WHAT IS A GRAND JURY?
   A grand jury is an investigating, reporting, and accusing agency of the circuit court (or of the Florida Supreme Court in the case of the statewide grand jury). It consists of citizens of a specified number who have been summoned and empaneled by a judge of the circuit court (or by a judge appointed by the Florida Supreme Court, in the case of the statewide grand jury). The grand jury is an agency and an arm of the circuit court (or the Florida Supreme Court in the case of the statewide grand jury) and is uniquely independent.
   The grand jury is answerable to no person or agency of government except the court that empanels it and, even then, only to the extent that it may exceed its authority and privileges.
TERM OF THE GRAND JURY
   At least two terms of court are held each year and once the grand jury is empaneled, it will serve for the balance of the term of court. In exceptional cases, its term may be extended. (The statewide grand jury's term is for a period of 12 months, but may be extended for up to 18 months.) The grand jury will not be in continuous session but will be called in from time to time as necessary.

PROCEEDINGS OF THE GRAND JURY
   Most of the work of the grand jury involves hearing witnesses and determining the sufficiency of evidence on the issue of whether that evidence, without regard to possible defenses, justifies indictment. Generally, the state attorney (or statewide prosecutor) or assistant state attorneys (or assistant statewide prosecutors) will present and explain the charge to the grand jury and advise as to the witnesses who will be presented, either voluntarily or upon being summoned on the request of the state attorney (or statewide prosecutor) or the grand jury itself. The grand jury may call any witness it deems appropriate and necessary.
PROTECTION AND IMMUNITY OF GRAND JURORS
   Grand jurors are fully protected from actions against them by being an independent body answerable to no one except the court that empanels it. No inquiry may be made to learn what grand jurors said or how they voted. The law gives the grand juror complete immunity for official acts. There is only one exception: if a grand juror testifies as a witness for the grand jury as to a commission of a crime and that testimony is perjured, the juror could be prosecuted for that perjury. This complete protection for the official acts obviously is vital to the operation of the grand jury and points up that grand jurors should be citizens of unquestionable integrity and high character.

Monken - I misread your post. Mammy is right. NONE of the testimony will ever be made public that occurs in the Grand Jury proceeding. Just a "true bill" will. We won't hear a word if there is a "no bill".


I'm sorry Knayknay & Mammy, so IF Casey is indicted we will hear the witness testimony, right? But if she's not, we won't. Is this correct? 

No, I'm sorry I'm confusing this. We will not hear ANY testimony. The only thing we'll hear is if a "true bill" (indictment) is passed down.


  So how will we know what's said? Will it have to leak?? 

We won't. But I think the witnesses can speak about it. ???

Jurors, Detective Have Arrived
Several grand jurors as well as lead detective Yuri Melich of the Orange County Sheriff’s Office have arrived on the 23rd floor of the Orange County Courthouse this morning. The grand jury is expected to start soon to consider more serious charges against Casey Anthony, whose 3-year-old daughter, Caylee, has not been seen since June. Grand jury proceedings are secret, but the media is camped outside the courtroom where the jury is meeting. Expected today are investigators like Melich as well as George Anthony, Casey Anthony’s father.



Thanks, Mammy, i still can't figure out how the witnesses can speak if the testimony is sealed, though. 


I thought someone said that a person can talk to media if he wishes, but the FOIA act does not apply to the transcripts b/c they are sealed. Could be wrong, only had one cup of coffee so far.

IF an indictment is handed down, then the witnesses are allowed to speak about it...if they want to.


but if there is no indictment, or until there is one, they are NOT allowed to.

October 14, 2008 - No Responses

George Anthony and attorney Mark NeJame just walked past the media and into a conference room outside the room where the grand jury is meeting. We have counted 18 grand jurors, made of of 10 mostly older women. The men appear slightly younger, more in their 30s and 40s.

If you testify before a Grand Jury, you are allowed to speak about your own testimony to the press (or whoever you please.) Jury members may not discuss ANYTHING.

Most interesting post for free.....Hello Monkey Family....regarding my post this morning...my info came from The Body Farm....and the Oakridge Facility they are in conjunction with....the Oakridge facility did the air testing from the trunk of Casy's car....the call I made today...confirmed...that both facilities....had NEW evidence for testing in the Caylee Anthony case....and I did pass this info to LP...Des



GREAT NEWS!!!

Praying for you, Des.  Big mental hugs headed your way as well.   (BTW, did you ever get my e-mail??  I sent it weeks ago)

OK, I have a question... When george is finished on the stand, do they make him leave the room or will he be allowed to sit and listen to all the evidence that will be presented? I am just curious, since some say this could go on for days, he would be able to leak things to his family each night? I would hope not but I am wondering how this is done. TIA for any great answers

9:25 a.m. George Anthony just walked into the courtroom to testify before the grand jury. The other witnesses are waiting in various conference rooms on the 23rd floor. There's more than a dozen media standing outside the courtroom to capture the various people going in and out.

It is my understanding each witness testifies seperately, the witnesses do not hear each other's testimony.

At 9:24 George Anthony was just escorted in to the grand jury room along with  his attorney Mark NeJame.  Just before going inside, Anthony was visited in a conference room by an FBI agent and Prosecutor Jeff Ashton. Ashton is a veteran prosecutor who has tried many homicide cases over the years. He tried to first successful DNA case in Orange County two decades ago.

A nineteenth grand juror has also arrived. A man who appears to be in his late 20s or early 30s. That makes almost an even split of ten women and nine men. A court baliff explained to a member of the public trying to get inside that this is not an open proceeding.

State Attorney Lawson Lamar told us he would comment after the hearing was over.

A spokeswoman for the ninth judicial circuit says the grand jury’s findings will be read in open court after the jurors reach a decision. If an indictment is reached, the suspect would not be named if the person is not yet in custody.

No timetable yet on how long it might take.
