIX (CBS5) -
The judge in Jodi Arias' sentencing retrial is postponing the release of Arias' closed-courtroom testimony in her sentencing retrial.
In a ruling that overturned Judge Sherry Stephens' decision barring the public from watching Arias' testimony, the Arizona Court of Appeals has ordered the transcripts released.
A lawyer for media organizations on Thursday requested release of the transcripts.
However, Stephens said she won't do that until the state Supreme Court rules on defense lawyers' motion to pause the retrial while they appeal the Court of Appeals' ruling.
The oft-interrupted proceedings in the Jodi Arias sentencing retrial resumed Thursday morning as the jury continues to determine whether Arias deserves life in prison or the death penalty.

Jodi Arias Loses Bid to Put Sentencing Retrial on Hold
PHOENIX — Jan 8, 2015, 5:57 PM ET
Convicted murderer Jodi Arias has lost a bid to put her sentencing retrial on hold while she appeals a court's ruling over the public's access to her trial.
The denial Thursday by the Arizona Supreme Court means a transcript of Arias' closed-door testimony on Oct. 30 is one step closer to being released.
Earlier Thursday, Maricopa County Superior Court Judge Sherry Stephens said she wouldn't rule on a request by news organizations to release a transcript of the closed-door testimony until after the state's high court chimed in on Arias' request to pause the trial.
Meanwhile, Stephens allowed a witness on behalf of Arias to testify Thursday under a pseudonym.

Delay, delay, delay...
Jodi Arias has already been found guilty. It's time to stop torturing the victim's family and friends, and spending a fortune on legals. One of the drawbacks of cases which can have the death penalty is the huge amount of time and resources expended for a sentence that often times is never even followed through. Years and years.... if at all. Jodi Arias and her defense team have been given a platform. Yank it out from under them. Sentence her to life without parole. JMHO

Day 23 of Jodi Arias trial: Push to drop death penalty
Posted: Jan 09, 2015 10:17 AM CST Updated: Jan 09, 2015 6:10 PM CST
PHOENIX (CBS5) -
Jodi Arias' attorney Kirk Nurmi, pleaded his case Friday, to spare the convicted killer's life.
Nurmi told Superior Court judge Sherry Stevens,
during an afternoon hearing
, that a number of issues have come up that have made it impossible for his client to receive a fair trial.
Nurmi argued that 14 witnesses have been afraid to come forward - because the court won't protect their identity.
He also said that prosecutors withheld key evidence, and that Arias' conviction was based on false testimony.
A Mesa police officer testified during the original trial that there was no pornographic material on the computer of murder victim Travis Alexander.
However, there's now proof that pornographic images were on the computer, according to Nurmi.
"Your honor, it is our argument here today, that under these highly unusual circumstances, the pursuit of the death penalty in this case is not lawful," said Nurmi.
Nurmi insists the false information hindered Arias's case and the judge has no choice but to have the state no longer seek the death penalty

Jodi Arias sentencing trial: Could it all be over Monday?
6:27 p.m. MST January 9, 2015
Will the Jodi Arias sentencing retrial be over by Monday?
On Friday, her defense attorney, Kirk Nurmi, made a last-ditch effort to have the prosecution's intent to seek the death penalty thrown out, his motion alleging prosecutorial misconduct and inability to get witnesses to testify on Arias' behalf because of a court ruling forbidding testimony in a closed courtroom.
Maricopa County Superior Court Judge Sherry Stephens said that she would rule by Monday
.
On Thursday, Stephens ordered the release of transcripts of the two closed-trial days with a witness who turned out to be Arias herself. Those transcripts are expected to be made public next week
.
But Nurmi said in Friday's hearing that 14 of Arias' mitigation witnesses will refuse to testify if they have to do so in public.
Martinez countered that the witnesses could be subpoenaed and forced to testify, or that they could have been interviewed on video or prepared affidavits.
Nurmi claimed that Arias has been denied her right to a fair trial.
"It's game over," he said. "She cannot present a good defense."
Stephens took the matter under advisement.
If she rules against Arias, trial will resume Monday

Mesa police detective testifies in Jodi Arias sentencing retrial
Posted: Jan 12, 2015 5:41 PM CST
Updated: Jan 12, 2015 6:40 PM CST
PHOENIX (KSAZ) - A Mesa Police detective was grilled on the witness stand, and there was a big ruling that didn't happen. Some of the highlights of today's action at the Jodi Arias trial.
Jodi Arias was found guilty of first-degree murder for murdering her ex-boyfriend Travis Alexander in 2008.
The jury was deadlocked on whether she should get the death penalty or life in prison. Det. Esteban Flores took the witness stand Monday.
Arias was in court watching attentively as her defense team questioned Det. Flores.
Arias' attorney Jennifer Wilmott accuses Flores of altering the files on Travis Alexander's computer by improperly waking his computer out of sleep mode.
Hanging over this testimony is the question of whether Judge Stephens could pull the plug on the entire sentencing retrial by taking the death penalty off the table.
That's what the Arias defense team asked for last Friday. The judge promised to rule by 9:30 Monday morning but didn't.
Instead, the judge said she wanted to wait for computer witnesses to finish testifying before ruling.
Meanwhile, we are still waiting to transcripts of Jodi Arias' secret testimony behind doors to the jury last fall. Latest word is that testimony should be made public tomorrow.
But no testimony is expected tomorrow, the trial will continue Wednesday morning.

Jodi Arias revealed few new details in closed-door testimony
January 13, 2015
PHOENIX (AP) —
Convicted murderer Jodi Arias' closed-door testimony two months ago at her sentencing retrial revealed few new details about her actions in killing her former boyfriend — and no specifics about why she was allowed to speak to the jury in secret.
Transcripts of the testimony were released Tuesday, weeks after an appeals court threw out a judge's decision to bar the public from the courtroom while Arias was on the stand.
At the time, the judge explained the witness, whose name was then kept secret, was skittish and wouldn't testify in public. The release of the transcripts came after news organizations protested the closure.
Dwane Cates, a criminal defense attorney in Phoenix who isn't involved in the Arias case, believes the courtroom was likely closed in hopes of preventing the case from becoming an even bigger media spectacle than it already was. He doubted the request was granted just to appease Arias.
"It had to do a lot with I think everybody wanted it closed," Cates said.
Arias was convicted last year in the 2008 death of Travis Alexander, but jurors deadlocked on her punishment. A new jury has been hearing testimony since mid-October over whether she should be sentenced to life in prison or death.
Prosecutors said Arias attacked Alexander in a jealous rage after he wanted to end their affair and planned a trip to Mexico with another woman. Arias has acknowledged killing Alexander but claimed it was self-defense after he attacked her.
Despite her reservations about testifying during the sentencing retrial, Arias has actively courted the spotlight since she was arrested in 2008. She did interviews on TV's "48 Hours" and "Inside Edition" after her arrest and was on the witness stand for several weeks during her criminal trial.
She also did a series of media interviews after the jury convicted her of murder.
Her lawyer Kirk Nurmi is quoted in the transcript as saying he was concerned about the media getting hold of the transcript.
As she did in her first trial, Arias said in the most recent testimony that she was raised by physically abusive parents and faced a string of failed romantic relationships in early adulthood. She also detailed the early days of her relationship with Alexander, including their first sexual encounters and bonding over religion.
Her testimony was halted after the appeals court overruled the unusual decision by Maricopa County Superior Court Judge Sherry Stephens to let Arias testify in private.
Prosecutor Juan Martinez didn't get a chance to question her then, though he did so at her criminal trial. It's unknown whether Arias will take the stand again.
The sentencing retrial, which had been expected to end in mid-December, is scheduled to resume Wednesday.

Convicted killer Jodi Arias struggled to admit murder, transcript says
January 13, 2015
(Reuters) - Convicted murderer Jodi Arias told a jury deciding whether she should be executed for killing her former lover that she struggled for two years to admit to herself that she did the crime, according to secret testimony released on Tuesday.
Arias, 34, wasted no time telling jurors last year in closed-door testimony during her ongoing sentencing retrial that she killed Travis Alexander at his Phoenix-area home in 2008, according to the Arizona Republic newspaper.
But in the testimony obtained by the newspaper, Arias expressed remorse and explained that her behavior in the time that followed the murder amounted to an attempt to hide her involvement, the paper said.
"Why did it take you two years to admit that ... that you did it?" the transcript quoted Arias' defense attorney as saying, according to the state’s largest newspaper.
"It took me that long to be able to admit to myself that - that I did it," she responded.
Her words were contained in roughly 250 pages of testimony given on Oct. 30 and Nov. 3 in Maricopa County Superior Court without the public or the press being allowed to attend the proceedings.
The testimony was released after news organizations mounted a legal challenge to Judge Sherry Stephens' decision to close the courtroom. On Friday, Stephens ordered the transcript be made public following a ruling by the state Supreme Court.
Defense attorneys had sought to keep the testimony private, maintaining that releasing it hampered Arias’ right to a fair trial. Arias, who testified for 18 days in her high-profile trial, said she feared for her safety and that media coverage would hurt her ability to state her case.

Even Jodi admitted what she did to Travis Alexander was "horrific". Self defense? Nope. Premeditated. Yep. Jodi murdered him in several different very painful ways. She thought she was so smart and had it planned out. She got caught. Time to pay up Jodi.

Secret testimony of convicted Arizona murderer Jodi Arias revealed
The transcript of the exchange with her lawyer was released Tuesday, two months after she took the stand in a closed-door portion of her sentencing retrial. Her testimony on Oct. 30 and Nov. 3 was held in closed court, but an appeals court ruled the transcript must be made available after news organizations protested
January 13, 2015
Jurors were unable to decide whether to sentence her to death, so a new jury was picked in the fall to consider capital punishment for Arias.
Her testimony on Oct. 30 and Nov. 3 was held in closed court, but an appeals court ruled the transcipt must be made available after news organizations, including The Arizona Republic and 12 News, protested.
In the transcript obtained by The Republic and 12 News, Arias admits to killing Alexander, and admits to feeling bad about it.
"Did you kill Travis Alexander?" lawyer Jennifer Willmott asked.
"Yes," Arias responded.
"When is the first time that you admitted that to anyone?" her lawyer followed.
"In 2010," Arias said.
"This happened in 2008, didn't it?," Willmott asked.
"Yes."
"Why did it take you two years to admit that, that you did it?"
"It took me that long to be able to admit to myself that — that I did it."
"Why did it take you that long to admit it to yourself?"
"Because — because what I did was so horrific that I couldn't have — I could never have imagined myself doing that to another human being."
The sentencing retrial is expected to resume this year.

Jodi Arias trial: Transcripts of Arias' secret testimony released
Posted: Jan 13, 2015 7:01 AM CST
Updated: Jan 13, 2015 6:45 PM CST
PHOENIX (CBS5) -
There won't be any testimony in the retrial of convicted murderer Jodi Arias on Tuesday, but court officials released a transcript of secret testimony given by Arias more than two months ago during her sentencing retrial.
The transcripts linked below were provided to KPHO's lawyer, David Bodney, after they were purchased from the court recorder. The paper used for printing these transcripts has a watermark on it that reveals "unauthorized" when scanned or copied. However, because KPHO is a client of Bodney, we are authorized to use the files
.
[PDF file: Oct. 30 testimony (144 pages)]
[PDF file: Nov 3 testimony (105 pages)]
CBS 5 read through the transcripts released Tuesday.
Arias wasted no time confessing to the crime.
Her attorney asked, "And did you kill Travis Alexander?
Arias said, "Yes."
Arias went on to express remorse over murdering her former boyfriend Travis Alexander, back in 2008.
Arias said, "This is somebody that I cared about and I caused... I caused that pain, and those were his last moments and it makes me sick and I wish.. I wish so badly that I could just do that whole day over again."
The convicted murderer also told jurors that she regretted lying to police, and leaving a misleading message on Alexander's voice mail shortly after she killed him.
"By the time I made the phone call, I realized that I had done something very bad," Arias told jurors. I couldn't remember details, but I knew... I had a very heavy feeling, and I knew that I had done something bad. So that phone call was the beginning of when I started to try to cover my tracks."
While on the witness stand, Arias also spent time talking about her life before she met Alexander.
Arias said that she was physically abused by her mother, father, and former boyfriends..
Arias went on to discuss how she met Alexander during a convention in Las Vegas, then had sex with him a week and a half later.
The testimony was cut short when Judge Sherry Stephens received an order from Arizona's Court of Appeals, stating that the secret testimony must stop immediately.

Sickening to watch Jodi Arias and her two stupid fat butt attorney's manipulating the court when the truth is, she MURDERED a man. Porn on the computer or no porn is not going to change that their
CLIENT MURDERED a man and was cruel about it. Cruel!
She could have stayed in California, but she PLANNED to KILL him and she carried it out.
Now Justice needs to be carried out. No way did Det. Flores delete anything off of that computer. No way!
I say lets take life in prison off the table and that leaves the death penalty.
