Lawyer hedges bets on South Florida wildcard juries

The immortal words of Florence Orbach remain a siren song for upstate defense lawyers who fear their locals lean toward the prosecution.

They know that a change of venue to South Florida could come with a jury pool stocked with the likes of Orbach, the 78-year-old questioned as a prospective juror in Palm Beach County during the sensational trial of William Kennedy Smith.

Asked about the rape charge against Smith, she responded, ``Who cares who diddled who?''

It's no surprise that Casey Anthony's lawyer, arguing that the deck is stacked against his notoriety-drenched client in Orlando, not only requested a change of venue, but a change to a particular venue.

José Baez, a one-time intern with the Miami-Dade Public Defender's Office, wants Anthony's murder trial moved to South Florida, the land of wildcard juries.

JURY TROUBLE

The lawyer's request comes, perhaps not coincidentally, as jury deliberations in the third trial of the Liberty City Six seemed to be foundering yet again, forcing the judge to dismiss a troublesome juror, install an alternate and send the reconstituted panel back to the jury room.

Two previous trials of the hapless gang of would-be terrorists ended with hung juries.

Baez, you might have noticed, didn't request a trial in Jacksonville or Ocala or Tampa or some other town where juries aren't known for veering into the Twilight Zone.

In 1992, it was a Miami jury that watched a videotape of grinning Circuit Judge Phillip Davis taking stacks of cash in the back seat of a car from a government informant, counting out $20,000 and saying, ''beautiful.'' Yet the judge was acquitted. Jurors later explained to The Miami Herald that a single, insistent, overbearing juror had worn the others down.

UNREASONABLE DOUBT

South Florida jurors often turn downright obdurate, devouring an insignificant question like a feast of reasonable doubt.

Which might explain why it took five trials over six years before a jury finally convicted Alan Ruff of Coconut Creek for the 2001 murder of his ex-girl friend. The fourth trial had ended with a single, stubborn, vintage South Florida juror holding out for acquittal.

In a 1996 case, a Miami jury heard testimony from a judge, a bailiff, police and correctional officers that Charles Edward Robinson punched a prosecutor. It wasn't enough. The jury deadlocked.

After a federal corruption conviction of Hialeah's then Mayor Raul Martinez was tossed on appeal, two subsequent trials ended in hung juries, the last in 1996. The feds, coming to terms with South Florida, gave up.

Last August, Miami-Dade jurors heard gripping testimony from songwriter Estefano describing how his former handyman had barged into his Miami mansion and shot him in the chest and head.

Estefano offered the ultimate eye-witness testimony. But jurors, CSI fans apparently, decided to acquit, later citing a lack of DNA evidence. After the shocking only-in-Miami verdict, defense attorney Jeffrey Fink, indulging in considerable understatement, told The Herald's David Ovalle: ``Jurors do seem a bit different from jurisdiction to jurisdiction.''

Casey Anthony, accused in the death of her own two-year-old child, painted as a baby-killing villain on cable TV's nightly foray into sensationalism, sorely needs a venue where jurors ''seem a bit different.'' Her lawyer knows just the place.

Okay, I just emailed my first set of questions to Larry King:

Early on, when Caylee was still missing, George Anthony stated that the "kidnappers" were being watched. 

My questions are:
Who were these people being watched?
Who was watching them?
Did you give any of this information to Law Enforcement or FBI?

a little weird
