Wesley Mathews Files Legal Challenge Over Life Sentence

The defense attorney for Wesley Mathews is expected to file a legal challenge on Friday after Mathews was sentenced to life in prison for his daughter's death in 2017, NBC 5 has learned.

Mathews pleaded guilty to the lesser charge he faced at the time of felony injury to a child the day his trial began in late June and admitted to not calling 911 and instead disposing of his daughter's body after he said she choked on milk in the family's Richardson garage.
 
In a motion for a new trial, Wesley's appeal attorney, Brook Busbee, states Mathews should be granted a new trial because the "photographs of the remains of the decedent, both where her body was discovered and in the autopsy suite" were so prejudicial as to deny Mathews a fair trial.

At least two jurors were visibly affected when shown the graphic images.
The images were not shown to the audience in the courtroom.

Busbee also states that jurors were shown evidence that Sherin suffered "fractures from before she died. There was no evidence" that linked Mathews to the injuries and "introduction of that evidence unfairly prejudiced the jury."

The move to file an appeal or a motion for a new trial is standard, according to a source close to the case.

Sherin Mathews' father transferred into state custody to begin life sentence for her death

A Richardson father has been transferred to state prison to begin his life sentence in connection with the death of his 3-year-old adopted daughter.

Wesley Mathews, 39, was taken from the Dallas County Jail on Thursday to the Texas Department of Criminal Justice in Huntsville so he can be assigned to a prison unit, according to the Dallas County Sheriff's Department.
 
Mathews' attorneys have requested a new trial for their client. In a motion filed last week, they argued prosecutors showed graphic photos to the jury that were prejudicial and prevented Mathews from receiving a fair trial.

His attorneys also argued the state lacked evidence to show Mathews was responsible for broken bones Sherin sustained while she was in his care. Mathews and his wife, Sini Mathews, adopted the child from India in 2016.

A hearing on the motion for a new trial is scheduled for Aug. 2, according to court records.

DALLAS - The man sentenced to life in prison in connection to his adopted daughter's death wants a retrial.

Wesley Mathews and his attorneys were in court again Monday morning claiming he did not get a fair trial when jurors were shown pictures of his daughter’s remains.


Mathews pleaded guilty to a reduced charge of injury to a child by omission and was given a life sentence in June for his daughter Sherin's 2017 death.

He maintains that the 3-year-old died after choking on her milk. He admitted to dumping her body in a culvert near their home and then reported her missing the next day.

Richardson police searched for the little girl for several weeks before finding her body. It was so badly decomposed the medical examiner could not determine her cause of death.

The judge on Monday heard the motion by the defense and also heard from the state. She said she will make a decision on Sept. 5.

Wesley Mathews, who was convicted earlier this summer in connection to the 2017 death of his adopted daughter Sherin Mathews, 3, was denied a motion for a new trial Thursday morning.

Mathews' defense claimed the jury in the June trial should never have been shown photographs of the child's dead body, or photos that detailed a history of injuries prior to her death.

The defense team for the Richardson father filed a motion for a new trial last month, arguing that "photographs of the remains of the decedent, both where her body was discovered and in the autopsy suite" were so prejudicial as to deny Mathews a fair trial.

Based on the above, Mathews' defense filed a motion for a new trial. That motion was denied Thursday and now his team is expected to file an appeal.
