HKS was also ordered not to leave the country.

I agree, I hope finally that the real Dad is closer to having the answers, who ever that may be. I just hope it is NOT HKS. and if it is she should be taken from him as she probably would be in the states for child endangerment.

I wonder if anyone has looked into how many other debts HKS has racked up in "her name" since her death. Or at least, starting AFTER the death of her son.

NASSAU, Bahamas: DNA tests to identify the father of Anna Nicole Smith's infant daughter may not resolve legal struggles over custody of the girl, a lawyer for Smith's former partner said Wednesday.

Howard K. Stern, who has been caring for 6-month-old Dannielynn in the Bahamas, was complying with the court ordered tests, but may not relinquish custody even they prove the father is Smith's ex-boyfriend Larry Birkhead, attorney James Neavitt said.

"Howard is the legal father. If Mr. Birkhead's DNA matches, then he can come and say he's the biological father, and then you'll have that court battle," Neavitt told The Associated Press.

Neavitt did open the possibility of a negotiated settlement if the test proves his client is not the biological father. He said Stern respects Birkhead and that the two men will likely reach an agreement if the Los Angeles-based photographer is proven to be the father.

"At that point, it will be a whole different scenario, and the two guys will have to work something out," he said by phone from Los Angeles. "Dannielynn's interests are the most important, and Howard's been protecting her from the start."

At the gated, waterfront home where he lived with Smith, Stern drove away with Dannielynn on Wednesday morning, then returned later without speaking to reporters.

The paternity dispute intensified after Smith, 39, died of still-undisclosed causes in Florida on Feb. 8.

Frederic von Anhalt, the husband of Zsa Zsa Gabor, also says he may be Dannielynn's father. Last month, he too filed legal documents seeking a DNA test.

Another contender for custody is Smith's mother Virgie Arthur, who says she could provide a more stable home than Stern and has asked the court to name her Dannielynn's guardian. Stern has been ordered not to leave the island nation with the girl before a custody ruling.

The girl, Dannielynn Hope Marshall Stern, could inherit millions from the estate of Smith's late husband, Texas oil tycoon J. Howard Marshall II. Smith had been fighting Marshall's family over his estimated US$500 million (€380 million) fortune since his death in 1995.

I thought there was an issue on retaining the house as well.  Wasn't there an eviction hearing on this?

DNA samples of Dannielynn and Larry Birhkead are in the bag, according to MSNBC's Rita Cosby.

Cosby broke the story and TMZ has confirmed that Birkhead and baby were both at a Bahamas doctor's office at 9 this morning and had samples taken. Howard K. Stern's DNA was not taken because by law there is a presumption that he's the father since he's listed as such on the birth certificate.

We're told Birkhead saw Dannielynn in the doctor's office.

If Birkhead's DNA matches Dannielynn's, he can then challenge Stern to pony up DNA and fight for custody.

 It is this statement and similar that bothers me the most. "Howard has had her protected." "He is the only one she has known to be her Dad" and etc...

 Of course He is the only one she has known as a FATHER. HOWIESleezeBoy has KEPT her from everyone that would love her, basically kidnapped as he did her mother! When will these idiots wake up and realize this??? If I were his lawyers I would be embarrassed to even utter such remarks, and shame on them if they actually believe that carp they are spewing.

And yes, there was suppose to be hearings about evicting him from that house. I thought they were already underway, perhaps there was a recess in that proceding.

None... I think that inquest is scheduled for next week, I think the end of March, but I may be mistaken.  

I have also had red flags about the Myrtle beach "friends and family" they do not ring true to me.   I do not think that Thompson "gave" her the house, I think he was just assisting her, but I think he was expecting to be repaid, or to be paid rent.  The daughter and son and law, Kellys??, seem a little disfunctional to me.  I am not sure what there agenda is..or why??

Info on FOX about tonight regarding Stern was not favorable to him. Apparently, he is trying to make some kind of deal with Larry~ exchange the baby for continued oversight of any estate issues.    What a scumbag.

Not all eyes are on the Bahamas court that will hopefully force the DNA testing of Anna Nicole Smith's little baby Dannielynn Hope to determine her father.  Many observers are still very curious as to what killed Daniel Wayne Smith, the 20-year old son of Anna Nicole.  His mysterious death kicked off the horrific chain of events that has lead to the custody case.

On September 10, 2006, Anna Nicole's son died at the age of 20 while visiting his mom and newborn baby sister in the Bahamas. The cause of death was later determined to be a lethal combination of methadone, Zoloft and Lexapro.

Now the nightly syndicated television program 'Entertainment Tonight' is reporting that summons have been sent out for individuals to appear at the inquest.  According to that report, the question that is also being asked is "Was Daniel grappling with anorexia before he died?"  The report notes that the Bahamas have no jurisdiction over the U.S. legal system, so they're depending on the courtesy of those summoned to appear.

Chief Magistrate Roger Gomez reportedly will be the official that will be presiding over the inquiry, RT reports.  As the various key players prepare to participate in the inquest, Anna Nicole Smith's former friends, G. Ben Thompson and his son-in-law Ford Shelley, share the revelation that Daniel may have been grappling with anorexia.

"[Anna] was worried he was anorexic," Shelley tells ET. "He had a touch of anorexia and depression and we had been told that he had been hospitalized [before]," says Thompson.  According to ET, Daniel had reportedly been depressed over a relationship, and Thompson says he believes the young man had been prescribed medication for his depression.

Along with that, Thompson says, "He just couldn't eat."

I'm sorry but he's suspect IMO

oh Jacq I don't disagree about the drugs, Rick was prescribed lexapro during his cancer treatments, predominately a fast-acting anti-anxiety drug and I have had friends use Zoloft too for PMS and also depression? I don't know what those mixed with methadone might result in, I just know even yo-yo dieting can weaken your heart but that's all I know.

Any kid on methadone should be outlawed if they aren't in drug rehab where it's prescribed, so it's unfortunate he ever had access to this cocktail.

Yes, interestingly enough, the DNA was brought to my city of Columbus, OH for the test.  I am curious as to how/why they came up with this particular location.  I understand they all had to agree on the location....

Perper is supposed to release the cause of Death on Monday too, correct?

Font: ****A report by both Star and National Enquirer claims Smith died with a toxic level of chloral hydrate – a sleep medication – in her system. She also had a serious blood infection that contributed to her death on Feb. 8.

According to the publications, the blood infection was caused by an unsterilized needle used just three days before her death to inject an unknown substance in her left buttock. As she flew from Bahamas to Florida, Smith developed a painful abscess and fever.

Sources told the Star/National Enquirer team that upon arriving at the Seminole Hard Rock Hotel & Casino, the former Playboy Playmate had a fever of 105. She allegedly developed a second infection from a virulent form of norovirus, which causes intestinal problems.

But, the publications report, instead of taking Smith to a hospital, her entourage gave her an ice bath to bring down her fever and allegedly administered the antibiotic ciprofloxacin and an over-the-counter flu medicine.

The report claims Smith began vomiting and suffered severe diarrhea and dehydration.

On Feb. 7, Smith reportedly told those caring for her that she wanted to sleep. Star and National Enquirer claim she was given a toxic dose of chloral hydrate, a potent sleep medication. She never woke up.

Smith was pronounced dead at 2:49 pm, just over an hour after a nurse found her unresponsive.
