The Court entered a new order today in the State of California v. Melissa Huckaby.  It requires the attorneys to provide 2 days written notice to the Court of all issues they intend to present at any "further arraignments and pretrial hearings" along with any supporting briefs. The order is routine and is merely to allow the Court to plan and be adequately prepared so as to not waste limited judicial resources.

Thank you for the information on the statues and chain of custody for child pornography.  I continue to watch for further arrests in connection with this and the alleged sixty found with it on their computers.

No, don't read that into it Tracygirl.  Any blank CD you can throw in your computer and write files to is a recordable CD (you've probably seen them abbreviated CDR or CD-R (compact disc recordable)).  LE more likely than not found porn he downloaded or traded with others recorded to CDs in his possession.  That's usually the case in cases like this.  I bet he'll try to argue that he didn't possess it because the CDs weren't his. Just another hurdle for LE to jump over, but not a very high one.  He probably doesn't realize that deep within the bowels of his computer is a file or two or three that contains information about every file he ever downloaded, opened, moved, copied, modified, wrote to disc. . . it's all there.

Thanks for explaining. Everyday I am still able to remember how to turn on my computer is a good day! Honestly the information highway escaped me.  But you know this guy lives on his own and unless he rents out storage space to strangers he is going to have a tough time making the suggestion it is not his.

I agree - I think her attorney would be remiss if he did not at least make the request. I think it is the only defense that will make any difference in mitigating her sentence.

Wyks and Jess ...appreciated both of your posts, as well as all our Monkeys.

In following your 'chain of command' on the porn issue...I felt dizzy at the 'red tape' spinning round and round.  As for what Wyks posted about how investigations get negated and the abuse goes on and on.  OMG

Reminds of my 'work experience'.  I worked for individually owned companies for many years before I went to work for an international corporation w/over 300,000 emp.

When I worked for the local companies, and my boss walked in and said 'We are now going to start our day by entering our chairs from the right'...we immediately followed that order from that day forward.  So, when I worked for the int. corp. and was given a directive ...I immediately complied.  Well, two days later, another memo would come out stating ...we have rethought that and will now do it a different way.  After a couple of months, I learned to wait a couple of days, if not a week before I tried to redo whatever it was.  Can you say RED TAPE or TOO MANY CHIEFS?

My point is, and I do have one, is that the Marshall's are also in on this child porn RED TAPE investigation.  Remember they they put out the pictures of 3 men and wanted help from the public to identify that were shown on video having sex w/children?  Then we had a poster from Australia that her husband works on US cases (and we are guessing international porn/child trafficking).  Wow....mind blowing at all of the layers and layers. 

I live in NO and our cops can't stop the gang murders, much less have an internet porn investigation.  However, a small suburb around here does have such a department (they have lots of money because when they passed a law to allow a casino the people voted that all of the money would be dedicated to the police dept.  Think they get like $3.00 per person every time they enter the casino)

OK..let's be honest...most local police dept's can't afford the equipment, nor the manpower to be effective.  The Feds formed the office of Homeland Security to try to cut down on the RED TAPE.  I think it is time to form a CHILD PORN/MISSING CHILD/CHILD TRAFFICING TASK FORCE.  This can be streamlined, added to, defined in many directions.  All I know is that I a sick and damned tired of defenseless children having their innocence taken away, damaged & scarred for life, murdered, exploited, and so on.

I would like to see FEDERAL MANDATED SENTENCES set down for child porn (whether across the street or across the pond), molestation, exploitation, murder, etc.  When it involves a child..it would be taken away from the state's optional sentencing.  Not out of the state's courts....but no optional sentencing.  (One case in particular that I remember NG going off on was a judge that didn't send a child molester who's victim was under 12, and was molested for yrs., to jail because he was so small and said that the other prisoners would take advantage of him) IT WAS A FEMALE JUDGE!!!!!!!!!!!

There should be say a 2/3 man task force (there should be many of these task forces ...say 100) ready to move into any town that comes across say child porn or that the task force would uncover during their investigations. 

One would be a computer geek and the others would head up the investigation and the local police/sheriff would offer support and the arrests. 

The reason why you need a Federal Task Force for this as it would automatically lead across state lines and you could use the same agency/resources/investigations to follow the trail, not just worry about your jurisdiction. 

Jess....think in these terms too...  They came up w/RICO in order to knock down the Mafia.  Maybe we can plant a seed to encompass these sicko's.  In other words, we can think outside the box and cut some of this damn red tape.  Our children are worth it.

So sorry for this very long post.  Am so sleepy, I hope it makes sense, but after reading back, there was no way that I could sleep with all of this running around my head.  Thanks for everyones insight into this serious problem.

There are a host of laws on the federal level that are incredibly strict and impose very harsh sentences for those who commit crimes against children.  The Child Pornography Prevention Act is one such law that made it easier to prosecute and convict those who peddle in child porn.  That is, until the Supreme Court essentially gutted it in 2002 by holding that, to the extent the Act applied to "virtual" porn, i.e., porn that may involve virtual as opposed to real children, it's an unconstitutional infringement on free speech.  Yeah, that's right--free speech.  You can thank the Free Speech Coalition for that ruling.  It is now very difficult and expensive to prosecute suspects under the Act because it gives them a defense, and because today's technology makes it difficult to determine whether the porn involved a real child.  And rather than it being an affirmative defense where the accused must prove the porn did not involve a real child, the burden belongs to the government to prove that a REAL child is depicted in the photo or video or what have you.  While that may sound easy, with today's technology, that isn't so.  In fact, it's ridiculously time consuming and expensive.  How ridiculous the ruling.

There are also numerous federal agencies involved, such as the FBI, the Secret Service, the Postal Inspection Service, the U.S. Customs Service, the Department of Justice, and the NCEMC.  The problem is that they are greatly underfunded given the breadth of this crime.  For example, in 2002 (the latest numbers I could find), the FBI was allotted a mere $38 million toward combating child exploitation (which includes all crimes against children).  Customs (which is really geared toward the international component) was allotted about $15 million.  The remaining agencies were allotted something in the neighborhood of $10 million combined.  In comparison, during the same time period our country spent upwards of $20 BILLION fighting the "war on drugs." Did your jaw hit the floor?  Mine did. . .  So we spend $50 million a year to combat a criminal enterprise that preys on our most vulnerable, helpless, and precious little children and which, by some estimates, is a $2 billion a year industry.  To put it in perspective, remember the Texas couple that was busted a few years ago for providing credit card web service for access to child porn web servers located in Russia and, I believe, Indonesia?  Do you know that, in one months time, they grossed over $1.5 million in "sales?"  I wish we were allowed to swear in this forum, because I'd be expressing myself quite colorfully right now.

"Task forces" of the type you suggest actually exist already.  There's an arm of the FBI in its Crimes Against Children Unit that is supposed to do exactly what you suggest.  In fact, it's the arm that swept in to Tracy when Sandra went missing, probably triggered by the extent of the known child porn presence there.  Again, their effectiveness is limited by resources and funding. 

There is a fairly interesting report authored by the GAO (the investigatory arm of Congress) called "Combating Child Pornography: Federal Agencies Coordinate Law Enforcement Efforts, but an Opportunity Exists for Further Enhancement."  There is also a follow up report that specifically deals with the problem of peer-to-peer file sharing.  I recommend that anyone interested in the subject read them.  You can find them at www.gao.gov.  The studies provide a high-level glimpse into the federal efforts at combatting the problem.  The theme I believe you'll take away from the studies is that the tools exist--but resources and funding do not.  In fact, the studies come right out and say, because of funding limitations, most cases that are "small potatoes" as the feds choose to define that term are relegated to state and local authorities to investigate and prosecute.  Because the crime is getting more sophisticated, and because of case law such as the ruling on "virtual" porn I discussed above, it is getting more and more expensive to investigate and prosecute, which means the feds hold on to less and less cases so that they can concentrate their efforts on the largest and most sophisticated networks.  That means more and more of these crimes go unpunished.

In short, after all this rambling, it appears that it all boils down to the almighty dollar.  So let me ask this question to the group.  If the government was to propose raising income taxes some fraction of a percent, say .25%, and allocated that money to the war against child offenders, would you vote for it?  That would mean an extra $125 a year in taxes for a couple making $50,000 a year.  Combined, it would generate revenue equal to what this country spends a year on national defense.

Thank you very, very much for your kind comments.  As to your question, "How do we get the ball moving," I am working VERY hard on that.  I just ask for everyone's patience.  I will be sharing my thoughts will all of you once I get it all together.  It will take time.  We can then put our collective minds together and form a unified front.  As a country, we've been successful at effecting change in some very difficult areas.  Difficult change ALWAYS starts with a grassroots movement.  And when that movement gains momentum, it is impossible to stop.

While all children are my inspiration and motivation to do this, this one pushed me over the edge.  I just can't take sitting idly by and doing nothing anymore.

I snipped a little. . . I'll get you a copy of the Act and the Supreme Court ruling and post it. 

On the "virtual" question you pose (whether you have to produce the child), the answer is almost.  What they've been trying to do is match up the allegedly "virtual" photos with "historic" photos of the same child and prove it that way.  That way they can say, in essence, the "virtual" child is the same child as in this picture, and this picture is a real child.  Time consuming, cumbersome, expensive and, in my view, unncessary.

On the GAO report, don't hold your breath.  Basically what they recommend is information sharing between two agencies that don't yet share everything.  Big deal.

Your comments on the drug war are right on.  But it's not too late.  It's never too late.

Good afternoon Monkeys & hope everyone is enjoying their day.  I just got caught up with the posts and have to thank you all for your passion for Sandra and for all the great information you have brought forward.  Even with the gag order in place, you have been outstanding.  Thank you.  Since it is quiet here today, I would like to share a tribute to Sandra that I found on youtube:


Thanks for posting this.  It was beautiful.  That darn surveillance video makes me cry every time.  I wish we had the power to turn back time.

Thanks so much for your most informative post.  I see that someone/some org/some agencies have attempted to get these things done.  I understand that we/our cause doesn't have the backing of some drug/tobacco/alcohol/porn mag/whatever money laden greedy industry lobbyist.  However, internet users can be united IN HUGE NUMBERS I believe in order to rev up the noise and media to accomplish these measures.

Thanks again for that link...hope that I can 'understand' what they are saying...you speak in plain enough English and make it so comprehendable for the lay person.

It is my personal goal, and hopefully OUR mission, to change this.  In my opinion, the reason your statement is true is because, unlike drugs, this crime is suppressed.  No one in power wants to publicly acknowledge it or its pervasiveness. I don't know why.  We need to bring it to the forefront, and frame the issue in such a way that everyone is forced to take notice, especially those in power.  In the United States, that means two groups:  (a) the government and, perhaps more importantly, (b) the media.  The media can be our greatest ally here.

I will be posting those materials shortly.  Once you've read them, if you have any questions, feel free to ask them.  If I can answer them or add insights, I will.
