Baden-Clay case referred to Supreme Court as prosecutors present murder indictment

A JUDGE will decide whether a person privy to confidential conversations involving alleged wife killer Gerard Baden-Clay's can testify at his murder trial, a court has been told.

Prosecutors told the Brisbane Surpeme Court a pre-trial hearing would have to be held to decide if a particular witness involved in counselling during a Family Court matter can testify at Baden-Clay's proposed four-week trial - likely to be held later next year.

Prosecutor Danny Boyle today presented an indictment in court charging the 42-year-old former real estate agent with murdering his wife, Allison Baden-Clay, on or about April 19 last year.

"I tender an indictment charging Gerard Robert Baden-Clay with one count of murder,'' Mr Boyle told the court.

The packed public gallery fell silent as Baden-Clay's matter was called.

It seems like it is taking forever!

 

I agree, it seems like justice is a long, long time coming. 

We now have a date for the trial - see my next post.  Still a long time to wait but hopefully all their ducks are in a row and there will be Justice for Allison and her children.

Date set for murder trial for Gerard Baden-Clay

GERARD Baden-Clay will face a Supreme Court trial for the alleged murder of his wife Allison in June next year.

The former Brookfield real estate agent, 42, stands accused of murder after his wife's disappearance in April, 2012.

Her body was found beneath the Kholo Creek bridge 10 days later.

At a hearing review on Friday, Justice Glenn Martin listed the trial to begin on June 9.

He listed the case for a hearing on October 1 in order to resolve legal argument concerning Relationships Australia counsellor Carmel Ritchie's intention to claim client privilege if called to give evidence.

Ms Ritchie had seen both Baden-Clay and his wife for counselling before she was reported missing.

Both Crown prosecutor Danny Boyle and barrister Michael Byrne QC, for Baden-Clay and instructed by Peter Shields, have argued the counselling sessions are admissible evidence that should be examined at trial.

The court heard barrister George Kalimnios, for Relationships Australia, had filed an outline of argument against the submission.

Justice Martin listed a pre-trial recording of evidence in relation to the case on February 24 next year.

He also listed two-days for a pre-trial hearing on February 3 and 4.

The trial will be heard before Supreme Court Justice John Byrne.

I agree, it seems like justice is a long, long time coming. 

We now have a date for the trial - see my next post.  Still a long time to wait but hopefully all their ducks are in a row and there will be Justice for Allison and her children.

 With the setting of court dates to resolve issues and especially now that the trial date has been issued, it's beginning to look like  justice for Allison and her three children is firming up .  It must be very difficult for the families and friends of victims to go through such a long process.  I concur with you in hoping their all their ducks are in a row.  We don't want a murderer escaping prosecution of their crime due to technicalities or shoddy preparation.  Thank you keeping us updated Tib.

We do not televise trials here but there will be constant reports of the hearings and trial.
I cannot imagine what it must be like for family having to wait so long and then have to re-live all the heartache all over again.

 JURY has found Gerard Baden-Clay guilty of murdering his wife Allison.

The former Brookfield real estate agent, 43, pleaded not guilty in the Supreme Court at Brisbane at the opening of his trial six weeks ago.

A jury of seven men and five women delivered its verdict shortly after 11.50am today after deliberating for 21 hours before reaching a decision.

Justice John Byrne asked the jury to retire to deliberate on Thursday at 11.10am.

Jurors lined up across one side of the court as they were asked by the judge’s associate: “Do you find the defendant Gerard Robert Baden-Clay guilty or not guilty of murder?’’

The family of Allison Baden-Clay, including her parents Geoff and Priscilla Dickie, who are seated in the packed public gallery of court 11, cheered as the jury replied: “Guilty”.

The accused was seated in the dock and stood to talk to his lawyer Peter Shields as the judge discharged the jury and thanked them for their service.

Justice Byrne told the jurors he was grateful for their service.

The best outcome under our legal system as we do not have the death penalty.
