The Kalpoe brothers were previously jailed in the case, but were rearrested last week and charged with being involved in the "voluntary manslaughter" of Holloway.

The judge reasoned Friday that "the new evidence, together with the existing evidence in this case, produce serious grounds for the suspicion of some kind of aiding and abetting, of covering up the traces of a crime committed or of the disposing of a corpse," prosecutors said.

Considering that Deepak and Satish are no longer suspects in the Natalee Holloway case ... could this be the reason that the court has not dismissed the defamation lawsuit?

Think about it.  It as be well over two years since the judge afforded the Kalpoes' representatives a five day extention to produce the requested case documents.

Could the position of the Kalpoes' attorneys be that the non-suspect status regarding their clients imply that the disputed segment of Dr. Phil recording must stand alone and any possible manipulation implies defamation?

Considering that lawsuit has yet to be thrown out for non-compliance to the court's five day extention over two years ago for case documents ... could it that the position of the Kalpoes' attorneys have merit that the judge is weighing?

Judge Refuses to Dismiss Holloway-Related Suit Against CBS and 'Dr. Phil' McGraw
LOS ANGELES Feb 6, 2008 (AP)

A judge refused to dismiss a defamation suit Tuesday against CBS and television psychologist "Dr. Phil" McGraw brought by two brothers who were questioned in the disappearance of Natalee Holloway.

William Cremer, the lead attorney for Surinamese brothers Deepak and Satish Kalpoe, praised the decision by Superior Court Judge Edward A. Ferns.

"I'm going to take Dr. Phil down," he said outside the courtroom. ....
 
The Kalpoes, who have maintained they had nothing to do with Holloway's disappearance, sued in December 2006, claiming the "Dr. Phil" talk show altered portions of a taped conversation between Deepak Kalpoe and a private investigator to "create false, incriminating, and defamatory statements that the plaintiffs engaged in criminal activity against Natalee Holloway."

The brothers also contend the TV show implied they helped kill Holloway and got rid of her body. Their suit claims defamation, invasion of privacy, emotional distress, fraud, deceit and civil conspiracy.

Cremer said the taped remarks by Van der Sloot, which were secretly recorded by a Dutch crime reporter, help his clients' defamation case.

"It pretty much exonerates my boys, doesn't it?" Cremer said.

In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.

But the judge gave the Kalpoes' lawyers another five days to satisfy the document deadline.

I haven't seen anyone here at SM that believes 100% of what Joran says whether it be the Range Rover story or the most recent falling off balcony story.  I do believe many feel as though with every lie is a smidgen of truth. 

It's clear to me that Joran is simply throwing stuff out there hoping it sticks and in the process making some $$.  He knows that he's already paid the consequence of unlawful disposal of a corpse.  Could be that the stories not involving K2 are in hopes of K2 getting a large settlement from Dr. Phil and sharing with Joran.

According to the interrogation log ... in August 2005 the FBI was able to identify Wendy Terry as Deepak's friend ... Deepak's friend who contacted the FBI regarding his request for an alibi following the gardener's court testimony.

The indication is that Wendy Terry resides in Dallas Texas.  Unlike Aruban case documents ... hopefully these records will be forthcoming to Phil Mcraw's defence attorneys.

Why was Deepak's vehicle parked in the lot of the Bubali police station at 8:00 AM on the morning of May 31, 2005?  Was it impounded?

Deepak declared in his suspect statement that on the morning of May 31, 2005 he drove straight home after leaving the VDS residence.  He declared he arrived home at 6:45 AM and went straight to sleep after conversing with Satish.

Satish declared in his suspect statement that Deepak arrived home on the morning of May 31, 2005 at approximately 6:30 AM.  He states that Deepak claimed that he had just come from the police station.

When both Deepak and Satish statements are considered ... is it possible that Deepak received a ride home from someone within LE?  Could it be that Deepak received a ride home from Charles Croes who apparent resides on the way?

Nevertheless ... why was Deepak deceptive in his suspect statement.  Lies are created to cover the truth.  What was the truth?

Thirty minutes prior Jug and Beth Twitty’s arrival at the VDS' residence on the morning of May 31, 2005, Deepak Kalpoe’s was observed parked inside the gate of the VDS' compound by the handlers who had met them at the airport upon arriving on the Island.

Deepak's June 13th suspect statement give an account of his movements from the time he left his workplace at 11:00 PM on the evening of May 30, 2005 right through the wee hours of May 31, 2005.  His presence at the VDS residence prior to the arrival of Jug and Beth was an obvious omission..

Alberto and Claudio went to the location, looked over the fences, and there it was. A silver-gray Honda with big tailpipes and fancy features, just like the (MB) students had described. They wrote down the license plate number and the address. On the piece of paper is everything we need: the name of Joran van der Sloot, his address, and the tag number.

Page 45:  We haven't located any police yet, but with this solid information (the name, address, and tag number) the handlers decide to take us to the Noord police station.

Deepak Kalpoe related to one of the security guards while they were both detained in the same period of time in June, 2005 that he was a participant along with Paulus van der Sloot and others in the collaboration of the Holiday Inn fabrication.

Considering the Holiday Inn fabrication was conveyed to Jug and Beth in the early hours of May 31, 2005, the meeting Deepak had with Paulus and others must taken place prior to the Twitty groups arrival at the VDS' residence.

Deepak had to have been aware that Natalee Holloway was deceased on May 30, 2005 or he would not have been a participant in a lie ... a lie that would be exposed if a live Natalee had turned up.

I am the best friend and neighbor of Joran. We got to know each other about two years ago. Joran and myself are both really into sports and that is how we became good friends.

Monday afternoon on the 30th, Joran came to my house. He told me that the previous day, Sunday, he had befriended a girl in the Holiday Inn casino and that she had invited him to come to Carlos and Charlies that evening. He went and they danced and drank together. After that he, Deepak Satish and the girl drove off. Her friends saw that. The drove in the direction of the Lighthouse; a white car was behind them and most likely wanted to race Deepak. But that is something Deepak would never do. Joran told me that he fingered and had french kissed the girl while they were driving. He did not say that he had had sex with her. They drove to the Lighthouse, she wanted to see sharks. But Deepak only drove up to the Lighthouse because his car is very low to the ground and cannot drive up to the North side of Aruba. The girl had said to Joran that if Deepak and Satish would have lived in her town, they would be slaves. After that they drove to the hotel. When the girl had pushed open the door of the car, she fell to the ground. Joran wanted to help her but she shoved him away. (....)


The next day, Tuesday May 31st 2005 in the afternoon, I was with Joran at the raquetclub. Joran looked worried. He asked me if I could remember what he had said the previous day about the girl. I told him yes. The girl had gone missing. The FBI had been to his house during the night but he had not been home. His father had called him to find out where he was, Joran said that he was in the Raddison Casino. He told he that after that phone call he was called on the phone by Deepak and that Deepak picked him up a few minutes later. They drove to Joran's house. The FBI and the girls family were at his house.

After that Joran told me that Deepak, Satish and himself did not drop off the girl at the Holiday Inn Hotel, but that the four of them drove to the beach at the north side of the Marriot Hotel. The girl had fallen several times on the way to the beach. Joran told me that at some point she "no longer came around/no longer regained consciousness" and that they had left her on the beach. He also told me that he had left his gym/sporting shoes on the beach. After Joran had told me this, I asked him why he had left her there. He answered me that at that moment he had not known what to do. Joran told me that after this he was dropped off at home by Deepak and Satish.

Page 44.  Alberto and Claudio went to the location, looked over the fence, and there it was.  A silver-gray Honda with big tailpipes and fancy features, just as the students had described.  They wrote down the license plate number and the address.  On the piece of paper is eveything we need: the name of Joran van der Sloot, his address, and the tag number of the car Natalee was seen getting into. 

Page 45:  At Noord it takes almost half an hour to get uniformed officers to accompany us to the van der Sloot home.

The silver Honda isn't here any more.

The officers sound their horns and sirens for about five minutes before a man answers the door.  He is Joran's father, Paulus van der Sloot.  He has his cell phone in his hand.  The police as to see Joran.  Paulus responds that he isn't home and calls his son to find out where he is.  He tells the police that Joran says he is in a poker tournament in the back of the casino at the Wyndham Hotel.  Again we load up, adding Paulus to this madcap possee riding in convoy with the police to the Wyndham.

Page 46:  We arrive at the Wydham, and the car barely stops rolling before I jump out ...

I run straight to the back where Joran told his father he would be and return to the front.  There is no sign of him.  I turn around to see Paulus on his cell phone aain.  He tells us that his son is back at their house now.  He is there with his friend, Deepak Kalpoe, the own of the silver Honda.

Page 47:  We are instructed to go back to the van der Sloot residence, where Joran is now waiting.

Page 48:  It’s about three o’clock in the morning .  It’s a school night.  They (Joran and Deepak) aren’t dressed as if they have been to a casino.  They are in grubby T-shirts and shorts.  I make a mental note that I will ask to be the casino footage from the Wyndham later on.  Just to see if they were really there tonight – or, rather, this morning.

Page 121:  And finally we learn from the Wyndham Hotel manager that Joran and Deepak do not appear on their security videos at the time the two claimed to be at the poker tournament there – the same time we were stand in the van der Sloots’ front yard in the wee hours of May, 30.


Deepak Kalpoe - Suspect Statement - June 13, 2005

Because all of the blackjack tables in the casino were full, Joran and I decided to go to the Wyndham Casino. Guido had said that he was going home and that he would drop off Andre at his place. Joran and me walked to my car that was parked on the parking lot. We got into the car and we drove to the Wyndham Hotel.

When I was parking my car in the parking lot, Joran's phone went off. Joran had said Paul. So I knew that it was Joran's father.

THE INVOLVEMENT OF DEEPAK AND SATISH KALPOE

According to the interrogation log ... in August 2005 the FBI was able to identify Wendy Terry as Deepak's friend ... Deepak's friend who contacted the FBI regarding his request for an alibi following the gardener's court testimony.

The indication is that Wendy Terry resides in Dallas Texas.  Unlike Aruban case documents ... hopefully these records will be forthcoming to Phil Mcraw's defence attorneys.

Page 178:  According to others present in the courtroom, Deepak appears very nervous when he hears the gardener's statement.  He panics.  And according to the FBI, contacts a young lady to ask her to lie for him.  The young lady calls the FBI in the States and reports that Deepak asked her to give him an alibi for the night Natalee disappeared.  They are trying to locate this girl.

Deepak panicked. He panicked when the gardener gave that testimony. That very afternoon, he called an Aruban girl to help him establish an alibi. She, in turn, panicked. She called FBI. She dialed the 1-877-NATALEE number and told them that she did not want to be involved in this.

But here we have someone that says categorically that they did not go home, they were in the car with Joran. Joran was sitting in the driver`s seat.

Deepak Kalpoe's June 13th suspect statement regarding where he was prior to going to the Wyndman is a blatant lie.  His vehicle was had been observed by the handlers behind the gate in the van der Sloot's resident less than an hour prior to the Twitty group's arrival there.

What was going on behind those gates?  Had Paulus learned that Natalee Holloway's mother and stepfather were on the island looking for their daughter and damage control was where it was at?

Had Paulus, Joran and Deepak been forwarned by LE, Charles Croes or Eric Williams that the Twitty group was on the way to his residence to confront Joran?  Is this way Deepak's vehicle was no longer on the premises?

QUESTIONS THAT DEMAND ANSWERS

It has been well over two years since the judge afforded the Kalpoes' representatives a five day extention to produce the requested case documents.

1.  Considering that Deepak and Satish are no longer suspects in the Natalee Holloway case ... could this be the reason that the court has not dismissed the defamation lawsuit?

2. Could the position of the Kalpoes' attorneys be that the non-suspect status regarding their clients imply that the disputed segment of Dr. Phil recording must stand alone and any possible manipulation implies defamation?

3.  Could it that the possible position of the Kalpoes' attorneys have legal merit that the judge has been weighing for the past two years?

LOS ANGELES Feb 6, 2008 (AP)

A judge refused to dismiss a defamation suit Tuesday against CBS and television psychologist "Dr. Phil" McGraw brought by two brothers who were questioned in the disappearance of Natalee Holloway.

William Cremer, the lead attorney for Surinamese brothers Deepak and Satish Kalpoe, praised the decision by Superior Court Judge Edward A. Ferns.

"I'm going to take Dr. Phil down," he said outside the courtroom. ....
 
The Kalpoes, who have maintained they had nothing to do with Holloway's disappearance, sued in December 2006, claiming the "Dr. Phil" talk show altered portions of a taped conversation between Deepak Kalpoe and a private investigator to "create false, incriminating, and defamatory statements that the plaintiffs engaged in criminal activity against Natalee Holloway."

The brothers also contend the TV show implied they helped kill Holloway and got rid of her body. Their suit claims defamation, invasion of privacy, emotional distress, fraud, deceit and civil conspiracy.

Cremer said the taped remarks by Van der Sloot, which were secretly recorded by a Dutch crime reporter, help his clients' defamation case.

"It pretty much exonerates my boys, doesn't it?" Cremer said.

In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.

But the judge gave the Kalpoes' lawyers another five days to satisfy the document deadline.

I haven't seen anyone here at SM that believes 100% of what Joran says whether it be the Range Rover story or the most recent falling off balcony story.  I do believe many feel as though with every lie is a smidgen of truth. 

It's clear to me that Joran is simply throwing stuff out there hoping it sticks and in the process making some $$.  He knows that he's already paid the consequence of unlawful disposal of a corpse.  Could be that the stories not involving K2 are in hopes of K2 getting a large settlement from Dr. Phil and sharing with Joran.

Why do you think that the judge ... after affording the Kalpoes a five day extention in February, 2008 to produce the documents ... has not bowed to the request of McGraw's attorney to dismiss the case.

I cannot answer what the Judge is basing his rulings on -- but it is a sad fact that in American law today -- cases are postponed, extended, and delayed almost indefinitely. The cases are so back-logged that it is routine to continue to delay and delay and delay. All it takes is one side to simply ask one question or make a request for a minute ruling for the judge to simply postpone another "hearing" a few months off. Sad, but Civil cases often drag on for many many years. When the Kalpoe attorneys run out of these tricks (or they run out of their money supply) it might eventually stop.

Maybe it's because the Kalpoe's US attorneys have used the law to their advantage, which also might include their failing to apply for their visas in the proper manner. 

Of course, I am just throwing this out there...I do not have legal background...far from it.

I agree that the Kalpoe attorneys are using the law to their advantage.  I just hope that this advantage that has prevented the court from dismissing the case after all this time ... does not imply that Deepak and Satish are going to emerge as victors through a negotiated settlement with Phil McGraw or ... a win in a court of law.

BETH HOLLOWAY TWITTY, NATALEE HOLLOWAY’S MOTHER: It is now that I ask the world to help me. Two suspects were released yesterday who were involved in a violent crime against my daughter. These criminals are not only allowed to walk freely among the tourists and citizens of Aruba, but there are no limits where they may choose to travel.
 
I am asking all mothers and fathers and all nations to hear my plea. I implore you, do not allow these two suspects, the Kalpoe brothers, to enter your country until this case is solved. Do not allow these criminals to walk among your citizens. Help me by not allowing these two to get away with this crime.

It is my greatest fear today that the Kalpoe brothers will leave Aruba. I am asking the Aruban officials to notify the United States State Department in the event these suspects try to leave this island. I am asking all nations not to offer them a safe haven. I am asking this in the name of my beautiful, intelligent and outstanding daughter who I haven’t seen for 36 days and for whom I will continue to search until I find her.
