George Zimmerman defense: Who should pay bills? O'Mara answers questions

Mark O'Mara today said the state should pay all of George Zimmerman's legal costs because he was innocent but predicted it would wind up paying roughly one-quarter of that.

At a 1p.m. news conference O'Mara, who was Zimmerman's defense attorney, reiterated that he would soon ask a judge to sign an order, authorizing the state to cover $200,000 to $300,000 in Zimmerman's court costs.

That's what he estimates Zimmerman owes for legal expenses minus lawyers' fees.

But he conceded that the state agency responsible for those costs, the Judicial Administrative Commission, would likely dispute many of the submitted bills and would end up paying $50,000 or less.

O'Mara called that unfair and suggested that Special Prosecutor Angela Corey should have to pay the total cost plus Zimmerman's lawyers' bills because she filed charges against an innocent man.
 
Before the trial, O'Mara said repeatedly that defense funds were so low he might be forced to ask the judge to declare Zimmerman indigent, and thus, require the state to pay his legal bills. But that never happened.

This upcoming motion, however, would have the same effect.

It would be based on Florida Statute 939.06, which states that a defendant who has been acquitted is not liable for any costs associated with his case and, if he or she paid anything, they would be due a refund, if approved by a judge or clerk.

The money would come from the Judicial Administrative Commission, the state agency that pays the non-lawyer legal expenses of indigent defendants.


O'Mara said he would ask the judge to certify the costs he submits. He then expects the commission, which is commonly referred to as JAC, to challenge many

We have detailed before the perjury charge against George Zimmerman’s wife, Shellie, based on her testimony during a bail hearing as to their assets.

I’ve pointed out that legally the charge was weak because perjury requires an affirmative misstatement of a material fact, and many of her answers, while evasive and misleading, did not rise to that level.  Many of the questions at issue were ambiguous and called for opinionated characterizations.

Perhaps recognizing the weakness of the case, it appears that the prosecution has agreed to a plea deal. (Update: Plea Deal docs embedded at bottom of post.)

SANFORD - Shellie Zimmerman, the wife of acquitted murder suspect George Zimmerman, today pleaded guilty to a less serious form of perjury in a plea deal that requires her to serve one year of probation.

It was a negotiated deal, designed to avoid a felony conviction and to allow her to move on with her life. The 26-year-old was a nursing student nearly done with her schooling at the time of her arrest. Had she been found guilty of a felony — the perjury charge she was facing — she would have been banned from applying to become a state-certified nurse for three years.

She was composed during this morning's 10-minute hearing. She answered questions from Circuit Judge Marlene Alva in a clear, confident voice, saying, "Yes, ma'am," when asked if she understood what she was doing and believed it to be in her best interest.

There were only two unexpected bumps at the hearing: Defense attorney Kelly Sims asked the judge if his client could travel nationwide for a job while on probation. Alva said yes, so long as her probation officer authorized it.

It's not clear what that job might be. Shellie Zimmerman did not answer questions after the hearing, and Sims would not provide details, saying only, "You must wait for the next chapter."

The other bump involved community service. Her deal requires her to perform 100 hours. Sims told the judge that his client wants to do that at her church, but Alva said Zimmerman must perform it at a place authorized by the Florida Department of Corrections.

Sims said he'd try to work out the details.

After the hearing, Sims called the overall plea deal "more than a triple. It's a homerun." It allows Shellie Zimmerman to move on with her life without a felony conviction on her record.
 
The official charge filed against her is perjury during an official proceeding - of lying during one of her husband's bond hearings last year. That's a third-degree felony, which carries a possible five-year prison term and $5,000 fine.

She pleaded guilty to perjury but not at an official proceeding, a misdemeanor, punishable by a maximum of one year in jail and a fine of $1,000.

Shellie Zimmerman, the wife of acquitted murder suspect George Zimmerman, revealed new details about their strained relationship on Thursday — one day after taking a plea deal in her perjury case.

Shellie Zimmerman expressed uncertainty about the future of their relationship when asked if they are still together.

"I'm not going to answer that," Shellie Zimmerman said in the ABC News interview aired on Good Morning America Thursday.

"Of course I want to have children and stay married..." Shellie Zimmerman said.

"With George?" freelance journalist Christi O'Connor asks.

"That's something I'm going to have think about," Zimmerman responded.

She spoke about how she and George Zimmerman went into hiding after the February 2012 shooting death of Trayvon Martin, the unarmed teen from Miami Gardens who was visiting his father in Sanford.

"We have been pretty much gypsies for past year and a half," Shellie Zimmerman said. "We lived in a 20-foot trailer in the woods, scared every night that someone was going to find us and that it would be horrific."

She revealed she wasn't home the night her husband confronted Trayvon because they had an argument and she was staying with her father.

She told O'Connor her husband wouldn't have profiled Trayvon, as many have claimed.

"That's just not his way,'' Shellie Zimmerman said.

The interview SZ gave was very telling. Her carefully chosen words, body language and appearance in court alone speak volumes.. They seem kaput... I think SZ will move on, become a nurse, and a good one.

Saw on mail online that George was arrested for speeding for the second time since the trial ended. Going 65 in a 45  sigh... Some people never learn. For someone who is so worried about his safety maybe he should stop drawing attention o himself in negative ways? He s  Growing a beard now.

my next prediction is GZ will be in the news again... and not in a good way. 

I wonder if GZ is going to self-destruct.  Getting caught speeding  in such a short time (and receiving a citation on one)  isn't a way to stay under the radar and get his life back on track.   Also, with Shellie filing for divorce, he's left to his own devices.  I can't say I blame her for divorcing him.  Even if you really love someone, the pressure must have been (and still is) tremendous.  JMHO
