Will county commissioners approve a revised land-use code, something that has sparked intense feelings among rural landowners who value private property rights? Will a jury be selected to consider evidence against Mark Redwine, who is accused of murdering his 13-year-old son, Dylan, in 2012? Will Mother Nature bring much-needed moisture to Southwest Colorado, which is experiencing an “exceptional drought”?

 

JUSTICE FOR DYLAN?: Mark Redwine is expected to face a jury trial on suspicion of murdering his 13-year-old son, Dylan, who disappeared in November 2012 while on a court-ordered visit with his father.

Defense lawyers have been fighting to suppress evidence that they say would be prejudicial to their client. They are also fighting to move the trial to a different judicial district, claiming Redwine cannot receive a fair trial in La Plata County.

6th Judicial District Court Judge Jeffrey Wilson is expected to rule on hundreds of motions during the next several months. The trial was previously scheduled for late February, but the date was canceled after Redwine’s lawyers argued they would not be ready by then. Redwine has pleaded not guilty to second-degree murder and child abuse resulting in death. If convicted, he could face between 16 to 48 years in prison.

The trial of Mark Redwine, a Vallecito man accused of killing his 13-year-old son, Dylan, is set to begin June 24 in Durango.

The trial date and location were announced Thursday by 6th Judicial District Judge Jeffrey Wilson. Lawyers will have a chance to vet potential jurors at the start of the trial. If it becomes apparent an impartial jury can’t be seated in La Plata County, Judge Wilson said he will consider moving the trial to a different judicial district.

Public defense lawyers filed a motion seeking to move the trial to a different judicial district, saying their client can’t receive a fair trial in La Plata County. But Thursday’s decision suggests Wilson wants to hold a trial in La Plata County.

Dylan’s disappearance and murder generated local, state, national and international media attention, including a two-part episode on the “Dr. Phil” show.

John Moran, a public defender representing Redwine, declined to comment about the trial being held in Durango, saying a gag order prohibits him from speaking about the case.

In court Thursday, Moran said the midyear trial setting may be too early for the defense team to have its case ready to go.

“If we’re talking hard setting, sometime around September seems about the sweet spot,” Moran said before Wilson issued his order.

The June trial is expected to take four weeks.

There needs to be a time limit set for how many times an attorney can ask for delays. They do it
in hopes that something will change. It must be hell on Dylan's mom and his brother. STAY the Course and
may G_d bless them so that justice will finally come for that child, Dylan.

I agree about the delays, it's ridiculous!   

The judge has faced his final judgement.

Judge David Linwood Dickinson died Friday, September 8, 2017, in Durango due to complications from ALS Disease. He was 71 years old.

Dickinson was diagnosed in August 2014 with progressive bulbar palsy, which affects the brain stem and its ability to control swallowing, speaking and other functions, Wilson said. It eventually leads to Lou Gehrig’s disease, or ALS.

Dickinson died in his sleep with his wife by his side, Wilson said.

He retired two months after Dylan disappeared, I think he probably knew what he'd done and lived with that decision until he died almost five years later.  jmo

Well good, in my opinion, he was a bad judge. That kid would be alive if he had not forced him to go visit that murderer of a father. He will receive a greater judgment in death!!!! Dylan would be alive if it wasn't for that judge.

Well good, in my opinion, he was a bad judge. That kid would be alive if he had not forced him to go visit that murderer of a father. He will receive a greater judgment in death!!!! Dylan would be alive if it wasn't for that judge.

I recently purchased some of the court documents that are available, and even though a lot of details aren't included in what's available online; one thing really bothered me about what I've read.

Judge David Dickinson presided over MANY of the court hearings starting when Elaine filed for divorce in 2005. 

He's the same judge that ordered the visitation, that ended in Dylan's death.

He was familiar with this family, and the issues.

It was his JOB to look at the whole picture and see the signs; THEY WERE THERE. 

HE should have protected Dylan.

According to the 28 lawyers who responded to the survey, they identified areas which need improvement to include: promptness of rulings on pre-trial motions; promptness of decisions after trial to the Court; willingness to reconsider errors of law or fact after ruling in a case; application of rulings on law and fact in a consistent manner. Overall, these surveyed attorneys gave Judge Dickinson a less than average assessment of his case management skills.  Of the 54 non-lawyers who responded to the surveys, his overall approval ratings were acceptable, however, these results were below the statewide averages and district averages for all judges in Colorado.

Considering what happened with the civil suit against Mark, I'm thinking the statute of limitations has probably expired.  If it could help heal the wounds of this whole process, I hope Elaine would consider writing a book one day though.  She'll never get over losing Dylan, but I know it would mean a lot to be able to help others.  They have been through so much, and it's still going on...waiting for justice.  Wondering what trick the monster will try next, delay, delay, delay.  I don't know how they do it.

Defense team says canines are unreliable and may be biased by trainers

Mark Redwine’s attorneys are asking the judge overseeing his upcoming murder trial to exclude evidence from cadaver-sniffing dogs, questioning the scientific reliability, accuracy and consistency of canines trained to sniff for human remains.

Prosecutors accused Redwine of murdering his 13-year-old son, Dylan, after the boy disappeared in November 2012. The boy’s remains were found about eight months later buried along Middle Mountain Road near Vallecito Reservoir near Redwine’s home.

Sixteen dogs trained in detecting human remains scoured Redwine’s property in the weeks and months after Dylan’s disappearance. The canines alerted trainers and law enforcement to the existence of human remains near a hamper in Redwine’s master bedroom, near a clothes washer, in Redwine’s Dodge pickup truck and on the clothes he was allegedly wearing the night his son went missing.

Prosecutors, in part, hinge their case on the fact that cadaver dogs “indicated that a deceased person had been in his living room and bed of his pickup truck ...,” according to the indictment.

Defense attorney John Moran, in a 39-page motion filed last month, said the findings are unreliable, the dogs used in the Redwine investigation were not properly trained, dog handlers may have biased their animals, the dogs’ findings were not corroborated by any findings of actual human remains and the evidence obtained by dogs may be given “undue weight” in jurors’ decision about guilt.

 

6th Judicial District Chief Judge Jeffery Wilson has yet to respond to Moran’s brief supplementing his motions seeking exclusion of evidence obtained by cadaver dogs. Wilson previously declined the defense’s request to exclude sniffing dog evidence, but he did require the prosecution to explain how the evidence meets state standards for admissibility.

District Attorney Christian Champagne addressed the admissibility of cadaver dog evidence in November, saying in three motions responding to the defense’s arguments that the evidence is reliable and that prosecutors can submit documentation to help support their case.

 

Attorneys in the Redwine case are scheduled to meet Thursday afternoon for a status hearing ahead of the trial scheduled for late June in Durango. Attorneys in the Redwine trial are barred by gag order from speaking about the case.

Boy’s father, Mark Redwine, is charged with second-degree murder

Mark Redwine, the Vallecito father accused of killing his 13-year-old son, Dylan, in 2012, is scheduled to stand trial in September, a three-month delay from previous plans at the request of attorneys who say they need more time to prepare their arguments.

A four-week trial to determine Redwine’s guilt is scheduled to begin Sept. 18, said 6th Judicial District Attorney Christian Champagne. This is at least the second time Redwine’s trial has been postponed. Redwine has spent more than 600 days in the La Plata County Jail since his arrest in July 2017 in connection with his son’s death.

Redwine is charged with second-degree murder and child abuse resulting in death, both Class 2 felonies. He faces 16 to 48 years in prison if found guilty of either charge.

Dylan Redwine went missing in November 2012, last seen in the custody of his father, who the boy was visiting from Colorado Springs. Dylan’s partial remains were found almost a year later, about 8 miles up Middle Mountain Road near Redwine’s Vallecito home. The boy’s death was ruled a homicide by the La Plata County coroner.

Dylan Redwine, who would have graduated from high school in 2017, is remembered by his Bayfield High School classmates. He attended Bayfield schools through seventh grade.

Prosecutors say evidence collected by law enforcement and experts indicates Dylan’s blood and a cadaver were found in various spots around Redwine’s home and pickup, according to an indictment. Redwine and his son had a fraught relationship around the time of Dylan’s disappearance, according to the affidavit, and the area where the boy’s body was found was well-known to his father.

Redwine has pleaded not guilty to the charges.

Public defenders Justin Bogan and John Moran are asking Chief District Judge Jeffery Wilson to throw out evidence obtained by cadaver dogs – canines trained to detect human remains. Moran filed a legal brief addressing the issue in March. The language in the brief was drafted by a nonprofit legal organization called The Innocence Project. Judge Wilson previously denied allowing any filings from The Innocence Project, but he did not take issue with Moran’s admission in court Thursday that the brief was largely put together by The Innocence Project.

Judge to decide if boy’s comments to others can be substantiated

Prosecutors say Mark Redwine killed his 13-year-old son, Dylan, in La Plata County about 6½ years ago. Now, they have provided the court with detailed information about the boy’s statements to family, friends and legal professionals that they say link the father to the boy’s death.

Sixth Judicial District Attorney Christian Champagne filed a second-degree murder charge against Redwine in 2017, five years after Dylan disappeared after arriving in La Plata County on a court-ordered visit to his father. Court documents filed at the time suggested that tension between Redwine and his son was the “ultimate motive for the murder.”

Attorneys working the Redwine trial have been barred from speaking about the case and, therefore, declined to comment.

Redwine is charged with second-degree murder and child abuse resulting in death, both Class 2 felonies. He faces 16 to 48 years in prison if found guilty of either charge.

Prosecutors formalized the statements they would like to introduce from Dylan in a document that details what the boy said to others about his relationship with his father. The document, as ordered by 6th Judicial District Court Chief Judge Jeffery Wilson, cites evidence contained in hundreds of pages of discovery.

Wilson must now review Dylan’s statements and decide whether 13 conversations the boy had with 10 people before he died will be permitted at trial, which is scheduled to start Sept. 18.

The law Champagne is asking Wilson to rule on is known as hearsay: a statement about another person’s words that cannot be substantiated, cross-examined or established as credible. For example, if someone is testifying about a conversation she had with a friend as truth, but the friend cannot appear in court to substantiate the conversation, that would be hearsay.

In this case, Dylan is not able to testify about the statements prosecutors are attempting to admit into evidence or be cross-examined by the defense.

But prosecutors say the boy’s words are crucial to fact-finding, suggesting Dylan’s statements corroborate each other. Prosecutors maintain:

The boy had no reason to lie about the tension between him and his father.

Audio recordings and electronic records confirm the truthfulness of the conversations.

It would be an “injustice” to not allow the jury to consider Dylan’s statements, especially because his father downplayed the tension in the relationship to law enforcement after the boy’s death.

“Dylan cannot speak for himself, but he made it clear to many people that he did not want to visit the defendant and that there was significant tension in his relationship with his father,” Champagne wrote in a notice to introduce statements.

He added: “To allow the defendant to downplay this tension and mischaracterize this relationship to law enforcement in interview after interview without the jury having Dylan Redwine’s input would be an injustice and thwart the fact-finding, truth-seeking responsibility of the jury.”

Prosecutors say odor of human remains found in Vallecito home

Prosecutors who say Mark Redwine killed his son, Dylan, in 2012 will be allowed to present cadaver dog evidence at a trial in September, a judge has ruled.

Two handlers of German shepherds trained in human-remains detection may testify to the alerts and indications their dogs made identifying the odor of human remains in, around and on Mark Redwine’s property, Chief District Court Judge Jefferey Wilson ordered Tuesday.

A third dog handler, who Wilson disqualified as an expert in human remains detection, will be permitted to testify about Redwine’s alleged misleading of law enforcement when he provided a pillow case to investigators that he said would contain Dylan’s scent. The dog identified that the fabric did not contain the boy’s odor, and prosecutors may present the evidence to show Redwine’s motive to mislead investigators.

“All or nearly all of the evidence against the defendant in this case is circumstantial, and if the jury believes that the defendant intentionally misled the scent tracking dog handlers, such evidence will be very probative as to whether the defendant committed the crimes charged,” Wilson wrote in his order.

Wilson found testimony from Carren Corcoran and Katie Steelman about their training with their dogs Molly and Darc, respectively, probative, or serving to prove the facts of the case. Rae Randolph’s dog, Selah, did not meet the same standard of training in human-remains detection as Molly and Darc, Wilson said, and the handler’s testimony about her dog’s cadaver-scent locating abilities would prejudice the case and will not be allowed at trial.

Public defenders John Moran and Justin Bogan enlisted the help of New York City-based legal nonprofit Innocence Project in an attempt to convince Wilson to disallow cadaver dog evidence based on its scientific unreliability. Strategic litigation attorneys Dana Delger and M. Chris Fabricant traveled to Durango in June to argue on Redwine’s behalf.

Dr. Mary Cablk, who Wilson qualified as having “scientific expertise in remote sensing by use of the auditory, visual and olfactory senses,” testified to the unreliability of evidence obtained by canines and their handlers.

Cablk testified to the ephemeral nature of the odor of human remains, saying that, based on her experience, the lingering smell of a decaying human corpse after it has been removed from a location “should be detectable by HRD (human-remains detection) dogs for no more than one week,” Wilson wrote.

She argued the organic compounds that emanate the odor of human remains are volatile and may be detected “for no more than one week,” court documents show. She said there are no published studies about how long human remains linger.

The state’s strongest witness – Corcoran and her dog Molly, who has since died – detected the odor of human remains in Redwine’s home almost a year after Dylan’s disappearance.

“While this scientific explanation is reasonable, it is contradicted by persuasive, although anecdotal, evidence presented at the hearing ...,” Wilson wrote.

There are three reasons Wilson said he “can theorize” as to why the odor of human remains could be detected, including: “residual odor does exist and does not dissipate as fast as those in the scientific community believe”; “when decaying human tissue is at a location, it releases fluids and/or undetectably small amounts of human tissue that remain and/or are absorbed into the environment”; and “dogs are very sensitive to human facial expressions and can read extremely subtle changes in human expressions ... tips the dog off to the proper location” of the source of an odor of human remains.
 
Prosecutors plan to use human-remains detection dogs to show Redwine had a dead body in his home and truck.

District Attorney Christian Champagne is also seeking to admit Dylan’s statements to friends, family and legal officials about his relationship with his father before his death. Charging documents suggest tension between Redwine and his son was the “ultimate motive for the murder.”

The boy was missing for months after he traveled to Southwest Colorado on a court-ordered visitation with his father for Thanksgiving in 2012. Investigators found his partial remains in 2013 near the Bear Creek Loop trailhead on Middle Mountain Road north of Vallecito Reservoir. The boy’s skull was found in November 2015 just off Middle Mountain Road and had what appeared to be knife markings.

Law enforcement arrested Redwine in 2017 in connection with his son’s death. Prosecutors charged Redwine with second-degree murder and death as result of child abuse in 2017. He’s being held in La Plata County Jail on a $750,000 bail and must come up with about $112,500 to secure pretrial release.

The 57-year-old faces 16 to 48 years in prison if convicted on either count.

John Moran accused of domestic violence

A Colorado public defense lawyer assigned to the murder case against Mark Redwine was arrested Sunday on suspicion of misdemeanor assault and domestic violence.

John Moran, 42, of Durango, appeared Monday in La Plata County Combined Courts wearing an orange jail-issued jumpsuit.



Sr. Judge Raymond Satter issued Moran a personal recognizance bond, meaning he would be released Monday afternoon or Monday evening without paying any money. A protection order has been ordered preventing Moran from contacting the alleged victim.

According to an arrest affidavit, the incident occurred about 8:30 p.m. Sunday when Moran began arguing with his former girlfriend, who was sitting in a chair on the back porch of a house in the east 500 block of Fifth Street.

Moran became angry and pushed the woman’s chair, knocking it off the porch, according to the arrest affidavit. The woman fell to the ground, causing a knot and a bruise to her arm. The woman also said she might have a concussion from the impact to her head.

While on the ground, the woman saw people walking near the street and screamed for help, according to the affidavit. In response, Moran sprayed the woman with a water hose to “make her stop screaming,” the affidavit says. The woman then gathered her things and left the house.

In explaining the story to police, the woman said Moran “has a history of abusing her, and that she was afraid of him, especially when he was drunk.” They had been in a relationship for about 1½ years, “and she recently ended it because of the continued abuse,” according to the affidavit.

Police went to the house about 9:05 p.m. where they found Moran intoxicated, according to the report. He was arrested and booked into the La Plata County Jail.

As a public defense lawyer, Moran represents dozens of criminal defendants who cannot afford their own attorney, including Redwine, who is charged with second-degree murder and child abuse resulting in death in connection with the 2012 death of his 13-year-old son, Dylan.

Justin Bogan, who heads the Durango public defender’s office, is also assigned to Redwine’s defense team. Efforts to reach Bogan for comment were unsuccessful Monday.

Redwine’s trial is scheduled to start Sept. 18 in La Plata County.

Moran, who has no criminal history, was represented Monday by Durango defense lawyer Ingrid Alt, who declined to comment outside the courthouse. The Office of the Colorado State Public Defender’s Office declined to comment.

The 6th Judicial District Attorney’s Office and La Plata County Judge Dondi Osborne have recused themselves from the case for conflicts of interest. The 7th Judicial District Attorney’s Office is serving as a special prosecutor.
