Huckaby’s Not Guilty Plea Could Lead to Lengthy Preliminary Hearing

STOCKTON, Calif. (KCBS)-- The not guilty plea by the Tracy woman accused of murdering Sandra Cantu has set the stage for what could be a lengthy preliminary hearing.

Prosecutors say the hearing for 28-year-old Melissa Huckaby will last six days, but Bay Area Attorney Steven Clark says that is “a conservative estimate” and that it will likely last must longer because of the special circumstances surrounding the sexual assault and the two new charges filed last month. In May, prosecutors filed new complaints against the former Sunday School teacher for allegedly poisoning a seven-year-old girl in January and an adult man in March.

I missed somewhere that she poisoned and adult male?  Who is that man?  I assume when they talk of poisoning the 7 year old, that is with drugs??    Was that the other child that lived in the trailer park?   sorry, I have been missing in action, and lost track of information.  thanks.

My brain is going  I am trying to answer your question however it is not making sense, lol. MH was dating some man and he ended up drugged and was arrested for being under the influence. I cannot remember how they linked MH to the drugging but they did and she was charged.

Last night, I went to sleep thinking, the reason for so many crimes against children are taking place is because parent's are unable to care for them - so get rid of them.  I feel the same today.  We are in the U.S.!

You are going to love this.  Good old Dr. Cyril Wecht who did the autopsy on Sandra -

It's in Globe - please do not buy this tabloid - I just have to have it incase someone pushes me.

“Famed forensic pathologist Dr. Cyril Wecht, author of a Question of Murder, notes the scene of the crime would lead people to believe that Carradine, known to enjoy kinky sex, was practicing “erotic asphyxiation.”

I just read my own post - it sounds like I am implicating the parents - I am not and I do not think they know anything - I am just saying we have a big problem.

Sacsayhuan~  have you been to the "Crimes Against Children" area at Scared Monkeys?

http://scaredmonkeys.net/index.php?board=9.0

The number of children that are scalded, starved, beaten, abused, sometimes killed by their own families is staggering.  And the cases here at SM are only a few, that we have time to be able to post.  I know some days I have to step away from that area because it is so sad.  And what is really sad are children are being abused at the hands of those that should love them and sometimes it's never brought to light.  There are children that are missing and not even reported for months or years.  There are cases in our missing persons threads of children that are gone, and I suspect some of them were murdered by their own families.

Unfortunately, MuffyBee is right.  Crimes against children are much more prevalent than people think.  In fact, I just read a news article from Warren, Michigan yesterday where a grandmother choked to death her 4 year old granddaughter.

http://www.chicagotribune.com/news/chi-ap-mi-granddaughterslai,0,4380844.story

That's why I am lobbying hard here for us to put together a grass roots movement for change.  Funding this isn't a political issue.  It doesn't matter which side of the political spectrum you're on.  It's merely a matter of persistence, dedication, and the willingness to fight for what's undeniably right-the protection of our kids.  The crime will never be stopped, but a dedicated program can put a big dent in it.

It's a shame that the FBI is given a mere $30 million a year to battle child exploitation crimes when this country squanders away billions upon billions of dollars a year.

Inspiring post Jess!

Did I phrase that question a little disjointedly?  Thanks for the answer though.  Was she dumping ecstasy on him?  This is just more and more bizarre.

Good afternoon everyone. Just jumped on real quickly to correct a misstatement in one of tha above posts. Cyril Wecht did not conduct the Sandra's autopsy. So don't worry about what some may think is an odd COD in the Carradine case. I'm working mobilly right now, so I can't pull up the doctor's name that performed the autopsy, but he is a very well-respected pathologist, and the current ME for Joaquin County. He practiced under Wecht for many years. I know Cyril Wecht fairly we'll. Once you get passed his ego, he's likely one the finest MEs in the world. With that said, I wouldn't laugh at his prelim COD for Carradine. Believe it or not, despite how weird it sounds, erotic asphyxiation occurs more often than one might think. There have been several deaths associated with it in recent years. Let me know if you want me to go into the details. It's probably OT here though.

Here's the story on the ME for Sandra Cantu's autopsy

Defense Attacks Credibility of Pathologist in Sandra Cantu Case
Created by Administrator Account on 4/23/2009 5:24:39 PM

SAN FRANCISCO (AP) - Though Melissa Huckaby's attorneys plan to withdraw their motion to exhume Sandra Cantu's body, the prosecution and defense remain on a collision course over the forensic evidence from her autopsy.

The defense is attacking the credibility of the pathologist whose findings will be used to support charges that Melissa Huckaby raped the 8-year-old--an allegation that could bring the death penalty if the one-time Sunday school aide is convicted. Huckaby is scheduled to make her second court appearance Friday.

At the center of the conflict is San Joaquin County's chief medical examiner, Dr. Bennet Omalu, who has been in the spotlight before.

The 40-year-old neuropathologist gained national media attention for his research on the damaged brains of dead NFL players.

He is also a government witness in a federal corruption case against his former boss, celebrity pathologist Dr. Cyril Wecht, who has earned millions of dollars investigating high-profile deaths, including those of Elvis Presley and JonBenet Ramsey.

In a phone interview with The Associated Press before a judge issued a gag order in the case, Public Defender Peter Fox questioned Omalu's objectivity.

Several attorneys in his office have complained that Omalu's opinions in other homicide cases they were defending were biased toward the prosecution, said Fox, who declined to detail specific cases where defense attorneys have questioned Omalu's work.

Omalu could not comment on Fox's claims because of the gag order, according to a San Joaquin County Sheriff's spokesman.

You know, when it first broke that MH was being charged with this crime, many people in the community voiced disbelief that a woman--and more importantly a mother of a small child--could commit such a heinous act.  Well, take a look at this piece of trash, take a step back, and thank God that these children were saved:

Maine Mom Nabbed in International Child Porn Sting
Monday , June 15, 2009

By Joshua Rhett Miller

A mother of four young children in Maine was charged Monday with gross sexual assault after British investigators more than 3,000 miles away used the Internet to allegedly catch her in the act of Webcasting a sexual assault of her young child.

Julie M. Carr, 30, of Mars Hill, Maine, was arrested at about 11 p.m. Friday. Her four children — believed to range from 18 months to 5 years old — were taken into protective custody.

The Child Exploitation Investigation Team of England's West Midlands Police said their unit received information late Thursday that a local man was using the Internet to show inappropriate material of children. An unidentified 18-year-old man was later arrested in Walsall, England.

A day later, on Friday, additional information was obtained by investigators, prompting the West Midland Police to contact officials at the Child Exploitation Online Protection and the U.S. Embassy.

"Our officers worked through the night on Thursday and Friday to ensure the identification and safety of these children across the other side of the world," West Midlands Police Detective Chief Inspector Dave McCrone said in a statement obtained by FOXNews.com. "Many people use the Internet safely and securely; however, there are a small minority who choose to use it to commit criminality."

"We work to make people safer, sooner. The very same technology used to commit the crime enables us to work quickly to protect those who may be vulnerable."

Carr, who is being held on $50,000 bail on charges of gross sexual assault and felony exploitation of a child, was arraigned by videoconference before a judge on Monday. She did not enter a plea, Maine State Police Det. Sgt. John Cote told FOXNews.com.

Cote declined to identify the victim seen during the assault but said one recording was taken as recently as Wednesday.

"That's kind of what facilitated us acting quickly on this information as we received it," he told FOXNews.com.

Cote said it was impossible to immediately determine how many individuals viewed the material allegedly posted by Carr. He declined to discuss statements Carr may have given to investigators, but said "this type of crime" is increasingly common.

"It's just continuing a trend that we're seeing — an increase in this type of crime," he said. "But as technology gets better, more units are dedicating more agents to this type of crime and are just getting better at it. It lends itself really to the prevelance of computers in our society."

Cote, in a release issued on Saturday, said investigators were able to confirm that the woman seen in the video was Carr, and a search warrant was then secured for her home.

Attorney Jeffrey Pickering, who represented Carr during Monday's arraignment, could not immediately be reached for comment. If convicted, Carr faces up to 20 years in prison for each charge.

What a great example of International Teamwork.  These LE groups deserve the greatest of commendations.

Here's a picture of this piece of trash so we can memorialize it here forever:

JessStar, thank God the detectives worked so tirelessly.  But only $50,000 bond.  Now that is something we citizens should be up in arms about as well.  For a mere $5,000 she gets to walk the streets.  This is wrong!!!!

You are RIGHT, Sister!!!!
$50,000???  WTH?!?!
This article literally TURNED my stomach!!!  Thank GOD these babies were rescued!!!  She looks like she is quite possibly a meth head.

Crystal Meth is a different drug than the other narcotics ( heroin, cocaine, crack, etc..)...
Prior to meth, only 1 in 3 drug abusers was a woman and getting their children back was intense motivation for them to stop using.

But meth....
The ratio of users is 50-50 and in my county here in California - 50% of children in Foster Care are there for meth related reasons.  The rate of relapse is HUGE and the CHILDREN are paying the price!!!!!

Sorry if this is Off Topic...
But I have wondered actually if MH ever dabbled???
Some of those Guys in the MBP look like possible meth users....

You're reaction to the bond was the same as mine.  Unbelievable.  When are these judges going to learn.   In my mind, there should be no bond for those who commit crimes against children.  Alternatively, there should be no bond in those cases where the evidence to support the charge is so clear.  Here, this POS is on video tape--there's no question it's her--there's no question she's guilty.  It's not a question of "innocent until proven guilty" (which is the very premise for having a bond.)  So she should be locked up.  Period.  End of story.  The judge may look at this as "an incident" of abuse, but the fact is, this child is going to be repeatedly abused and exploited as long as there's an internet.  The image and "tape" memorialize the abuse forever.

But I supposed I'm somewhat consoled by the fact that James Easter couldn't even come up with the $250 he needed to be released in Nevaeh's case.  So I doubt this dirt bag is going anywhere soon.  At least I hope not. She doesn't look like the kind that has 5 grand sitting around (assuming the bond is a 10% bond and not a straight cash bond).

Thanks Jess Star for the forensic info.  I'm thinking how do these people who produce Child Porn get paid ?  How do the watchers find the web sites ?  I don't think one could google Child Porn and come up with a list of web sites.  There must be a word of mouth communication.  Who would get off watching child porn anyway ?  Sick.

This is sooo sad, not only the children being hurt and exploited, but the innocent children playing on line who accidentally stummble upon these same findings, all while being totally innocent! i know monitoring them online and not allowing them on there with out adult supervision will help, but regardless it happens! soo very sad and sick the world has become
