BOISE, Idaho (AP) - A judge ruled Tuesday there’s enough evidence for a man to go to trial after the bodies of his new wife’s two children were found buried on his Idaho property. The bizarre case involving doomsday beliefs and the deaths of several people linked to the couple has attracted national headlines.

Chad Daybell, 52, has pleaded not guilty to charges related to hiding the remains of 7-year-old Joshua "JJ" Vallow and 17-year-old Tylee Ryan. Investigators found their bodies during a search in June, months after they were last seen in September.

Daybell last year married Lori Vallow Daybell, who has pleaded not guilty to conspiring to help him keep the bodies of her children hidden. Authorities have yet to file charges related to the deaths of the children.

They also have yet to say how or when the children died, but the prosecuting attorney on Tuesday during closing arguments called both deaths homicides based on the condition of the bodies.

The two-day hearing included graphic testimony about unearthing the duct-tape bound body of the boy and the charred and dismembered remains of the girl.
 
Lori Daybell faces a hearing next week on whether the case against her will proceed to trial.

ST. ANTHONY — The district court arraignment for Lori Vallow Daybell is scheduled for the afternoon of Aug. 27.

Daybell waived her preliminary hearing last week, moving her case automatically to the district court. Daybell is facing two felony counts of conspiracy to conceal, alter or destroy evidence in Fremont County.

The charges came after investigators discovered on June 9 the remains of her two children, Joshua “JJ” Vallow, 7, and Tylee Ryan, 16, buried on the property of her husband, Chad Daybell.

The judge assigned to Lori’s case is District Judge Dane H. Watkins Jr. He typically handles cases in Bonneville County but can cover any hearing in the 7th Judicial District. At the arraignment, Daybell will enter a plea. If she pleads not guilty, a jury trial date will be set.

In Madison County, Lori is also charged with misdemeanor resisting or obstructing officers, criminal solicitation to commit a crime, and contempt of court. She pleaded not guilty to those charges, and a jury trial is set for Jan. 25 to 29 before Magistrate Judge Michelle Mallard.

Chad is charged with two felony counts of conspiracy to conceal, alter or destroy evidence. Prosecutors also charged him with two felony counts of concealment, alteration or destruction of evidence. He will appear for an arraignment on Aug. 21 in Fremont County to enter a plea.

(KUTV) — Arizona police are looking to submit new charges, as early as December, against Lori Vallow Daybell in connection to the death of her estranged husband Charles Vallow.

Sgt. Jason A. McClimans with the Chandler Police Department confirmed to 2News on Thursday that "if and when they go over to the Maricopa County Attorney's Office, one [charge] will be conspiracy to commit murder."

McClimans said other charges, if any, are unknown at this time.

FREMONT COUNTY, Idaho (KUTV) — Idaho prosecutors want to combine the criminal cases against Chad Daybell and his wife Lori Vallow Daybell, the mother of two children whose remains were found on Daybell’s property in June.

Special prosecutor Rob Wood and the state of Idaho moved to join the cases Wednesday, saying both defendants participated in the same series of acts, according to court documents obtained by KUTV News.

"Charges against defendant and the co-defendant allege they participated in same act or series of acts and conspired to commit the alleged act or series of acts," the motion reads.

The state argues that assigning the couple to different judges and holding separate hearings would "create an undue burden on the state by requiring repetitive work and hearings."

"Trials in these matters will require the same witnesses and evidence be presented by the state," a memorandum in support of the motion states.

Daybell pleaded not guilty in August to two felony counts of conspiracy to commit destruction, alteration or concealment of evidence, and two felony counts of destruction, alteration or concealment of evidence.

Chad Daybell's attorney is asking an Idaho judge to dismiss the charges against him or try him in a different county than the one in which he allegedly concealed the remains of his wife's two children, Joshua "JJ" Vallow and Tylee Ryan.

Judge Steven Boyce granted Chad's attorney, John Prior, more time to prepare for a hearing on Prior's motion to dismiss, court documents show. Prior's Aug. 27 motion claims that Fremont County special prosecutor Rob Wood did not present sufficient evidence against Chad during his two-day preliminary hearing, which Prior has requested a full transcript of to prepare his case for dismissal. 

During the Aug. 3 and 4 preliminary hearing, Wood called numerous law enforcement officers, forensic experts and former friends to the stand as part of his case against Chad. A magistrate judge ruled there was sufficient evidence to move the case to district court. Now, district court judge Boyce has ruled that the court has until Oct. 1 to provide Prior with a transcript at Chad's expense, according to court documents.

Last week, Prior also filed a motion for change of venue, arguing that a "fair and impartial jury trial cannot be had in Fremont County."
 
Lori is scheduled to be arraigned Thursday on felony charges of conspiracy to commit destruction, alteration or concealment of evidence in Fremont County. Her attorney, Mark Means, recently filed a document asking for more time to file a motion to transfer her trial, signaling he may also seek a change of venue for Lori. Lori has previously pleaded not guilty and denies all allegations of wrongdoing.

If the prosecutor on the case gets his way, however, Chad and Lori will be tried together. Last week, Wood filed a motion to join their cases, writing that "due to the nature of the conspiracy charges alleged against the Daybells, the State's evidence in both cases is nearly identical and the trial for each case will be nearly identical."

BOISE, Idaho (AP) — A couple charged with conspiring to hide the bodies of two missing children in a case connected to the parents’ doomsday beliefs and the mysterious deaths of their previous spouses will stand trial together, an Idaho judge said Thursday.

But attorneys for Chad and Lori Daybell could ask to have the cases split in the future if they feel their clients won’t get fair treatment in a joint trial, Judge Steven Boyce said.

Lori Vallow and Chad Daybell, the mother and stepfather of two Idaho kids who were last seen in September 2019, were indicted on first-degree murder charges Tuesday in the children's deaths.

Joshua "JJ" Vallow and Tylee Ryan were 7 and 16 respectively when they disappeared.

Daybell was also indicted on a charge of first-degree murder and insurance fraud in the death of his then-wife Tammy Daybell.

Daybell is a self-published author who has written more than two dozen books about near-death and doomsday events, and multiple people close to Vallow have raised red flags about her bizarre doomsday beliefs and mental state.

Indictments released Tuesday said the couple “did endorse and espouse religious beliefs for the purpose of encouraging and/or justifying the homicides” of Tylee, Joshua and Tammy Daybell.

During Daybell's first court appearance Wednesday, he was informed of the charges he faces and potential sentences. His arraignment is scheduled for June 9.

Vallow also appeared in court Wednesday, but Judge Faren Eddins said the hearing would be postponed at the request of Vallow's attorney based on "information provided to the court." He didn't elaborate or set a new date
.

Attorneys for Vallow and Daybell did not immediately return a request for comment. If convicted, they could face life in prison or the death penalty. Prosecutors in Idaho have 60 days to decide whether they will pursue the death penalty.

An Idaho jury on Friday found Lori Vallow guilty of murdering two of her children and conspiracy to murder her husband's first wife nearly four years ago.

She killed her two children, 7-year-old J.J. Vallow and 17-year-old Tylee Ryan, around September 2019, when they went missing for months, allegedly with help from her husband, Chad Daybell. Vallow also conspired, allegedly with her husband, to kill Tammy Daybell in October 2019.

Vallow was convicted on all counts, including two counts of first-degree murder, three counts of conspiracy to commit murder and grand theft for stealing her children's Social Security benefits after their murders.
