ELECTION 2008
Will Michelle Obama tape 'change political atmosphere in America'?
African news says she should 'come clean,' but candidate's campaign calls story 'made up'

Michelle Obama
The African Press International news agency, which reported that Michelle Obama called to protest its coverage of WND investigative stories about her husband – characterizing the source of the material as "racist" and describing WND senior reporter Jerome Corsi as "evil" – now is calling on the possible first lady of the United States to "come clean" about her call.

As WND reported, the Norway-based API said Michelle Obama called to accuse the agency of "colluding with American Internet bloggers in an effort to bring down her husband."

The Obama campaign immediately denied there had been any telephone call from Michelle Obama, flatly dismissing the story as "not real" and "made up." API later responded by claiming  it had recorded the conversation. Besieged by demands from both sides of a campaign that has reached the white-hot stage, the agency said although it had the tapes, it would not release them immediately.
(Story continues below)

Now, in a statement dated Friday because of the time difference, API Chief Editor Korir has promised that the tape will be made available after his lawyers clear it for publication, and he denied being an advocate either for or against Obama's campaign.
He said the delay also is intended to allow Michelle Obama to explain her actions first.

There was no response to a WND call to the Obama campaign headquarters in Chicago tonight to request a comment.
"A number of Americans who are die-hard Obama followers have tried their best to intimidate API using all kinds of threatening methods when they call in and when they e-mail us," the API statement said. "They are implying that API is planning to destroy Obama's chances to become the next U.S. president. API does not have a direct interest in the U.S. presidential elections and we want Obama supporters to understand that. However, when someone who may become the next first lady makes such comments as in the story we have published, the public have the right to know. Intimidation directed to the publishers of the story is not the answer.

"The delay to make public the recordings is expected to give time to Mrs. Obama to come clean and tell the American people that her comments were not meant to harm anyone but that she was reacting to the media pressure on her husband. She should also come out and tell the American people that she will not discriminate those who are not Obama fanatics if she becomes the first lady," the statement said.

Those on the other side of the political fence also were told to back off.

Get the book that started it all, Jerome Corsi's "The Obama Nation," autographed by the author, exclusively from WND's online store.

"Those who do not support Obama are actively pushing for the release of the recordings also, and we understand them very well. In many telephone conversations with them we, however, get disturbed when we realize that most of them want the recordings to be released because they want to use it to stop Senator Obama from being elected president. They state clearly that if the story is true and released now, the contents will sa[v]e America from a constitutional crisis that may come if things come out after the elections that proves Obama was adopted by a foreigner, thus, disqualifying him from the presidency," Korir wrote.

The statement confirmed that API "has recordings of the conversation between API and Mrs. Obama" and "we confirm that the audio will be released to the public."

"In the last 24 hours, API has been consulting legal advisers on the way forward in order to avoid being sued by the Obama camp. API has realized that the contents of the tapes if made public may change the political atmosphere in America for ever, especially in the next few days," the statement said.

"API now understands the impact of the statements made by Mrs. Obama. The American people have reacted in a way we in API would never have expected.

"Many have question[ed] why Mrs. Obama would choose a little known online media group instead of the American media. API was chosen because of a Nairobi contact that did not like the way API was covering Barack Obama using information collected from American media outlets. The Nairobi contact prevailed upon Mrs. Obama to talk to API," the statement said.

"The only thing API may have done wrong is not informing Mrs. Obama that the conversation was being recorded. This is why it is taking time to release the recording while consulting a legal team because API wants to be legally safe from any Obama camp law suit," Korir wrote.

"API is not out to convince the American public of anything. We do not want to influence the outcome of the U.S. presidential elections. API got a true story and published it. The fact that the story has caused a stir was unexpected, but that does not mean API must rush in a manner that will cause problems to itself, just to satisfy those who want the audio tapes so badly," the statement said. "When the legal concerns are cleared, which is happening in a short while, API will make public all the recordings available. This will also include comments, not yet published, which will most certainly put the Obama campaign spokesperson who had dismissed the story off balance.

"Even if our recordings or any other recordings had surfaced after the elections and if the contents were damaging to the elected person that still could have caused any elected president to vacate the White House. We all know that the tapes released in the U.S. in 1974 forced President Richard Nixon out of office. The truth is the truth. The tapes during Nixon time did not lie. The same here. The recordings that API will release soon will not lie to the American people. Most probably, it will change the political landscape, something the Americans should start getting prepared to face," Korir suggested.

API's original report said Mrs. Obama said she had hoped the African media "was mature enough to be in the front to give unwavering support to her husband, a man Africans should identify themselves with."

API's account said it was "only relaying what the American bloggers and other media outlets had discovered through their investigations." This, according to the story, angered her.

"African Press International is supposed to support Africans and African-American view," she reportedly said. "It is strange that API has chosen to support the racists against my husband. There is no shame in being adopted by a stepfather. All dirt has been thrown onto my husband's face and yet he loves this country. My husband and I know that there is no law that will stop him from becoming the president, just because some American white racists are bringing up the issue of my husband's adoption by his stepfather.American white racists   The important thing here is where my husband's heart is at the moment. I can tell the American people that my husband loves this country and his adoption never changed his love for this country. He was born in Hawaii, yes, and that gives him all the right to be an American citizen even though he was adopted by a foreigner."

After the initial API report, Tommy Vietor, an Obama campaign spokesman, told National Review's Byron York  the conversation didn't happen.

"The answer is no, it's not real, the report is made up. She did not speak to the organization," Vietor said, according to York's report on National Review Online's blog "The Corner."

Korir, however, responded to WND's e-mail confirming the report is accurate.

"API hereby confirms to you that the story is true and if the huge interest on this particular story continues, we will post the recording on our website in the next immediate days," his e-mail said.

API asked Michelle Obama to comment on the detention of Corsi during his visit last week to Kenya, where he was investigating the presidential candidate's links to a controversial strongman serving as prime minister.

"When API asked Mrs. Obama to comment on why Dr. Corsi was arrested by the Kenyan government and whether she thought Kenya's prime minister, Mr. Raila Odinga, was involved in Dr. Corsi's arrest, she got irritated and simply told API not to dig [into] that which will support evil people who are out to stop her husband from getting the presidency," the publication reported.

API also said the Democratic candidate's wife had some clear instructions for the publication.

"Mrs. Obama asked API to write a good story about her husband and that will earn API an invitation to the inauguration ceremony when, as she put it, her husband will be installed as the next President of the United States of America next year," the report said.

this is entirely made up.
the phone call never happened.
they say they have a tape of it, but it doesn't get released.

another hoax, just like the whitey-tape and all the other hoaxes.

those right-wing blogs can make up and google for stuff as much as they want.
but it's not going make any difference.

I don't know about the "whitey-tape" but am watching this.

I had read an API article covering the "phone call."

this is entirely made up.
the phone call never happened.
they say they have a tape of it, but it doesn't get released.

another hoax, just like the whitey-tape and all the other hoaxes.

When MSM doesn't cover anything derogatory about Obama, how would you ever know.  As far as MSM is concerned, Obama will be squeeky clean until the day they decide their new "scum-position."  What goes up . . . must come down; and, they'll see to it.

but . . . but, how is it that you know it's made up; never happened; hoax?  Why would African Press International push propaganda against Obama?  Seems they would be more interested in getting him elected.

I consider this story to be important to watch; while considered it may not be true.  I wonder at the motivations involved.

ok keep me posted.

API said they were going to release a tape.
and they are not doing it.

in my opinion all these smears are coming from the neo-conservative smear machine.
trying to spread confusion and division.
realising they are about to lose their grip on power.

and McCain is fuelling this with his robocalls.
and Palin with her talk about anti- and pro-American parts of the USA.

it is going to take the GOP a very long time to recover from this.

Correct, and I'm not betting they will or won't.

If API doesn't release the tape on/before Nov. 3, the article is here to remind us.  If API does release the tape, that should be here.

10/20, Update:

Update! API will come with more information on Michelle Obama tapes at 16.00 hours Norwegian time

Important Update: US Law firm enters into agreement to represent API in The Michelle Obama tapes to be released soon in the US

Posted by africanpress on October 20, 2008

The touchy interview tapes of Michelle Obama, the wife of the US Presidential Candidate Barack Obama is soon ready for release in the US and will be aired unedited.

The release has taken long due to the fact that API wanted to clear all legal hurdles and be safe from getting sued by any one. API and a US Law firm - LAW OFFICES OF PHILIP J. BERG has just entered into an agreement giving the law firm the right to represent API in all matters that may arise due to the Michelle Obama interview and the release of the tapes in the US.

API has realised that the interview with Mrs Obama is of great significance in the coming elections. The release of the tapes is not intended to derail the elections or to destroy the chances that Mr Obama may have in getting elected the first black president of the United States.

For us in API we wanted to get the tapes released - aired by a news channel that has a good reputation in the US, one that has listeners interested in the elections.

Many networks have contacted us and due to the fact that we in API do not know them from before, it took time to go through all requests from the networks that took contact with us and to choose one that will air the tapes unedited.

API is not interested in selling the tapes to any network. Our demand is that the tapes must be aired unedited by the network that we finally select.

While doing the selection, we have landed into a problem with some networks who have taken upon themselves to inform the readers that they have already got an agreement to air the tapes.
So far, no network has been selected and yet we have received signed agreements by three networks claiming to have been finally given the go ahead to release the tapes.

One kind reader has helped us a great deal by forwarding one email that has been circulated in the US about a deal. We want to state categorically that we are not asking any one for money in exchange for airing the tapes.

After reading the email below, we were very shocked at the turn of events:

Subject: Audio Tape

Hi Will: I have been in contact with the African Press International, who ran the Michelle Obama story. I have talked to them about releasing the audio tape they have of her. It would appear that this is going to happen. The format will be, I will bring the reporter on and let them tell us how they obtained the tape, and then I will run the audio tape, and bring the reporter back on to verify that it is the real thing. Once I have this done, I will place it on my web site, file for and get a copyright on it. Once I have this done, I will contact you with the link. What I would like for you, since you live in Washington DC, to do is contact CNN, Fox, NBC, CBS, ABC and MSNBC. Let them listen to the audio tape. I will then take bid on this tape. The starting bid will be 2 million dollars. Once you have received the high bid, we will break the money down this way, 45% to Bar H Farms Inc, parent copy of Plains Radio network, 45% to African Press International and 10% for yourself. If you can do this, please call me at 806-447-0010. Thanks Ed

Response from API:
It is true that we have been in contact with many news groups because they have contacted us. The email above is talking about money and is send to someone who was kind enough to forward it and alert us us on how we were being potrayed as a news organization that wants to cash in 45% of 2 million dollars.

API wants the readers to know that we are for the truth and such email being circulated in the US makes us look bad. This serves to further delay the release of the tapes because we do not know who we can trust to air the tapes unedited and without cashing in on them.

The same group of people we thought we could trust have gone ahead and signed unilateral agreements binding them and API, agreements stating that API surrenders all the rights to the tapes to them and that the tapes will belong to them and they are the one to decide who should listen to the tapes on cost. This is against API’s principles.

Now that we have an agreement for representation with a US law firm, we think things will move faster in the direction of releasing the tapes. The Law firm will help us get out of the unilateral agreements not signed by us.

We ask the readers to bear with us. We owe you the truth and the tapes being released.

What is it that Barack Obama knows that the rest of us don’t?

By Judi McLeod  Monday, October 20, 2008

Is November 4, 2008 more a coup d’etat than it is a general election?

Is Election ’08 a mere formality?

With ACORN under investigation for registering bogus voters in at least 15 states; with House Speaker Nancy Pelosi--who leads a Congress even more unpopular than a fast-fading- from-the-scene George W. Bush--claiming “It’s 100% that Barack’s gonna win”, with Minister Louis Farrakhan claiming a “new beginning for the Nation of Islam” and Barack Hussein vowing to “change the world”, it certainly seems more coup d’etat than presidential election.

If it weren’t for the fact that the future of the United States of America is at stake; that a group of rich and powerful, elitist malcontents such as George Soros and Kyoto godfather Canadian Maurice Strong have an agenda to usher in a new era of Socialism for the USA, Obama for all of his media and Hollywood hype, would be something of a joke.

Obama came onto the scene comparing himself to the late great Abraham Lincoln, penned a book that some claim isn’t even his and arranged—or had arranged—Grade 8 textbooks with an entire chapter dedicated to him.

As Gateway Pundit so aptly pointed out, “Lincoln was a humble man.  He did not compare himself after six months in office to great men from history.

(snip)

The tragicomedy of Obama as “The Messiah” includes an advance to the White House with a largely AWOL mainstream media, who having come up empty on Sarah Palin in Alaska--one outlet even after advertising that they’d pay for provable dirt--are now vetting Joe the Plumber, rather than Obama sidekick Bill Ayers, the unrepentant terrorist bomber, who launched the senator’s career in his living room.

It would seem that Obama cannot lose for winning.

Already making a game plan with his “transition team” and unruffled that his wife snacked on lobster tails and Iranian caviar last week, Obama is already USA President without a single vote having been cast.

(snip)

“Your agent for change” Raila Odinga took over the office of prime minister in Kenya after his campaign called for protests—even though he had lost that election by more than 200,000 votes to incumbent Mwai Kibaki.

Was Barack Obama who actually campaigned for Odinga merely learning the ropes to usher in an era of Socialism for the United States of America?

In a page straight out of Marxist strategy, Barack Obama’s campaign is, according to FoxNews, “accusing Republicans of enlisting law enforcement officials in a “frenzied and pathetic” attempt to turn the allegations of voter fraud surrounding a low-income advocacy group into a political football.”

How did Obama break all records in fundraising in a massive economic meltdown?

Even for someone whose ego is bigger than his ears, the pre-election gloating of Obama and friends is unprecedented.

Time to determine why he won’t produce a simple birth certificate, or why he’s artful dodging his increasing associations with controversial figures is fast running out.

(snip)

With what is likely malicious laughter, a mammoth Election Night Victory Party is being planned and at this rate, all the people thrown under the bus likely will be there; those who have already passed on, if not in body, then in spirit.

What is it that Barack Obama knows that the rest of us don’t?

http://canadafreepress.com/index.php/article/5682

This is the first time I've heard of Obama and the textbook and Mr. Lincoln.

There is that pesky birth certificate thing again...and Soros.

newsvine.com

(...)
A review of their archives reviews a curious, patched together assortment of press clippings and releases on various topics. However, their top and ongoing American news story is anti-Obama coverage that essentially reproduces, uncritically, most of the major smears promulgated over the last year.

The “African Press International” is owned by “The Rainbow Foundation”, to which they provide a link - which turns out to be a website created last week, on another WordPress blog spot. The “Foundation” lists a number of objectives that oddly have nothing to do with Obama or US politics. They also list a number of “projects” being run by the Rainbow foundation: however, it turns out there AREN’T any actual project. What there is a list of countries where they say they’re GOING to run projects at some unspecified future date - but NO projects.

Now, there IS another “Rainbow Foundation” - NOT the one that “owns” African Press International, but an authentic charity. And THEIR website has an urgent note up warning folks of a fraudulent “Rainbow Foundation”, soliciting funds and making claims using their name.

Use caution with this story.  We know that MSM would not touch it, even if true; but, that doesn't make the story true.

Obama: Most Secretive Democratic Presidential Candidate Ever

Wednesday, October 22, 2008 7:58 PM

By: David A. Patten  Article Font Size

Sen. Barack Obama’s campaign says his campaign will bring a new level of honesty and transparency to the White House. Obama proudly touts that he and Sen. Tom Coburn, R-Okla, passed a law requiring more transparency via a public database of all federal spending.

(snip)

During the heated Democratic primary, Obama complained of the Bush White House being “one of the most secretive administrations in our history” and chided Sen. Hillary Clinton for not releasing her White House schedules.

Ironically, Obama, just days away from possibly being elected president, continues to stonewall a growing chorus of information requests for documents about his legislative, personal health, education, financing, and background -- leaving many voters to cast ballots based on incomplete information.

And serious questions about his past continue to swirl as Election Day looms, fueled in part by his own campaign’s refusal to make relevant documents available.

(snip)

A Newsmax survey of key Obama aspects of Obama’s public and private life continued to be shielded from the public.

Among the examples:

(snip long list)

- Obama also has not disclosed the names of small donors giving $200 or less to his campaign. An exception to the finance-reporting laws exempts the campaign from reporting those who donate less than $200, but that law never envisioned the more than $300 million that has been raised by Obama in small amounts. The Republican National Committee has released its small donors, as well as McCain’s, on a public database.

(snip long list)

When Internet rumors began to fly that perhaps Obama was born outside the United States, for example, the campaign released images of a birth certificate that verified his birthplace as Honolulu, Hawaii. When that led to suggestions the birth certificate had been altered, the campaign again responded, allowing reporters to examine the actual birth certificate, complete with raised seal. (In late July, according to FactCheck.org, a researcher uncovered an announcement of Obama’s birth in the August 13, 1961 edition of the Honolulu Advertiser).

(snip)

The hue and cry from the media for disclosure usually forces candidates to release sought after documents. But the press has largely acquiesced to Obama’s stonewalling.

Under these conditions, why don't we just yell, "Come on down, Voters!  Choose Doors 1, 2, or 3!"

After the election, the door pops open . . . and SURPRISE:

We have elected MICKEY MOUSE!

I had been following the API (African Press International) story for a while, and forgot to check on it.

Last night, I looked at the site.  The saga continues.

I really don't know what they have, but they are playing it out.

Last night, this was posted:

The Michelle Obama tapes to be aired any day/time from now: API and Fox News Network (USA) in a final agreement on the airing days/time.
Posted by africanpress on October 29, 2008

A final agreement has been reached between African Press International (API) and Fox News Network (USA) on the dates to air the Michelle Obama tape arising from a discussion Mrs Obama had with the API two weeks ago. The show will take place any day/time from now, with a 15 minutes alert on when it is to take place. Other programmes will be interrupted. This is a precaution taken to avoid interference from any quarter.

In the agreement, Fox News Network will broadcast 39 minutes of the  54 minutes long tape. The whole tape cannot be aired unedited due to security reasons and especially due to the explosive political temperature in the country because of the Presidential elections that is just around the corner, November 4th.

The tape will be aired in two portions by two separate units in the Network. API’s representative will appear live in one of the shows.

The parties have agreed that the information to be released to the public on the agreement will not include the naming of the units at Fox News Network that will air the tapes in order to avoid outside pressure and influence of any kind before the show has taken place. Nondisclosure of the name of the shows that will air the tapes has become necessary due to pressure from groups interested to block the release of the contents to the public.

Due to a huge interest in the tapes shown by some private individuals, groups belonging to some political camp(s) and persons connected to a section of an intelligence network, it has been decided that the 54 minutes long unedited tape is to be kept outside the United States in safe custody of one of API’s Lawyers based in Ontario, Canada.

The day and time schedules of the broadcast will only be announced 15 minutes before the Show begins in order to avoid attempts to block the Show from airing the tapes.

Any pressure from any outside forces that may want to know the exact day and time schedule of the Show before-hand or any other details in the agreement will get no answers to their requests either from API or Fox News Network.

The decision to have the above information public was a difficult one due to the sensitivity of the case and huge interest against, and for, the release of the contents of the tape for public consumption.

Obama’s campaign manager offers 3 million dollars to API in connection with Michelle Obama tape to be aired by Fox News Network
Posted by africanpress on October 29, 2008

Six hours after the release of information by API on the planned broadcast by Fox News Network of the Michelle Obama tape, in accordance with an agreement that has been reached between API and Fox News Network, API  was contacted by Obama’s Campaign Manager.

Those who are close to the democratic presidential candidate must be desperate to win the elections no matter what, otherwise they would not have taken such bold step to contact API with an offer of a bribe in order to stop the airing of the tape.

Obama’s campaign manager contacted API by telephone and email offering 3 million US dollars followed with a request to API to cancel the deal with Fox News Network.

Ten days ago API received the first request to accept 2 million US dollars by Mr Ed Hale, President of Plains Radio, Texas - USA, in an effort to suppress the information from reaching the public before the coming US Presidential elections.

API has now taken a decision to contact the American Embassy in Oslo, Norway as soon as possible in order to report the matter and hand over the evidence for investigative purposes.

API’s Canadian lawyer is expected to fly to Oslo shortly in order to assist in the legal matters that arise from the bribery attempt.

API’s Chief editor is expected to travel to New York, together with the Canadian lawyer, where he will appear live in one of the shows that  will air the Michelle Obama tape.

i am going to be very surprised if something real comes out of this API blog.
they have been milking this for weeks now and haven't produced anything.

same as this whitey-tape and supposedly fake birth certificate.
a lot of noise, but it leads absolutely nowhere.

everytime there is a lot of interest in a news event (in this case the U.S. election) there are some who think they can make a few bucks out of it or use it to get some attention.

KITV's Denby Fawcett Gets to the Truth About Obama's Grandmother's Illness

By Bob Jones, 10/29/2008 8:23:15 AM

For some reason only Denby Fawcett of KITV got the story October 21 that Barack Obama flew in here because his grandmother is diagnosed with terminal cancer — not just a broken hip.

(snip)

...Obama’s elderly paternal grandmother in Africa once told a reporter he was born in a hospital in Kenya while his mother was visiting there. The Constitution doesn’t define what is meant by “natural born citizen.” We all agree John McCain meets the test by being born in Panama to American parents.  ...

“Natural” probably means you never went through the naturalization process to become a U.S. citizen. Obama was born of an American mother, raised here and was elected as a senator. Never "naturalized." Berg claims a fatal complication because Obama briefly went to Indonesia with his step-father who — in order to get him into a government school — listed him as Barry Soetoro (stepfather’s name) on the entry form and his religion (the father’s) as Islam. But that’s meaningless, even if his stepfather temporarily passed him off as a Indonesian citizen. Obama was never “naturalized.”

This is truly frivolous litigation.

Until quite recently, Senators Obama and McCain both had civil suits brought against them alleging they were constitutionally ineligible to serve as President.  McCain chose to cooperate with the courts, produced his documents, and was ruled constitutionally eligible.  However, the question for Obama is still open.  He has not produced documentation  in a court of law proving that he is eligible.

On the Michael Savage Show on October 23, Berg stated that he has in his possession a verified translation and recording of Obama’s Kenyan grandmother, who is still alive, stating she was present at little Barack’s birth in Kenya.

The Associated Press with its often negligent style of journalism titled its short seven-sentence blip of an article "Judge tosses lawsuit challenging Obama citizenship" on October 25.  However, in their last sentence they did state the truth.  "Surrick ruled that Berg lacked standing to bring the case, saying any harm from an allegedly ineligible candidate was "too vague and its effects too attenuated to confer standing on any and all voters.""

PS I am biased, but I would say they same about anyone who refuses to prove he is constitutionally eligible.  For being a constitutional law professor, Obama seems determined to follow it his way - the Socialist way.  Here is a 2001 radio recording of how Obama will redistribute the riches of the wealth to the poor, to each according to his/her needs.

http://www.nolanchart.com/article5315.html

The youtube is about the victories and failures of the civil rights movements.

My paraphrase - right to vote, sit at lunch counter.  Supreme Court never ventured into the redistribution of wealth...

Tragedy of civil right movement - lost track of community organizing etc. for redistributive/reparative change.

Talks about desegregation and costs, separation of powers, administrative and takes a lot of time...courts not very good at it.

Something interesting to listen to.  I wonder if there are more recordings?

It has been alleged that presidential aspirant Barack Obama is ineligible to become president because, it is claimed, he was not born in the United States, but rather born in Kenya to a Kenyan father, making him a Kenyan citizen. The story has gained credence for several reasons. His paternal grandmother in Kenya has reportedly been audiotaped saying that she was in the delivery room when Obama was born. Obama has refused to release an official birth certificate. Instead he has released a "certification of live birth," which not only shows evidence of tampering — Obama's half-sister's name Maia appears under his name — but wouldn't normally be considered a legal document anyway. Further, Obama will not release his medical records or his records from Occidental or Harvard College. It is speculated that he will not release these records because they indicate he is not a citizen and may, in fact, have applied for some type of U.S. government aid for foreign students.

These are the accusations that lifelong Democrat and former Democratic candidate for office Philip Berg has made in the case Philip J. Berg v. Barack Obama, et al. Berg, a former deputy attorney general of Pennsylvania, further alleges that even if Obama were born in the United States, when Obama's mother was remarried, she moved to Indonesia with her new husband and renounced her and Barack's U.S. citizenship. The basis for this claim is the fact that Obama was enrolled in school for four years in Indonesia, and the government required (during the time Obama was there) that one had to be a citizen of Indonesia and renounce citizenship in other countries in order to attend school.

Though as of yet unverified, the claim that Obama is not a natural-born citizen rings true if for only one reason: by refusing to supply the requested documents, Obama is alienating voters and losing votes. But there is virtually no chance that voters will find out the truth of the matter before election day because on October 24, Judge R. Barclay Surrick of the U.S. District Court of Pennsylvania dismissed Berg's lawsuit "for Lack of Subject Matter Jurisdiction." The court did not rule on the facts of the case and, in fact, did not consider them at all.

Quote
This does not mean that the legal fact-finding endeavor is at a dead-end. Berg has appealed his case to the Supreme Court, and if that fails, he can wait until Obama (upon winning the presidency) takes office and then attempt to get the information using the Freedom of Information Act. (Berg has attempted this already, but he did not adhere to the rules governing how FOIA requests must be made, and he requested information from a state agency when the FOIA only applies to federal agencies — such as the executive branch.)
