This could be a mistake...
But that's a pretty darn lame mistake on the part of that journalist, if that's the case....

Prosecutor Tom Testa is asking the judge to enter a plea even if Melissa Huckaby refuses to do so, and also wants to set a preliminary hearing date -- eliminating the need for a grand jury.

Former defense attorney and current Humphreys College law professor John Schick said a grand jury could mean lengthy legal challenges. However, Schick doesn't think Melissa Huckaby is a candidate for the death penalty.

"She doesn't have prior convictions, never been involved in crimes of violence, those are the kinds of things that in my experience have been in a person's background," Schick said.

Most legal experts who talked to KCRA 3 also think that the case will be moved out of San Joaquin County because of pretrial publicity.

Where do they think they can go to get away from the publicity ?  Oregon ?

I agree Sacsayhuan.  With the gag order in place, it is very quiet.  I don't think there has been very much "pretrial publicity" compared to other cases.  (But that's JMO)

Notice the wording........
It is common knowledge that Judy Lawless and Johnny Huckaby are embroiled in a bitter custody battle.  So why as a journalist, would you ask, is this "Cameron's" father??? We already KNOW he is Madison's father!!!!

STOCKTON, CA -- The former Sunday school teacher charged with the murder of an 8-year-old Tracy girl pleaded not guilty to the charges against her.

Melissa Huckaby also denied the enchancements in this case.

This was Huckaby's fourth court appearance on murder, rape and kidnapping charges in the death of Sandra Cantu, whose body was stuffed into a suitcase and dumped in a canal.

A preliminary court date has been set for September 24, 2009.

STOCKTON -- The Sunday school teacher accused of kidnapping, raping and killing an eight-year-old Northern California girl has pleaded not guilty to murder charges.

During a 10-minute hearing Friday, the lawyer for 28-year-old Melissa Huckaby entered the plea on her behalf.

Authorities say Huckaby killed Sandra Cantu, who was a playmate of Huckaby's daughter. The girl's body was later found stuffed in a suitcase in a nearby irrigation pond.

Friday's plea comes after increased pressure by prosecutors to have Huckaby enter a plea. Her lawyer, Sam Behar, has repeatedly requested more time to review evidence in the case.

If convicted, Huckaby could face the death penalty.

The judge scheduled her preliminary hearing to start Sept. 24.
