This jury is doing a compromise verdict. Self defense does away with both second degree murder and manslaughter.

The crime of Manslaughter can be committed in one of three ways, either by:

  1  Manslaughter by Act (Voluntary Manslaughter): Committing an intentional act that was neither excusable, nor justified that resulted in the death of another person.
  2  Manslaughter by Procurement (Voluntary Manslaughter): Persuading, inducing, or encouraging another person to commit an act that resulted in the death of another person.
  3  Manslaughter by Culpable Negligence (Involuntary Manslaughter): Engaging in “Culpably Negligent” conduct that resulted in the death of another person.

What is amazing is all of the may be moot as this situation with the evidence that the State did not hand over to the defense and Friday's firing of the head of the State's IT department.

That will result in an appeal and could cause a potential guilty verdict of 2nd degree murder or manslaughter to be over-turned.

Let's face it, had that been turned over to the defense in a timely manner and the defense was able to track down who Martin was texting with and confirmed that it was TM, that evidence would have been damning the prosecutions case and have shown that TM was an experienced fighter and the weapon that he had was not Skittles and ice tea, but his fists.

That was a really huge piece of evidence not handed over by the State and the firing and subsequent smearing of him shows that the State is trying to discredit a potential whistle-blower.
