If you were a crayon, what color would you be?

« Reply #560 on: December 03, 2008, 08:31:42 PM »

I agree LovinLife that it would be a defense that might not work at all.  But what else does he have?  Baez has a client who failed to report her child as missing, may be an amateur porn star, partied while her child was gone, drove around in a car that smelled of death, etc.  He can have experts who refute the forensics, but how can he convince a jury that Casey had a reason for not reporting a child who was missing for 31 days or that partied during that time and fooled around with two guys and stole from her friends?  How do you make such a person in the least bit sympathetic or likeable?  And that counts a lot with juries.  His only hope, it seems to me, is to put her on the stand and have her claim to have been abused in some way and unable to cope.  I am just brainstorming and maybe I am way off base, but he might try it.

Just now catching up but I think Baez may even say that Casey gave Caylee away to protect her from the same abuse that KC suffered. ????

Interesting post by NJ Lawyer on another WS

Hi. I've tried to go back and read the various posts but can't put it together. I know Cindy Anthony claims that her computer account with yahoo was "hacked" and is making this claim after Kathi Bellich (the reporter) phoned up the FBI after Bellich got a bunch of emails from Cindy's email account (emails that were to and from Cindy and various others including her "press rep" whoever that is these days). What I can't figure out: folks on here seem to be tracing something via IP addresses. What's being traced? Also, what is the connection between the hacking and the relative of David Lohr. Thanks to anyone who cares to clarify.

PS - I wonder if Bellich handed the emails over to the FBI b/c there was a concern that if she gave them to OSCO, then OSCO would share them with the prosecutor and it's possible the emails include information that is subject to a legal "privilege" as respects the defendant such that the prosecutor normally wouldn't be entitled to receive them. There could be some interesting developments concerning waiver of the attorney-client privilege. Only the client (Casey) can waive the a/c privilege (the one that attaches to her own lawyer communicatons) -- Cindy can't waive the privilege "on behalf of Casey". On the other hand, if Cindy is in possession of the material, then Casey waived the privilege to the extent Casey gave the information to Cindy in the first instance. Courts have held that the privilege is waived even if it's done accidentally (i.e., if Casey didn't mean to send the information to her Mom and Cindy didn't mean for the info to be sent to Bellich......the privilege is still waived. Even where the client is careless about how he/she handles information resulting in third parties getting it....then too bad.....a waiver has occurred. I hope the prosecutor's office is trying hard to get a hold of the emails. They might have to go to court over it unless in-house counsel at the FBI has a look at the issue and decides to hand them over to OSCO.

That was too much  talk for me.

Deputies Re-Publish Sketch In Search For Jogger's Killer
Thursday, July 3, 2008 – updated: 5:39 pm EDT July 3, 2008

http://www.wftv.com/news/16783963/detail.html

ORANGE COUNTY, Fla. -- Deputies are re-publishing a sketch of a person of interest in the murder of Nicole Ganguzza hoping the public will come forward with information.

Investigators released sketches of four persons of interest shortly after the UCF grad student was murdered while jogging in Blanchard Park in east Orange County last month. Two of the men came forward and were cleared by detectives.
Now, police are asking the public for help in identifying one of the others.
"This is an individual that has been described to us as possibly being in the area of the park on the night of the murder," said Chief Ron Stucker, Orange County Sheriff's Office.

Detectives said they have received dozens of tips from people who were in the park the night Nicole was murdered and are asking the public to continue calling tips in.

* I do not know if this individual has come forward since this article of July 3rd ... I have not been able to locate an updated version of this request ...

Missing Fisherman's Body Found
Wednesday, December 3, 2008 – updated: 5:19 pm EST December 3, 2008

MERRITT ISLAND, Fla. -- The body of a Brevard County man who has been missing for more than a week was found Wednesday afternoon in the Indian River Lagoon. Investigators said the body was found by a friend of Shawn Waters' who had been searching for the missing 31-year-old on his own.

There are no signs of foul play in the case. He was found by his friend face down and said he knew it was him based on a tattoo found on his body.

The body was found about ten feet from the shore in about a foot and a half of water off the shore of the Pine Island Conservation Area of Merritt Island (see map). The area could only be reached by helicopter or boat.

Waters was last seen alive on Sunday November 23. He vanished in the Pine Island Conservation Area just days before his 32nd birthday. He was found not far from an area he had previously gone fishing with friends and about three-quarters of a mile from where his boat was found last week.

Investigators said Waters' body was not entangled and there were no obvious signs of foul play. His body will be taken to the medical examiner's office with the hope an autopsy will provide some clues as to how he died.

As of now, Florida Fish and Wildlife Commission consider it an accidental boating death.

I thought TES was searching as well.

TES was there!  I wonder why he was found by his friend though!!

Mytime - just like you volunteered to search for Caylee, I imagine some of Shawn's friends volunteered to search for HIM.  I don't know this to be the case, but the friends could have joined up with TES to help search.  Makes sense?

YES, then the local news should give TES credit too if TES was still there.

http://www.wftv.com/news/18181567/detail.html

One of Waters' friends has been searching on his own.

"Oh yeah, I've been everywhere. I got out of the kayak and hiked around a bit, searching everywhere," Pete Sims told Eyewitness News.

TEXAS CITY, Texas —  A 62-year-old woman has been hospitalized after authorities found her barely alive with maggots eating her flesh, Texas City police said.

Police found the woman after someone called 911 late Friday night claiming to be her son and said his mother had bedsores and needed an ambulance, police Capt. Brian Goetschius said. The caller, who police are searching for, said the back door of the house would be open and hung up, Goetschius said.

The officer who entered the house said it was in deplorable condition and there were several cats running around inside. He said he was overcome by a smell similar to that of a decaying body. The person who made the 911 call was not there.

The officer then saw what he first thought was a dead woman on the living room floor. Goetschius said that the officer then saw the woman blink.

"She was teetering on the brink of death," Goetschius told The Daily News in Galveston.

He said the woman is Linda Sue Sainz, a retired Galveston County Sheriff's Office dispatcher.

Sainz was taken to Mainland Medical Center in Texas City. Hospital officials said early Tuesday morning that they could not release a patient condition.

Police Chief Robert Burby said his department contacted Adult Protective Services, which is conducting its own investigation.

Police said that the 911 call came from a phone in the house.

"The circumstances with the 911 call were unusual. I think this whole case is unusual," Goetschius told Houston television station KHOU.

Family members told police they had not seen Sainz since January.

TEXAS CITY, Texas —  A bedridden woman found barely alive with maggots eating her flesh remains hospitalized at Mainland Medical Center, but police are not sure she will survive.

Retired Galveston County sheriff's deputy Linda Sue Sainz was taken to the hospital, located in Texas City, after someone called 911 late Friday night claiming to be her 38-year-old son. He said his mother had bedsores and needed an ambulance, police Capt. Brian Goetschius said. The son, who police continued to search for Tuesday, said the back door of the house would be open and hung up, Goetschius said.

Struggling with health problems, the 62-year-old woman stayed inside for weeks at a time with her son, who had lived with her almost all his life. Sainz also did not like going to doctors, her children told police.

Police declined to specify Sainz's pre-existing medical problems, noting they are still waiting to receive medical records that were subpoenaed. Prosecutors also want the medical records before pursuing charges, the Houston Chronicle reported Tuesday in its online edition.

Adult Protective Services caseworkers also are investigating.

The son, whose name police declined to release, has not been charged with any wrongdoing. The initial police investigation indicates Sainz's son was her sole provider of food, medical care and shelter, while her retirement income paid their bills, Goetschius said.

Authorities said they believed it's been weeks, if not months, that anyone other than her son visibly saw her.

Sainz's other three children, all living in the Houston or Galveston County areas, had spoken to her by phone, but had not visited her in person before the grisly discovery, Goetschius said.

Her eldest son, Aaron Martelli, 43, of Santa Fe, said he had no idea his mother had become so sick or that she was living in such deplorable conditions. He said he last spoke to her by phone a month ago.

"I have a feeling she was putting up a pretty good front," Martelli said outside his mother's home Tuesday.

The first officer to arrive smelled a strong odor of feces and saw what he thought was a decomposing body lying in a puddle of body fluids on the living room floor next to a bed. The woman was motionless and appeared to be dead, police reports show.

Then the officer saw the woman blink her eyes. He yelled for paramedics to come inside, Goetschius said.

I am reading the emails from Cindy's Aunt to Cindy's mom, but I am very confused. Does anyone know why they are all from the aunt, not the mom. It just seems to be responses to emails the Mom (Mrs Plesea) sent to the aunt. Does that makes sense or have I not read far enough?

where did you find the emails please??
In the last documents (700 pages) I think it was in the 13th one. The aunt is adorably funny. Calls it like she sees it.

I agree...the aunt is a hoot....the emails between Rick and cin-cin are so. so sad......the pain, frustration, disgust, love for his sister  and his anger jump right out of the computer....everyone sees the truth except cin-cin....what an evil creature she bore

Sean Krause is David Lohr's nephew.  He came out with his emails to prempt the release of his emails to the public.  He is very ill and wanted to be able to share HIS side before he was unable to due to his illness.  Somehow his emails will be a part of this whole hacking situation.  He was interviewed by YM.  Go to http://thedailybs.com/news/?p=2094  for more details.
I also wonder what MORE will be coming here.  I do not believe he is suspected of anything.  He just had some inside info from emailing Cindy several times over the past months.
Please correct me if I am wrong about anything...

No Caylee on NG tonight

I would love to know if the POI that resembles LA has been located....there are lots of folks in Orlando so what are the odds that there would be so many connections between this person & Lee? Maybe I'm thinking too hard!

OMG, have they found the son yet? There was a lady in North Texas a few years ago who had been her bed so long the bedsprings  were inbedded into her body. They had to cut a hole out of her house to get her to the hospital. WHAT THE H*LL IS WRONG WITH PEOPLE?  I don't get it. My dog is laying sick by me right now and I do everything within my power to take care of him. People that hurt children, old people and animals are DISGUSTING. Really makes me cry.

I agree...the aunt is a hoot....the emails between Rick and cin-cin are so. so sad......the pain, frustration, disgust, love for his sister  and his anger jump right out of the computer....everyone sees the truth except cin-cin....what an evil creature she bore
She is funny. At first I felt sorry for Cindy, but she cannot see the truth. Her brother tried to show it to her, she didn't get it, so she lashes out at him. Finally he had enough. I really feel bad for their mom and dad. They don't need this in their old age and bad health. CINDY GET A GRIP! YOUR DAUGHTER IS A MURDERER!

There I feel better!

If the son lived with her and allowed his mother to lay in this condition, I hope they lock him up and throw away the key!
