According to Aruban attorneys ... under Dutch law "serious/strong" suspicions are requirments for detaining suspects.  What was the foundation that authorities derived "serious/strong" suspicions from in the detention of Paulus van der Sloot as a suspect in the Natalee Holloway case?

Paulus claimed he left the casino during the Poker game prior to Natalee entering the establishment.  Why would he lie?  If there was nothing to hide ... why not admit that he had a short encounter with Natalee at the Black Jack table?  Why did Paulus attempt to distance himself from any connection to Natalee?

Beth Holloway alleged from the getgo that Paulus van der Sloot initially claimed that he had picked up Joran and others at the Palm Beach McDonalds at 4:00 AM on the morning that her daughter went missing.

Paulus denied Beth's allegation.  However ... the Superior Court panel of judges which deemed that Paulus's detention was justified affirms that he had originally declared the 4:00 AM pick up time.

Why did Paulus want to distance himself from all happenings that connected him to the missing American teenager?  It is said the lies are created to coverup the truth.  What truth was Paulus attempting to coverup?

The possible involvement of Paulus that could then be deducted from the file with the official reports of witnesses, amongst which two people suggested a contact existed between Paulus and Natalee Holloway the night of her disappearance, and a taped report (that was given by the Prosecutor in her final note 1 to the Court). The taped information and his declaration that he picked up Joran and Natalee by the McDonalds Palm Beach and brought them to the Holiday Inn, are clearly understood by the Dept. of Justice, and could in the judgement of this Superior Court, be considered as an indication of the involvement of Paulus in the disappearance of Natalee Holloway.

Natalee Holloway's parents to meet with Aruban prosecutor


ORANJESTAD, Aruba (CNN) -- The chief prosecutor in the Natalee Holloway investigation has agreed to meet Saturday with the parents of the missing Alabama teen, who is presumed dead.

"I'm really anxious to meet him," Beth Holloway told CNN. "I've waited a long time for this meeting."

A lawyer for Beth Holloway contacted prosecutor Hans Mos last week after suspects Joran van der Sloot and brothers Satish and Deepak Kalpoe were arrested on suspicion of manslaughter.

"There's no doubt in my mind that [Natalee Holloway] is dead. ... I think we have enough evidence to prove the girl is not alive anymore, even without a body," Mos said last week.

Natalee Holloway's mother said she has hope that Mos will be able to solve the case.

"He seems great. The case seems to be handled well. I'm going to ask him some long-awaited questions," she said.

The family is encouraged that the meeting will take place, Holloway attorney John Kelly told CNN. Two years ago, the previous chief prosecutor -- who has since returned to the Netherlands -- would not sit down with them.

Kelly said Beth Holloway and her ex-husband, Dave, want to share information they've gathered since their daughter disappeared in May 2005 while on vacation with about 100 classmates

Neither he nor Beth Holloway would provide details.

Questions about evidence

Lawyers for the three suspects were in court in Aruba on Thursday on behalf of their clients. They argued that last week's rearrests were baseless and that prosecutors have no new evidence against their clients. They said they have no idea what happened to Holloway.

As he rushed out of the closed hearing before a judge, van der Sloot's lawyer told CNN that authorities have no reason to hold van der Sloot in jail again as they did two years ago. He said the so-called new incriminating evidence is worthless.

"To say it's less than nothing is too much. But it's not very much. It's very, very thin," Ariean de Bie said.

Van der Sloot's parents were allowed to provide him with a Bible but no other reading materials, the lawyer said. Van der Sloot is forbidden from seeing any visitors and can meet only with his lawyers and interrogators.

De Bie said van der Sloot has not provided authorities with any new information since his rearrest and extradition from the Netherlands, where he'd been attending college. He said his client would rather be anywhere than in a prison cell.

"He's not very happy about it," the attorney said.

Van der Sloot's co-counsel -- New York attorney Joe Tacopina -- said he has no doubt his client is innocent.

"Whatever they're holding in their bag, whatever they don't want to show anyone ... it's not going to amount to a hill of beans against Joran van der Sloot because he had no involvement in Natalee's disappearance," Tacopina told CNN.

Tacopina said he'll be in Aruba next week and try to meet with van der Sloot in his jail cell.

Attorneys for the Kalpoe brothers will meet with a judge in separate jailhouse hearings Friday to argue that their clients should be set free and not held another eight days.

A judge will decide whether prosecutors can continue to hold the Kalpoes even longer.

Van der Sloot will have a similar hearing next Friday when prosecutors are expected to ask to keep him jailed another 60 days.

Mos has said he hopes to decide by the end of the year whether he will try all three suspects for Holloway's presumed death, which he suggests was an accident. The prosecutor won't say what his new evidence is until his investigation is complete.

VAN SUSTEREN: All right. Did the -- did -- was there ever any follow-up to see whether or not your witness had information that was truly helpful? Did Hans Mos, even though he didn't believe him -- did he at least assign someone to go out and investigate and look at that pond area?

HOLLOWAY: No, he didn't. You know, we had asked him to. And in fact, we had planned to go excavate the pond ourselves, and these hurricanes came through and one came close to Aruba and filled the pond back up with water. It's still our plan to go back. I think Hans Mos and I discussed, you know, Natalee's not in the pond, but we believe that, you know, he could possibly find a tennis shoe, maybe her driver's license or even some of Natalee's clothing, which would help lead into, you know, the timeline. And also, this witness implicates Paulus van der Sloot. So if that's the case, you know, that needs to be done.

And in fact, we had planned to go excavate the pond ourselves, and these hurricanes came through and one came close to Aruba and filled the pond back up with water. It's still our plan to go back. I think Hans Mos and I discussed, you know, Natalee's not in the pond, but we believe that, you know, he could possibly find a tennis shoe, maybe her driver's license or even some of Natalee's clothing, which would help lead into, you know, the timeline. And also, this witness implicates Paulus van der Sloot. So if that's the case, you know, that needs to be done.

When Beth and Melody's words are considered in context ... could there have been a witness who placed Paulus in the McDonald area at 11:00 PM ... a time he should have been home.  Think about it ... he claimed in his official statement that he left the Casino half-way through the Poker Tournament.  However ... security cameras appear to placed him much later at the Black Jack table conversing with Natalee.

So that is something that -- you know, we know that Paul Van Der Sloot did not pick him up at 11:00 PM on the 29th. We know now that that correct pick-up time was 4:00 AM on the 30th, and Paul Van Der Sloot stated that he picked them up.

  The prosecutor questioned why Beth did not come to her first with the information that was shown on the tapes, as well as the statement of Natalee's acquaintance who saw her leaving Carlos' n Charlie's on the night she disappeared.  I cannot question Beth's motives.  We are all unsure of whom to trust.

Looking back on everything that has transpired, I wonder what difference it would have made to reveal the information on the tapes to the prosecutor first.  Without the world knowing about them before the Aruban invetigators, they would have probably been sent off to Holland and never heard about again.

They will have dateline onboard and I understand that they were involved in the Titantic so I assume they have the expertise to preserve any remains or artifacts and have a protocol. They can always find and locate it, call for assistance and then retrieve it. But that is my fear that they imediately turn it over to Aruba where her remains can become that of a large crab.

However ... I did not.  It was something akin to looking into the sky at a cloud.  If I thought "skeleton" ... I saw a skeleton.  If I thought "rock formation" .... I saw a rock formation.

Nevertheless ... considering Kyle Kingman's own words regarding the contents of the trap/cage ... I was convinced if the image was a skeleton ... it was not the remains of Natalee Holloway.

I KNOW that no one is gonna believe me - but I messed around with that pic.. and believe it or not - it's really a pile of rocks. I know I know... how could I say that - well, I did everything I could with it, and it is a pile of rocks.

There is a rock that looks like a skull - but it's not. Sorry... and there is a rock that seems to have what look like "fingers" - but that is really just depressions in the rock... The rock that looks like a skull - could be a dead brain coral - or just a rock. It does look like a skull, but it's really a dead brain coral or a rock.

I wish this was more than an underwater camera and rocks that look like something - meaning - our Girl - Natalee. Ohhh how I wish, but it's not Natalee or anyone else. It's just a pile of rocks captured from an angle that makes it look like something more than it is.

I didn't capture all the shots cause it will just lead to a huge discussion about what everyone sees and there will be sooooo many varying points of what is seen - it just wasn't worth it. I have been here long enough to know what those screen captures would lead to - however, if you want to see a pile of rocks in differing shades, and textures - I'm sure that you can click "save as" and then "monkey" as I did... and you will also see it's a pile of rocks... sooo sorry to say. And especially since the "finger" area looked promising. But it was just depressions in a rock.

Just for the record - I feel confidant in what I saw - and it's not Natalee - nor a body.. but I COULD see how that could be discerned.

Friday, December 15, 2006


Two lawsuits have been filed in the case of a college student who vanished in Aruba nearly two years ago, FOX News has learned.

A wrongful death lawsuit has been filed against brothers Deepak and Satish Kalpoe, two of the young men last seen with Natalee Holloway, the Alabama teenager who disappeared in Aruba in May 2005.

The suit of Beth Twitty and Dave Holloway was filed in Los Angeles Superior Court as a related case to a defamation lawsuit the Kalpoe brothers filed Wednesday against pop psychologist and talk show host Dr. Phil, CBS and Paramount, among others.

"All we want is justice for our daughter," Twitty said in a press release issued about the civil case. "There is no doubt in my mind that Deepak and Satish played a role in my daughter's death and should be held accountable. It's unconscionable that they have not been punished so far."

Allegations against the Kalpoes, who are residents of the Caribbean island where the 18-year-old Holloway was traveling on a class trip when she vanished without a trace, say the brothers caused her death by "intentionally, negligently, wantonly ... unlawfully conducting themselves," bringing about injuries that proved fatal.

The Kalpoes' suit against Dr. Phil, whose real name is Phillip C. McGraw, maintains that an interview filmed with the brothers "was manipulated and later broadcast by the 'Dr. Phil' show as being accurate and which portrays Deepak Kalpoe and Satish Kalpoe 'as engaging in criminal activity against Natalee Holloway and constitutes defamation per se.'"

Holloway was last seen alive with the Kalpoes and a Dutch teen, Joran van der Sloot, in a gray Honda early on the morning of May 30, 2005. The brothers and van der Sloot have all been arrested in connection with her murder the Kalpoes on two different occasions and later released, but none have been brought to trial.

Holloway's body has never been found and the highly publicized case which drew swarms of reporters to Aruba for months during the summer of 2005 has never been solved, despite numerous leads and extensive searches of various corners of the island.

Does the above ruling imply that the disputed segment of the Phil McGraw recording was deceptively manipulated to imply that Deepak Kalpoe confessed to wrongdoing?

The entire transcript is an interesting read.  I concede I had difficulty in comprehending the wording and assistance in interpreting was required.

In the K2 vs Dr. Phil case, there are a couple of Minute Order docs.  I'll be posting as soon as I get them ready.  They will be posted in within the next 30 min.

The first minute order was about all parties missing the 5/6/2010 hearing date.

The second minute order is to explain that the 5/6/2010 date was a clerical error and then it goes on to set the future dates:
