I'm sorry to hear that Howard will be charged. If Anna had not gotten her drugs from him, she would have found someone else to get them for her. Addiction is a terrible thing.

Klaas I knew you'd be happy to finally see Howard arrested. I heard the original coroner on one of the networks yesterday and he related it was the 'syrup' that was used in lieu of a sleeping pill that reacted with the plethora of other drugs to cause AN's death. With the trio now charged to include Dr’s Kapoor and Eroshevich, I'm sure it's going to be much more difficult for any of the three to wiggle out of this, or I hope not.

When we look at meltdowns with celebrities like Brittney Spears I have to wonder if she had nuts surrounding her too, privately medicating her and risking her life? Perhaps that's how her father was able to wrestle her away with the judge's help.....


This is exactly what was happening to Britney Spears.  Sam Lutfi was the same as Howard Stern.  This is why they got a restraining order against him.

ANNA Nicole Smith's death may be reinvestigated after prosecutors prepare to try her former lover and doctors for supplying her with prescription drugs.

The move comes less than two weeks after California authorities arrested the former Playboy Playmate's boyfriend and two doctors on charges of conspiring to provide her with thousands of prescription pills.

Smith's lawyer and later lover Howard K. Stern, 40, and doctors Sandeep Kapoor, 40, and Khristine Eroshevich, 61, are free on bail and have said they're not guilty.

Smith, 39, was found dead in her bed in a room at the Seminole Hard Rock Hotel & Casino in Florida on February 8, 2007.

Legal experts say if there is evidence that anyone illegally supplied Smith with the prescription drugs blamed for her death, Florida could press for charges as high as first-degree murder.

Miami prosecutors are examining California officials' evidence to see where it will lead.

Florida law says people can be charged with murder if they illegally provide a drug that ends up killing someone. Another possible charge could be manslaughter by culpable negligence.

Ron Ishoy, a spokesman with the state attorney's office, said prosecutors had so far limited their role to providing legal help to Seminole tribal police, who investigated Smith's death.

LOS ANGELES — Anna Nicole Smith's two doctors and her lawyer-boyfriend have pleaded not guilty to drug conspiracy charges, and a judge has refused to suspend the physicians' medical licenses.

Dr. Sandeep Kapoor, Dr. Khristine Eroshevich and Howard K. Stern entered their pleas Friday in Los Angeles. They are accused of conspiring to illegally provide the late Playboy model with sedatives and opiates before she died. They are not charged with causing her death.

Superior Court Judge David Wesley rejected an effort by the attorney general's office to lift the medical licenses, saying a yearslong delay in seeking that action undermines the claim of an imminent danger to the public if the doctors continue to practice.

Smith died of an accidental overdose of at least nine medications in February 2007 at a Florida hotel.

Texas oilman J. Howard Marshall II never intended to bestow his fortune on his wife Anna Nicole Smith, a federal court ruled Friday, marking another twist in a convoluted inheritance battle that has outlived both Smith and her adversary, Marshall's son and executor E. Pierce Marshall.

The decision by a panel of the U.S. 9th Circuit Court of Appeal recognizes a 2001 jury verdict in a Texas probate court as having determined that Marshall's will was valid and free of illegal coercion by his son. The will left the oilman's $1.6-billion estate to Pierce Marshall.

The ruling appears to derail the late actress’ efforts to be recognized as an heir to half of Marshall's estate, which she claimed he had promised to leave her.

A topless dancer and Playboy centerfold, Smith met the 89-year-old Marshall at a Houston strip club he frequented, and they were married in 1994. Marshall died 14 months later, leaving behind an irrevocable trust and will that Smith claimed his son had forged or coerced her ailing husband into signing.

Smith had prevailed in getting judgments in her favor under bankruptcy proceedings in California, winning a court ruling in 2000 that she was due $450 million from her late husband’s assets, an amount later reduced by a federal district judge to $89 million.

Smith died of a prescription medication overdose at a luxury South Florida hotel three years ago. Pierce Marshall preceded her in death in 2006 at age 67 from complications of an infection. Lawyers for the two sides were representing the interests of Smith's now 3-year-old daughter, Dannielynn Birkhead, and Pierce Marshall's widow, Elaine.


The 9th Circuit panel ruling said the probate judgment precludes the bankruptcy case, giving precedence to the Texas court's decision that Marshall left everything to his younger son. The earlier case also denied claims to the fortune by J. Howard Marshall III, who had been written out of the oilman's will after business management disagreements.

An attorney for Pierce Marshall's widow said they were pleased with the appeals court ruling and hoped the long legal fight is now over.

"Our position has always been that there was a full and complete trial in probate court in Texas vindicating Pierce Marshall," said Hartford attorney G. Eric Brunstad, who represents Elaine Marshall. "That should have been the end of the matter."

Kent L. Richland, the Los Angeles attorney who represented Smith’s executor and former partner Howard K. Stern, deemed the 9th Circuit ruling “a fairly startling extension of the law” as it gave precedence to the probate ruling that came after the bankruptcy court decision. Richland said he was exploring the estate’s options to request rehearing by the full 9th Circuit or to appeal to the U.S. Supreme Court again, vowing that “we will certainly be pursuing something further.”

[Updated at 3:08 p.m.: A previous version of this post said Richland could not immediately be reached for comment.]

A legal battle over Dannielynn's paternity also carried on after Smith's death at age 39. Both Stern and Los Angeles photographer Larry Birkhead claimed to have fathered the girl. DNA testing eventually proved Birkhead was her father and he was awarded custody of the child.

perhaps Larry should avoid trying to be in the spotlight and the drama would die down..I haven't thought about Larry or his child in months...doubt if many others have either...I only think about him when he is on the tv circuit or is posing with the child in magazines...he is creating his own drama in my opinion....

More than three years after her death, Anna Nicole Smith  is again making headlines as the trial against her boyfriend and two doctors has gotten underway, with prosecutors trying to convince the jury that they funneled prescription drugs to a known addict.
The dazzlingly ditzy reality star and former Playboy model was found dead of a prescription drug overdose in February 2007.

The judge in the case has already told the jury that the trial, which started Wednesday, isn't about the cause of Smith's death, but prosecutors say it could have been avoided if she hadn't been recklessly provided a steady stream of pills.
Her longtime companion and lawyer Howard Stern along with Drs. Khristine Eroshevich and Sandeep Kapoor, are accused of conspiring to prescribe controlled substances to an addict.

The prosecutor has introduced as evidence Kapoor's personal journal in which he allegedly wrote, "I gave her methadone and valium. Can she ruin me?"

Their lawyers have said their clients are innocent that that they were only helping someone with documented pain and depression.

If convicted, the doctors could lose their licenses and all three could face more than five years in prison.
"The message is clear," ABC News legal analyst Dana Cole said. "You cannot give drugs to a known addict and her whole public perception was that she was a drug-crazed, drug-addicted individual."

Smith's death in a Florida hotel room was one of the first of a string of notable Hollywood deaths by prescription drugs, including Michael Jackson and Heath Ledger.

California Attorney General Jerry Brown said the trend must stop.

"Just because it's in a nice little package and has a name on it and a date and a doctor's name under it, doesn't mean that it can't kill you," he said.

Smith is also to blame, the prosecution says. They claim that Smith is also guilty in this conspiracy and that she may have traded sex for drugs.

LOS ANGELES (AP) - Anna Nicole Smith's boyfriend has been acquitted of two charges of obtaining drugs for her by fraud and deceit, including use of false names.

Superior Court Judge Robert Perry also dismissed part of a conspiracy count against Howard Stern and Dr. Sandeep Kapoor, ruling there was insufficient proof that the two men conspired to obtain controlled drugs through fraud and deceit.

But in his ruling Wednesday, Perry allowed the balance of that conspiracy charge to stand and said the bulk of the 11-count complaint would go to the jury for verdicts. Attorneys were scheduled for closing arguments on Monday.

Stern, Kapoor and Dr. Khristine Eroshevich have pleaded not guilty to conspiring to prescribe, administer and dispense a controlled substance to an addict. They are not charged in Smith's 2007 overdose death.

Perry accepted arguments by the defense that because Stern is not a doctor, he would not have known if there were problems with the legality of prescriptions written by Kapoor.

"I don't think there's evidence that a layperson knows it's illegal to write a prescription in another name for a celebrity," the judge said.

Defense lawyers had hoped for more dismissals based on the judge's critical comments regarding the prosecution's case through the trial. Perry previously indicated some charges would likely be dismissed.

"I think there are weaknesses in the prosecution's case," Perry said Wednesday. "But my inclination is to let it go to the jury."

But the judge also raised the unusual prospect that if he does not agree with jury convictions, he has the option to change the verdicts or order a new trial. He said he has done this in other cases.

Stern's lawyer, Steve Sadow, expressed alarm at that prospect, saying, "Once it's post-verdict, the whole scenario changes. My client would lose his license. The doctors would lose their licenses."

The judge said he had to be "mindful that certain issues are left for the jury, unless there is a total absence of evidence to support it."

The judge also grilled prosecutors intently, explaining repeatedly that to get a conviction, "you need a specific intent to violate the law." Lawyers for Stern, Kapoor and Eroshevich argued that no such intent had been shown because their clients were trying to help a woman suffering from intense pain.

The only conviction against Stern was for giving false names and acting by fraud to obtain prescriptions. Eroshevich was also convicted of unlawfully prescribing Vicodin by fraud.

The jury acquitted defendant Dr. Sandeep Kapoor of all charges.

The defendants were charged with conspiracy, excessive prescribing of opiates and sedatives to an addict, and fraudulently obtaining drugs by using false names.

LOS ANGELES (AP) - A jury acquitted Anna Nicole Smith's doctor Thursday of all counts in a prescription drug conspiracy case involving the late model.
Dr. Sandeep Kapoor was the first of three defendants to hear the jury's verdicts in Los Angeles.

The jury found the prosecution did not present enough evidence to convict Kapoor of six charges that he provided excessive prescription drugs to Smith.

Verdicts will be announced shortly for Smith's boyfriend Howard K. Stern and her psychiatrist Dr. Khristine Eroshevich (ee-ROW'-seh-vich).

The defendants were charged with conspiracy, excessive prescribing of opiates and sedatives to an addict, and fraudulently obtaining drugs by using false names.

The jury deliberated about 58 hours after being asked to decide if the three defendants were trying to relieve Smith's emotional and physical pain or were feeding her addiction to prescription drugs.

The defendants were not charged in Smith's 2007 accidental overdose death in Florida.

Prosecutors contended during the nine-week trial that the defendants were dazzled by Smith's glamor and filled her demands for prescription drugs to protect their insider status in her personal life and her celebrity world.

Stern, 41, had been Smith's lawyer, manager, lover and friend since they met in 2001. Testimony showed they were inseparable, even when she was involved with other men.

In 2006, Smith donned a wedding gown, and she and Stern had a commitment ceremony on a catamaran off the Bahamas. They exchanged rings and vows but were never legally married.
At the heart of the drug case was the question of whether Smith became dependent on opiates and sedatives after being diagnosed and treated for chronic pain syndrome and illnesses including seizures, migraines and spinal pain.

Superior Court Judge Robert Perry told the jury of six women and six men that a doctor who has a good faith belief that a patient is in pain is not guilty of a crime for prescribing controlled substances to relieve suffering.

While presenting their case, prosecutors displayed multiple prescriptions to Smith for heavy painkillers such as Dilaudid, Demarol, Vicodin and Methadone, as well as anti-anxiety drugs and sedatives including Ambien, Xanax, Valium and Chloral Hydrate. In one month, they said, Smith received 1,500 pills.

The judge, however, warned that numbers of pills were not the measure of addiction.

"To violate (the law) a defendant must willfully and knowingly prescribe, administer or dispense a controlled substance to an addict for a non-therapeutic purpose," Perry instructed the jury.

Each defendant faced a possible maximum sentence of four years in prison if convicted of all the charges. They also could lose their professional licenses.

The story of Smith's final years stretched from Los Angeles to the Bahamas with stops along the way in South Carolina and Florida, where her overdose death at the age of 39 was ruled accidental.

The two doctors also were close to Smith during her final years, and their lawyers portrayed them as angels of mercy trying to help her before and after she gave birth to her daughter by cesarean then quickly lost her 20-year-old son, Daniel, to a drug overdose.

He died in her hospital room after coming to visit his new half-sister on Sept. 10, 2006. Smith later named the baby Dannielynn in his memory.

Stern initially claimed the baby was his until DNA tests made clear the father was photographer Larry Birkhead, who now has custody of the child.
Defense attorney Steve Sadow, who represents Stern, said Smith was the love of his client's life and he would never harm her. He also stressed that Stern was not a doctor and was relying on medical professionals to do the right thing for Smith.

Stern's name was on a number of prescriptions which prosecutors said were intended for Smith.

Kapoor, 42, who was Smith's internist, wrote numerous prescriptions for opiates and sedatives during the period he treated her. His lawyer, Ellyn Garafalo, said he followed a drug regimen originated by Smith's previous doctor who sold his practice to Kapoor.

Prosecutors Renee Rose and David Barkhurst argued that Kapoor blurred the line between patient and doctor when he was photographed kissing her at a party. They also pointed to a diary in which Kapoor discussed the "mesmerizing" experience of riding with her in a gay pride parade and wondered: "Can she ruin me?"

Eroshevich, 63, was Smith's neighbor and friend before treating her as a psychiatrist. Prosecutors claimed the friendship was a violation of professional ethics and called a pharmacist who testified the amount of drugs Eroshevich requested for Smith at one point would have amounted to pharmaceutical suicide.

The pharmacist refused to fill the request, and prosecutors showed Eroshevich used other pharmacies to get most of the drugs and took them to Smith in the Bahamas.

They also showed jurors photos of Eroshevich naked in a bathtub with Smith as they contended the doctor also lost her objectivity about treatment.

Attorney Brad Brunon, who represents Eroshevich, said prosecutors were trying to prejudice jurors with something irrelevant.
"People on the ground saw her as caring for Anna Nicole Smith," Brunon said of Eroshevich. "And what is her reward? She's dragged through this, her name is ruined, and she's publicly humiliated."

Smith made headlines in 1994 when she married oil tycoon J. Howard Marshall, who was 63 years her senior.

When she died on Feb. 8, 2007, her legal battle for a share of the $1.6 billion fortune of her late husband was ongoing. It has been carried forward by Stern, the executor of Smith's estate.

The U.S. Supreme Court recently agreed to hear another challenge in the case.

Last week, two conspiracy felony charges against Howard K. Stern in the Anna Nicole Smith drug case were dismissed. Now, Stern sits down exclusively with ET's Mark Steines to share his feelings about the experience.

"I feel vindicated," says Stern. "I feel Anna's vindicated. The truth about her came out, as opposed to the fiction and the lies that the prosecution was trying to show."

Stern, along with doctors Sandeep Kapoor and Khristine Eroshevich, was accused of illegally providing drugs to Smith. All pleaded not guilty to the charges. On Thursday, a Los Angeles judge ruled there was no evidence that Stern intended fraud or deception when he got drugs for his former client/girlfriend under fake names. Smith passed away of an accidental overdose in a Florida hotel in 2007 at the age of 39.

This case should have never been brought [to trial]. It was brought for improper reasons. It was brought for publicity, for politics, at any cost," says Stern. "The toll that this has taken on my parents, there's no way to describe the damage, it's irreparable. You can't get back these years, and the lies that we have lived through."

Of the picture the prosecution painted of Anna Nicole's state of being in the days leading up to her death, Stern comments, "I was angry. Extremely angry with the way that they wanted to portray her as basically cowering, locked up in a room. It's so far from the truth, and they essentially discounted entirely the effect of [her son] Daniel's death on her, and how emotional she was, and they discounted her pain, her real pain. And they just basically said … she's just an addict, and the whole story they were trying to put on was a lie."

Now that the judge has dismissed the conspiracy felony charges, Stern contemplates his next movie.

"I kind of have to let it all sink in, and then see what's left, but one of the things I've been thinking about is doing some criminal defense work, because I see how prosecutors can be," he says. "When it comes to a person's life, there should be an objectivity, and it shocked me that there wasn't. What [my lawyers] did for me, I'd like to do for somebody else."

LOS ANGELES—State medical board officials say a Beverly Hills psychiatrist who treated Anna Nicole Smith in the days before her death has had her license suspended for a criminal conviction involving the Texas-born Playboy Playmate
The March 30 decision by the Medical Board of California didn’t name any patients in the case against Dr. Khristine Eroshevich, but the filing listed the court number of the Smith case.

Anna should have taken the settlement money that she w offered...instead she was greedy and her estate ended up with nothing jmo..

Her little girl is really cute. Seems like she has a good daddy too. She will probably have a more normal life with him...

LOS ANGELES — Prosecutors refusing to accept an appellate court's ruling in the Anna Nicole Smith case asked the court Friday to change its decision and allow her former boyfriend and manager to be retried.
California's 2nd District Court of Appeal ruled last month that Howard K. Stern could not be retried without violating the Fifth Amendment protection against double jeopardy. Attorneys in the office of District Attorney Steve Cooley filed a 19-page motion for rehearing that contends the court misinterpreted the law.
The court said a trial judge erred in dismissing conspiracy convictions against Stern and Smith's psychiatrist, Dr. Khristine Eroshevich, in a case that partially revolved around obtaining prescription drugs for the celebrity model under false names. The defendants were not charged with causing her death.
Superior Court Judge Robert Perry found it was not unusual in the celebrity world Smith inhabited for fake names to be used to protect privacy. The appellate court sent the case back to Perry but gave no guidance on what the judge should do next.
The motion filed Friday asked that the court modify its ruling so that Stern can be retried, or to grant a rehearing on the issue.

SANTA ANA, Calif. (AP) — The estate of Anna Nicole Smith has failed in its final bid to obtain her late husband's money, seven years after the death of the Playboy model and reality TV star.

A federal judge in Orange County on Monday rejected the effort to obtain about $44 million from the estate of Texas billionaire J. Howard Marshall, whom Smith married in 1994 when he was 89 and she was 26. The oil tycoon died the next year. His will left his $1.6 billion estate to his son and nothing to Smith.

Smith, under her real name of Vickie Lynn Marshall, challenged the will, claiming that her husband promised to leave her more than $300 million above the cash and gifts showered on her during their 14-month marriage. A Houston jury said Marshall was mentally fit and under no undue pressure when he wrote the will.

Over the course of nearly 20 years, the Texas bankruptcy court and local and federal courts, including the U.S. Supreme Court, all rejected Smith's various attempts to overturn Marshall's will and trust and to obtain money from his estate.

The efforts continued even after Smith died of an accidental drug overdose in February 2007.

On Monday, U.S. District Court Judge David O. Carter denied a request from Smith's estate to sanction the estate of Marshall's son, E. Pierce Marshall.

"Time spent litigating the relationship between Vickie Lynn and J. Howard has extended for nearly five times the length of their relationship and nearly twenty times the length of their marriage. It is neither reasonable nor practical to go forward," the judge said in his ruling. He noted that it was the last surviving piece of decades of litigation.
 
G. Eric Brunstad Jr., attorney for the Marshall family, said in a statement that the family agreed with the judge that it was time to stop the litigation.

A jury convicted Stern of two counts of conspiracy in 2010, but a judge later dismissed the case.

An appeals court ordered the convictions reinstated and ruled that Stern could not be retried.
