Jenise Wright murder suspect charged with murder, aggravated rape
KING 5 News 3:05 p.m. PDT September 12, 2014

SEATTLE – The teen suspected of sexually assaulting and murdering a 6-year-old Bremerton girl was formally charged Friday.

A Kitsap County Superior Court judge found probable cause to charge Gabriel Gaeta, 17, with aggravated first degree murder and aggravated rape in the death of Jenise Wright.

The Kitsap County Prosecutor's office said a psychological evaluation for Gabriel Gaeta, 17, has not been completed. A competency hearing is likely to be set in the next two weeks.

Senior Deputy Prosecutor Kelly Montgomery said Wednesday that lawyers for Gabriel Gaeta are expected to agree he is competent to stand trial.

The Kitsap Sun (http://bit.ly/ZOTqQT ) reports Gaeta retains the right to say he is not guilty by reason of insanity at the time of the crime.

Gaeta is expected to plead not guilty to aggravated rape and murder charges at an Oct. 31 court hearing. If convicted he would be sentenced to life in prison.

PORT ORCHARD — Despite not being evaluated by a mental health expert, lawyers representing accused killer Gabriel Gaeta say he is competent to stand trial and if forced to undergo an evaluation they will advise him to plead the Fifth.

Appearing in Kitsap Superior Court on Friday afternoon, Gaeta, 17, entered a plea of not guilty to charges that he raped and murdered 6-year-old Jenise Wright in August. Prosecutors had requested the evaluation of Gaeta during his first court appearance, following his arrest. Prosecutor Russ Hauge said the request was made after learning that Gaeta had been taking an antidepressant medication and due to his behavior during questioning with investigators.

When asked if he understood the charges against him, Gaeta answered "yes" in a quiet voice.
 
Judge Jennifer Forbes set trial for Dec. 22, but it is likely that date will be pushed back. Attorneys on the case have noted the large number of documents that were generated during the investigation of Jenise Wright's disappearance and death.

Gaeta, now an adult, transferred to Kitsap County Jail

Gabriel "Gabe" Gaeta was transferred on Dec. 23 from juvenile detention to the Kitsap County Jail, according to the Kitsap County Prosector's office.
 
Because he was a juvenile when he was arrested, he was held in juvenile detention. But Gaeta turned 18 on Dec. 23 and was moved to county jail.

In an earlier court appearance, Gaeta pleaded not guilty. He potentially faces life in prison if convicted of first-degree murder with aggravating circumstances. He faces two counts of first-degree murder and one count of first-degree rape of a child.

His next court appearance is Feb. 6 for a pre-trial hearing. The trial date has been set for March 9.
