DELPHI, Ind. – Court proceedings related to the Delphi murders of Abby Williams and Libby German will remain in Carroll County.

Allen Superior Judge Fran Gull has already started her work on the case. She was appointed to handle the proceedings after Carroll County Circuit Court Judge Benjamin Diener recused himself.

Allen County judge to be appointed as special judge in Delphi murder case

Diener cited concerns about his personal safety as well as the flood of media and public inquiries about the Delphi case. Before his recusal, Diener set a Nov. 22 hearing to determine if sealed court records pertaining to the arrest and charging of 50-year-old Richard Allen will remain out of the public eye.

Delphi murders: Prosecutors argue for secrecy as they search for additional suspects

DELPHI, Ind. — Prosecutors fueled speculation during Tuesday's hearing that Richard Allen was not alone when they allege he killed Libby German and Abby Williams in early 2017.

In his arguments against unsealing Allen's probable cause affidavit, Carroll County Prosecutor Nicholas McLeland cited the need to protect the investigation as well as to protect the names of witnesses who might testify against Allen.
 
At the conclusion of Tuesday morning's 40-minute hearing, Special Judge Fran Gull said she will publish a decision on whether to make public the charging documents and affidavit after reviewing both sides' arguments.
 
Motion for gag order filed Tuesday

Before Tuesday's hearing, prosecutors filed a motion for what amounts to a gag order, asking the court to bar statements or comments outside of the courtroom from all involved attorneys, law enforcement officials, court personnel, the coroner and family members.

The court-appointed attorneys for 50-year-old Richard Allen filed a request this week for a change of venue. Allen is charged with two counts of murder in connection with the February 2017 case. Court documents remained under seal at the request of Carroll County Prosecutor Nick McLeland until Tuesday afternoon, when a redacted version was filed in court.

The motion for the change of venue cites “extensive media attention” and the “highly publicized” nature of the case from the initial investigation through Allen’s arrest. The murders have garnered significant coverage in local, statewide and national media, the motion noted. Allen’s attorneys also said coverage on podcasts and social media extended its reach.

“Although it could be argued that the amount of publicity that this particular case has received in the past 5+ years will make it difficult to find a jury that has not heard of this case, Richard Allen’s defense team has gleaned statistical data that would strongly indicate that moving the case/trial just 150 miles away would significantly reduce the likelihood of obtaining a tainted jury pool,” the motion read.

A bullet found near the bodies of two teenage girls who were killed in Delphi, Indiana, has been linked to a gun belonging to the suspect in their 2017 deaths, newly unsealed court documents revealed.

An analysis performed on a .40-caliber pistol owned by Richard M. Allen, 50, determined that a .40-caliber unspent round found by the bodies of the victims — Abigail “Abby” Williams, 13, and Liberty “Libby” German, 14 — was allegedly fired from the weapon, according to a probable cause affidavit released Tuesday.

On Feb. 13, 2017, investigators believe, Abby and Libby were dropped off at around 1:49 p.m. near an entrance to the Delphi Historic Trail. Video found on one of the victim's phones shows that they encountered a man on the southeast part of Monon High Bridge at 2:13 p.m., the document says.

In the video, investigators saw the man wearing a dark jacket and jeans walking behind one of the victims.

"As the male subject approaches Victim 1 and Victim 2, one of the victims mentions 'gun,'" according to the document. "Near the end of the video a male is seen and heard telling the girls, 'Guys, down the hill.' The girls then begin to proceed down the hill and the video ends."

It is believed the man forced the victims down the hill to the location where they were killed, the affidavit says.

Update: Special Judge Frances Gull issued an order Dec. 2, 2022, that prevents counsel, law enforcement officials, court personnel, the coroner and family members from publicly communicating about the case against Richard Allen until a hearing on Jan. 13, 2023.

DELPHI, Ind. — Special Judge Frances Gull will decide next month whether to bar some people from speaking publicly about Delphi murder suspect Richard Allen, as well as potentially moving his case to a new location.

The judge approved two separate motions late Thursday from attorneys who requested a hearing to consider a gag order as well as Richard Allen’s request for a change of venue.

Both motions were filed in response to the extensive media coverage after Indiana State Police announced in October that Allen, 50, of Delphi, was charged as a murder suspect in the killings of Libby German and Abby Williams in February 2017.

Judge Gull has scheduled a hearing to determine both motions in Carroll Circuit Court on January 13, 2023.

DELPHI, Ind. — The man accused of killing Libby German and Abby Williams was back in court Friday.

During the hearing at the Carroll County Courthouse, attended in-person by Richard Allen, Judge Frances Gull gave the prosecutor and defense one week to agree on a county where they will select a jury and bring that jury to Carroll County.

"I think it is important to try here," Gull said on the location for the trial.

Gull said that it would be "difficult if not impossible" to find a jury in Carroll County. Both the prosecution and defense agreed.

Trial dates will be further discussed at a February hearing. Regarding the trial taking place in May, Gull said, "I can't see that happening."

The gag order issued in the case will essentially continue in its current form, Gull said. Lawyers, police and family members can't talk about the case publicly. Legal teams are only allowed to speak with the media about procedural items.

A bail hearing is scheduled for Feb. 17.

Friday's hearing started at 10:30 a.m. and lasted less than 10 minutes.

CARROLL COUNTY, Ind. – Lawyers for Delphi murder suspect Richard Allen are asking for a delay in a key bail hearing scheduled for next week.

Allen’s defense team filed a motion Tuesday for a continuance for the Feb. 17 hearing as well as a delay for his March trial.

Allen faces two counts of murder in the February 2017 deaths of Abby Williams and Libby German. Indiana State Police announced his arrest in October 2022, more than five years after the murders.

Prosecutors argue against granting bail request for Delphi murders suspect

According to the motion, the defense said it has “yet to receive the entirety of discovery” from the state and was “not yet prepared to proceed with the bail hearing.”

Allen’s counsel anticipated receiving the remaining discovery materials by the end of the week and said it lacked “adequate time to review the discovery in preparation for the bail hearing.”

As a result, the defense is asking Special Judge Fran Gull for a delay. If the hearing is continued, the defense acknowledged the court would likely have to push back Allen’s trial, which is scheduled for March 20, 2023.

CARROLL COUNTY, Ind. – Delphi murder suspect Richard Allen has a new date for his bail hearing.

Special Judge Fran Gull held a virtual hearing Friday with Allen, his attorneys and prosecutors to set a new date. Allen is now scheduled to appear in court for a hearing on June 15. A June 16 date has also been set aside in case the court needs additional time.

In addition to the bail issue, the parties involved will discuss potential dates for a new trial during the June hearing. An Allen County court official said Allen’s attorneys told the court it would be “shocking” if they could be ready for trial before the end of the year due to the amount of evidence they have to comb through during discovery.

PERU, Ind. (WISH) — The lawyers for Kegan Kline on Monday asked for and received a hearing to change his plea of not guilty in his child porn case.

The request also sought to cancel a pretrial conference and a jury trial. Kline is scheduled for trial in May on 25 child porn-related charges.

The judge in Miami Circuit Court set a change of plea hearing for March 30, which had been the date of the pretrial conference. The judge kept the jury trial scheduled to start May 10.

Prosecutors say Kline used a phony social media profile called “anthony_shots” to solicit sexually explicit photos from at least 15 underage girls. Investigators found dozens of the images saved to Kline’s phone and tablet.

Kline, 28, of Kokomo, has been linked to the investigation into the 2017 murders of Abigail “Abby” Williams and Liberty “Libby” German near Delphi. He has not been charged in that case and has not been publicly named a suspect in their deaths.

DELPHI, Ind. – Prosecutor Nick McLeland said in court Thursday that Richard Allen “confessed five or six times” that he killed best friends Abby Williams and Libby German on remote historic trail in Delphi in February 2017.

“He made multiple confessions to multiple people,” McLeland said on Thursday.

Richard Allen’s defense attorney acknowledged “incriminating statements” made by Allen but attributed the comments to his client’s deteriorating mental state.

“He has made incriminating statements implicating himself in the crime,” said Allen’s defense attorney, Bradley Rozzi.

Defense attorneys and prosecutors made arguments in court Thursday about statements previously made by Delphi murder suspect Richard Allen, including the reported “confessions” of the murders.

A trial date was also set for early January 2024.

The defense counsel for Delphi murders suspect Richard Allen withdrew from the double-murder case Thursday after allegations that leaked photos of the crime scene came from one of the attorney's associates.

The gruesome images, which were shared via text and appeared on social media, were taken in the wooded area off the Monon High Bridge Trail in Delphi, Indiana, where Liberty "Libby" German, 14, and Abigail "Abby" Williams, 13, were murdered after they disappeared from a hike on Feb. 13, 2017.

"We've had an unexpected turn of events, ladies and gentlemen," Carroll County Judge Fran Gull said during Thursday's hearing, which was recorded by FOX 59 Indianapolis. "Earlier this afternoon, the defense attorneys have withdrawn their representation of Mr. Allen."

Gull ordered Allen, who is entitled to new counsel, to be sent back to Westville Correctional Facility. She also ordered his counsel to send discovery back to the state of Indiana. The attorneys, Andrew Baldwin and Bradley Rozzi, agreed to cooperate with successor counsel, Gull added.
 
The next hearing in Allen's case is scheduled for later this month, according to Gull.

Baldwin did not immediately respond to an inquiry from Fox News Digital, and Rozzi's office could not immediately be reached.

ALLEN COUNTY, Ind. — Two attorneys have been appointed to defend Richard Allen on two counts of murder in the killings of Abby Williams and Libby German outside of Delphi in 2017.

On Friday, the Carroll County court system appointed Attorney Robert Scremin and Attorney William S. Lebrato as contract public defenders in Allen’s case.

Both Scremin and Lebrato are defense attorneys based in the Fort Wayne/Allen County area, the same county the trial jury will be selected from and where a previous hearing in the case was held.

Past case developments
 
While Gull has still not made a decision on all future court proceedings, the court on Friday did deny all requests from media to film at the next scheduled hearing on Oct. 31. This, the court said, was due to “unauthorized filming and broadcasting of pre-hearing activities” last week.

CARROLL COUNTY, Ind. – An evidence leak, legal filings and the removal of the original court-appointed defense team spelled another delay in the Delphi murder case.

Attorneys for Richard Allen filed a motion for a continuance to delay the proceedings. The trial had been scheduled for January 2024.

Allen’s new attorneys indicated it would be “impossible” to meet the January trial date, given the amount of discovery material they have to review.

The state had no objection to the motion, according to the filing. Special Judge Fran Gull, who’d earlier expressed skepticism at meeting the January date, pushed Allen’s trial back, setting a new date of October 2024. The trial is set to take place between Oct. 15 and Nov. 1, 2024.

DELPHI, Ind. — Civil attorneys, on behalf of Richard Allen, the Delphi murders suspect, are asking the Indiana Supreme Court to step in and remove the special judge on the case, reinstate his formal attorneys and set a trial date with 70 days after the decision is made.

According to court documents, civil attorneys Mark K. Leeman and Cara Schaefer Wieneke filed the brief "to ensure that, going forward, Richard Allen receives his fundamental right to counsel."
 
Allen's recently-appointed public defenders, William S. Lebrato and Robert C. Scremin, asked the judge to push his trial back. It was originally set for Jan. 24, 2024, but is now set for Oct. 15-31, 2024.

The next big day on the schedule for the case is Nov. 9. That has to do with a separate case before the Indiana Supreme Court. The state's highest court is considering a request to order Gull to follow court rules or correct mistakes in the case.

ALLEN COUNTY, Ind. — Allen Superior Judge Fran Gull, the woman appointed to oversee the trial of Richard Allen in the Delphi double murders case, has released a transcript of a meeting in her chambers last month where the suspect’s defense team felt they were “ambushed” into withdrawing.

In the transcript, it is revealed that Gull, who was assigned out of Allen County as a special judge to the case, had plans to remove defense attorneys Andrew Baldwin and Bradley Rozzi from the case prior to her announcement in a court hearing in October that the lawyers had voluntarily withdrawn from the case.
 
Gull, meanwhile, has assigned a new defense team for Allen and moved the trial date from January to October.

INDIANAPOLIS (WISH) — The special judge presiding over the Delphi murders case has been elected to a new role, according to Allen County Superior Court website.

Judge Frances Gull has been named Superior Court Chief Judge. Gull will serve a two-year term that began on January 1, 2024.
 
Gull, from Allen County, was appointed as special judge for the Delphi murders trial, in Carroll County.

Richard Allen, 51, of Delphi, was arrested on Oct. 28, 2022, for the February 2017 murders of 13-year-old Abigail “Abby” Williams and 14-year-old Liberty “Libby” German near the Monon High Bridge in Delphi.

Allen has asked the state supreme court to reinstate his original defense lawyers and remove Special Judge Frances Gull, from his trial.

The Indiana Supreme Court will hear oral arguments that will be livestreamed beginning at 11 a.m. on Jan. 18th.

The state’s highest court is expected to hear requests from Allen, who has maintained his innocence since his arrest in October 2022.
 
Allen’s attorneys says Gull is biased against them and Allen and have asked the state’s high court to replace her.

It is unclear if the election of Gull to Superior Court Chief Judge will have any bearing on the Delphi case.

Murder charges approved, kidnapping charges dismissed for Delphi murders suspect

DELPHI, Ind. (WNDU) — The special judge in the Delphi murders case made a few key decisions in two separate hearings on Monday that will determine how the case moves forward.

Richard Allen is accused of killing 13-year-old Abby Williams and 14-year-old Libby German back in February of 2017. He was arrested and charged with their murders in October of 2022.
 
Meantime, Allen’s request for an early jury trial was accepted by the court earlier this month, and it will now take place between May 13 and May 31. That trial had previously been scheduled for Oct. 15, nearly two years after his arrest.
