The prosecution refused to act on a recommendation by Dr. Dan via Peterson Attorney Joel Brodsky that Stacy be granted immunity in writing allowing her to cooperate if she were able. The prosecution denied the request. The case was initially ruled an accident by the County coroner and a grand jury. An exhumation and autopsy by even OJ Simpson case coroner Michael Baden has challenged the accidental death ruling and believes it to have been a homicide.

Will County State’s Attorney James Glasgow’s quest to have hearsay statements used during Drew Peterson’s murder trial continues as the prosecutor filed an appeal with the Illinois State Supreme Court today.

The move -- which could further delay the high-profile case – comes about a month after an appellate court ruled that Glasgow missed the 30-day appeal deadline when he sought to overturn a trial court's decision barring 8 of 14 hearsay statements.

Glasgow largely built his case around pathology reports and the 14 hearsay statements that he says would allow Savio and Stacy Peterson to speak from the grave. He even pushed for a new statute -- dubbed Drew's Law -- to allow secondhand testimony.

Though White found the preponderance of evidence showed Peterson's wrongdoing, he still barred the majority of hearsay witnesses because they did "not provide sufficient safeguards of reliability."

CHICAGO (AP) — Drew Peterson's attorneys are asking the Illinois Supreme Court to release the former Bolingbrook police sergeant from jail because prosecutors' appeal to the same court has delayed his murder trial.

Peterson attorney Joel Brodsky says he sent the appeal by FedEx on Monday. It comes days after Will County prosecutors appealed an appellate court ruling that prevents them from using several hearsay statements Peterson's ex-wife Kathleen Savio allegedly made before her body was found in her bathtub in 2004.

Peterson’s lawyers, in a motion filed with the Illinois Supreme Court on Tuesday, argue that their client should be freed altogether while awaiting trial, and we’re sympathetic to that view. Much of the evidence presented at a hearing 14 months ago that resulted in Peterson’s continued jailing was of the hearsay variety — what one person allegedly said to another person — and, as we have argued before, we doubt the constitutionality of such evidence.

But the state Supreme Court may well view the matter differently and allow such evidence — precisely what prosecutors have asked the court to do this fall — and that makes Peterson a legitimate flight risk if he is not grounded by at least a monitoring bracelet. A bright guy, he might reasonably calculate that his odds of winning at trial are grim if the hearsay evidence is allowed.

Murder suspect Drew Peterson will remain behind bars while the Illinois Supreme Court weighs a critical appeal from Will County prosecutors.

The court late Monday refused to order his release from the Will County Jail, where he has been detained on $20 million bond since his May 2009 arrest on charges he drowned his third wife, Kathleen Savio.

But the ruling left Peterson’s attorneys “hopeful” the high court will not hear the appeal from prosecutors, which could clear the way for Peterson to stand trial in the next few months.

“We’re obviously disappointed that Mr. Peterson won’t be released but we’re also hopeful that this is an indication that the Supreme Court is not going to hear the state’s appeal,” defense attorney Joel Brodsky said.

Attorneys for the 57-year-old former Bolingbrook cop sought his release after Will County prosecutors in August asked the Supreme Court to consider whether so-called hearsay evidence can be used when Peterson is tried for Savio’s 2004 drowning death. Peterson also remains a suspect in the still-unsolved disappearance of his fourth wife, Stacy.

CHICAGO (CN) - In a sharply worded opinion, the 7th Circuit ordered prominent Illinois attorney Walter Maksym to show cause why he should not be removed from the court's bar, calling his filings in a 2007 civil case "unintelligible" and "riddled with errors."
   
Maksym has been a dominant presence in the news this summer as he represents Drew Peterson against charges he murdered his third wife, Kathleen Savio. Peterson, a former Bolingbrook police sergeant, has been in jail since 2009 without trial on suspicion of murdering his fourth wife, Stacy Peterson.
     
Monday, the state Supreme Court rejected Maksym's claims that the long wait violates Peterson's right to a speedy trial. Maksym also threatened to sue Lifetime cable network over plans to produce a film about the case, with Rob Lowe starring as Peterson.
   
But the federal appeals court rebuked Maksym for his handling of a different case.

The court ordered a copy of its order forwarded to the Illinois Attorney Registration and Disciplinary Commission.
     
Maksym told the Chicago Tribune that he was undergoing treatment for cancer at the time of the filing.

The article below states that his wife is a federal agent with the inspector general's office for the U.S. Housing Department.  It seems that the marriage didn't last long; they got married in 2007.

This is not the first time Drew Peterson's police officer son has been in trouble. Stephen Peterson has been suspended on at least five occasions in his short career. His resume of punishment includes a suspension in April, 2008 for violating Oak Brook Police Dept. rules. He wore his police uniform and used a village squad car to drive to Joliet for his appearance in front of a Will County grand jury that was investigating his father.

That suspension followed an I-Team report in Dec. 2007 that Illinois state investigators had subpoenaed the personnel files of three men with connections to the village of Oakbrook Police Department. Among them was Steve Peterson.State authorities removed Steve Peterson's police personnel file and other records of his patrol activities during key period of his step-mothers' disappearances. In 2007 the I-Team was by investigators that state police seized the Oakbrook department personnel files of two of Peterson's closest friends on the force. One had resigned while under investigation for professional misconduct. The other was terminated for lying and unauthorized access of criminal files.

Those who know Drew and Steve Peterson say the men are more like best friends than father and son. Drew was Steve's best man at his wedding in 2007. Stephen Peterson's wife Teresa is a federal agent with the inspector general's office for the U.S. Housing Department

The whole point of his termination was that he was a constant problem child and like his Dad Drew couldn't follow orders ..and neither could his two best buddies on the force..who are also gone.

Plain and simple both Steve and Drew knew that Steve taking and concealing his father's firearms during the disappearance of his stepmom was against the law..they were both cops..they knew what they were doing was wrong..and Drew thought everyone would look the other way.  Drew was a dirty cop and his son was too..they both thought they were above the laws they were entrusted to enforce.

She can say whatever she wants about the chief ..his cooperation or lack of cooperation have nothing to do with taking and concealing firearms during a LE investigation...case closed.

The Illinois Supreme Court ordered a lower court to reconsider whether eight hearsay statements should be allowed in Drew Peterson’s murder case -- a move that offers prosecutors hope and keeps the much-delayed trial on hold for at least several more months.

Peterson, 57, is charged with the 2004 drowning death of his third wife, Kathleen Savio. Her death was initially labeled an accidental drowning, but the case was reopened after Peterson’s fourth wife Stacy disappeared in 2007.

The former Bolingbrook police sergeant is the sole suspect in Stacy’s disappearance, but he has denied wrongdoing in both cases.

Just before Peterson’s trial was to begin in July of 2010, Will County prosecutors appealed a judge’s ruling that barred eight of 14 hearsay statements from being heard by jurors. Prosecutors say the statements help tell Savio’s story.

In July, the Third District Appellate Court dismissed the appeal as untimely, saying that Will County prosecutors had missed a 30-day deadline to appeal.

But the high court ordered the justices to consider merits, not the timeliness, of the case. The appellate court will now decide whether the judge properly barred eight statements because he believe they did "not provide sufficient safeguards of reliability."

"The appellate court is directed to address the appeal on the merits," the Supreme Court stated in a ruling released this morning.

Will County State’s Attorney James Glasgow released a statement saying he was "extraordinarily pleased" by the decision.

An Illinois Supreme Court ruling on disputed hearsay evidence is more likely to help prosecutors than aid ex-cop Drew Peterson when his murder trial begins, legal experts said Wednesday.

The high court ordered an appellate court to take another look at allowing more of the secondhand evidence to be presented when the former Bolingbrook police officer stands trial for the 2004 drowning death of third wife Kathleen Savio.

The Supreme Court already has ruled such evidence can be admitted even if its reliability is uncertain — so the decision sending the issue back to an appellate court is probably not good news for Peterson and his defense team, experts said.

“I’d be optimistic if I were a prosecutor on this case,” said Richard Kling, a professor at Chicago Kent College of Law.

Will County State’s Attorney James Glasgow seemed to share that sentiment in a statement he released after the high court ruling..

“I am extraordinarily pleased by Wednesday’s Illinois Supreme Court order,” said Glasgow, who has contended hearsay evidence is critical in proving Peterson drowned Savio in her bathtub.

Drew Peterson Lifetime Movie to be Aired in January
Hollywood star Rob Lowe will play the accused wife-killer.

The Drew Peterson Story, Lifetime's made-for-TV movie based on the Drew Peterson saga, will air in January, said Joseph Hosey, author of the nonfiction book Fatal Vows: The Tragic Wives of Drew Peterson, which the book is based off of.

Hosey, who is also editor of Shorewood Patch, said the airing date is set for Jan. 21.

The movie has been in the works for nearly a year. In June, it was reported Rob Lowe signed on to play the former ex-Bolingbrook cop Peterson.

The film will explore the two cases in which one of Peterson's wives was killed and another mysteriously disappeared and also features Kaley Cuoco, who stars the Big Bang Theory, as Stacy Peterson.

Drew Peterson wants an apology from the Illinois State Police because he says they wrongly casted suspicion on him after his fourth wife disappeared.

Peterson believes Stacy is alive and said in a statement Tuesday he wants an apology after another woman, Judith Bello, was discovered alive in California after disappearing 18 years ago.

Bello was reported missing in 1993 after she failed to pick up her 3-year-old at daycare after work, the statement points out. Police found her car abandoned the same day. Her husband was targeted as a suspect, according to the statement, because of their marital difficulties.

“There is a huge cloud of suspicion cast over Drew Peterson because of the Illinois State Police’s statement that Stacy Peterson is presumed dead; however there is absolutely no evidence to support that statement,” said Drew Peterson's attorney Joel Brodsky. “They made it seem like no woman, no mother, would ever just disappear, but as this most recent case shows, it does happen. In fact it happens more often than you would think”

Brodsky said in the statement Stacy Peterson's mother disappeared when her kids were young. “In Stacy’s mind disappearing may be ‘normal,’” Brodsky said.
