It is my understanding from the video that ZG's atty is wondering whether CA and GA will answer certain questions during the depostion for the civil trial or plead the 5th. I cannot find anything that says you cannot plead the 5th during civil proceedings.

http://www.lectlaw.com/def/f083.htm

FIFTH AMENDMENT [U.S. Constitution] - 'No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation.'

The Fifth Amendment 'can be asserted in any proceeding, civil or criminal, administrative or judicial, investigatory or adjudicatory; and it protects against any disclosures which the witness reasonably believes could be used in a criminal prosecution or could lead to other evidence that might be so used.' Kastigar v. U.S., 406 U.S. 441, 44-45 ('72). A reasonable belief that information concerning income or assets might be used to establish criminal failure to file a tax return can support a claim of Fifth Amendment privilege. See U.S. v. Rendahl, 746 F.2d 553, 55-56 (9th Cir.'84).

The only way the Fifth Amendment can be asserted as to testimony is on a question-by-question basis. Rendahl, 746 F.2d at 555, citing with approval U.S. v. Bell, 448 F.2d 40, 42 (9th Cir.'71) (Fifth Amendment challenge premature on appeal from enforcement order; appellant must present himself for questioning after enforcement and as to each question elect to raise or not to raise the defense).

The appropriate device for compelling answers to incriminating questions is a government grant of use immunity. See Sharp, 920 F.2d at 1172.

It is my understanding that you are correct. However, I won't debate with Strayze, because I find the posts rude.

Well of course I'd be the outcast.I'm not so sure Cindy is the root of Caseys's evil though it sure would look good at her defense trial.Could someone please show me documented proof where Casey is saying that her mother called her all these things? All I've seen is Lee saying that this is what Casey told him.It could be, but I'd have to see it.I don't even recall Lee saying he ever heard it either first hand from Cindy. In defense of Cindy,if my daughter was out whoring, stealing money from everyone she came across including me,I know for sure I would question her parenting skills..I think Cindy was distraught most of the time by Casey and her antics and probably was the better at parenting.I believe little Caylee thought so too which probably contributed to her demise..Sad We are all responsible for our own choices and Casey made some really bad one's.This day in age,it's always someone elses fault..Sad It's my opinion that Casey doesn't get to pass go!
TOT!!!
I agree Casey needs to be held accountable for her actions 1000000%.  The constant debate (not here, in general) of a person is a product of their surroundings and environment are true...HOWEVER its up to that person to then take the cards they are dealt and make it work for them the very best way that they can.  My parents were 14 y/o when they had me, that being said, not to toot my own horn, but I think for now I have come out alright. They too have done really well for themselves.  You have to rise above it and hold your head high.
Killing Caylee was not Cindy's fault, it was Casey's.

YES!!!

Hi Sunny.

Janet

Hi Janet!!

Hi everyone.  Just home from work and i have only read a half a page.  I am gonna try and catch up.

You can only plead the fifth in a civil case if you have pending criminal charges or if your testimony would cause criminal charges against you.

It will be interesting to see if that is what they do.

So how are all the monkeys !!!!!!!!

Switchy, I missed out somehow on this squirrel story.  Where are you keeping him?  Your own body farm?   Inside or outside????

He's resting comfortably atop a towel on my screened in back porch.

Examiner Switchy is it warm or cool on the porch.......just wondering to better understand the process. TIA
Good question!  You should place him under a heat lamp to simulate the hot sun of Florida.  During those times of the year down here its like 98 degrees on regular basis.

JMO...I think baez got in way over his head taking casey's cases...Does anyone know a case he has one?  if my attorney messed up when he filed that paper to stop all testing...I would be looking for a new attorney for sure. I would have to say. he just set it up for casey to get a new trial before this one has even started.

I do think he's in over his head; and I think the arrogance he showed in that letter to LE proves it. I am glad she picked him! I would be worried if she had someone with more experience and better character. (How awful of me, eh?)

I've thought the same thing ever since I realized what a dummy he is!  I'm totally relieved that her lawyer is an idiot, because I don't want there to be any chance she'll get off.

sorry, another squirrel joke ... I can't help it. Her stories are too bizarre. Throw only banana pudding if you must.

Asked about his involvement in the Casey Anthony case, Spike, the owner of a local tattoo parlor, made an obscene gesture and threw acorns at reporters. More at 6.

Too funny...Casey's tattoo artist! Any update on Frankensquerel?

Just checked on Frankensquirrel.  He is now completely stiff.  I can no longer move any of his joints.  The odor is noticeable, but not yet unbearable.  No hair falling out or anything like that.  At this point he still does not smell like a human decomposing.  It's now 26 hours post mortem.
Thank you for the update Detective Switchy!

You guys are cracking me up !!!  When i was little, my sisters and i would play detective and i would call one of them secret squirell and they would call me red robin.  Those were our code names.
I want to start calling Switchy "secret squirell""

That's what she gets for finding a lawyer through Facebook. Joking. Well, maybe.

Have we ever seen a pic of that Brandon Snow who she was arguing with the night of the half naked party?  Wasn't he in the running to be the babydaddy?  Could this be him?

I started laughing here hearing Lee hit on the table "I firmly believe, I firmly firmly believe, I believe it to be true...my sister did not pack that bag"...good to hear he is so passionate about something!  LOL

ABSOLUTELY!....Even Jessee frequents that word

"Certainly" (?) a close 2nd

If they were to do a movie or book, it should be titled "Absolutely"
If I never hear that word again, it'll be too soon.

Sure absolutely...I agree!

My mistake............the word was "Exactly"  close 2nd to "Absolutely"

Just had this thought..is it not freaky that Casey could have been near your children or other people's children while working at Disney and Universal...(back when she did indeed work there.)
