Superior Offshore is in bankruptcy
BUT Superior Endeavor is currently on its way to Saudi Arubia for a year through a contract

Gulmar Falcon vessel owned by Superior Offshore is also terminated due to Superior Offshore's bankruptcy troubles.

BUT it's continuing to charter the boat for a short term

Gulmar Condor vessel owned by Superior Offshore is chartered until April 2009 and working for BP in Trinidad.

Well, in MY opinion --it goes beyond getting "chumped". I think Kyle knew (and cared about what was going on) until about June '08 when he started looking at Silvetti being his "gravy train". I'm sorry to say that the Persistence crew either got WAAAAY side-tracked or were not genuous from the start.

Wreck ... I agree. I believe that Kyle was troubled by the obvious betrayal by John Silvetti of Natalee Holloway's family.  The ROV images sent to the FBI and ... his connection with the Natalee's Freebirds ... tells me that he wanted the deception exposed.

I believe that John Silvetti, Tim Trahan and Louis Schaefer realized that Kyle Kingsman was a force that had to be reckoned with or there would be legal and professional fallout from the Persistence undertaking.  Incentives involving major network deals and career opportunities was where it was at in the name of appeasement.

It is realized by John Silvetti supporters that Kyle Kingman's words reveal the truth encompassing his betrayal of Natalee Holloway, the family and those who embraced the Persistence undertaking with prayers and financial support.

Kyle Kingman holds the the power ... the Ace card and ... he must be appeased if John Silvetti is to be protected from the legal and professional fallout encompassing so many aspects of the Persistence deception.

If all this Persistence/Kyle conspiracy theory stuff is the real deal, why is the family, the media, etc. not jumping all over it? The more I read all Kyle's "statements" the more he reminds of when my son was 14 and had his own website. I think Kyle the ocean exploring geek has a little make believe world going on, and you're all going along for the ride.

That's what I'm wondering. And looking at the ships and how they are still being utilized.


I get the angle you're working Kermit, and its a good one.  I'm just having a hard time keeping it all straight and putting dates to it.  I figure if I just keep adding it all to the timeline it'll eventually wash out.

We know Mermis was travelling to Venezuela during the Class Action period, which was approx. iirc from the IPO in April 2007 to January 28(?), 2008.  During the planning and first half of the search.
We don't know yet if he was going there before the IPO, but I imagine he may well have been.


It is really hard following all these vessels and it gets into a bit of a quagmire.

And Mermis is involved in the buyback agreement with Legacy.

Mermis resigns from Superior Offshore and plans to join - Kaplan Industry

Mermis said in that Q & A clip that they were setting up the IPO
"as we set up the IPO here, the executive management received restricted stock. That stock vests over a four and a half year period. The first tranche came six months after the IPO,

It's traunch or traunche not tranche.
Meaning a number of stock transaction.

Fleet Update:


The Superior Endeavour, a DP II saturation Dive Support Vessel ("DSV"), returned to service in September 2007 on a saturation diving project in the U.S. Gulf of Mexico and began generating revenues in October. It has committed work through December 2007;
The Gulmar Condor, a DP II saturation DSV, experienced nearly full utilization during the third quarter of 2007 while working in Trinidad. Installation of a saturation diving system and work-class remotely operated vehicle ("ROV") was completed during the quarter. This vessel has a deepwater heave-compensated crane and is currently being bid on projects that capitalize on synergies that will be provided by Ocean Flow in the deepwater market. She will enable Superior Offshore to secure the track record needed before final commissioning of the Superior Achiever;
The Seamec III, a DP II saturation DSV, is on hire in Trinidad and experienced nearly full utilization during the third quarter. The Company is currently marketing her in Trinidad and is seeking opportunities to keep her utilized in the area after completion of the BP project;
The Adams Surveyor, a DP II vessel, is currently providing deepwater ROV services in the U.S. Gulf of Mexico. This vessel experienced strong utilization during the third quarter, and the Company is negotiating for another ROV vessel to be chartered into the fleet;
The Gulmar Falcon, a DP II DSV, returned to service in October 2007 on a saturation diving project in the U.S. Gulf of Mexico and began generating revenues in November. She has committed work in the Gulf for the remainder of this year and will come up for re-charter in April 2008. Assuming utilization of its DP assets remains strong as anticipated, Superior Offshore will negotiate a renewal of her charter;
The Toisa Puma, a DP II vessel, is in drydock and has not generated any revenues to date. Superior Offshore is currently engaged in a dispute with the vessel's owner regarding the vessel's readiness for its intended use;
The Crossmar XIV, an anchored subsea construction barge, is currently on hire in Trinidad and based on weather could see utilization there through the end of this year. The Company is working with its partner, Crossmar, to secure additional work for the vessel, either in Trinidad or the Gulf of Mexico;
The Gulf Diver III, V and VI four-point surface diving vessels continued to experience low utilization and declining dayrates due to decreasing demand in the Gulf of Mexico. Superior Offshore is exploring the possibility of moving some of these vessels to locations outside of the Gulf of Mexico. The Company is currently considering several strategic alternatives for the Gulf Diver IV, including refurbishment or sale;
Construction of the Superior Achiever, a 430-foot DP III vessel, remains on schedule, with delivery expected in the second half of 2008.

In addition, two further pieces of work were needed: connection of the Beachfield Upstream Development (BUD) gas pipeline, operated by Trinidad’s National Gas Company, to bpTT’s greater Cassia central processing hub; and also connection of the new tanker loading oil pipeline, the NOEL (new oil export loading) pipeline, with the Galeota terminal in Southeast Trinidad. BPTT contracted Superior Offshore for the work.

Lifesong ... both Kyle Kingman and Tim Miller became "liabilities" in my opinion ... liabilities who needed to be appease if John Silvetti was going to avoid legal and professional fallouts in regards to the chain of custody of the samples ... the chain of custody that involved only the Arubans ... the enemy.

I am only attempting to comprehend why both these "liabilities" are benefiting from an professional relationship with John Silvetti.  I would assume that their heartfelt concerns in regarding the events encompassing the sample recovery process would dictate otherwise.  I would assume that support for Natalee Holloway and her family would dictate otherwise.

KYLE KINGMAN - IN HIS OWN WORDS

Kyle Kingman:
  On the night of the 30th (I believe this was Tim's last night on the Persistence) I approached Tim and proposed some ideas to him. I suggested that we shouldn't take the Aruban Polis divers at their word and proceed with planning a recovery of the trap. Also, I proposed the trap site may not be pristine or the Polis may have already knew about it. This statement was backed up by several comments we heard, behavior we observed, and other things. Tim told me he thought I was right but didn't know what to do about it.

Kyle Kingman:  After the Dec 30th dive John [Silvetti] didn't want Tim Miller on board the Persistence because he said Tim wasn't necessary any more and was a liability. I don't know what that exactly means, but Tim wasn't hurting anything except releasing the statements to the press and Holloways that we found Natalee.

Kyle Kingman: The most likely to remain at or near it's original location was the skull, which is why I was so convinced the object pictured was a skull.

On Christmas Eve sonar pictures revealed what looked like a large trap, almost exactly where Tim Miller theorized it would be.

And on Dec. 29 the crew dropped a remote operated vehicle, or ROV, into the water to get a closer look.

Tim Miller: It looked like a skull. Still looks like a skull.  ... In my years of searching we have seen several bodies, skeletal remains--I have seen my own daughter's skeletal remains. I can’t help but believe at this moment that that is human remains in that crab trap.

  It's unanimous that Tim M. should never have told Dave and Beth anything about the trap until it's contents were forensically examined.  After the diver visual inspection of the trap he was obligated to report what the Aruban divers reported because although limited, it's the only information he had and the family rightfully wanted answers. It was a royal mess. I took a lot of heat for telling Tim Miller anything about the trap that may have prompted him to making the calls to the family. In my defence, I specifically told Tim not to tell anyone about the trap until the contents are analysed. He couldn't wait. He was very emotional, hopeful, and confident. It was a crushing time for all. Most of all- for Tim Miller, Dave, and Beth. This was Dec 30th

One thing is for certain, Mermis was making big decisions about the company by Nov. 2007.

“During the third quarter of 2007, we realized improved vessel utilization as compared with the first half of the year,” said president and CEO James Mermis in a statement. “All of our dynamically positioned vessels are currently under hire, except for [one], which is in dry dock until early December 2007.”

However, Superior Offshore had to temporarily dry-dock two vessels during the third-quarter, a move which negatively affected its earnings. The company also attributed the profit decline to softening demand for call-out diving services.

Off to world famous Stanley Park for the day.  A visit to The Vancouver Aquarium while we are at the park is where it is at.

It is a beautiful day in the West ... just north of the the American border.
