This link provides the actual exparte motion.

JB only lists 5 points, no case law, no precedences, just good faith.  WTH?
I think there are many many people that believe with good faith that we should be at trial now and this over with.

Hi all monkeys,

No Rose and someone else I missed (sorry!), did you think NG was worth watching tonight, or is it just "second verse, same as the first" at this point? I'm trying to decide whether to watch, clean, read, or etc. I'm finding I'm falling asleep during the show lately.

I hope you're all well.
Same old stuff, I would do something else rather then watch. I fall asleep watching tv everynight, I don't think I have finished any show I have started.

Ha ha (about the falling asleep). I am doing that lately, due to allergies. I may try to watch so I can contribute something tomorrow  , since I haven't had much to say lately.

I am adding reasons why I think JB could be using his exparte to throw Cindy under the bus:

Cindy had been looking after Caylee since she was born
Casey used to drop Caylee of at Cindy's work and lots of people saw
Cindy had been to counselling before when she was thinking of divorcing George
Cindy probably was prescribed Xanax or another anti-anxiety drug during the email scam
Cindy had taken a week off to go on a vacation the week that Casey said she was in Jacksonville
Cindy had access to the home
Cindy had keys to the car
Cindy had a huge fight with Casey and tried to choke her around the same period that Caylee went missing
Cindy has stated that Casey loved that child and would never hurt her
Cindy stated at the memorial she had three children
Last CONFIRMED sighting of Caylee was with Cindy
Cindy stated to officers that she had sent someone into the woods back in Nov.
Casey said to Amy that she will get the house soon, if Mom (and Dad) are in jail her wish comes true
Cindy will take the fall and go down as a Martyr...

So Zanny could be Cindy, Casey could say that she in fact left Caylee with Cindy that mystery week and Cindy was psychotic.

Shirley wondering if Casey hated Cindy more than she loved Caylee....well this may just come to fruition to hit her square between the eyes.

All speculation
Your speculation makes sense to me....almost frightening how this case can change.

Now that I know I am not going crazy, I am going to bed.  It must have been the new IE I just had to install. I will see ya'll in the morning!!!

DOCUMENT DUMP TOMORROW PLEASE!!!
See ya in the AM monkeys.

My son the Network Administrator said DO NOT install IE8 yet...too many problems.

OT - but Klaas, what does your son the Network Administrator say about this malware that is suppose to hit at midnight?  Anyone know if I reset my date if I will be safe - I just can't go cold turkey at midnight.

From what I read today, that won't do any good, because it will just hit you when you start the computer up again. I am hoping MS updates and running protection will do it.  Oh, you might also back up your files. Good luck!

Good faith!!!!! What good faith, the only way he could have got his information is from his client who has never been known to tell the truth under any circumstances. It seems that Bozo doesn't even have enough to throw against the wall here and wants a big fishing expedition to see if he can rake up some muck.

Maybe he wants dig up dates and times so they can concoct a story that fits, whoever gets thrown under the bus will be the one with the weakest alibi. I don't think the defense can do this at least I hope not.

Thanks for posting this link Northern Rose.  Looking forward to seeing this all day.  I thought that Jose would have learned how to file a motion citing law last time he was in court following the SA's example last time they were in court.

I believe that JB wants Ricardo Morales Hard drive and that is what he is trying to get. I think he is gonna pin this on poor Ricardo and that is is "so called" Defense. It will be Casey didn't do it, Ricardo Did. Back in the beginning when they first gave June 9th as the date she disappeared, Casey did so because they stayed all night with Ric that day/night and them saying that date was no accident. When they found proof that she was alive on Fathers Day their plan had to change. If the nursing home video didn't exist, they would have kept on saying June 9th.

I truly believe that this is what we will find out come trial time.
That's another great thought, and yes there is that darn June 9th date, so with that and that win her over with chloroform picture lets pin it on Ricardo.

Yes, Baez made that obvious denoting the "seduce with chloroform" picture....talk about a quantum leap.   Ricardo could care less about Casey, he certainly would not harm Caylee.   If anything he saw her for what she was and dumped her

What does defense attorney Jose Baez know that everyone else doesn't?

Baez seeks a private meeting with the judge to argue a motion. He wants to subpoena records -- without disclosing what they are -- that he sees as crucial to defending Casey Anthony, WESH-Channel 2's Bob Kealing explained. She is charged with the first-degree murder of her daughter, Caylee.

"All along, Jose Baez has said he knows information that will help explain why Casey Anthony didn't report Caylee missing for a month and why Casey didn't kill her daughter," Kealing said.

Baez wouldn't discuss details of his secret strategy when Kealing asked.

Criminal defense attorney Richard Hornbsy, who offers legal analysis for WESH, said Baez's move could be smart. "He sees something that everybody else is missing, and he doesn't want to tip the state off to what it is he is going to raise at trial," Hornsby said.

Or Baez's strategy could backfire if the state figures out what Baez wants, Hornsby said. "In some ways he's raising a big red flag and he's saying, 'Hey, look at me,' " he said.

Baez on Tuesday started the first of 10 depositions by questioning a corrections official, Sgt. Dennis Moonsammy.

The deposition took an hour and 10 minutes, WKMG-Channel 6's Adam Longo said.

Longo explained how Moonsammy has been mentioned in the case: In August, he handed to a captain a letter written by Anthony. In that letter to then-Sheriff Kevin Beary, Anthony sought a meeting with her father.

"Sources tell us that letter is tied to an allegation of police misconduct that Baez made in a motion a while back that relates to a video visitation Casey had with her parents," Longo said.

Moonsammy told Longo he had no idea why Baez wanted to talk to him.

"I didn't do anything wrong," Moonsammy told Longo.

Did Moonsammy see Anthony's reaction when her daughter's remains were found? WFTV-Channel 9's Jeff Deal wanted to no. "No, sir," Moonsammy said.

WESH also reported that Amy Huizenga, Casey Anthony's friend and a key witness for the state, has hired a lawyer and won't give a deposition to Baez this week.

Amy had to hire a lawyer....another person that Casey has infected......Amy has to use her money to hire an attorney simply by knowing this creature Casey....and being a young person, Amy may not have a few thousand dollars just lying around to pay an attorney....If Casey would just come clean on what she did, people would not be going through what they are having to go through because of her..
