Becca's case went to court today and Becca's trial is set for Sept 22, 2008. They wont allow police statements Becca made. And we have another hearing to be scheduled for the doctor and nurse that attended Becca's rape medical exam. They are to come and tell what statements Becca made during exam. I don’t know if the actual rape medical report will be allowed in or not, They’re shooting for June 25th if doctor and nurse can come then but nothing is set for sure, as of yet. They told us they’d let us know.

It comes down to deciding what’s testimonial and what’s not. Statements she made to friend will be allowed! We are so very happy that Becca’s voice will at least have a chance to be heard thru others! We’re upset that the Police Report & DHR Reports will not be allowed but grateful that we do at least get some answers and not another delay!
 
We do get to go to trial on Sept 22! Pray for the well being of all the other children and that justice will come forth on Becca’s behalf. Pray that Medical Exam will be allowed. In my opinion it should be allowed because the jury should be able to see all the evidence. I don't what the big problem is? If Bob Ingle is as innocent as they propose then why not allow the evidence to come into play if he’s not guilty the evidence will show that! Let the evidence speak for itself!
 
The defense went to court with WKRG Channel 5 about the reports Jessica Taloney did on Becca's case. They want transcripts of everything that Jessica did with the family on Beccas case, on air and off air what was said. So I think they want to subpoena transcripts and WKRG has taken Jessica off the story. We have a new reporter, Keeshia Peyton; she said "It looks like I’ll be the one covering from now on because they want Jessica off the story.“ Right before our court today was court between Bob Ingle's defense & WKRG News.

Cherry, if  you pull up the Crimes Against Children forum, you'll see a few lines below a thread by BleachedBlack about the FBI busting a child porn ring.  Thought you might be interested. 

Thanks LilPuma, that was interesting, I sent it to a friend in UK who is family of abuse victim. Maybe it'll help him keep the pedophile in prison!

don't worry -

this ruling has nothing to do with the reasons the court allowed hearsay statements in becca's case

it has to do with the "forfeiture by wrongdoing" rule -- which means - IF you wanted becca's hearsay to be admitted on the theory the rapist caused her to become unavailable for trial - you would have to prove that he rendered her unavailable INTENTIONALLY.  Given that nobody is claiming the perp CAUSED becca's unavailability, you have nothing to worry about.

In this situation, the crime had not been committed yet.  Was there corroborating evidence to say he killed her?

On one hand, things that are said in anger are not always the truth, on the other hand, the victim should be able to say she was in danger and by whom.

What if person A overheard person B say he was going to kill person C.  Person C says that person B was going to kill her.  Then person A actually does the killing.  Is it fair to person B if he was only shooting his mouth off and had no intention of killing person C?  Would person B then be convicted of killing person C even if person A was the killer?

When Becca spoke with the police, the crime had already been committed.  Her voice should not have been silenced.  She was brave enough to stand up against that pos, her voice should be heard.

Two completely different circumstances.  I hope that made sense.

I am writing concerning a case here in Mobile, Al. that involves my recently deceased baby cousin Becca. Becca died this past Jan. 14, 2008 as a result of a car wreck. She was seriously injured and stayed on life support for 10 days from which she never recovered. Unfortunately her death came while awaiting Grand Jury in Mobile, Al.

Before her death Rebecca suffered over a year of rape & sodomy and other unspeakable acts from Bob Ingle. He was her step-father/cop at the time of the abuse.

The reason for my concern now, is that an even greater injustice may occur due to her untimely death. Due to" Crawford V' Washington "a law that not only supports the right to cross examine the victim but, also stops a lot of testimonial evidence. In cases such as Becca's this law stands in the way of justice. Under Crawford statements made to friends or anybody as a cry for help is acceptable.

However, this law works backwards for the victims of sexual abuse. It stops police reports, counselor’s statements, and often-medical personnel from being used in these cases. Everybody has a 6th amendment right under our constitution but under Crawford they have taken away almost all the victims rights.

Certainly, in a case such as Becca's where the victim is no longer available for cross-examination due to death. I find it quite disturbing that our system puts these children through the whole process of exam, counseling, and police statements and then does not even accept it in the court of law.

I would like to see Crawford amended and a law enforced for victims like precious little Becca. At age 9 she had no rights because, he took them from her and still he has more rights under our backwards justice system that works in the favor of the perpetrator.

I want National media attention to this case because; already the police statements and counselors have been thrown out due to Crawford. My family has suffered enough and now we are suffering even more due to this flawed judicial system.

We need a "Becca's law" stating that in cases where the victim becomes deceased the testimonial evidence has to be accepted - an exception to the Crawford rule. This needs to be one so, we don't invite perpetrators to kill their victim's in order for Crawford to work in their favor.

I can't believe a law that promotes so much more crime could have been passed. If Crawford goes uncorrected then there will definitely be more killings when our justice system fails these children.

People will take the laws in their own hands because; the current ones do not protect our children. Perpetrators will be encouraged to kill the victims!

Becca McEvoy suffered and many others have as well at this mans hands but none willing to testify due to the fact they are all his family. They previously gave statements and then later recanted after Becca's death. It’s a shame my 9 yr. old cousin was the bravest of all and treated the worst.

Now, we Rebecca's family will fight until there is justice and corrections made for her. We want her last wish fulfilled and him and other pedophiles punished for such horrific crimes of children under 12. Please, help us with this very important matter before it's too late.

Lil Puma it's good you ask these questions. There are things we can do. Get laws past. For example my daughters rapist was allowed to plea bargain to a lessor crime of aggravated domestic violence. WHY? They had his confession and medical evidence and victim compliance. Why It made the DA's job easier. So they are trying to take that choice away from the DA's if you're charged with a crime you can't offer a plea bargain to a lessor crime if it's a sexual assault. Hard to believe we need a law to stop this but we do and Jennifer Jennkins of www.illinoisvictms.com is currently working with Illinois lawmakers to try to make it happen. They did a similar law about gun crimes.
We need laws. We need to look at these crimes. Hang in there and keep looking at what we can you. You're helping others. And it's always better ti give than to receive.

Cherry, it makes me angry that as a society, we're doing such a bad job of looking out for victims.  We keep have to pass laws and tweak laws because prosecutors and judges screw it up.  Granted, there are some laws that need to be added to the books.   Some need to be changed.  But when we have to change laws in order to force the people charged with protecting the public from criminals to do so, we need to look past the laws and see what the heck we're doing wrong.  It's like re-training police and prosecutors that a woman's clothes or drinking habits are not what causes rape.  It's the predator, stupid.  The predator rapes.  It's about power, control, not sex.  By the same token, putting a 17 year old boy in jail for having consentual sex with his 16 year old girlfriend is absurd.  We can't trust our public officials to make wise decisions.  Then again, we can't trust our own juries to make wise decisions, as one of Dana's guests discussed (the police officer who was murdered.)  Anyway, keep us posted about any developments with both Becca's case and your daughter's.   These are definitely issues that women and parents should be aware of.  Unfortunate the MSM isn't picking up the ball and running with it.

I received this email from Becca's Cousin. She's asking for coverage on Becca's case. I just wanted to update everyone and remind them of Becca. - Thanks Cherry

I am the cousin of Becca McEvoy and was hoping you might do a story on her case.We are hoping to bring attention back to the case of Rebecca McEvoy. In hopes that we might get some help in improving the laws and the current errors in the system as we fight for justice in her case.

Becca died while awaiting trial for being sexually assaulted by her x stepfather/cop Bob Ingle.In Jan.2008, Rebecca passed away due to the result of a car accident she was in on Jan.4,2008 with her biological father Aden McEvoy also, a Chickasaw, Al. cop.

Her case goes to trial on Sept. 22, 2008 and although it is going forward due to the Crawford V' Washington a lot of the crucial evidence is being thrown out due to her death. Rebecca had police statements & DHR counseling & evidence that has already been thrown out due to this right to cross examine.

The Judge here is going by the Supreme Courts standards though they are all mixed-up if you ask me.Why does the perpetrators get all the rights and the victim's have none.We are currently contacting the Federal Congressmen and anybody who might help bring change for children such as our beloved Rebecca McEvoy.

Hello!

I just heard from Rhonda last night she said there's court on Sept 22 @ 9am.

She and Theresa have been busy.  Writing to the Senator's Congressmen and legal activist's trying to get some help on the case and help pass possible laws which could ensure a speedy trial for victims of crime, especially children. As well as investigate the Crawford vs. Washington problems. It does look like the court maybe throwing out much of the evidence and the accused pedophile is still walking around free.

They persevere and are an inspiration to many (including me!). I'll try to update everything soon!

Keep them in your prayers and thank you for asking and caring!

I remembered September but not the date.  Thanks for the update.   This whole issue is very disturbing.  Our laws need to protect the innocent, especially this tiniest ones, not the perps.

I'm going to add that I think we need to somehow, someway, come up with a One Strike law for those who hurt children.  I think about Caylee and Madeleine McCann and Jessica and so many others that don't make national  headlines and it sickens me.  This is what got me involved with animal rights issues, as I've mentioned before.  Someone needs to protect and speak for those who cannot do it for themselves.  Those who hurt the smaller and weaker because of their own self-interests or psychological messes should be punished severely and not allowed to live in our society.  No excuses, no rationalizations, no parole.

Becca died while awaiting trial for being sexually assaulted by her ex-step-father/cop Bob Ingle.  Becca was 8 when the abuse started, she died at age 11. The crime was reported in 2006.  She went before the Grand Jury twice. The case against the alleged sex criminal may be in jeopardy because a little girl died in a traffic crash.

IMHO The defense is using legal loop holes, tricks and victory by delay. Siting the Crawford vs. Washington law, http://www.law.cornell.edu/supct/html/02-9410.ZO.html which states the perpetrator has the right to cross examine the victim. In Becca's case this isn't possible because she died. Please note this law has only been in effect for a few years and is wreaking havoc through the justice system. Prior to it this prior testimony and records were allowed.

Her case goes to trial on Mon. Sept. 22, 2008 at  9am at the Mobile County Courthouse, 205 Government St, Mobile, AL 36602 (gov't plaza) on 8th floor. Judge Youngpeter is presiding over the case.

• We believe the medical report and doctor's testimony will be allowed.

• The Police Reports & DHR Reports will not be allowed.

• Statements Becca made to a friend will be allowed.

• Judge never ruled on the gag order from May 2008.

Becca's cousin Theresa has been busy calling on Alabama Senator's and Congressmen asking them to pass a law that states in cases of child victims of sexual abuse they must be heard within a two year period.

The wording which is applicable to victims is "a right to a trial free from unreasonable delay", this is at issue for many people across the county. Becca's family would like the law to be named in honor of Becca.

Another Delay - Evidence is being sent to AL capitol, Montgomery

D.A. Giardini told us that the defense is challenging the information that was going to be allowed in the case. The information is going to be sent to the Alabama capitol, Montgomery, to decide if the information can or can not be allowed

Since Becca is not here anymore for him to cross examine this gives our family great concern. I am truely worried that the defense is doing all this as the tactic known as Victory by Delay!! The accused pedophile Bob Ingle has only served 6 hours in jail for this, he was released the same day back in December of 2006.

What happened to the victims rights? What to a speedy trial for Becca?? What about the fact that this man has served only 6 HOURS for what Beca had to endure at his hands for over a year of her short life!

Could someone Please help us & tell us exactly why this is being sent to Montgomery and our family has to face another delay?

Now we are forced to wait til Montgomery reviews the evidence and decides whether or not it will or won't be allowed before the case can go to trial.

Please someone, anyone tell our family what is goin on & why? Why are the victims force to endure such heartache while the perps walk free, when they are the cause of all this?

Our family will be protesting on Monday morning @ 9a.m. Sept.22 this was suppose to be the time of the trial until now! We need supporters and if you see that you can come out and help us, please be at the government plaza @ 9am on Monday morning.

We are Inviting the media to come out then too.
