I don't believe this defamation suit should be dismissed.  NBC and other media outlets need to be held accountable when they do things like this.  JMHO

Life after the acquittal has been turbulent for Zimmerman, who's now 30. He moves among the homes of people who let him sleep on the couch, said his brother, Robert Zimmerman Jr. He's jobless and has been arrested once, accused of threatening his girlfriend with a gun, and put in handcuffs another time, accused of punching his father-in-law.

In both cases, authorities filed no criminal charges.

He left his wife, Shellie, a month after the trial and is in the midst of a divorce. He owes defense attorneys Mark O'Mara and Don West $2.5 million. He has sold paintings on eBay and toyed with but rejected the idea of taking part in a pay-per-view boxing match with rap artist DMX.

In a Spanish-language interview in February, Zimmerman told Univision that he suffers from post-traumatic stress disorder.

"I think his state of mind is better," said his brother, "but I would submit that he is a very traumatized person because he has had his liberty taken away from him."

Circuit Judge Debra S. Nelson

After the five-week trial and verdict, Nelson, 60, took two days off and then went back to work, hearing civil and divorce cases in Sanford.

She has not commented publicly about the Zimmerman trial and is overseeing his defamation case against NBCUniversal Media LLC. Zimmerman sued the company 10 months after the shooting, accusing it of falsely reporting that he used a racial slur while talking to a police dispatcher the night of the shooting.

Nelson will preside over a hearing next week on NBC's request to dismiss the suit.

Defense attorney Mark O'Mara

The trial made O'Mara, 58, of Orlando a familiar name. He sold a boat and a car and got a business loan during the trial to cover expenses, he said Thursday, and is not yet financially whole. But the trial allowed him to expand his practice and won him a contract providing legal commentary on CNN.

His firm used to have five employees. Now there are 11, including someone in charge of media and marketing. He's also raised his hourly rate from $400 to $525.

O'Mara's greatest satisfaction, he said, is that he now speaks to bar associations and law schools and teaches attorneys what he's learned about the media, high-profile cases and social media.

I don't know about the first part about Zimmerman's failure to comply with Florida's statute, but )my bold) I believe NBC's editing and then releasing the broadcast certainly caused not only Zimmerman to suffer harm, but also his parents, who had to move and go into hiding.  The broadcasts inflamed some of the public, and there are those still today that don't know the broadcasts were edited.  NBC should take responsibility for what they did.  It wasn't an error or something overlooked.  It was done with them knowing full well what they were releasing, which were lies. 
My view isn't so much defending Zimmerman for what he did or didn't do, but it just isn't right for the news to be manipulated like this.  I believe it affected a lot of people's views.

Attorneys for NBC will argue Thursday that the case should be dismissed since Zimmerman failed to follow Florida's retraction statute, and he wasn't harmed by the reports.
 
Zimmerman's attorneys argue they haven't even had time to interview witnesses. They say pretrial depositions will support his claims that NBC's broadcasts were false and reckless.

Judge throws out part of Zimmerman libel case against NBC

SANFORD – A judge this morning threw out part of George Zimmerman's libel suit against NBC Universal and held out the prospect that she may throw out the whole thing.

Circuit Judge Debra S. Nelson tossed the allegations related to one of four broadcast and said she needs to do more homework before deciding about the other three.

Zimmerman is suing the media company, alleging he was falsely portrayed as a racist.
 
The suit also says Zimmerman should be paid damages because the company falsely reported that during that call, Zimmerman used a racial epithet.

In their response, NBC's attorneys contend that Zimmerman has no valid claim.

The most important point, they say, is that Zimmerman was a public figure and cannot prove that NBC employees acted with "actual malice".

That means that they either knew what they said was false or had grave misgivings about its truthfulness.

The phrase that NBC employees interpreted as a racial slur, an NBC attorney said, was "very difficult to understand or decipher."

And other news organizations reported that same thing, he said.

As for the editing, the network should not be held liable for reporting truthfully what Zimmerman's actually said, NBC's attorney said.

Other news organizations also used excerpts of that tape, he said.

The hearing started shortly after 10 a.m. and concluded shortly before 11 a.m.

Zimmerman did not attend.

NBC's attorneys raised several defenses, some of them technical. They contend that any harm Zimmerman claims to have suffered were not caused by the specific NBC news reports that are at issue.

Zimmerman's attorney, James Beasley Jr., told the judge it would be a mistake to throw out the case now before he can gather evidence.

He pointed out that an NBC executive apologized for the edits and that two employees were either fired or disciplined.

George Zimmerman’s defamation lawsuit against NBC Universal was back in a Seminole County courtroom.

Judge Debra Nelson, who presided over Zimmerman's murder trial, heard arguments from both sides Thursday.

NBC's attorneys argued Zimmerman is a public figure. Therefore, the First Amendment protects the network from his defamation claims.

Meanwhile, Zimmerman's lawyer countered NBC's argument, calling the issue reckless reporting.

Zimmerman filed the lawsuit against NBC in 2012, claiming NBC aired edited versions of the 911 call he made right before he shot and killed 17-year-old Trayvon Martin.

The network actually ended up firing three producers.

The hearing was previously postponed because the judge wanted to wait until after Zimmerman’s murder trial finished.

Attorneys for NBC said they believe the lawsuit should be tossed out because Zimmerman did not meet Florida state law retraction requirements.

NBC’s lawyers also said the harms Zimmerman said he's suffered were not because of the broadcasted 911 call on NBC.

On the website Zimmerman’s attorneys set up for this lawsuit, attorneys for the former neighborhood watchman said “NBC News saw the death of Trayvon Martin not as a tragedy but as an opportunity to increase ratings..."

The hearing ended with Nelson reserving judgment. She will issue a written ruling in the coming weeks.

Part of George Zimmerman defamation lawsuit dismissed

A judge has dismissed part of a lawsuit against NBC Universal that claims the television network defamed George Zimmerman's reputation.

Thursday's decision puts the entire lawsuit in jeopardy.

Seminole County Circuit Judge Debra Nelson ruled that Zimmerman's attorney waited too long under Florida statute to ask NBC to retract the information from the March 19, 2012 broadcast.
 
Three other NBC broadcasts are still in question.

The case had been postponed pending the conclusion of Zimmerman's murder trial in July 2013. He was acquitted of second-degree murder in the death of Miami teenager Trayvon Martin.

After the hearing, WFTV asked Zimmerman's lawyer about how Zimmerman is doing.

"Terrible. How would you be doing? He's in hiding. What else is he going to do? He can't get a job," Zimmerman's attorney Jim Beasley said.

Nelson said she'll decide whether to dismiss Zimmerman's lawsuit against NBC either in the next week or in about a month when she gets back from vacation.

SANFORD – In his attempt to win a libel suit against NBC Universal Media, George Zimmerman's civil attorney wants records about the Rev. Al Sharpton, according to new court pleadings. Same for Angela Corey.
 
In paperwork filed Friday, Beasley disclosed some of the people he intends to press for information or whose communication records he plans to seek.

They include Sharpton and Corey, the Jacksonville state attorney who served as special prosecutor in Zimmerman's murder case.

He was acquitted of second-degree murder by a Seminole County jury on July 13.

Beasley also disclosed that he intends to press for communications from several NBC news employees and executives, including Phil Griffin, president of MSNBC.

Sharpton, who has a show in MSNBC, was one of Zimmerman's harshest critics and traveled to Sanford, calling for his arrest.

Zimmerman also filed an affidavit in the case Friday, explaining to Nelson why she should rule in his favor.

"We need to take discovery and have not yet had any opportunity to do so," his affidavit reads. "I believe pretrial discovery, including depositions, will support my claims the defendants' broadcasts were false and outrageous."

In his affidavit, he also accuses NBC of editing his 911 call to a police dispatcher in a way that "caused me to be identified as a racist stalker."

George Zimmerman divorce records: I've got no home, no job and spend $100 a month on vacations

As part of the divorce case, Zimmerman filed a financial affidavit last week, spelling out his income, assets and debts.

According to it, he spends $3,304 a month, despite having no income.

He listed his total assets at $14,000 – most of that is his 2008 Honda pickup. His debts total $2.5 million, most of that is money he owes criminal defense attorneys Mark O'Mara and Don West.

According to his paperwork, Zimmerman has no job, pays nothing for rent or a mortgage and has no health insurance.

He spends $350 a month for medical care plus $200 a month for psychological, psychiatric or mental health counseling.

He also spends $100 a month on vacations, he wrote.

Zimmerman's legal defense fund, which raised more than $400,000, now has a balance of $300, according to the affidavit.

It is not clear what happened to any money he earned from the sale of a painting on eBay in December. The winning bid was $100,000. There is no mention of it in his affidavit.

His banking account has $650, he reported.

Not a Zimmerman fan either, but I don't agree with the judge.  I remember very well when this happened, and I remember all the hate and anger that was in the comments of articles and I remember articles that went on about this.  Even though it was later shown NBC edited out the dispatchers question, there are still people to this day that believe the edited edition is the true one.  I believe the editing by NBC caused a backlash of anger and hate.  JMHO

Earlier this month, Seminole County Circuit Judge Debra Nelson dismissed one of the five broadcasts in question, ruling Zimmerman's attorney waited too long under Florida statute to ask NBC to retract the information from the March 19, 2012, broadcast.
Nearly a year ago, it was in Nelson's courtroom Zimmerman was acquitted of second-degree murder in the shooting death of 17-year-old Martin.
Lawyers claimed in a letter sent in December 2012 that NBC edited Zimmerman's 911 call the night of the shooting to make it sound like the former neighborhood watch volunteer was a racist.

In the call, Zimmerman did not mention Martin's race until a dispatcher asked.
"OK, and this guy, is he white, black or Hispanic?" the dispatcher asked.
"He looks black," Zimmerman replied.
But in a series of reports on NBC in March 2012, the dispatcher's question was edited out, which Zimmerman said made it appear as though he was suspicious of Martin only because the teenager was black.

George Zimmerman’s lawyer vows appeal in suit against NBC

The lawyer in George Zimmerman’s defamation suit is vowing to appeal the ruling of a Florida judge who yesterday tossed the litigation from her courtroom. Judge Debra S. Nelson wrote that Zimmerman “shall take nothing by this suit” even though NBC News in multiple broadcasts had shortened a police call in a way that inaccurately depicted Zimmerman as volunteering racial information about Trayvon Martin on the night of their fatal encounter in February 2012.

“We obviously disagree with the judge,” says James Beasley, Zimmerman’s Philadelphia-based attorney. “We understand she has her position and we respect it, but we obviously disagree.” An appeal is coming. Nelson is the same judge who presided over Zimmerman’s 2013 criminal trial, in which he was acquitted of second-degree murder.
 
Beasley would like a chance to contest Nelson’s notion of Zimmerman’s public figureness. “The nature and extent of his thrusting himself into this as opposed to NBC thrusting him into this is a fundamental question,” says Beasley.

Though courts and lawyers can argue ad nauseam about who’s a public figure, there’s one component of the Nelson ruling that’ll be harder to counter, and it relates to the progression of the Zimmerman-Martin story. In Nelson’s words: “The undisputed evidence shows negative publicity was directed at Zimmerman by the Martin family’s lawyer, by civil rights activists, and by a litany of news media entities well before the non-emergency call was released to the public and before NBC broadcast any of the news reports at issue.”

Or, this was a media circus from the start.

Beasley didn’t sound too worried. He noted that NBC News’s journalistic errors vis-a-vis Zimmerman were so grave as to warrant firing two staffers. “This coverage got universal criticism,” said Beasley. “Every one of these libel cases are all 15 rounders.”
