Interesting posts this morning! I thought I'd put my 2 cents in, too.

I don't doubt that Casey's going down. There will be a conviction out of this. I don't think she'll get the death penalty out of it, though, for a couple of reasons.

First, her family doesn't want it, and when sentencing comes, they will be given some consideration. Just as the family of victims of crime can be heard prior to sentencing, so too, can the families of the convicted. In this case, they are one in the same, and the family does not want the death penalty.

Secondly, the prosecuton is not likely to ever know the actual manner of death. To condemn someone to death without that information makes it harder, IMO.

Casey deserves death, but I'm not sure we'll ever see it happen. JMO.
I totally agree with you, and her sex and age is also a factor, I see no way that a jury would go along with the death penalty, the state wants to win this case big time, would not be a good move putting the death penalty back on the table. imo

(just teasin' ya, Dolce. I'm actually making fun of myself..after last month's concussion, every time I spell something correctly or remember stuff, I get all happy...the brain rewiring process is continuing as promised. But, still, if I don't earn 4 points in the rest of this semester's classes, I'm gonna sue the turd who totaled my car!)

Prisoners spend an average of 14 years on Death Row. The rate of execution in Florida fluctuates. Six were put to death in 2000, for example, but only two last year.

Amazing!  While are tax dollars are spent housing and treating these bastards!!

I think that I have just solved our economic crisis...I have a great "Stimulous Package", lets get the show on the road and exicute these Death Row inmates already.  Save tax dollars, give jobs to exicutioners and journalists...heck even the electric company benefits from the additional wattage used to power the injections.

I have a question; I'm not a lawyer, but it seems to me that I recall the process to be that the jury is selected with one of the criteria being that they could convict even in a death penalty case, but if the jury comes back with a conviction, it's up to the judge to determine the sentence and whether to impose death or not. I could be wrong but was wondering if anyone knew for sure? TIA!

I think you are right CBB.  The jury determines the degree of which the person is convicted and the Judge then makes a ruling as to what the sentencing would be, which is sometimes set at later dates.

I could have sworn I read on here, that a jury could come back with a conviction, but say they don't come back for the death penalty, that in Florida the judge can way in on that, and can say the crime that the defendant committed warrants the death penalty. Hopefully someone can set me straight if I'm wrong, and I probably am wrong.

Was thinking about this case a lot on my ride home on Friday...
In the beginning...Biaz..said something alluding to an accidental overdose.  Thinking this may possibly be the defense. 
(Of course if KC overdosed and/or poisioned Caylee it was intentional.)
But in their original court hearing, Biaz, never said anything about a kidnapping...just a possibility of an accidental overdose.
