9 year old  Thalio Otto, 8 year old Michael Otto and their 28 year old mother Yessenia Suarez have been missing since Wednesday, October 23, 2013 in Deltona, Florida. Florida Department of Law Enforcement issued a missing child alert after they went to their home to check on them after relatives of Suarez reported her missing when they had not heard from her. Prior to the disappearance, Suarez’s husband, Luis Toledo, showed up at her job at American K-9 Detection Services on Tuesday, started a fight and slapped her face. Toledo was arrested on domestic violence charges Wednesday.

According to reports, the family has dealt with domestic issues in the past and Luis Toledo was arrested in 2000 on charges of attempted second degree murder, robbery with a firearm, aggravated battery with a deadly weapon and kidnapping with intent to inflict harm with a weapon in Orange County, FL. However, the case was never prosecuted. The Volusia County Sheriff’s Office are considering the two missing children and the mom as endangered under suspicious circumstances.

Her family said the three went missing just hours after Suarez's husband, Luis Toledo, 31, showed up at Suarez's job in Lake Mary and beat her up.

Toledo fled before Lake Mary police officers had arrived on the scene.

 Authorities said Toledo arrived at the house a short time later and was subsequently arrested based on Lake Mary Police Department's battery charge from the previous day. He was booked into the Volusia County Jail in Daytona Beach.

Missing Deltona mother Yessenia Suarez and her two children are dead, the Volusia County Sheriff's Office has confirmed.
 
Deputies are searching for the bodies of Suarez, 28, and her children, 9-year-old Thalio Otto and 8-year-old Michael Otto, who have been missing since Tuesday night.
 
The Volusia County Sheriff's Office Wednesday evening said Suarez's family was notified about 6 p.m., and the relatives have gathered together.
 
Investigators would not reveal how they learned the mother and children were dead or how they were killed, saying they want to be sure the case is solved.
 
"It's a very sensitive investigation," sheriff's spokesman Brandon Haught said. "We've been following leads wherever they may take us."

   This didn't sound good at all from the onset.  We've been seeing innocent women and children facing abuse and too often times, losing their lives at the hands of one such as this.     Should be at least automatic LWOP, but then that really isn't justice, because the innocent have already lost their lives.

I agree Muffy   it seems more and more women and their children are being taken way to early. It seems we have become a throw away society.  From things to human life.

DELTONA, Fla. (WFTV) — A family of a Deltona mother and her two children received news they had feared. Authorities in Volusia County said Yessenia Suarez and her children, 8-year-old Michael Otto and 9-year-old Thalia Otto, were dead
 
Suarez's family told WFTV that detectives told them her husband, Luis Toledo, confessed to killing the three, but detectives would not confirm that
Perez called the Sheriff's Office on Wednesday morning and asked for deputies to conduct a well-being check on the 28-year-old at her Covent Gardens Place home in Deltona. When Volusia sheriff's deputies responded to the Deltona address, Suarez and her children were not there.

On Thursday, investigators from Volusia County crossed jurisdictions to pull potential evidence out of a set of dumpsters in Sanford.

Family members said the last time Yessenia's family had seen her was Tuesday evening. They called her cellphone, but said it went straight to voicemail.

Authorities said one of Yessenia's two vehicles was found by Lake Mary police at a Publix parking lot, but there was no sign of her or her children.

It's not clear what drew Suarez, a 28-year-old working mother who also attended Rollins College, to Toledo, a former Orlando-area gang member with a violent history.
Toledo went to state prison for taking part in an armed home invasion in Broward County, according to state and prosecution records. He also went to jail in Volusia County for shooting his gun toward a victim, an incident in which no one was hurt.
 
And he was arrested but later cleared on charges that he and other gang members gave a baseball-bat beating to a woman whom they also choked with a plastic bag in Orange County.
 
All of those incidents happened between 1997 and 2000 when Toledo was 15 to 19 years old and in a period during which he told deputies he was a member of a gang called the Latin Kings.
 
He was released from state prison in 2008 after serving four years for two sets of crimes — the Broward County home invasion and an Orange County burglary. Until earlier this week, had not been rearrested for a violent crime in Florida
 
•He was arrested on a charge of attempted murder in Orange County in 2000, accused of trying to strangle a woman. Prosecutors later abandoned the case, but here is what Toledo admitted to, according to his arrest report:
On Halloween night 2000 he lured a woman whom he accused of betraying him to a dark area, and he and three other gang members overpowered her, beat her with an aluminum baseball bat then put a plastic bag over her head.

Sadly the prosecutors in 2000 did not do their job and get this killer off the streets and away from law abiding people.

Should we be shocked that an abusive individual with a track record would kill.

Just a damn shame that the legal system allowed this monster to kill again.

I agree Muffy he is a coward. I was once told by a LE that men that beat on women are the biggest cowards around.  I hope Yessinia and her children are found soon. So they can be laid to rest and their family can say their good byes.

Search for bodies of Deltona mother, children continues
 
According to authorities, Toledo was being questioned Saturday morning when he asked to use the bathroom. Officials said Toledo was guarded by a deputy but forced the doorway closed, smashed his head on the mirror and tried use pieces of the mirror to cut himself.

Deputies said he was quickly secured and had to be taken to Halifax Health Medical Center to be treated for cuts, which were non-life-threatening. Toledo has been released from the hospital and is back in the jail, officials said

The remains are of an adult, said Shannon Cordingly, a Sanford police spokeswoman. But it's likely they're not of 28-year-old Yessenia Suarez, who has been missing for about a week, Cordingly added. She said the medical examiner still needs to conduct an autopsy.

"The skeletal remains have been there for a long time," she said. "It was bones we found."

Luis Toledo had previously been described as a "person of interest" in Suarez's killing.

He has denied killing her two children — Thalia, 9, and 8-year-old Michael Otto — who are also missing and presumed dead, the Volusia County Sheriff's Office said. As of Monday night, Toledo had only been charged in his wife's death.

Police are saying that the case of missing Yessenia Suarez and her children is an ongoing criminal investigation and they don't need civilian assistance.

A massive, multi-agency search is still underway in Volusia County, with dozens of people fanning out across Deltona in search of Yessenia Suarez and her two children, missing for a week-and-a-half and believed to be dead.
 
About 80 people were out searching a massive area of Deltona near Lake Monroe.
 
And the extra help was needed, because of the ground investigators are trying to cover as well as the weather conditions.
 
When it comes to covering the dense woods are various bodies of water in this search area, the Volusia County Sheriff's Office is not lacking resources.
 
On Friday, nearly two dozen additional people were added to the search team.
 
Volusia, Lake and Seminole Sheriff's Offices are searching.
 
"The Ocala Police Department, the Daytona Beach Fire Department is here with two cadaver dogs," said Gary Davidson, spokesman for the sheriff's office. "The Volusia County Beach Services have some divers, so we really have a full compliment of personnel.”

A Volusia County public defender says the man accused of murdering missing mother, Yessenia Toledo, should never have been arrested on the domestic violence charges in the first place.

Public defender for the Seventh Judicial Court James Purdy said Lake Mary Police did not have the right to arrest Luis Toledo.
 
Purdy said it’s a mistake that could now have an effect on evidence admitted in court.
 
"This is an amazing faux paux. I mean when I look at it, I scratch my head as soon as I saw it,” said Purdy.

Purdy said he saw the problem in Toledo's arrest report on Oct. 24 at Yessenia Suarez's Deltona home.

He said Volusia County Sheriff's Office deputies detained Toledo after he allegedly slapped Suarez at her Lake Mary office the previous day.
 
They waited for Lake Mary Police to arrive, make the arrest and transfer him to the Volusia County jail.
 
But it was illegal, Purdy said, because Lake Mary Police have no jurisdiction in Volusia County, and the only authority they had at that time would have been to make the arrest was as private citizens.
 
"Under Florida law, which follows the common law, a private citizen can only make an arrest for a misdemeanor if it occurs in their presence. So the arrest itself was an illegal arrest," he said.
 
According to Purdy, Toledo's detention was also illegal because the arrest was illegal.
 
Toledo confessed to killing Suarez, investigators said, and told them he believed the children were dead, implicating another unidentified person.
