Arrest made in Pequannock attack on 5-year-old girl

A previously-convicted sex offender, who was charged this morning with breaking into a Pequannock home on Sept. 10 and attempting to molest a 5-year-old girl, is believed to have sneaked into the child's bedroom on at least three occasions, according to court records.

Timothy Iberer, 27, of Sandra Lane, Bloomingdale, was arrested this morning and is being held on $1 million bail in the Morris County jail on charges of aggravated sexual assault and burglary. He previously lived on Tudor Lane in Pompton Plains.

The child's mother at 3 a.m. on Sept. 10 heard noises in the Kinney Place house and went into her daughter's room, where she saw an intruder sitting on the girl's bed, holding a flashlight pointed toward the girl. The child was face-down on the bed with her pull-up diaper pulled down to her knees and her buttocks exposed. The mother screamed and the man leapt out a window and fled, according to the arrest affidavit.

The child told police the man had touched her buttocks. A relative told police that the child reported a month earlier that "the doctor came into her room and touched her 'pee-pee," but the unsuspecting parents told the girl it was a bad dream and did not report it. The girl has stated the man came into her room at least three times and used "cream" when he touched her, the affidavit said.

Authorities found on Sept. 10 that the child's bedroom window had been imperceptibly slit so the attacker could gain entry. Iberer's fingerprints were found at the scene. He was convicted in Passaic County in 2002 of a sexual assault on an 8-year-old child and spent 4 years at the state's Adult Diagnostic and Treatment Center for sex offenders.

Officials: Attempted assault on Pequannock girl

Timothy Iberer, charged Friday with breaking into a 5-year-old Pequannock girl's bedroom to sexually assault her, is a convicted pedophile who knew his alleged victim's neighborhood well: He grew up there.

Before his family moved away seven years ago, residents recalled, the odd and somewhat awkward young man liked to play with children. Lately, they'd seen him at his job delivering pizzas around Pequannock.

 
Iberer, 27, was registered as a sex offender locally in Bloomingdale, but he was not on the more publicly accessible state police registry of the state's most dangerous sex offenders. He had spent nearly four years in prison for molesting his girlfriend's 8-year-old daughter in Clifton.

On Friday, authorities described him as every parent's nightmare: an anonymous and obsessed sex predator. In announcing Iberer's arrest in the Sept. 10 Pequannock break-in, investigators said the victim told them Iberer had visited her on three separate nights.

"This was the case of a target victim," Morris County Prosecutor Robert Bianchi said in announcing the arrest. "This was not the case of a random attack."

Authorities did not say how Iberer got to know the victim, other than that they do not think he had ever delivered pizza to the Kinney Place residence.

According to the arrest affidavit, the girl told investigators that about one month before the Sept. 10 incident, "the doctor came into her room and touched her pee-pee." The girl told her parents, but they thought the child was having a bad dream and didn't report it to police.

Then, in the early morning hours of Sept. 10, the girl's mother heard a noise in her child's room and went to investigate. She saw an intruder jump through the girl's bedroom window and escape. The affidavit states that the child was found with her pull-up diaper pulled down and buttocks exposed.

Investigators arrived and found that the bedroom screen had been slit to allow it to be pulled off. They dusted the windowsill for fingerprints and found some. A small yellow-tinted plastic container filled with lubricant was found by the victim's bed, the affidavit states.

Bianchi said that two of the fingerprints were matched to Iberer, who had pleaded guilty in 2002 to molesting his girlfriend's daughter. On Jan. 17, 2003, Iberer was sentenced to four years in prison, and was confined to the Adult Diagnostic and Treatment Facility in the Avenel section of Woodbridge. He was required to serve at least 85 percent of his term before becoming eligible for parole. He was released on parole on June 7, 2006.

Iberer was living with his brother at a condominium in Bloomingdale and working as a deliveryman for a Pequannock pizzeria when he was arrested Friday. He is charged with attempted aggravated sexual assault on a child, attempted sexual contact on a child, endangering the welfare of a child and burglary. Iberer was being held Friday night in the Morris County Jail in lieu of $1 million bail. He is scheduled to be arraigned Monday in Superior Court in Morristown.

Iberer had been required to register as a sex offender under Megan's Law and was given Community Supervision for Life, which prohibits him from moving out of New Jersey. Under CSL, he was monitored by a state parole officer and could leave the state only under the most extreme circumstances, such as a death in the family.

Joseph Del Russo, Passaic County chief assistant prosecutor, said the four-year sentence Iberer received was an appropriate one, given the circumstances. "I would not consider that a lenient sentence," he said. "There is a cost to the outcome, and if the outcome you want is 10 years [imprisonment], the process is quite more complicated than it was in this case ... An 8-year-old girl never had to testify against her mother's boyfriend," he said.

Del Russo said he could not detail what tier or classification of sex offender Iberer fell into, low-risk or high-risk. Iberer's name does not appear on the state police Internet registry of sex offenders. Del Russo could not explain why, but suggested that it might be because that registry is reserved for sex offenders that are considered "compulsive" and are thus the highest risk to commit another sex crime.

"Not everyone who is convicted of a sex offense is on the Internet," Del Russo said. "A small subset of sex offenders are on the Internet registry, and an even smaller subset results in door-to-door notification. It's not unusual. Only more serious offenders wind up in the registry."

That aspect of the case apparently was much on the minds of area residents as they learned, piecemeal, details of the arrest.

The residence of Iberer's brother, in an attached condominium community, is across the street from Bogue Park, which includes a pond for fishing and a playground area popular with children.

Karen Cortese and Tricia DiGerolamo, both Bloomingdale mothers, weren't pleased to hear that a convicted sex offender lived in their town and has been accused of committing another sex crime on a child.

"When we heard about what happened in Pequannock, it was upsetting that it was that close. But when we found out he was a resident in our town, it has bothered me all day," said DiGerolamo, a mother of two, ages 2 and 6. "You get goosebumps thinking about it. It's very upsetting."

Cortese, who has two girls, added, "He's within two miles of three schools and 100 feet of a park ... You couldn't find a more ideal location to live if that's what he intends to do."

They said they also had checked the state police list of registered sex offenders and were shocked that Iberer wasn't registered.

Meanwhile, Birch Road residents on Friday remembered in hindsight Iberer's actions – playing with children much younger than him – before the family sold its home and moved away about five years ago.

Matt Ingenito, 20, lived across the street from Timothy Iberer and recalls him coming over to play street hockey with boys.

"He was scruffy, with long hair," Ingenito said. "We used to play a game called 'Manhunt' -- which is hide-and-seek in the dark -- and I remember playing that with him."

Ingenito's sister, Danielle, said her mother warned her about playing with Timothy Iberer because he was much older.

"My mother thought it was kind of creepy," she said. "He used to like to come over and bounce on our trampoline with my brother."

The Iberers moved away about seven years ago after the parents divorced, neighbors said.

MORRISTOWN -- Timothy Iberer, the Bloomingdale man charged with attempting to sexually assault a 5-year-old Pequannock girl, was arraigned in Superior Court in Morris County Monday.


Iberer, 27, stood with his head down throughout the five-minute appearance before Judge Salem V. Ahto. The judge read the charges against Iberer and advised him that he had the right to remain silent. Asked if he understood the charges against him, Iberer responded "yes" in a low voice.

The judge then continued Iberer's $1 million bail and he was returned to the Morris County jail. Iberer's attorney, Richard Baldi, did not request a reduction in bail, but advised the judge that he made do so at some point. Iberer, a convicted pedophile who was released from prison in June 2006 after serving a four-year sentence, was arrested early Friday morning at the Bloomingdale condominium that he shared with this brother.

Authorities say that on three occasions he slipped into the bedroom of a 5-year-old Pequannock girl. He is charged with attempting to sexually assaulting the girl in the early morning hours of sept. 10. He's also charged with criminal sexual contact, debauching the morals of a child and burglary.

Megan's Law was designed to protect everyone -- but mostly children -- against the kind of horrific sex crime that Timothy Iberer stood accused of Monday in Superior Court in Morristown.

The convicted pedophile, a pizza delivery man living in Bloomingdale, made his first appearance in court since his arrest Friday in the attempted rape of a 5-year-old Pequannock girl early Sept. 10 in her bedroom.

Head down, Iberer could muster only a faint "yes" when Judge Salem V. Ahto asked him if he understood the charges. The judge then promptly sent him back to the Morris County Jail on $1 million bail to await presentation of the case to a grand jury.

Meanwhile, many people are wondering why the 27-year-old Iberer, who had served four years in prison for molesting an 8-year-old Clifton girl, wasn't tagged as a high risk to commit another sex crime when released from the Adult Diagnostic and Treatment Facility in Avenel in June 2006.

If Iberer was classified under Megan's Law as a more dangerous offender, in either Tier 2 or Tier 3, that designation could have resulted in his name and photo posted on the publicly accessible state police online registry for sex offenders. As it was, he apparently was assessed as a low risk that required only that he tell local police he lived in town -- which police are then forbidden under Megan's Law from telling the public.

 
At Bloomingdale police headquarters on Monday, Police Chief Joseph Borell followed the law's directive in declining a request by a reporter for The Record for specific information on Iberer's status.

"I've gotten a hundred calls from people asking why there was no notification that he lived in town," Borell said. "But they don't know how Megan's Law works."

Most of the information about the evaluation of an offender is kept confidential under Megan's Law. The evaluation is done by the county prosecutor's office shortly before the offender is released and based on a complex series of categories. They take into account the offender's case history, personality, age of the victim, and future potential for therapeutic and community support to control his illness.

Iberer underwent that review by the Passaic County Prosecutor's Office shortly before his release from Avenel. The evaluations and the tier designations are confidential and the public is not allowed to see them. Only law enforcement agencies have access to them.

Only about 4 percent of the state's nearly 9,000 sex offenders are deemed Tier 3 -- which means that it's the rarest occasion when a sex offender is released into the community and there is any notification to residents.

"You're more likely to find a sea lion in the Paterson sewer system," said Joseph Del Russo, the head of the sex crimes division at the Prosecutor's Office. He had helped evaluate Iberer, but -- again in accordance with Megan's Law -- could not discuss details.

Del Russo, who helped draw up the evaluation guidelines when the law took effect, acknowledged the system was imperfect and often tilted toward protecting the privacy of sex offenders over the public's right to know their whereabouts.

Del Russo would not comment directly on the Iberer case, but said predicting behavior among sexual offenders is an inexact science. "Like anything in life, there's no one single model that fits all of human behavior," he said.

Iberer's attorney, Richard Baldi, did not ask the judge to reduce the bail Monday. But he told Ahto that he might at some future point ask for a bail reduction. Baldi would not give his reasons in court, but says Iberer has so far remained silent and isn't speaking to authorities.

"He has not given a statement to police," Baldi said. "He has not confessed."

Levels of offenders

Under Megan's Law, convicted sex offenders are evaluated within 90 days of their release from prison. The evaluation is done by the prosecutor's office in the county where the offense occurred. Offenders are ranked in three categories, which determine the level of community notification when an offender moves to town:

Tier 1: Offender is considered a "low risk" to commit another sex crime. Requires only that offender notify local police of residence. Not included in online registry maintained by state police. Make up 43 percent of state's 8,803 sex offenders registered under Megan's Law and placed under the tier system as of June 2006.

Tier 2: Considered "moderate risk." Police must notify local schools and some community organizations that serve children, such as day-care centers and summer camps. Some Tier 2 offenders are included in Internet registry. Represent 53 percent of registered sex offenders in New Jersey.

Tier 3: Considered "high risk" to commit another sex crime. Requires police to notify local schools, community organizations and residents who live within a certain distance of offender's address. Included in online registry. Make up 4 percent of registered sex offenders in New Jersey.

I think a lobotomy would be in order here.  Render him harmless.  Let him do mundane labor for the rest of his life-he can pay for his own upkeep and give back to society. That would take care of those who oppose the death sentence, wouldn't it?  And he wouldn't be a threat to anyone?  I don't think lobotomies will catch on again anytime soon, but I think about it a lot lately, with some of these people.  Just my own humble opinion, of course...

Castrate and lobotomize.  But then those who oppose the death penalty would also oppose that too, probably saying it is not in the interest of human rights.  Yeah right.  When you hurt a child, your rights need to be cut off, along with your manhood and frontal lobe.

POMPTON PLAINS - Iberer's parole decision due

POMPTON PLAINS - The State Parole Board is near to settling whether to revoke parole for Timothy Iberer, who was accused of attempting to sexually assault a 5-year-old Pompton Plains girl in her bedroom last September.

Also pending is grand jury action against the Bloomingdale man for the September home invasion targeting a 5-year-old, although no date for that action is set, according to the Morris County Prosecutor's Office.

Although grand jury deliberation and a subsequent trial could bring the heaviest consequences for Iberer, a previously convicted sex offender, the State Parole Board is still moving ahead with consideration of penalties at its disposal.

Neal Buccino, a spokesman for the State Parole Board, said that the board could decide Wednesday whether to revoke his parole when it reviews the case and the results of a final parole revocation hearing held earlier this month.

"The hearing was held as a result of his recent arrest," Buccino said, referring to Iberer's Sept. 21 arrest on allegations that he broke into the bedroom of a 5-year-old girl and attempted to sexually assault her there last September. 

Iberer could face punitive action by the State Parole Board because he falls under its domain after being convicted of sexually assaulting an 8-year-old Clifton girl and jailed for that offense in January 2003.

The No Early Release Act required Iberer to serve 85 percent of a four-year sentence, which he did, Buccino said. Credits awarded for factors like time served then moved his release up to June 2006, when he was freed from the Adult Diagnostic & Treatment Center, a Woodbridge prison with therapy for sex offenders.

Despite his release, Iberer was subject to three years of mandatory supervision by the Parole Board before he started Community Supervision for Life, further monitoring required under Megan's Law to protect the public from sex offenders.

Because mandatory supervision had not expired, Iberer now finds himself facing possible revocation of his parole and a return to jail for the remainder of the three years, or June 2009, Buccino said.

He was entitled to a probable cause hearing, which would have been an opportunity to argue that there is no cause to consider revoking his parole. But he waived a hearing that was set for Jan. 3, Buccino said.

Instead, a final parole revocation hearing was conducted, and now the State Parole Board will consider evidence and testimony from that hearing, probably this Wednesday.

"The outcome would be to determine whether to revoke parole, and therefore for all intents and purposes have him back in custody," Buccino said. Iberer has been held at the Morris County Correctional Facility with the option of $1 million bail removed since the State Parole Board began the process of determining whether he violated parole, state officials said.

A longer jail sentence awaits Iberer if he is convicted of the September home invasion in Pompton Plains that targeted a 5-year-old girl for sexual assault.

As the case travels through the justice system, the next step, according to the Morris County Prosecutor's Office, is grand jury consideration of whether to indict Iberer and send him to trial. Robyn D'Onofrio, Prosecutor's Office spokeswoman, said that the case is pending grand jury, though she could not be specific about the date.
