David Dao, Doctor Dragged Off Plane, Files Court Papers Demanding United Airlines Preserve Evidence

The United Airlines passenger who was videotaped being bloodied and dragged off an overbooked plane by airport police signaled Wednesday he would fight back in court.

David Dao filed an emergency "bill of discovery" against the carrier in Illinois State Court demanding that evidence documenting Sunday's "re-accommodation" aboard a Kentucky-bound plane be "preserved and protected."

That includes all surveillance videos, cockpit voice recordings, passenger and crew lists, incident reports and other items.

Why United Was Legally Wrong to Deplane David Dao

Like all airlines, United has a very specific (and lengthy!) contract for carriage outlining the contractual relationship between the airline and the passenger. It includes a familiar set of provisions for when a passenger may be denied boarding (Rule 25: “Denied Boarding Compensation”).

When a flight is oversold, UA (United Airlines) can deny boarding to some passengers, who then receive compensation under specific guidelines. However, Dao was not denied boarding. He was granted boarding and then involuntarily removed from the airplane. What does the contract say about that?

It turns out that the contract has a specific rule regarding “Refusal of Transport” (Rule 21), which lays out the conditions under which a passenger can be removed and refused transport on the aircraft. This includes situations where passengers act in a “disorderly, offensive, abusive, or violent” manner, refuse to comply with the smoking policy, are barefoot or “not properly clothed,” as well as many other situations.

  There is absolutely no provision for deplaning a seated passenger because the flight is oversold.

Angry United Airlines pilots union issue statement denying ALL responsibility for forcible removal of doctor last week...

The United Master Executive Council released a statement on Thursday regarding Dr. David Dao's violent removable from Flight 3411 on Sunday
The United Master Executive Council represents the airline's 12,500 pilots
The United pilots' union wrote that the Chicago Department of Aviation's 'grossly inappropriate response' was to blame for the events that transpired
The statement also pointed out that the plane from which Dr. Dao was ejected was one of which that was separately owned and operated by Republic Airlines

United changes crew booking policy after passenger dragged off plane

Reuters  April 14, 2017

(Reuters) - United Airlines said on Friday it is changing its policy on booking its own flight crews onto its planes after a man was dragged off an overbooked flight to make way for a United employee on Sunday, video of which went viral and made the airline the target of global criticism and ridicule.

The airline, owned by United Continental Holdings Inc <UAL.N>, said it would make sure crews traveling on their aircraft are booked into seats at least 60 minutes before departure.

I understand the airline would not permit any food to be left the Jacob?  What is up with that?  Why does the airline ask on the checklist for 2 food/water dishes,
and if her mother (allegedly) was not permit to leave food for the dog?  The airline check list #15: Does the kennel have 2 food/water dishes?
A dog would need water and food within the 20 hour duration of layover, IMO.  Was he given water during the 20 hours?  Who at United Airlines feeds the flying cat or dog?

I hope we get some clear answers someday. United Airline's statement said the case is closed according to the post at the end of the youtube video.
