The Justice Department issued a brief statement saying it was disappointed in the ruling and was reviewing its options. If the Obama administration challenges the injunction, the case would head next to the New Orleans-based 5th Circuit Court of Appeals.

States, hospital sue feds over transgender mandate

By Paige Winfield Cunningham (@pw_cunningham) • 8/23/16 12:47 PM

Five states and a Catholic hospital network are suing the Obama administration over a new rule requiring doctors to treat patients based on their gender identity instead of their biological sex.

The plaintiffs say the new regulation, finalized last month, would require doctors to perform gender transition surgeries on children even if they believe such surgery could be harmful.

Partial win in fight over North Carolina transgender bathroom law

By Colleen Jenkins
August 26, 2016

WINSTON-SALEM, N.C. (Reuters) - North Carolina's university system must allow two transgender students and a transgender employee to use bathrooms matching their gender identity, a U.S. judge ruled on Friday, in a partial victory for those fighting the state's restrictive restroom law.

Most transgender people in North Carolina, however, will still be bound by the law adopted in March that requires them to use bathrooms in government buildings and public schools that correspond with the sex on their birth certificate.

Backlash Against Transgender Locker Rooms in Clovis, California
By Michelle Moons 17 Sep 2016  Comments  64

(Snip)

Mothers said at a Wednesday board meeting that they first contacted Clovis Unified trustees in May when they learned that their daughters voiced their concerns about being made to change in front of a biological boy, according to the Fresno Bee. They said they were told to accept it or withdraw their daughters. The transgender bathroom/locker room law that California Gov. Jerry Brown signed in 2013 was cited as the reason the girls were forced to change in front of the boy.

U.S. Catholic school hit with $1 million suit for not allowing same-sex date at dance

MEMPHIS, Tennessee, September 29, 2016 (LifeSiteNews) — An all-boys Catholic high school in Memphis, Tennessee, is being sued for $1 million by a former student who claims the school caused him “severe injuries and damages” by refusing to allow him to bring his same-sex date to a homecoming dance last year.

 an angelic monkey
Massachusetts law could forbid churches to preach on transgenderism

Boston, Mass., Oct 13, 2016 / 12:43 pm (EWTN News/CNA)

Four churches and their pastors are challenging a Massachusetts law which they say could regulate their speech regarding gender identity.

“This case is about who controls Massachusetts churches,” said the churches’ legal motion to halt enforcement of the law. “Are pastors and churches still free to teach their religious beliefs and use their houses of worship to reflect and reinforce those beliefs?”

The four churches and their pastors filed the motion in U.S. District Court for the District of Massachusetts, Eastern Division. They have also filed a lawsuit against Massachusetts officials.

“The First Amendment forbids government intrusion into ecclesiastical matters like church teaching and administration,” the legal motion continued. “Yet Massachusetts officials have ignored these boundaries and injected themselves into what churches teach, believe, and promote. Fearing devastating financial penalties and imprisonment, Massachusetts churches and their pastors are now forced to seek judicial protection of their most basic First Amendment rights.”

In July 2016, the Massachusetts legislature added “gender identity” as a class protected under anti-discrimination law.

The Massachusetts Commission Against Discrimination and Attorney General Maura Healey have interpreted the law in a way that would force churches to open their changing rooms, showers, and restrooms to someone based on their perceived gender identity, not on their biological sex.

The legal prohibition against discrimination or incitement also regulates the churches’ speech and would silence churches and pastors if their religious views on gender identity differ from those of the law, the legal group Alliance Defending Freedom said.

Each violation of the law may be punished by up to $50,000 in fines, 365 days in jail, and attorneys’ fees.

Healey, the state attorney general, is named in the lawsuit. Her spokeswoman, Jillian Fennimore, said the law is about civil rights and is “critical for people who were without full protection and equality under the law for too long.”

Attorneys with the legal group representing the plaintiffs were critical.

“The government shouldn’t encroach on the internal, religious practices of a church,” said Steve O’Ban, senior counsel with Alliance Defending Freedom. “Neither the commission nor the attorney general has the constitutional authority to dictate how any church uses its facility or what public statements a church can make concerning a deeply held religious belief, such as on human sexuality.”

The law applies to places of public accommodation. However, guidance from state officials said a church could be included in that definition “if it holds a secular event, such as a spaghetti supper, that is open to the general public.”

According to the lawsuit, the legislature and the anti-discrimination commission failed to provide a religious exemption and failed to define what events fell under the law’s parameters.

The proposed “spaghetti supper” test, in the lawsuit’s view, was “woefully inadequate and confusing.” The guidance’s suggestion that legal charges against religious institutions would be reviewed on a case-by-case basis also drew criticism. The lawsuit said this would result in pastors, church leaders or courts guessing about the application of the law and its penalties.

“All events held at a church on its property have a religious purpose, and the government has no authority to violate the First Amendment’s guarantees of freedom of religion and speech,” said Christiana Holcomb, legal counsel with Alliance Defending Freedom. “Government officials have no business determining which church activities are religious and which ones aren’t.”

Opponents of the state law have also gathered enough signatures to place a repeal of the law on the 2018 ballot. However, the law itself appears to have significant support. A May 2016 Suffolk University/Boston Globe poll appeared to show that 53 of voters favored it while only 30 percent were opposed.

BREAKING: Judge reaffirms nationwide ban on Obama transgender school bathroom policy

Fr. Mark Hodges  Wed Oct 19, 2016 - 1:58 pm EST   Comments 15

WICHITA FALLS, Texas, October 19, 2016 (LifeSiteNews) — A federal judge has stopped President Obama's policy forcing public schools to allow boys in the girls' locker room.

U.S. District Court Judge Reed O'Connor rejected the Obama administration's request to lift an injunction against enforcement of the transgender bathroom policy put forth by the Department of Education.

In response to 13 state attorney generals, Judge O'Connor issued the nationwide injunction in August. The Justice Department requested the injunction at least be limited to the 13 objecting states, but O'Connor ruled late Tuesday against the Obama administration.

KGR to Delta April 21 at 2:21 pm

Delta, on Tuesday, 4/18/17, you removed a passenger from the flight for using the restroom during the 30+ minutes that we were waiting on the tarmac.

This was unnecessary and caused a 2+ hour delay, along with stranding the customer in Atlanta. I cannot believe you can treat a paying passenger in this way.

Delta Employees Asked Man to Leave Flight After Using Restroom, Videos Show

by Kalhan Rosenblatt and Daniella Silva

Snipped

The first video posted to YouTube shows the employee repeatedly asking Hamilton to follow him off the plane, as Hamilton calmly asks the man to clarify why he's being removed.

The employee tells Hamilton several times he will explain the situation after he steps off the plane, but Hamilton refuses to leave without being told why.
"Mr. Hamilton was never confrontational. He was very polite. He only asked for clarification throughout," Michael Rosolino, Krista Rosolino's husband told WMJ4.
In the second video, which is more than nine minutes long, another airline employee boards the plane to speak with Hamilton.

Urgent trip to restroom gets man kicked off Delta flight

All of that because he had to pee, and because airline rules sometimes miss the point of common sense. A passenger from a different Delta flight told Krista Rosolino two passengers needed to use the restroom while the plane prepared to taxi, and in that case the flight attendant simply told the pilots to wait until they were done.

Open Letter to Delta Regarding Removal of Passenger on DL2035 on 4/18/17

 study

Dear Delta:

On Delta flight # 2035 this week, I observed the most outrageous treatment of a paying customer that I have seen in my two decades of flying.  I trust that you will investigate this matter and see that similar situations are handled better in the future. Not only did your staff truly harm and humiliate one person who was forced to pay hundreds of dollars for a new same-day flight, but you forced the rest of us passengers to endure a 2 hour saga of watching a man being targeted for having a bathroom emergency.  I am disappointed and horrified at how Delta Airlines staff treated their customers/passengers.

I was a passenger on DL 2035 on April 18, 2017 from Atlanta to Milwaukee (2:55 pm departure time).  I was seated with my husband and with my infant in my arms across the aisle from another passenger, a stranger to us, but clearly a nice gentleman (“Nice Gentleman”), who played hide and seek with my child as we waited to takeoff.
