UN condemn locking up of juvenile prisoners amongst adults

WILLEMSTAD/GENEVA – The United Nations’ Committee against Tortures in Geneva criticized the locking up of juvenile prisoners amongst adults, the custody that lasts much too long, and due to this, the huge number of prisoners that are not sentenced in the Antilles and Aruba. They also criticized the sexual abuse and other violence against prisoners that is taking place in Aruba.

The UN Committee against Torture reports this after her 38th meeting, where reporting of 7 countries were considered. Other than in the Netherlands, the situation in Denmark, Luxembourg, Italy, Ukraine, Japan, and Poland was also investigated. Basic principle of this is the Convention against Tortures from 1984 that was signed by a total of 144 countries.

When discussing the subject the Netherlands, the committee that falls under the High Commissioner of the UN paid most attention to the situation of the juvenile prisoners in the Antillean and Aruban prison. The committee condemns the locking up of juvenile prisoners among adults. The committee says that this has to end, with the biggest immediacy. As already known, there is no special juvenile prison in the Antilles or in Aruba. In some cases, juvenile delinquents are placed with the Foba (Forensic Observation and Counseling department) or the not-confined GOG (Government’s Reformatory), but that is not always possible. When placing juvenile delinquents in the Bon Futuro-prison, their age is definitely being considered and they are not placed amongst the heaviest felons. According to the committee, as part of the rehabilitation, the Antilles lacks an educational reformation program for the punished juvenile in order to improve their return in the society. Schooling and training must be part of that.

ARUBA
The committee also paid attention to the situation in Aruba, where sexual- and other violence is taking place against prisoners in the KIA. This is supposedly done by police officers and prison guards and/or they have no control over this. The committee wants the Netherlands to take measures to stop this.
The committee is very concerned about the fact that between 2005 and 2007, a big number of assaults were reported and that just a few, 2 of he 49, were taken to court. But both cases were not sentenced due to c\lack of evidence. The reportage has nothing to do with the visit of the CPT- and the UN committee that investigates torture and violation of human rights in the prisons of the Antilles and Aruba, which is planned for the end of this month. Justice-minister David Dick already indicated that he does not rule out hard negative opinion considering the situation in the Curacao and St. Maarten prisons. A few human rights organizations have pointed out the unbearable situation to the Antillean government.

THE NETHERLANDS
The UN-committee also criticized the accelerated procedures with the Immigration law that was introduced in the Netherlands in 2000. This law makes it very difficult for an asylum seeker to substantiate his/her petition. They do not get enough time to argue their case. The committee is also not happy with the long time that asylum seekers are locked up in the Netherlands.

Concerned at the Netherlands' indication that information related to sexual abuse or assault in the Aruban prison rarely reached the prison board, and that victims were not likely to lodge complaints for privacy concerns, the Committee recommended that the Netherlands put in place specific mechanisms to receive complaints of sexual abuse that would ensure the privacy of victims and protect both victims and witnesses against ill-treatment or intimidation as a consequence of the complaint. The Committee was also concerned at the number of reports of assaults committed by Aruban law enforcement officials and that, as reported by the State party, of the 49 cases lodged at the Internal Investigations Bureau between 2005 and 2007, only 2 had been dealt with in court, and those had not led to a conviction due to insufficient evidence. The Netherlands should take all appropriate measures to send a clear and unambiguous message to the Police Force and to prison staff that torture, violence and ill-treatment were unacceptable.

Already eleven fatalities in traffic in 2007, and that is unacceptable for the police.

ORANJESTAD – Police Corps Aruba ( KPA ) is very concerned about the 11 persons that died in traffic this year, and we are only in the fifth month.  In the entire year of 2006, the number of persons that died in traffic was 14.    The reasons for the accidents were in almost all the cases irresponsible driving.  This has to change, because if it continues, the figures of 2007 will be much higher.  

Driving back the number of fatal traffic accidents is one of the priorities of the corps.  The most important solution is to change the driving behavior.  One way to do this is to give a lot of information.   Joining other organizations in this will be of great advantage.  The number of collisions in San Nicolas, Noord, and Santa Cruz dropped slightly in 2006; from 6320 in 2005 to 6246 in 2006.  This however increased in Oranjestad with more than 200.  There were 7 fatal traffic accidents in Oranjestad.  Of the 14 deadly traffic accidents, 11 took place during the night.  Compared with 2005, the number of traffic violations didn’t increase in 2006.  As a matter of fact, it dropped drastically from 8808 to 7588.    

Hospital figures show that 55 percent of the beds in the surgery ward are occupied by road victims.   Per day, an average of five traffic accident victims is treated on the intensive care.  The hospital can re-claim only 25 percent from the patients’ insurance companies.   The rest cannot be re-claims, because the victim is not insured or the policy does not cover the accident.  

Another priority of the KPA is tackling the local drug dealings and sale.  It causes inconvenience and criminality.  Compared to 2006, the police have confiscated almost 600 cocaine and 50 kilo heroine versus 109 and 12 in 2006.    

The superintendent is extremely pleased with the solution percentage of the number of deadly criminal offences.  7 Persons were violently killed and the police have solved all the cases in 2006.  The number of offences has increased.  This is to be blamed on the higher number of robberies (an average of 12 per day).  The number of stolen cars (2 every day) remained the same as in 2005.

Well, Max DeVries has now been missing for three years and Yvonne has no paper work at all.

I have been speaking to Travis Makings, the son of Gary Makings and he is heart broken about his dad. He wants answers and there are none from Aruba.. he doesn't seem to have any paper work either.

Just because a case is closed does not mean anyone is getting any paper work from Aruba. It might be a law, or a statue, but when was the last time they followed the law?

This will go on for years to come in my humble opinion.

Remember when the beheading happened just at the time Natalee disappeared?  The police were asked about that and I do recall one of them saying something like, oh, that doesn't count as it is "just" a domestic disturbance!

Like you, I wonder about only 7.  Guess some of those bodies that wash ashore are just considered accidental or whatever.  Suicide seems to be a very popular label for unexplained deaths as well.

Very different counting system perhaps but we do take our accounting straight from the newspapers so it would tend to be low from some not receiving coverage considering the high number of crimes to be covered daily in addition to the constant stream of automobile mishaps.

And as for murders - who knows what may or may not "count" -- only native Arubians? Probably not domestic ...

Criminal investigation on Namdar-letter  

ORANJESTAD – The exploratory investigation on the letter of Effy Namdar that started around April 10th, is recently wrapped up.   The findings of this investigation provoke a criminal investigation on the matter, announced the Public Prosecutor.  

 This letter was given publicity through Mike William on March 26th.  The letter was not dated, but according to the contents it must have been from before 2004.  In this letter, the diamond dealer from New York , Effi Namdar offers money in exchange for the realization of a shopping mall near the cruise terminal, especially for jewelers.  Namdar writes tht if his company can be granted the land before September 2004, he can guarantee that the completion will be before November 2005.  That would conveniently coincide with the ‘the re-election of your party’; but no names of a party is mentioned.  

The company links these conditions with the offer to deposit 500.000 florins in the party’s cashbox before the elections and another 500.000 florins ‘in the course of a few years’.  The letter made publicity when Royal Caribbean Cruise Lines (RCCL) signed a declaration of intend with Aruba Ports Authority ( APA ) for the development of the harbour area of Oranjestad.  Namdar is supposedly one of the partners of RCCL in the realization of this project.  The question about which political party the letter was addressed to and what the date of the letter is, caused a lot of discussions.  In a letter to the editor of Prime Minister Nelson Oduber in the Amigoe of last Tuesday is stated: “From the beginning I already indicated that our government has nothing to do with Namdar; that we have never asked him for any money for any project; and that according to our investigation, the letter in question is from before our time in office.”  

The OM indicates that it has a few suspects in mind.  But in the interest of the criminal investigation, the OM won’t reveal the identity of these suspects in this stadium.  The investigation focuses on punishable facts, varying from defamation to bribery and also forgery.   If the interest and the position of the criminal investigation allow it, the OM will give more information.

Commentary: Another whitewash, or is it? And why ignore Curacao?

Natalee Holloway. It's a name that hangs like a cloud over the island of Aruba. Her disappearance two years ago has given both the island and its Ministry of Justice a black mark.

Finally, after being on the sidelines for most of the past year-and-a-half, authorities from the Netherlands have acted.

This, of course, raises the question of just why it took them so long to discharge their judicial obligations with respect to an island that is listed as part of the Kingdom of the Netherlands. Considering the glare of publicity given to the initial investigation by the island's police, as well as their lack of results and possible questionable procedures, the homeland authorities had to know what was happening. Especially since units of the Dutch Air Force were sent there in what became a show of noise without results.

A skeptic might ask if the current effort is only a political move or a serious initiative for solving this crime. One possible positive aspect might be the involvement of the Aruban police charged with combating drugs on the island. But that still means a section of a department that didn't distinguish itself in the first place is again being involved.

Another question is just why the prosecutor is evidently being promoted and sent back to the Netherlands. This is the same person whose efforts at arresting then quickly releasing suspects was named a "catch-and-release program," by TV host Nancy Grace.

Now that these investigators are already on Aruba, why stop there?

On the island of Curacao there is another case that demands their attention. Like the Holloway case, this one involved the disappearance of another American woman. But, in the case of Amy Lynn Bradley, it's known that she survived. Ms Bradley was kidnapped in March 1998 as the cruise liner she and her family were vacationing on docked at the island. Some passengers reported last seeing her with two men holding on to her as they walked along a deck. Minutes later, both men were seen again without Ms Bradley.

Apparently, there are situations where unruly passengers, and maybe misbehaving crewmembers are removed from ships. Still it's a wonder that a woman, dressed only in a pair of shorts and a top, could have been taken off a ship without either being challenged or really noticed. Especially since a liner doesn't arrive at a dock without a crew there to receive it. I'll let the readers arrive at their own conclusions about this situation.

Things get even more curious in the months that followed. Shortly afterward the kidnapping, Mr Bradley and his son headed a search party that returned to the island. Upon his arrival the Chief of the Harbour Police gave Mr Bradley a tour of the island. Bradley allowed that the tour didn't inspire confidence in this effort. Later he was told that the Chief made an interesting remark to members of the search party. In effect he told them the family should go ahead and search for her and get it out of their system, as they would never find their daughter.

At first glance, this might be a comment by a man that knew the island and what the family was up against. Over the next 11 months, other events transpired to give some doubt about just what this comment implied. That fall, two Canadians encountered Ms Bradley as she was being walked along a beach. After hearing reports about her, and remembering the tattoos she had, they reported this to the family. Almost a year later, a US Navy petty officer, visiting a brothel located close to the harbor and off-limits to servicemen, met Ms Bradley. She identified herself to him and asked for his help. Unfortunately he chose not to report the incident for another two years.

When the family contacted authorities on the island, Mr Bradley said they were told, "...we have no illegal prostitutes here." By that time the brothel didn't exist, as it had been demolished after being damaged by a fire. This means that, for at least most of a year, Ms Bradley was moved around the island in broad daylight as well as enslaved in a brothel right under the nose of the harbour police. Yet during all this time both the harbour and island police failed to find her, even they both knew about her kidnapping.

Another interesting fact is that apparently no one has found or identified the brothel owner. In the Bradley case, questions need to be asked, as three offences might be involved. This writer is certain that a civilized country like the Netherlands has sanctions against kidnapping. While there is a law in the Netherlands Antilles against forcing someone into prostitution, a Caribbean women's rights site explained it's never enforced on the islands.

Finally, since it is the 200th anniversary of the ending of the trans-Atlantic slave trace, there is a chance these laws are still on the books in the Netherlands. And this offence, if still enforceable, just might be a capital crime. Both the Bradley and Holloway cases raise many questions. Another, for Aruba, is if any police or judicial officials will ever be disciplined if it's found they mishandled this case. On Curacao, will officials, and another individual, ever face justice or discipline over the Bradley case?

Both cases demand answers from the authorities based in the Netherlands, who have the judicial obligation in the islands. If these questions aren't answered, it would appear both cases will end in a whitewash and the Dutch justice system will receive a well-deserved black mark on its record. One can only guess about the repercussions to the tourist industry in these islands.

I visited Aruba in June 2004. We rented from Budget. We opted to not get the insurance. Well, we were scammed BIG TIME. The car first of all had scratches and nicks all over it. On the day we were leaving the island we took the car back and there was a mark on the side. It was a white "rub" mark. The kind of mark you get when something with paint on it rubs against something else. This was NOT a scratch, dent etc.. It needed a little buffing cream. Anyway, we knew that we didn't put the mark there. Well, the guy came out and barely looked at it and told us the WHOLE car would need repainted!! Ummm...what about all the scratches and nicks on it already? Was it repainted from the last suckers you scammed? They had our credit card info and charged us $500 to have it "repainted"! I told them I wanted pictures and proof that it was indeed repainted. Surprise...never heard from them again. These people know where you are staying. I really believe they send people out to do damage to these cars to rip you off. Also we were robbed while we were diving. Our stuff was taken out of the car. All of my friends money and ID was stolen. I felt so violated and unsafe in Aruba. The only good part was we met a girl from Belgium who works at one of the hospitals as a nurse and we became friends and she came back to the states several times to stay with us. I hope everyone has better luck than we did!
