The U.S. Justice Department said Tuesday it will not file criminal charges against George Zimmerman in the 2012 shooting of 17-year-old Florida resident Trayvon Martin..

Atty. Gen. Eric H. Holder Jr., who had vowed to complete the investigation before he left office, said a “comprehensive investigation found the high standard for a federal hate crime prosecution cannot be met."

But Holder added that Trayvon's "death necessitates we continue dialogue and be unafraid of confronting issues and tensions his passing brought to surface.”

Prosecutors from the Justice Department’s Civil Rights Division, officials from the FBI, and the Justice Department’s Community Relations Service met Tuesday with Martin’s family and their representatives to inform them of the findings of the investigation and the decision.

George Zimmerman, the neighborhood watch volunteer who fatally shot a black teenager three years ago, blames President Barack Obama's "racially charged comments" for turning many Americans against him.

In an interview recorded with the lawyer who worked on his 2013 divorce case, Zimmerman calls out the president's messaging following the fatal shooting.

Zimmerman also refers to the president by his full legal name, Barack Hussein Obama.

"I think that throughout the process, the president should have done what he said he was going to do and not interject himself in a local law enforcement matter or a state matter and waited until the facts came out, instead of rushing to judgment, making racially charged comments, and pitting American against American," Zimmerman said.

The shooting took place on Lake Mary Boulevard near Rinehart Road, east of Interstate 4.

It's not known what prompted the shooting, but Lake Mary police said two vehicles were involved.

Video from Local 6 helicopter Sky 6 showed a sport utility truck, believed to be a Honda Ridgeline belonging to Zimmerman, being towed.  There's a possible bullethole in the passenger-side window of the truck.  An SUV was also at the scene.
 

who is surprised?? not me... this pattern of behavior will continue until it ends in his death or incarceration...

'I shot George Zimmerman, call 911'


An employee at a nearby business, Kenneth Cornell, said he was exiting his car after lunch when a man drove up and started yelling about the shooting.

The man shouted to Cornell: "I shot George Zimmerman, call 911. I don't have a phone."

Cornell said the man didn't know whether Zimmerman was hurt. He called 911.

According to Cornell, the man told him that he and Zimmerman have had three disputes. This time, Zimmerman waved a gun and the man shot at him, according to Cornell.

Police arrived minutes after he called 911, Cornell said.

Police have not verified Cornell's account to CNN.

ORLANDO, Fla. (Reuters) - George Zimmerman, who was acquitted of murder charges in the 2012 shooting death of an unarmed black teenager in Florida, suffered a minor wound after being shot at in a road-rage incident on Monday, media reports said.
Zimmerman did not fire a gun in the incident, the Orlando Sentinel reported, citing a statement by police in Lake Mary, Florida, a suburb of Orlando where the incident occurred.

An attorney for Zimmerman said a bullet missed his head but he was hit by broken glass from the vehicle, according to WESH. The television station also said a bullet hole could be seen in the passenger window of Zimmerman's vehicle.


Police spokeswoman Bianca Gillett said the shooting was under investigation but did not provide details.

Police said it appeared to be a "road-rage incident," according to the FOX 35 television station in Orlando. WESH-TV in Orlando said Zimmerman's injury was minor.

 “He simply maintained that he acted in self-defense,” attorney Mark NeJame said. “We see everything to suggest that that is correct.”

Sadly I agree. He just seems to not be able to stay out of trouble or have trouble find him. I don't see it ending well for an individual who just cannot fade into obscurity.

A redacted version of a 911 call was released Tuesday.

"The guy right here just said he had to shoot someone through his window, so he wants the police to come," an unidentified caller told dispatch in the 48-second 911 call. "He said it was George Zimmerman."

Gillett said the 911 call is only the first half of the call.

The rest has "pertinent information" to the ongoing investigation, so it's not being released right now.

ORLANDO, Fla. — George Zimmerman had moved out of Florida recently, hoping for a fresh start.
 
Zimmerman had returned to the area for Mother's Day and a doctor's appointment, and was driving to his doctor's office when the confrontation took place, said his attorney, Don West. Apperson works nearby, at a disability-benefits office.

Police recovered a handgun from Zimmerman and took two guns from Apperson's car. Both men had their guns legally.

"He never waved it, displayed it or brandished it," West said of Zimmerman. "He did not threaten Mr. Apperson in any way with a firearm."

Apperson's attorney, Mark NeJame, said the shooting was "a good, old-fashioned self-defense case" and that Apperson's encounter with Zimmerman was pure "happenstance." Apperson claimed Zimmerman brandished a gun and he feared for his life, NeJame said.

"He is not looking for trouble. He did not want trouble," NeJame said of Apperson. "He's not following George Zimmerman around. He's not wanting anything to do with George Zimmerman, as it relates to any of this."

Police on Tuesday released a 911 call in which the caller says Apperson told him he was forced to fire at Zimmerman.

"A guy says he had to shoot a guy through the window and he wants the police to come," the man said on the call. "He had to shoot at somebody ... He said it was George Zimmerman."

Documents show detectives are investigating the shooting as a possible aggravated assault with a deadly weapon without intent to kill. There is no timetable on when they will decide on whether any charges are warranted.

Police appealed to the public for help, believing "there is someone that saw something" on the busy road, Lake Mary Officer Bianca Gillett said.

IMO Zimmerman is worse than an accident waiting to happen.

I know legally he can carry a firearm -- but I don't think mentality he should be allowed.  JMO

LAKE MARY, Fla. —The bullet fired at George Zimmerman on Monday has been recovered from his vehicle, according to Lake Mary police.

Zimmerman gave a statement to police on Wednesday, reiterating the claim that he did nothing to provoke the shooting.

But police are still trying to sort out exactly what happened along Lake Mary Boulevard. The accused shooter, Matthew Apperson, 36, has not given a statement to police.
 
Police said they are going to work on tracking the trajectory of the bullet to see if Zimmerman's window was down at the time of the shooting.

A nearby business has a surveillance camera that is pointed at Lake Mary Boulevard, but it is unknown if the incident between Zimmerman and Apperson was captured on video.
 
WESH 2 legal analyst Richard Hornsby believes law enforcement has been hesitant to file charges and make an arrest simply because Zimmerman is involved in the incident.

Police said they are classifying the incident as an aggravated assault with a deadly weapon, but until they receive a sworn statement from Apperson, no arrests are expected.

Lake Mary police said Zimmerman and Apperson have an ongoing dispute and were involved in an altercation in September, when Apperson accused Zimmerman of trying to kill him while on the road.

Apperson has been arrested and convicted at least four times, according to police records.

In 2005, a woman accused Apperson of punching her window in a road-rage incident, police said. That woman decided not to press charges.

Winter Springs police said they have been called to Apperson's home at least 15 times since July 2012.

While Apperson has spent time in jail, he has not been arrested in more than a decade.

Lake Mary police arrested a Winter Springs man Friday on charges related to a shooting involving George Zimmerman earlier this week.

Matthew Apperson, 35, turned himself in Friday evening, police spokeswoman Bianca Gillett said.

Apperson was charged with aggravated assault with a deadly weapon, aggravated battery with a deadly weapon and firing a deadly missile into an occupied conveyance.

Police have released a 911 call from the shooting involving George Zimmerman, which sent the former Neighborhood Watch volunteer to the hospital with minor injuries.

"After conducting numerous interviews throughout the week, detectives determined that Mr. Apperson did intentionally fire his weapon into the vehicle occupied by George Zimmerman without provocation," Gillett said in a statement.

Apperson is being held on no bond, Seminole County Sheriff's spokeswoman Kristen Bentsen said.

On Saturday, Apperson made his initial court appearance, which lasted four minutes. While Apperson was initially held on no bond, Judge Michael Rudisill agreed to set bond at $35,000. Rudisill set a number of conditions if Apperson is released. He is not allowed to possess or own any firearms and must surrender all of them.

Apperson was also ordered not to have any contact with Zimmerman. There will not be any GPS monitoring, since Zimmerman opted to keep his location unknown.

LAKE MARY, Fla. —
The man accused of shooting at George Zimmerman bonded out of jail Saturday afternoon.

Channel 9 was there as Matthew Apperson walked out of the Seminole County Jail. He had no comment.

A judge set a $35,000 bond for Apperson earlier in the day and ordered him to turn in any guns to the Seminole County Sheriff’s Office within 24 hours of his release, and to have no contact with Zimmerman.

"I don't care whether you've been shopping at Publix for two hours and have a full cart of groceries or whatever. You see Mr. Zimmerman walking through that door, you're the one that has to leave," the judge said.

In Apperson's arrest report, which Local 6 obtained from the Seminole County Clerk of Courts, a Lake Mary police officer wrote, "During the investigation, I learned that Apperson has exhibited unusual behavior in which he had recently been admitted to a mental institution. It appears that Apperson has a fixation on Zimmerman and has displayed some signs of paranoia, anxiety, and bipolar disorder."

A Lake Mary Police spokesperson said the information came from family and friends but was not independently verified.

Apperson did not answer the door at his Winter Springs home Monday afternoon when Local 6 knocked seeking comment.

Mark Nejame, Apperson's former attorney, said he's referring Apperson's case to a colleague within his office and that he did not believe Apperson's mental health history should be publicly released.
 
His arraignment will be June 23 with Judge Debra Nelson, the same judge that presided over the Zimmerman/Trayvon Martin  trial.

A Lake Mary police spokesperson said it's now up to the state attorney's office to file charges after a thorough investigation that will likely include verifying Apperson's mental health history.

When Local 6 asked police why Apperson was allowed to have a loaded gun in his car if he was admitted to a mental health facility, Lake Mary Police spokesperson Bianca Gillett said,if law enforcement wasn't involved in getting Apperson to the mental health facility, law enforcement wouldn't have known he'd been there. Gillett said the facility cannot report the visit because of patient confidentiality rules.

ORLANDO, Fla. (AP) — A Florida man charged with shooting at George Zimmerman last week had "a fixation" on the former neighborhood watch leader and had recently been admitted to a mental institution, according to a police report made public Tuesday.

The Lake Mary Police Department report said that 36-year-old Matthew Apperson had shown signs of paranoia, anxiety and bipolar disorder.

Apperson's attorney, Michael LaFay, refused to comment on any past hospitalizations of Apperson, but he questioned the qualifications of the Police Department to make any psychological or psychiatric diagnoses.

"I'm unaware of any psychological or psychiatric degrees that are held by the officers at the Lake Mary Police Department," LaFay told The Associated Press on Tuesday. "I'm going to take their diagnoses with a grain of salt."

Zimmerman told officers he had been driving in the Orlando suburb of Lake Mary last week when Apperson got behind his truck and yelled, "You remember me you fat mother f-----?" according to the report.

Apperson then yelled at Zimmerman, "You owe me your life. The only reason I didn't press charges on you is because I wanted to kill you myself," Zimmerman told detectives, according to the report.

State officials are requesting GPS monitoring for the man who was arrested after firing a gun into George Zimmerman's truck earlier this month.

Matthew Apperson turned himself in to authorities and was charged with aggravated assault with a deadly weapon, aggravated battery with a deadly weapon and firing a deadly missile into an occupied conveyance, an arrest report said.

The state filed the motion on Thursday and a hearing will be held on Friday at 1:30 p.m. A judge had previously said that there is no GPS monitoring required because Zimmerman does not want anyone to know his whereabouts.

In the motion, officials said Zimmerman's address would not need to be provided for Apperson to receive GPS monitoring.

The assistant state attorney writes the judge was "misinformed by jail staff at the time of Apperson's First Appearance" and that Apperson "poses a continuing threat to safety of Mr. Zimmerman."

Also in the motion, the state writes that Apperson has a history of mental illness, including bipolar disorder and generalized anxiety disorder.
