Now that the Zimmerman criminal trial has concluded, much attention has focused on the prospects for Zimmerman seeking protection under Florida’s self-defense immunity statute from any possible civil action against him.
Florida’s statute 776.032, is among the broader self-defense immunity statutes, in that it possesses all four qualities of an optimal statute of this type.
First, it is not limited to particular settings or circumstances (e.g., such as to self-defense encounters in and around one’s home).
Second, it prohibits even the arrest of the person who acted in self-defense, in the absence of probable cause for such arrest.
Third, it immunizes against criminal as well as civil liability.
And, fourth, it provides for the defendant who successfully obtains immunity to recover all reasonable legal expenses (and, in the case of Florida, even compensation for lost income) from the plaintiff.
Fully 32 states provide some degree of limitation of liability for the individual who has genuinely acted in self-defense, but there is considerable variety in terms of the scope and manner of protection provided.

The Decline of the Civil-Rights Establishment
By SHELBY STEELE
The verdict that declared George Zimmerman not guilty of murdering Trayvon Martin was a traumatic event for America's civil-rights establishment, and for many black elites across the media, government and academia. When you have grown used to American institutions being so intimidated by the prospect of black wrath that they invent mushy ideas like "diversity" and "inclusiveness" simply to escape that wrath, then the crisp reading of the law that the Zimmerman jury displayed comes as a shock.
On television in recent weeks you could see black leaders from every background congealing into a chorus of umbrage and complaint. But they weren't so much outraged at a horrible injustice as they were affronted by the disregard of their own authority. The jury effectively said to them, "You won't call the tune here. We will work within the law."
Today's black leadership pretty much lives off the fumes of moral authority that linger from its glory days in the 1950s and '60s. The Zimmerman verdict lets us see this and feel a little embarrassed for them. Consider the pathos of a leadership that once transformed the nation now lusting for the conviction of the contrite and mortified George Zimmerman, as if a stint in prison for him would somehow assure more peace and security for black teenagers everywhere. This, despite the fact that nearly one black teenager a day is shot dead on the South Side of Chicago—to name only one city—by another black teenager.
This would not be the first time that a movement begun in profound moral clarity, and that achieved greatness, waned away into a parody of itself—not because it was wrong but because it was successful. Today's civil-rights leaders have missed the obvious: The success of their forbearers in achieving social transformation denied to them the heroism that was inescapable for a Martin Luther King Jr. or a James Farmer or a Nelson Mandela. Jesse Jackson and Al Sharpton cannot write a timeless letter to us from a Birmingham jail or walk, as John Lewis did in 1965, across the Edmund Pettus Bridge in Selma, Ala., into a maelstrom of police dogs and billy clubs. That America is no longer here (which is not to say that every trace of it is gone).
The Revs. Jackson and Sharpton have been consigned to a hard fate: They can never be more than redundancies, echoes of the great men they emulate because America has changed. Hard to be a King or Mandela today when your monstrous enemy is no more than the cherubic George Zimmerman.

When the Facebook comment of Tristan Breaux ... president of the Norfolk NAACP ... is consider ... it would would appear that Benjamin Todd is not speaking on behalf of of all of NAACP membership with his request to involved the Obama administration. In other words ... common sense does prevail in the Black community.

Norfolk NAACP president under fire for Facebook post

NORFOLK
A Facebook post by the president of the Norfolk NAACP about the George Zimmerman trial has sparked criticism.
According to an image of the post shown on WAVY-TV, Tristan Breaux, 25, wrote, "I wonder why is it that we are always willing to say someone who clearly had a shaky past, was the victim. Are we blinded about why Trayvon was at his dad's house in the first place, and why he wasn't at home at the time he was shot? Please think logically and not racially."
Several local NAACP members asked Breaux to take the post down, and he initially refused, said Jeffrey Logan, a former member of the local chapter's executive committee.
The post went up last week. Breaux's Facebook page is no longer visible.
"With a sensitive issue like this, for an NAACP president to post that - it's not a good thing," said former Norfolk NAACP President Bob Rawls.
Logan and Rawls said Breaux should resign his position.
Members of the branch's executive committee said they have no plans to seek his removal.

The TalkLeft blog noted last night that the American Civil Liberties Union, after encouraging U.S. Attorney General Eric Holder to pursue civil rights charges against George Zimmerman the day after he was acquitted in the death of Trayvon Martin, reversed course just four days later.
Though it's no longer available at its national web site, the Associated Press ran the organization's press release. Various searches at the AP's national web site indicate that there has been no coverage of the organization's reversal. Several center-right blogs have noted the reversal, but no one in the establishment press besides Josh Gerstein at the Politico, where stories the rest of the establishment press would prefer to ignore tend to go and all too often die, has noted it. So did the organization have a change of heart? Or did it attempt to manipulate its media exposure with a politically correct initial press release followed by a legally and constitutionally correct reversal it hopes few will notice?
Here's the ACLU's original statement as relayed by AP (headline is AP's; ACLU's web site statement is here; bolds are mine throughout this post):
The American Civil Liberties Union calling for action after the George Zimmerman verdict
American Civil Liberties Union Executive Director Anthony D. Romero released the following statement on the not guilty verdict in the trial of George Zimmerman:
"Today, our thoughts are with Tracy Martin and Sybrina Fulton, whose young son was taken from them far too soon.
Last night's verdict casts serious doubt on whether the legal system truly provides equal protection of the laws to everyone regardless of race or ethnicity.
This case reminds us that it is imperative that the Department of Justice thoroughly examine whether the Martin shooting was a federal civil rights violation or hate crime. We call on Attorney General Eric Holder to release strengthened guidance on the use of race in federal law enforcement. We also urge Congress to pass the End Racial Profiling Act. These specific actions would go a long way to ameliorate the widespread problem of racial profiling. We need solutions not only in Trayvon Martin's case, but also systemic reform."
Here is the first paragraph of the organization's reversal, in the form of a direct letter to Holder
:
We are writing to clearly state the ACLU’s position on whether or not the Department of Justice (DOJ) should consider bringing federal civil rights or hate crimes charges as a result of the state court acquittal in the George Zimmerman case. Even though the Supreme Court permits a federal prosecution following a state prosecution, the ACLU believes the Double Jeopardy Clause of the Constitution protects someone from being prosecuted in another court for charges arising from the same transaction. A jury found Zimmerman not guilty, and that should be the end of the criminal case.
One clue that the group would rather not talk about its position any more is at its "This Week in Civil Liberties" blog post.

The American Civil Liberties Union is experiencing some uncomfortable déjà vu.
George Zimmerman’s acquittal in the shooting death of black teenager Trayvon Martin has triggered the specter of an awkward and often raucous debate the group thought it had put behind itself two decades ago.
After the 1992 acquittal of Los Angeles police officers in the videotaped beating of African-American Rodney King, ACLU leaders split sharply over the possibility of a federal trial for the officers. The group eventually suspended its policy opposing double jeopardy — only to reverse itself the following year.
A New York Times editorial back then called the ACLU “torn by internal disagreement.” A Boston Globe column described the organization as “twisting itself up in knots.”

A range of legal experts think that the Department of Justice’s attempts to collect information from the public on George Zimmerman is a way to pass responsibility for investigating the man onto the public, as well as to give the impression that the agency is acting.
The FBI and DOJ investigated Zimmerman last year, canvassing dozens of neighbors, friends, and acquaintances to determine if he was racist. Chris Serino, the lead investigator on the Martin shooting, said that he believed that Zimmerman had profiled Martin based upon his attire and “not his skin color”.
Federal investigators closed the investigation without finding any evidence to support the claim that Zimmerman was racist. During the trial, Judge Debra Nelson refused to allow state prosecutors to argue that Zimmerman racially profiled Martin leading up to the shooting. Zimmerman’s defense also flipped racism claims around on Martin, suggesting that by allegedly calling Zimmerman a “creepy ass cracker,” his assault on Zimmerman may have been racially-motivated.
Harvard law professor Alan Dershowitz told TheDC that he believes the DOJ’s recent move is “highly questionable”. He asked, rhetorically, “Are they also investigating Martin’s background to see whether he attacked anyone previously?”
Ilya Shapiro, a legal scholar at the Cato Institute, called the investigation “a waste of resources.” “It seems to me that this is just the DOJ trying to be seen as doing something,” he told The DC.
The Civil Rights division of the Department of Justice has used the email tip method in the past. For example, in November 2012 it
set up an email address to investigate the Albuquerque, New Mexico police department
which was alleged to have high incidents of excessive use of force.
In October 2012, the DOJ
set up a tip line to investigate complaints that officials
in Meridian, Mississippi were discriminating against juveniles and creating a “school-to-prison pipeline” which targeted African-American students.
And in September 2012, the department began
investigating the Alamance County, North Carolina sheriff’s department
for allegedly profiling Latinos.
A spokesperson for the Department of Justice would not provide details of the special email account other than to acknowledge its existence.
TheDC was unable to determine if the DOJ had ever used such an account to pursue an investigation against a private citizen who’d been acquitted of a crime

Kevin Jackson: Obama has responsibility to talk about race, how blacks are more successful now than ever before

Kevin Jackson says that he doesn’t believe Obama has had the racial ‘experiences’ he claimed last Friday, saying that Obama is just trying to gin up racism. The fact that Obama spoke out, he said, on a case as innocuous as the Zimmerman case just shows how much racial tension he wants to create.
He does believe Obama has a special responsibility to talk about race, but from the perspective of how great America really is and that blacks have been successful in every walk of life in this country.

Sanford Police Department Capt. Jim McAuliffe told ABC News that Zimmerman "pulled an individual from a truck that had rolled over" at the intersection of a Florida highway last week. Florida Highway Patrol is now handling the case, McAuliffe said.
The crash occurred at the intersection of I-4 and route 417, police said. The crash site is less than a mile from where he shot Martin.

Kevin Jackson was interviewed by Tucker Carlson of Fox News regarding Obama’s “impromptu” drive-by at the recent White House press briefing, and he didn’t disappoint.
Jackson asked if Obama would like Trayvon to date his daughters, and also offered that Obama was trying to get back some “street cred” from blacks. See the interview here.

By the time a deputy arrived, Zimmerman and another man "had already helped assist the family by getting them out of the overturned vehicle," Smith said.
"Zimmerman was not a witness to the crash and left after making contact with the deputy," Smith said in an emailed statement. "There were no report of injuries to the vehicle occupants."
