Why Commencing A Defamation Action Is Not Aways A Good Idea

While people who are targeted by lies may well be angry enough to file a lawsuit, there are some very good reasons why actions for defamation may not be a good idea.

The publicity that results from a defamation lawsuit can create a greater audience for the false statements than they previously enjoyed. For example, if a newspaper or news show picks up the story of the lawsuit, false accusations that were previously known to only a small number of people may suddenly become known to the entire community, nation, or even to the world. As the media is much more apt to cover a lawsuit than to cover its ultimate resolution, the net effect may be that large numbers of people hear the false allegations, but never learn how the litigation was resolved.

Another big issue is that defamation cases tend to be difficult to win, and damage awards tend to be small. As a result, it is unusual for attorneys to be willing to take defamation cases on a contingent fee basis, and the fees expended in litigating even a successful defamation action can exceed the total recovery.

Another significant concern is that, even where the statements made by the defendant are entirely false, it may not be possible for a plaintiff to prove all of the elements of defamation. Most people will respond to news that a plaintiff lost a defamation lawsuit by concluding that the allegations were true.

In other words, the plaintiff in a defamation action may be required to expend a considerable amount of money to bring the action, may experience significant negative publicity which repeats the false accusations, and if unsuccessful in the litigation may cement into the public consciousness the belief that the defamatory accusations were true. While many plaintiffs will be able to successfully prosecute defamation actions, the possible downside should be considered when deciding whether or not such litigation should be attempted.

Cindy, how much money would it take to make you feel better?  Your granddaughter is dead and suing everyone that calls Casey a liar, a whore, or a murderer won't bring her back.  Find some other way to heal yourself.  OMG, suing anyone who "slanders" Casey? a WASTE...a huge Waste.

Move on with your life.  Put your daughter in jail where she belongs and start grieving for your loss.  It's the nicest thing you could do for yourself.  Seriously.

In a small sense, dont you think that Cindy defamed Casey's character by raising her the way that she did??? In an odd sense, didnt she fail her own daughter in every responsible way? Never holding Casey accountable or responsible for anything???  Had she done these things.....would we even be here today???  Cindy...pick up a mirror...take a good look at yourself....you are just as guilty as the monster you created.
But, in your sick and twisted way....Im sure its MY fault, or all the Monkey's fault, hell....its probably that damn Santa's fault----but NEVER will it be your fault!

I have to say something about Baez, don't get me wrong I hate looking at his smug face too, but......

He is a defence attorney that is his job thats what he does.  I know it's hard to imagine but moral has nothing to do with it.  Everyone is entitled to fair representation.  I mean everyone.  From you and I to the lowest of the low.  If he was not defending her then some other defense attorney would.

I see two smug faces

Baez is smiling because his little play toy/meal ticket is being released.

That is absolutely correct!  Casey is entitled to legal representation and a trial by a jury of her peers.  Innocent until proven guilty.  That's the law.  But we are all intelligent people here using common sense, and it's pretty obvious that Casey is guilty of actions that led to Caylee's disappearance and most likely her death.  Why do defense attorneys do what they do?  Is it because they think it's mostly innocent people being charged of crimes that need their help and they are compelled to help these falsely accused citizens?  Or is it because they can charge up the wazoo for spinning the story, filing motions to drag things out and advising their clients to hold their heads high and smile?  I think very few defense attorneys do what they do from the goodness of their conservative hearts.  It's all about the money...and in this case, the fame.

So yes, we detest Baez and his smug look almost as much as we detest Casey for hers.  But you're right.  He's just doing his job.

My uncle was a defense attorney for twenty years some of the people he defended were just plain evil.  I could not belive he would try to defend some of them.  I mean when you pass the bar and start to practice not everyone goes straight to the DA's office some have to start out at the bottom.  There are also a lot of defense attorney's that get appointed by the court they have no say in who their client's are.  So I think it's pretty unfair to say most do it because it's all about the money. She is expected to be released from the Orange County Jail after 1 p.m. today, according to a spokesman for the Orange County Jail.

"We're not the ones that are writing bad checks and falsifying ID. She did that," Carlos Padilla of the Orange County Sheriff's Office said.

But Baez called the repeated charges "nothing more than police intimidation."

Okay, I'll give you that.  Maybe not MOST, but many.  Do you know why your uncle did it?  Not being argumentative...just curious.

Not all attorneys who pass the bar go into criminal law.  I've worked for litigation attorneys for years on both sides of the fence.  Sometimes we represent the plaintiff, sometimes the defendant, and we know we aren't always on the right side of the fence.
