Judge Edward Burmila hailed as a legal scholar skilled at handling difficulties

When a man entered Judge Edward Burmila's courtroom on crutches earlier this year, muttering about being unable to take a drug test because he'd recently been shot in the bladder, court personnel didn't seem to know what to make of him.

They and other observers seemed frozen in shock as the man began urinating on the courtroom floor, but Burmila halted his crowded court and in a loud voice restored order by directing deputies to get medical help.

Burmila, 61, is hailed by experienced Will County attorneys as a master at handling unexpected difficulties, with knowledge gained from decades of legal experience as a prosecutor, defense attorney and judge.

Burmila started as a Will County prosecutor in 1977 after graduating from DePaul University law school. In about 10 years, he rose from handling traffic cases to taking on death penalty cases as the first assistant state's attorney.

"We've got a judge who truly understands criminal law," Glasgow said. "We're going to get a nice, fair trial and we're anxious to have it start."

Peterson's lawyers also were pleased by Burmila's selection. "He has an excellent reputation as a fine judge and … somebody who's a straight shooter," said Peterson's attorney Joel Brodsky.

Attorneys for both sides may want to wear a White Sox hat during their closing arguments. Burmila can sometimes be heard discussing games or players while off the bench and enjoys kidding attorneys about their clients' baseball allegiance.

"If someone comes in wearing a White Sox shirt, he will say, let the record show that the defendant is properly attired," said Joliet attorney Chuck Bretz. "He's loosening things up a little bit."

The disappearance of Drew Peterson’s fourth wife will loom large if he goes to trial this year for the death of his third, but his lawyers don’t want jurors to hear anything about it.

Peterson’s legal team is asking Will County Judge Edward Burmila to bar the mention of Stacy Peterson’s disappearance “or possible death” during his trial for the murder of Kathleen Savio, which could start in a few months.

They also asked Burmila not to let prosecutors convict Peterson for Savio’s death “upon innuendo.”

Leaving out Stacy Peterson’s disappearance could get problematic in the courtroom because she purportedly made some of the disputed hearsay statements allowed into the trial last month by an Illinois appellate court. And jurors might notice when Stacy Peterson doesn’t appear in the courtroom to testify for herself.
 
Peterson’s defense team has said it’s not done fighting the hearsay statements, though.

Peterson’s lawyers also are challenging evidentiary hearing testimony from attorney Harry Smith, arguing that he violated attorney-client privilege when he testified about conversations he had with Savio and Stacy Peterson. More motions could be filed before Peterson returns to Burmila’s courtroom May 17.

Producers didn’t bother waiting until after Drew Peterson’s much-anticipated trial to turn the tale of his dead and missing wives into a made-for-TV movie.

But as Illinois continues its experiment with cameras in its criminal courtrooms, crime buffs shouldn’t expect to watch the real thing from the comfort of their own living rooms. Will County’s top judge said cameras likely won’t be allowed into the former Bolingbrook police officer’s trial.

Chief Judge Gerald Kinney has said he’s exploring the idea of letting cameras into Will County courtrooms. But he also said it’d be logistically difficult to clear the way for the cameras in time for a Peterson murder trial that attorneys said could begin as soon as this summer.

He also said he thinks Illinois’ Supreme Court is aiming for smaller media markets as it lets cameras in.

About the same time, the Illinois Supreme Court announced it would begin a pilot project allowing cameras in trial courts on an experimental basis. So far the court has announced it will allow cameras in 13 Illinois counties, including Kankakee.

Have law schools started showing reruns of Matlock or something?  It sure seems that defense attys are more theatrical and given to middle school drama than intelligent debate.  I guess its just another sign of the moral decay of society.

Drew Peterson's self-proclaimed "lead attorney," Joel Brodsky, had earlier speculated that electronic communication conducted by a juror might end up getting his client sprung on technicality.

Will County prosecutors will be back in court Friday, after filing an emergency motion to curtail all parties in the Drew Peterson case from discussing legal and logistical matters via e-mail.  

The motion to “limit electronic communication” was filed under seal Wednesday. Sources told the Tribune that the state’s attorneys office was worried that too many conversations about the case were being handled via email and after standard work hours.

“It deals with procedural issues,” Will County State’s Attorney spokesman Charles Pelkie said.

May 25, 2012 (JOLIET, Ill.) (WLS) -- A Will County judge heard arguments Friday on an emergency motion in the Drew Peterson murder case. Prosecutors wanted the judge to limit e-mail communications about the case.

The emergency motion was about e-mails sent between the prosecutors, the defense attorneys and the judge. In the end, they agreed to only send e-mail to each other during business hours, between 8:30 a.m. and 5 p.m.

He calls allegations made by state in motion 'highly inappropriate'

The judge hearing the Drew Peterson case raked prosecutors over the coals Friday for filing a "hyperbole"-filled motion that he said unnecessarily "exposed the court to suspicion."

With the trial of Peterson, a former Bolingbrook police sergeant charged with drowning his third wife, set to begin in about two months, Judge Edward Burmila said he had encouraged defense attorneys to share motions with all involved parties via email before they were filed so the state had more time to respond.
But earlier this week, prosecutors filed a sealed motion seeking to bar those emails, and Burmila said the state's motion misstated the facts and implied that he had improperly made substantive rulings that should only have been done in court.

Burmila called a rare hearing for 4 p.m. — a half-hour before the Will County courthouse closes — on the day before a holiday weekend to address the matter. He said in court that the timing of the hearing wasn't "punitive" but based on the availability of the attorneys.

He first ordered State's Attorney James Glasgow or his criminal division chief, Kathy Patton, to substantiate the allegation that Burmila had limited emails to those discussing the location of the trial and the availability of witnesses.

"Mr. Glasgow, Mrs. Patton — call your first witness," Burmila said.

The two attorneys conferred, and then Patton asked for a minute to respond.

"You don't have a moment," Burmila replied. "Call your first witness. You knew this was set for hearing."

Prosecutors conferred for about five more minutes before saying they would withdraw the allegation.

But Burmila wasn't finished.

He said it was "highly inappropriate" and "shocking" for prosecutors to imply that he had made substantive rulings by email when he had not.

"I don't believe for a moment that's what Mr. Glasgow believes in his heart," Burmila said. "This motion was not well-thought-out."

Patton told the judge she had not meant to imply that and said she would "certainly apologize if the court took it that way."

"This is not a question of me having taken it some way," Burmila interrupted.

Glasgow also apologized to the judge. "This apparently got out of hand," he said. "We did not intend to show any disrespect."

Prosecutors were concerned that defense attorneys were sending emails late at night that they didn't have a chance to respond to until a day later, he said.

"I'm 61 years old," Glasgow said. "These emails started flying in at 10 o'clock, 11 o'clock at night. It seemed to be getting away from us."

In the end, both sides agreed for now to only exchange emails during office hours.

Prosecutors said Wednesday that they are preparing for two of Will County's biggest criminal trials in years to overlap this summer, with both Drew Peterson and Christopher Vaughn scheduled to face a jury in adjoining rooms at the Joliet courthouse.

Peterson, the former Bolingbrook police sergeant accused of drowning his third wife, is scheduled to go on trial July 30, with jury selection taking up the week prior. Vaughn's jury selection is scheduled to start Aug. 13. He is accused of shooting to death his wife and three children in the family's SUV on the way to a Springfield water park.

He’s been called untouchable, unflappable and a killer.

“I’m sick of being called sinister,” said accused wife murderer Drew Peterson, who has been imprisoned for the past three years awaiting trial for the death of his third wife, Kathleen Savio, and is the chief suspect in the disappearance of his fourth wife, Stacy Peterson.
 
“I’m just a wise-ass [ex-cop] who gets in trouble for attempting to be funny,” Peterson told Sneed. “But what’s happening is not funny.

“I’m very angry about what has happened to me and my family— and especially the Illinois State Police unexpectedly interrogating my son Tom recently at college and questioning him for hours [about the death of his mother, Kathleen Savio].

“I want them to get off his back,” said Peterson in an exclusive pre-trial interview with Sneed Sunday at Will County jail, where he has been held for the past 1,158 days. “My children have suffered enough.”
 
Ironically, the interview was conducted on the day that another one of Peterson’s sons with Kathleen Savio, Kris, 17, was graduating from Bolingbrook High School.

In this second part of an exclusive Sneed interview, Peterson — who is awaiting trial next month for the murder of his third wife, Kathleen Savio — seemed to be an enigma encased in a six-pack of Coors Light with a taste of chili dog. His comments are easy to swallow but hard to digest.
 
Consider:
◆ Peterson, who shows no remorse for any of the mess caused by his marital decisions, wants “to apologize to all those people who have written to me I’ve not been able to answer. ... I don’t think I am getting all my mail.”

Angry over being labeled “sinister,” Peterson smirks when he describes his former wife Kathleen Savio’s “hellcat” temper — yet softens when he talks about wanting to teach Lacy, his young daughter, how to fish.
 
And just when you thought you had a handle on what might be Peterson’s soft side, you get pushed off track by an unexpected answer; a louche comment; a startling response.
 
Example:

◆ Question: “What is your favorite magazine.”
 
◆ Answer: “Cosmopolitan” (A women’s fluff mag)
 
◆ Question: Really?
 
◆ Answer: “Yeah.”
 
◆ Question: “How would you like to be described?”
 
◆ Answer: “In a swimsuit on the beach.”
 
Then there’s Peterson’s response to the Lifetime TV movie, “Drew Peterson: Untouchable,” starring actress Kaley Cuoco as his missing wife, Stacy, which paints a grisly Peterson picture.
 
◆ Quoth Peterson: “Not seeing Kaley Cuoco in a bikini was a waste of time.”
 
What?
 
Although Peterson claims to be angry with FOX newsman Geraldo Rivera, whom he feels entered his house “pretending to be a friend and wanting to help, but didn’t,” what he really is upset about is how he is being treated as a veteran: a former U.S. Army member of the Military Police.
 
“Why would President Obama endorse limiting hearsay evidence in trials against terrorists housed at Guantanamo — and yet they are going to permit hearsay evidence at my trial!”
 
This time Peterson is not smiling or cracking a joke; this is what really gets him animated: hearsay evidence — reportedly 14 pieces of hearsay testimony that may be used against Peterson during the trial of his life.
 
How much of it will have to do with the disappearance of Stacy? How much from close friends of Savio?

Peterson claims the majority of his mail comes from women “who tell me to hang tough. That there are people out there who believe in me.”
 
The story of Drew Peterson is now pretty clear; the subject always seems to be about women.

Drew Peterson’s jurors likely will be picked from the original pool set aside in 2009, despite objections from his defense attorneys, a Will County judge decided Wednesday.

Peterson, dressed in a blue prison jumpsuit, wearing glasses and a thin beard, sat quietly in the courtroom Wednesday as attorneys on both sides sifted through a number of legal motions in preparation for his upcoming murder trial. Peterson chatted briefly with Will County Sheriff Paul Kaupas before the hearing started.

On Wednesday, Burmila rejected a defense motion on the potential pool of jurors. About 175 potential jurors previously filled out a questionnaire and were admonished not to follow news of the case.
