It's about time.  He has been extremely disrespectful of the court.  Even O'mara has had to keep him in check a few times.

I agree that alleging child abuse at this point is wrong and am glad Nelson disallowed it.  Should have been a charge from the get go as Zimmerman admitted to knowing Trayvon was a child which makes his actions that night even worse, but it would be unfair to the defendant to include it just prior to closing.

I see the judge hasn't ruled on this issue yet. 

If she allows it she is going to have to delay closings until next week to give the defense more time to prepare.

That said, I do not believe she will allow it.

After yesterday's Judge Nelson harassing and argumentative behavior toward the defense and badgering Zimmerman whether he was going to testify before the end of the Defense's case, I would dare say that she needs to be brought up on judicial conduct charges.

 

I just watched the video of the exchange.  Nelson was not forcing Zimmerman to make up his mind about testifying, she was merely asking if he knew yet whether or not he would and she made it clear he could give her an answer later after the defense ended.  I believe she was trying to keep a tight timeline and prepare for George possibly taking the stand.  At this point she was done with West and his disrespect.

She knew exactly what his objection was going to be and she addressed it.

I don't think that Judge Nelson had any choice but to deny the Third degree murder Child abuse charges. That was such a stretch that it would have created such a poor precedent and obvious appeal situation that it would have affected cases forever in the future.

Also, if the jury convicted GZ of it and an Appeals Court struck it down, guess who would walk free?

I have to admit that it was a pretty sleazy move on the part of the prosecution as they had obviously been planning to do this for quite some time. It also tells me that they know they have a weak, weak case.

The problem with this is she was out of line to ask it at that point of the trial. The Defense had not ended their case yet, they still had two more witnesses at least to go. It is protocol for the defendant to be asked this at the end. Heck, why didn't she ask it at the beginning of the trial for that matter? What if one of the final two witnesses bombed completely and the State extracted some evidence/testimony from them that would have forced Zimmerman to take the stand, after  he had said to the Court that he was not? That is why it is standard to wait until the end. When West objected, she should have just said, ok you need more time and left it at that, not cause a hostile environment.
