ORLANDO, Fla. (WOFL FOX 35) --  Casey Anthony sits behind bars, charged with the murder of her daughter, Caylee Marie.  Now, the attorney representing Casey's brother, tells MyFoxOrlando.com that Lee Anthony may also face charges.

"Not because he has done anything wrong," said Thomas Luka.   As a former prosecutor, Luka said that the  State Attorney's Office could seek to charge Lee with obstruction of justice or aiding and abetting, even if was not Lee's intention to do so. 

"It's an ongoing investigation, so no one really knows where it's going to lead.  Mr. Anthony, obviously wants his civil rights protected.  Everyone involved in the case should have their rights covered when determining what the police can and can not do or should and should not expect from the witnesses involved in this case," said Luka.

Luka adds that neither Lee, nor George and Cindy Anthony, have been called as witnesses in the case, but they are preparing for just such a scenario.

For months, Lee Anthony has been conducting his own investigation into the disappearance of Caylee, looking into leads for other suspects, Luka told MyFoxOrlando.com.   

Luka contends that Lee has cooperated with detectives, even handing over a DNA sample.  Luka describes his role an advisor to Lee, in determining what he should and should not say to investigators.

"For that reason,  he feels at this point, now that the police are focusing completely on Casey, he wants to make sure that his own civil rights are protected," said Luka.

Meanwhile, prosecutors have added several new names to its witness list, Local 6 News reported.

The new names include photographers who took pictures of Anthony partying days after Caylee vanished. Also, several members of the FBI lab and the Oak Ridge National Laboratory may be called upon to testify about evidence found in Anthony's car, which was found abandoned at an Orange County Amscot and reeked of death, according to detectives.

The mother and brother of Cindy Anthony, Casey Anthony's mother, were also added as potential witnesses. In e-mails to Cindy Anthony, those family members said they think Casey Anthony may have harmed Caylee, released documents show.

ORANGE COUNTY, Fla. -- Deputies want know what a private investigator was doing in the area where Caylee's body was found. They've been told he was videotaping the area a month before Caylee's body was discovered.

The private investigator was apparently working with the Anthony family at the time. It raises questions about whether the Anthonys knew the remains were there a month before they were found.

The private investigator who works with the Anthonys told Eyewitness News he came to the area the month before Caylee's remains were found and videotaped the area. He says the tape shows Caylee's body was not there at that time, but now investigators want to know why he was there with a camera in mid-November.

Private investigator Jim Hoover says he recorded the wooded area where Caylee Marie Anthony's remains were found about a month before they were found.

"We will definitely look into that, absolutely," said Carlos Padilla, Orange County Sheriff's Office.

Hoover briefly showed an Eyewitness News photographer a short clip of the videotape, which appeared to be authentic; the fence was recognizable.

"They know the existence of the tape and want to look at all evidence that's available," Padilla said.

Investigators also want to talk to the Anthonys' private investigator who works with Hoover, Dominic Casey. The defense wants to intervene, because Dominic Casey used to work for the defense and attorney Jose Baez doesn't want him to divulge privileged information.

Baez said investigators won't let him sit in on the questioning, so he's asking the judge to appoint a special master to protect defense secrets if the private eye agrees to talk.

"Investigators have tried to make arrangements with Mr. Casey to speak to him and he's not responded," Padilla said.

The defense's spokesman said they don't want their former private eye to divulge privileged conversations they might have had about where Caylee's remains might be.

I wonder if Lee is in trouble, finally, for deleting a bunch of stuff from Casey's computer (or laptop) that he got from Tony's apartment? He did volunteer that bit of information to LE, I believe, about the deletions upto a particular date ( I think the date of Casey's arrest) The only one that would have done it was Lee. 

I was thinking about this either last night or this morning..  There is no logical way that emails deleted themselves up to a certain date.  No virus is that specific... not unless the person wanting to delete them knew how to create such a virus..  is that possible? 

Nah! Not unless it's name was Lee. It would have been a very fortuitous virus for Casey! I think he's going to claim that he believed the kidnapping tale, and that Casey told him to delete everything because it could endanger Caylee's life. Or some stupid tale like that.

Giving the meterman the benefit of the doubt, I think it's possible the bag was removed after the A's got hold of the crimeline tips, then the empty area was filmed, then the remains were put back, possibly in another bag over the one that the meterman originally saw. I think that may explain the discrepancy in the description of the color of the bag in the Aug. calls. I seem to recall early on after the bag was discovered on 12/11, that someone reported that it had been double bagged.

Okay this is going way out on a limb, but could this have been a set up? Cindy/George need money so they get Casey to make believe a kidnapping, Cindy lets Casey party for 30 days, steal Amy's money, etc. Cindy has Caylee all that time, but something happens to Caylee. Car is towed, CA/GA find it, George goes on and on about the daughter and granddaughter being missing to the tow man. Cindy calls the police THREE times the day she finds Casey because the cops are not doing anything about it. Could they have been in on it from the begining with those KFN crooked people? A plot to make money?

Some have suggested this before........I have always expected KC to blame either George or Cindy before it was over because by their OWN admission they were the last ones to see her. I have always felt she would say she left and was partying because she "thought" they had Caylee and didn't know any different until CA picked her up.

I have always found it strange that KC NEVER said one word about a kidnapping or a nanny UNTIL Cindy said " WHO TOOK HER?" Then she comes up with the nanny.

I'm not sure Casey was told about the news. She is in seclusion. Unless her lawyer made a personal visit and IIRC she had no visitors immediately.

Thanks for explaining Muffy, it's been a tough day and having just spoken with Peache's husband I need to make a post on his behalf.

He is such a lovely man and my heart breaks for he and his daughter.

We lost our Peaches to her illness, I will be forwarding information regarding the coming service for her to Klaas so that anyone who is in that area who might want to attend will have the information they will need to do so.

Please know her husband spoke of the love and support so many at SM had for Peaches, it's so apparent how meaningful that is to him at this time, he spoke of how many loved Peaches and it is so very true.

For intuition's sake I was on a mission to speak to her today, oddly enough post leaving her a voicemail, my daughter called me. We heard two series of beeps on the phone line, we both commented never having heard beeps like that on our mobile prior - we joked it was Rick letting us know he was there.

About a half hour later her husband called and left a voicemail. I have to think that Rick has Peaches by the hand now, that those beeps were their way of letting us know that.

There is a part of me that is in such deep sorrow tonight, for losing our Peaches and knowing the journey ahead for her husband and daughter. We need to keep them in our prayers as often as we can.

God bless you Peaches, forever and always. We miss and love you immensely and celebrate that God will bring you peace and a new purpose.

God bless her husband, her daughter, and her family and friends. We grieve with you and we hope in some small way, to be part of the many lights she cast into this world for goodness and for courage in the face of great adversity.

I find comfort thinking of her walking among the roses so many posted for her here.

Does anybody have any thoughts as to why Hoover would have been videotaping Dominic in this area? (This is per LP tonight on NG).  I don't understand why either would be there, frankly...  don't both of them work for the same person (though perhaps at different times)? This is so confusing..  it's odd enough that one of them would be in this area videotaping.. especially if the Anthonys claimed that Caylee was alive and that they were busy looking at leads.... then you have another PI there... filming a PI who was filming?
