I wish Judge Perry had warned the jury of that in Casey Anthony's case.  Thinking back to Jose Baez's opening at trial  regarding the dreamed up scenario of Caylee drowning in the pool.     JMHO

Tori Stafford trial: Rafferty jury enters first full day of deliberations


LONDON, Ont. — The jury deciding whether Michael Rafferty is guilty in the kidnapping, sexual assault and death of eight-year-old Victoria (Tori) Stafford will enter its first full day of deliberations Friday.


The nine women and three men on the panel were sequestered overnight in a local hotel following two hours of deliberations Thursday.


The group will resume these discussions from 9 a.m. to 9 p.m. ET at the London courthouse in hopes of reaching a unanimous verdict.

What the Tori Stafford jury didn’t hear

In the months before Tori Stafford was kidnapped and killed, Michael Rafferty, the man accused of her murder, performed Internet searches for “underage rape”, “real underage rape” and “real underage rape pictures,” according to a computer search conducted by police but never shown to the jury now deliberating in Rafferty’s trial.

Police also found evidence Rafferty possessed or accessed child pornography, had a penchant for violent sex and, days before the blond Stafford was killed, downloaded a Hollywood movie about the kidnapping of a young blond girl.

Christie Blatchford: Rafferty jury doesn't have all the facts
 Much evidence kicked out by judge in pre-trial arguments

In opening remarks on March 5 to jurors in the Michael Rafferty trial, Ontario Superior Court Judge Thomas Heeney was explaining in the weeks to come, they might be asked to leave the room while lawyers argued important legal matters in their absence.

The judge then said something that dozens of his fellows have uttered before him, and with equal unctuousness.

"We are not trying to hide anything from you," he said.

But that simply wasn't the case, and the judge and everyone in the courtroom but the jurors and the public knew it.

After pre-trial arguments held two months before the jurors were even selected, Heeney had kicked out a great swath of powerful evidence of Rafferty's sexual interest in children.

The story behind McClintic's about-face

It took three interviews in the spring of 2009 -- and three hours in the last one -- to get Terri-Lynne McClintic to finger Michael Rafferty for Victoria (Tori) Stafford's murder.

It took less than 10 minutes one day in the winter of 2012 for McClintic to change her mind and say she killed the girl.

Jurors in Rafferty's murder trial have part of, but not all of the strange path McClintic took to the stand as the Crown's key, but perhaps unreliable, witness.

More information, from exhibits admitted during legal arguments while jurors were absent and from police search warrants, can now be published to fill in the gaps.

Breach of accused's charter rights meant Stafford trial didn't hear some evidence

LONDON, Ont. — The jury deciding the fate of a man charged in the brutal rape and murder of Victoria (Tori) Stafford is doing so without knowing that Michael Rafferty was interested in sex with children and that up until the day the little girl was abducted, he had used his laptop to look up several disturbing search terms, including images and videos of underage rape.


Part of this long history included a "substantial" amount of child pornography, including "how-to" videos and slideshows on sexually assaulting children and even a "snuff" film — which depicts an actual murder — that starred a child.


This evidence was just some of the explosive details gathered by the Crown that was excluded from the murder trial due to its highly prejudicial nature and what was ruled as being obtained with the use of an incomplete search warrant.

Rafferty interrogation video released as jury deliberates

The dark world of accused murderer Michael Rafferty came into focus on Thursday, as jurors were tasked with delivering a verdict in the kidnapping, rape and murder of Tori Stafford.

Since the jury was sequestered and began weighing Rafferty's fate, many disturbing details about the investigation into Tori's death were publically revealed for the first time, along with an interrogation video.

Over the course of the trial, what the jury did not hear was that when Rafferty was arrested outside a Woodstock, Ont., health club in May 2009, police seized his car and inside it was his BlackBerry as well as a laptop.

Police eventually got a warrant to search the Honda Civic, but a separate warrant for the electronics was never requested.

What a pity the warrant team did not prepare the warrant properly and the jury did not get to know of Rafferty's interest in child porn/rape. 
Also the Rafferty interrogation videos which the judge ruled prejudicial.

I think it will be of benefit to the defense.  The warrant and ability to introduce his interrogation video as well as all the porn and "how to" stuff would have been a trial changer IMO.

Tori Stafford jury asks judge 4th question

Jurors deliberating the fate of Michael Rafferty, accused of raping and killing Victoria (Tori) Stafford, returned to a London, Ont., courtroom several times Friday to receive further instruction from the judge, as they posed two questions about sexual assault.

The 12-member jury asked Justice Thomas Heeney whether removing a child's underclothing over the course of an unlawful confinement constitutes sexual assault and asked later whether doing so would constitute sexual assault causing bodily harm.

In response to the second question, the judge laid out the three requirements for sexual assault causing bodily harm explaining that it involves an intentional force, which could include removing a child's clothes, the force was of a sexual nature and that it caused bodily harm.

Heeney explained that jurors could find Rafferty guilty of sexual assault if only the first two conditions were met.

Jurors asked the judge four questions since beginning their deliberations Thursday night, including a request to review evidence shown previously in the trial.
