OK ... Here is what I am thinking ... At the GJ hearing tomorrow ... they will prove beyond a shadow of a doubt that Caylee is dead ... They will then give Casey the option to cooperate and tell Tim where she is and allow her to be recovered in exchange for not seeking the death penalty ....

anyone else?

I could be wrong but ... I do not think the death penalty would be an option in the prosecution's charges against Casey if Caylee's remains are not found.  Without a body ... there is no proof that Caylee's death was intentional ... is a capital case.

I think Baez has advised Casey just to remain silent ... it is only to her benefit.

Two New Areas Being Checked In Search For Caylee Anthony
POSTED: 5:13 pm EDT October 2, 2008
UPDATED: 6:12 pm EDT October 2, 2008

Thursday, Casey's attorney said it's not in her best interest to tell what she knows about where Caylee is.

"It does her no good to show her cards to give the prosecution any advantage they have to put her away for life," Jose Baez said.

Prosecutors to seek grand-jury indictment of Casey Anthony in Caylee's death

Jose Baez on the Today show this morning

11:40 a.m. Defense attorney Jose Baez was on the Today show this morning, where he told host Meredith Vieira that it would be a "pointless venture" for prosecutors to call Casey Anthony to testify at a grand jury proceeding.

Baez made the comment one day after reports surfaced that prosecutors will seek homicide charges against Anthony. An Orange County grand jury is scheduled to meet next week, starting Tuesday.

"I doubt they'll call her, but if they do, I think it will be a pointless venture," Baez said.

He said it's Anthony's right to not testify.

"I don't think it's in her advantage to testify in a proceeding where it's a one-sided affair."

Afternoon fellow monkeys~I need ALL your help. I just sent a lengthy e-mail request to Peter Coors of Miller-Coors asking for a donation of appreciated stock in lieu of cash. Please say a prayer tonight and tomorrow that he will read the entire e-mail and respond with a donation. I called TES and spoke with Erin about donations made this way because for the very wealthy they are highly adventagous for the tax benefits for the donor and the donee (not sure that's a real word), she had never heard of this type donation and I am sending her some links as to how to link this option on the donations portion of their site. It's very simple to do on TES's side and on the donor's side, so again I ASK FOR EACH AND EVERY MONKEY TO SAY A SPECIAL PRAYER AND REMIND MONKEYS WHO COME ON LATER TO PRAY THAT THE STORY OF TIM AND TES WILL TOUCH HIS HEART.

TIA

FOX 35 If Casey is indicted tomorrow on capital charges, Baez would have to step down.  He does not have the experience to handle this case!!

Casey is prepared for the worse but hoping for the best.  She is prepared for confinement.

Monkeys, I was on a 3 way call with Marlee & Erin Bridwell from TES.  She emphatically told us that Tim & TES are NOT pulling out. Caylee is at the forefront of every TES volunteers heart and they have every intent of continuing their search for her.

Tim is coming home tonight and at the time of the call, Erin didn't have a date for the search but she assures us IT WILL CONTINUE.

I have never lied or misled any of you. Please quit stressing yourself over this search. It will happen. I promise! I have Erin's word on it.

Now, take a deep breath and trust Tim. He won't let us down. If anyone can find Caylee, it will be Tim & TES.

thanks MrsK...that's the same thing I was told....no decision made on when....Tim coming home....and as soon as a date has been determined they will post it on the website.  So I guess that clears up for us that TIM will NOT be testifying at the GJ tomorrow....  Mrs. K did you see my question to you yesterday??

I'm sorry Sunny, I didn't. I worked most of the day on the cookbook stuff. I'm here now if you'd like to ask again.

Ok...and feel free to tell me/us to shut up!! You state after several phone conversations you had I believe yesterday....you had changed your postion on Lee being Caylee's bioDad...I was wonder what, if anything you can share about those conversations that changed your mind....I have to say I am still on the fence....I knw LP said yes...then I read that he had heard it was was 50/50 on it and HH's friend says No.....but you seemed to change your psotion from no to yes...after your phone calls....  Also the things we talked about re: the cook book look to be a GO!!!

As I said, I was skeptical about Leonard in the beginning. I found him to be very honest and admitted when he was wrong. I truly believe that he cares about this case as much, if not more, than we do here. Remember, this man lost $50,000 on the bond.

He has stated that his source (which I cannot reveal) has confirmed that Lee is the father of Caylee. He has further indicated, and I agree, had this NOT been true, Cindy, Lee & Baez would have been all over this and they haven't. Not a peep out of them. Leonard has stated this on NG, it's been on all the forums and blogs. Nothing has been heard from the Anthony camp.  In fact, it seems like the whole family has disappeared from the media and the front of their house. All of a sudden, Lee hires an attorney and refuses a DNA sample until it is court ordered. Lee is out of sight now too.

I am convinced that Leonard is telling the truth. Everything he has said so far as fact, has proven to be true. This he says is fact. I'm not sure why he would tell the other poster's niece something different. Maybe he just doesn't know her and isn't comfortable.

Hi mrsK:  I am interested in more than just what will come out at trial.  I am pretty sure the daddy thing will come out, but i am also curious about the initial sources of the information that we may not hear in the media.....like did LP find out from a LE source or a family source or a friend??  Did any of the extended family know Lee was the dada or even did Cindy know Lee was Dada before now???  I dont know if you can answer any of this ,  but if you can't, do you think we will ever find out???

So...if Casey is indicted tomorrow and JB asks for a speedy trial on her behalf, the State would have to have their case ready for trial in 175 days......

Speedy Trial

You have a right to a speedy trial under the Sixth Amendment of the United States Constitution, which requires that the trial be held within a certain time frame after a person has been charged with a crime.

This right can be waived by asking for additional time for the preparation of your defense.

Speedy trial rights in Florida:

    * Speedy trial without demand: In most cases, a defendant will be brought to trial within 90 days of arrest if the crime is a misdemeanor, and within 175 days of arrest if the crime charged was a felony.
    * Speedy trial with demand: With limited exceptions, every person charged with a crime has the right to demand a trial within 60 days. A felony is a crime usually punishable by imprisonment for more than one year. A misdemeanor, on the other hand, is usually punishable by a fine or a year or less of incarceration.

OK...thanks....I don't doubt what he is saying...but....it's still really really difficult for me to get my mind around that....their parents knew Caylee was a product of incest and both of them are walking around ALIVE ...the only thing I can think of is this is the information that was told to Casey, Cindy and Lee but not George...as George might take actions into his own hands?  But Cindy is a waking time bomb.....why would she be told?  Oh hell...I am confusing myself....anyway thanks for your reply

ORANGE COUNTY, Fla. -- Monday night could be Casey Anthony's last night of freedom. Eyewitness News is digging into the case against Casey and has obtained new inside information about Tuesday's grand jury testimony and how soon she could be re-arrested.

Tuesday's grand jury testimony will be behind closed doors, but sources are revealing more information to Eyewitness News about what will happen.

Casey Anthony's mother Monday accused prosecutors of playing politics and rushing the case to the grand jury before the November election, but Eyewitness News was told there are more important deadlines, legal ones, steering the strategy.

Casey could've pleaded guilty to child neglect to try to close the case before more serious charges were filed. Taking it to the grand jury stops that.

"Are you nervous about the grand jury?" WFTV reporter Kathi Belich asked Casey Anthony on Monday.

Casey didn't answer as she rushed to her weekly jail. She was not wearing her big white stolen sunglasses, either.

Casey's father George, a former sheriff's deputy in Ohio, will be one of the key witnesses against her Tuesday before the grand jury.

Casey's mother came to the jail Monday, as well, complaining that investigators are no longer accepting tips about Caylee.

"I'm worried for my granddaughter. Casey is gonna be able to defend whatever is out there right now, because it's just purely circumstantial evidence. I'm worried for Caylee. I found out they are no longer taking tips on my granddaughter," Cindy Anthony told Eyewitness News.

Eyewitness News has learned the grand jury will hear from half a dozen witnesses Tuesday, investigators from the Orange County Sheriff's Office and the FBI, FBI lab specialists and Casey's father. The grand jury will hear how investigators found high levels of the potentially toxic chemical chloroform in the trunk where they say Caylee's body had been.

If the grand jury indicts Casey for murdering her daughter Caylee, prosecutors would very likely drop the child neglect charge against her, because she couldn't be charged with neglecting Caylee by not reporting her missing if she had already killed her.

Depending on what the grand jury does Tuesday, Casey's visit to her lawyer's office Monday could be one of her last and Monday night could be the last night she spends at her parents' hou

How could Casey have explained a missing child when confronted by her mother or the police?

There are just so many possibilities:

  1.  The child was kidnapped while I was with her, as in a carjacking or someone snatching her at the park.  (The carjacking is probably harder to pull off than one might expect.  Most streets in town would have witnesses and possibily cameras.  She would have to go out of town where there was little traffic and claim someone took her car.  But then how would she get back to town?  If she claimed someone grabbed Caylee at the park, a stranger, there would be no reason to wait 31 days to report that.  Again, there might be other people at the park.  Maybe it did not work out for her.  She would almost have to get rid of the car, the way Susan Smith did, to claim it was carjacked.  And that would mean having to go back to her parents' house, something she would not want to do, unless someone else would provide her with transportation.  I think back now to William Waters, I think he was the one, who said she was thinking of renting a car.)

  2.  The child was kidnapped when she went outside without my knowing.  I did not see who took her.  (Since she lived with Tony and his roommates, it would be hard for Caylee to wander off without them or someone at the apartment area seeing her.  Malls now have cameras as do grocery stores, so claiming someone took Caylee from one of those places would be difficult too. And once the car started to smell, that pretty much made claims of someone taking Caylee moot.  The smell proved a body had been in the car, and Casey knew that.)

  3.  Someone I knew and trusted took her when I left her with them.  (She may have thought of pinning it on Jesse, for instance, but he would be around and able to defend himself and deny the charge.  It had to be someone who did not exist.  She had pretended to have a nanny before, so that became the most logical story.  And since nobody knew nannyh, they could not describe her or her car or find her or her sister or anyone in her family.  Nobody to deny anything.)

  4.  Caylee died in an accident and I was afraid to tell anyone.  (Why would she be afraid to admit that an accident had occurred?  Sooner or later it would be discovered.  She could not go on forever claiming the child was still alive.  And an accident does not carry blame with it to the extent that murder does.  But Casey wanted to get off scot-free of any blame or responsibility.  So claiming an accident would not work, and once she disposed of the body, it certainly would not work.  Casey may have thought of claiming it was an accident right after it happened, but she soon changed her mind and decided not to tell anyone.  Minutes passed...hours...days...and she was stuck.)

I don't think paternity will come out with the GJ unless LE feels that it may be a motive. Leonard's source is "official" but that's all I can say. Des may be able to give you more. I swear, Leonard loves her. LOL! Leonard said that Cindy & Lee knew but not George until this all happened. I don't believe any other family members were aware.

Remember a while ago, Leonard had a "theory" about Caylee falling off Tony's balcony? I believe he mentioned skull fragments. Bloody rags in the dumpster. I haven't heard any more discussion of this and I don't think it would hurt to re-visit this theory. Sounds pretty plausible to me.

Tough Economy May Force Texas Equusearch to End Hunt for Caylee
Monday, October 13, 2008

A nonprofit helping to search the Orlando area for missing toddler Caylee Anthony may end its work on the case because of the foundering economy.

"We gotta think about what's good for [Texas] Equusearch in these tough economic times, because people who donate money may not donate again if all our money goes to one person when there are more [missing persons] out there," Tim Miller, the founder of the nonprofit told MyFOXOrlando.com.

Hi Everybody, sorry I am posting to something posted awhile ago, but it's hard to keep up  , anyway int he post Tim says, "I would only hope the Anthony's would take advantage of what he has got to offer"  could he mean that he hopes that they would tell everything they know or some kind of deal? JMO
Just a little o/t someone posted earlier about tripolar add ocd is backward thinking and MuffyBee picked up on it and rightly so, that is why people should  educate themselves about such sensitive subjects, I know the poster ment no disrespect, but being a Mother of Special need adult daughter it did sting a little, but as I said I know they didn't mean to hurt anyone's feelings, I am very protective of my daughter as any Mother would be, I feel the same way when someone calls someone a +++++, if I didn't have a SN's daughter I may not even notice, but that is the point.
I was reading earlier about Knay KNay and how she was offended by somene's comments abot Tim, and I feel bad if she doesn't post anymore due to that, we all have to have a thick skin sometimes.  I hope Knay Knay will come back, I enjoy all of you and I get quite a few laughs and cries sometimes.  I hope this came out ht way I wanted and I don't sound like I am looking for sympathy because that is not what this is all about , please beleive me. Sorry for the long post...I will go back to my reading. Justice for Caylee!!!

Two reasons that I find it very difficult to comprehend how Leonard Padilla came to the determination that Lee Anthony is the father of Caylee Marie.  As far as I know NO THER SOURCE has made this claim.

1.  DNA from Cindy, George and Lee was only requested LAST WEEK.
2.  Forensic evident was only ordered LAST WEEK by a judge to be turned over to the defence.

Casey Anthony's Father To Testify Against Her In Front Of Grand Jury

George and Cindy Anthony voluntarily gave up DNA samples this week so investigators could scientifically exclude either of them as the source of the hair and stain in Casey's trunk, but investigators had to get a search warrant to get Casey's brother Lee to submit to a DNA test. He also has refused to take a lie detector test for the FBI.

FWIW.....I just spoke this AM with person deeply involved with the case....(not LP)...I was told...*there is significant new evidence currently being forensically tested*....this is NEW evidence from the Orange County Crime Division....sorry I can't say more at this time.....but I promise you this info is accurate...Des

I have a feeling that whatever it is, it's big.   Thanks, Des.  I was very glad to read this and trust everything you share with us!

Does anyone have any good guesses about when we might learn what "significant new evidence" is or if they actually have Caylee's body????    I am hoping tomorrow

I think it's Caylee.  I think that if there's ANYTHING that had to be kept hush-hush, it's that.   Just until tomorrow.   I may be wrong, but that's my dollar minus ninety-eight cents.

I heart Tim Miller and LP, and Yuri Melich and................all of em who have come to the aid of this little girl, especially when her family flat out refuses to.

So...Channel 6 News is reporting there will be 6 witnesses tomorrow...one of whom is George.  Is anyone else surprised at this low number of people testifying?  It really made me think that they must have some pretty powerful evidence....much, much more than we are aware of.
