For either conviction, the state must prove Zimmerman is guilty beyond a reasonable doubt.

Second-Degree Murder

    The state must prove Zimmerman killed Martin and it was an intentional killing that was not premeditated or planned.
    If Zimmerman convicted of second-degree murder, he will face up to life in prison.
    If the 10-20-Life Law is taken into consideration, a second-degree murder conviction means Zimmerman will have to serve a minimum 25 years in prison.

Manslaughter

    The state must prove Zimmerman committed an act that caused death.
    If Zimmerman is convicted of manslaughter with a firearm, he could be sentenced to a maximum of 30 years in prison.
    Under the 10-20-Life Law, a manslaughter conviction means Zimmerman will have to serve a minimum of 25 years in prison and face a maximum of life in prison.
 

YUP. This is why a jury is not supposed to do a compromise verdict. Sometimes the compromise carries just as long a sentence as the first charge.

It is also why I feel that the State should not be allowed to over charge a case, because they know they can fall back on the lesser charges. Not just for this case, but any case. If the State cannot prove a case, they should not be able to charge it. JMO.

What happens if the jury cannot reach a verdict in George Zimmerman trial?


SANFORD, Fla. —

If the jury deliberating in George Zimmerman's second-degree murder trial tells Judge Debra Nelson it cannot reach a verdict, she will read them an Allen Charge.

What's an Allen Charge? An Allen Charge is a strongly worded reminder given by a judge to a jury that is hung or divided, and it can only be read once during deliberations.

Ultimately, the jury decides how long it will continue deliberations. If jurors still cannot reach a verdict, Nelson will declare a mistrial and the state will be free to try the case with a new jury.

SANFORD, Fla. – Judge Debra Nelson ruled Thursday that the jury in the George Zimmerman trial will have the option to convict Zimmerman of manslaughter for the shooting death of Trayvon Martin, but that they won’t be able to consider third-degree murder.

The highest charge against Zimmerman is second-degree murder. Under Florida law, that charge is an unlawful killing which “evinces a depraved mind regardless of human life.”

Zimmerman’s defense said they only wanted the jury to consider the initial second-degree charge. “We don’t want a compromise verdict, just like we don’t want a jury pardon,” said Zimmerman attorney Mark O’Mara on Wednesday. “We want a verdict based on the facts of the law and that’s an acquittal.”
