Defense Team: Caylee Could’ve Been Poisoned By Chloroform
Wednesday, November 5, 2008 – updated: 11:33 pm EST November 5, 2008

ORANGE COUNTY, Fla. -- Publicly Casey Anthony’s defense team has always insisted that Caylee Anthony is alive. They did it as late as Wednesday.

“We all believe she’s alive,” said Jose Baez during a hearing at the Orange County Courthouse on Wednesday.

But Eyewitness News has learned that behind the scenes, the defense sent 30 pages of documents to prosecutors. In those documents, Casey’s lawyers argued that if Caylee is dead, “it was almost certainly a tragic accident.” The documents also said Caylee could’ve been poisoned by Chloroform or she could have died while she was sedated. They said the cause of death could have been an unwitting overdose of a sedative.

The defense documents went on to describe Casey as troubled, possibly depressed. They said her behavior had been erratic ever since Caylee’s birth and particularly in the months before the little girl’s disappearance. The documents also said Casey’s lack of emotion after Caylee’s disappearance is proof that Casey is not normal and could possibly be suffering from mental or emotional stress.

The defense used those documents to argue that the death penalty is not an appropriate sentence in Casey’s case because she is young and she’s never had a criminal record. However, the documents never mention Casey’s story that a babysitter took Caylee and disappeared with her.

Eyewitness News learned that dissention among the defense team may be behind the release of those documents. The death penalty-qualified attorney, who is helping Jose Baez, said he wanted Casey to be evaluated by a nationally known psychologist who was involved in the Unabomber and the Elizabeth Smart cases. The attorney thinks Casey is mentally ill, but we’re told Baez rejected his suggestion.
  O.k. Baez, you can't have it all three ways: Caylee kidnapped by Zanny at Sawgrass; Caylee taken by Zanny at Blanchard Park; and Caylee could’ve been poisoned by Chloroform or she could have died while she was sedated.  Which is it?

Baez and the New Lawyer disagree!  It sounds as if New Lawyer realizes Casey could very well get the death penalty and wants to keep his client alive as long as possible.  Baez and Casey don't want to plea this and want to go to trial.  New Lawyer knows this is a really, really bad idea. 

Totally agree, AZLady!  Is that the voice of more experience we hear?

Baez and the New Lawyer disagree!  It sounds as if New Lawyer realizes Casey could very well get the death penalty and wants to keep his client alive as long as possible.  Baez and Casey don't want to plea this and want to go to trial.  New Lawyer knows this is a really, really bad idea. 

Totally agree, AZLady!  Is that the voice of more experience we hear?

I'm thinking the A's are really getting worried about now...the TES calvary is riding into town 3,000 strong, thousands of people are praying nationwide specifically to find Caylee, and a doc dump too.  IMO, they know time is running out on their little secret. I also expect to see some Anthony antics in the next few days.

I want to know something...if Ca & Ga were so absolutely sure Caylee would be home for her birthday (remember how adamant they were) and Halloween, what happened?  What was their excuse?  Are we now going to hear GA say she'll be home in time for Thanksgiving?  Then, will it Christmas?  New Year's?

They soooooo want to believe little Caylee is alive. As we all do. sad, isn't it.

Speaking of seniority, wouldn't the new lawyer have more influence? I bet he is having to backpeddle something fierce to make up for any booboos made by Baez

Maybe, the psychologist is a last-ditch effort to get Casey to realize this time, she's gone too far with one of her games.  Maybe this is the bucket of cold water in her face that if she "loses", she dies.  IMO, I think Casey likes taking risks and so far her experience has been that she's beat the odds.  She seems to think she's invincible.

Or maybe it's a set-up for the mental health/insanity/post-partum defense.

I think she'll have to confess and tell where she put the body to get life without parole.  It would be her best choice.  DP is never a good choice.
