2:35 p.m. Nothing suspicious was the 'consensus'
Under cross examination from defense attorney Joel Brodsky, Robert Deel testified that he kept an open mind as he investigated Kathleen Savio’s home, but he saw nothing that looked like foul play.

He said there was "consensus" among the investigators that there was nothing suspicious about the death scene. The bathroom looked orderly, nothing was broken and while many items were undisturbed around the tub, there was a shampoo bottle and bar of soap inside it.

"There was even a soap bottle that was in the bathtub," Deel said. "If you’re going to move one thing, you’re going to move everything. The position of the body was consistent with where it should be… I can only say that it looked to me as if it was a normal bathroom and everything appeared as it should be."

But he said he placed bags over Savio's hands to preserve evidence in case her death was later ruled a homicide.

"When we left there, we didn’t really know what happened to her," he said

Earlier, defense attorney Steve Greenberg objected to a prosecutor’s line of questioning about what Deel didn’t do the night Savio’s body was found. Judge Edward Burmila said prosecutors are allowed to put on their case, but if they can’t tie it up, they won’t be able to argue a botched investigation in their closing arguments.

"If they want to say this is the worst police investigator on the face of the earth … I can’t stop them from doing that, but I don’t see how that prejudices Mr. Peterson," Burmila said.

4:45 p.m. 'Life would be easier if she was dead'
Bolingbrook Police Lt James Coughlin testified he was at the Will County courthouse in February 2004, standing near the elevators with a fellow Bolingbrook officer, when he saw Drew Peterson in the hallway.

Coughlin testified that when his fellow officer commented about how Peterson's divorce attorneys, who were laughing, seemed happy, Peterson said, "That's because they're getting all of my money."

Peterson, who Coughlin said seemed irritated, then said:

"My life would be easier if she was dead - or died, I don't recall which word," Coughlin testified.

The incident stuck with him, Coughlin testifed, because Savio was found drowned in her Bolingbrook bathtub just a few weeks later.

Robert Deel testified that Dr Bryan Mitchell, the pathologist who performed the original autopsy, told him that Kathleen Savio’s death was not a murder.

"He told me her death was not a homicide," Deel testified.

Defense attorney Joel Brodsky asked Deel if Mitchell, who died two years ago, had ever wavered in his belief.

"No," Deel replied

Testimony Wednesday in Drew Peterson’s murder trial is expected to focus on the retired Illinois State Police investigator who was one of the people who initially concluded Kathleen Savio’s death was an accident in 2004.

But first Judge Edward Burmila is expected to rule on defense attorneys’ request to throw out testimony from Bolingbrook police Lt. James Coughlin, who told the jury Tuesday that months before Savio’s body was found in her bathtub, Peterson told him “my life would be easier” if she were dead.
 
Coughlin said he quickly went to investigators to relay Peterson’s comment.
 
Peterson’s attorneys, though, argued prosecutors didn’t warn them Coughlin would dispute a conflicting FBI account of the encounter.

State police investigator defends work, says Savio's death was accident
August 8, 2012

His voice quaking slightly as he testified, the former Illinois State Police investigator who prosecutors allege botched the inquiry into Kathleen Savio's drowning appeared nervous on the witness stand Tuesday as he defended his work.

Robert Deel told a prosecutor he kept an open mind during the 2004 investigation but now considers Savio's death a slip-and-fall accident based on what he found in her bathroom the night her body was discovered.

"I believe that is consistent with someone who could slip, fall and bang her head," Deel said of her body's position in the bathtub. He said there was a "consensus" among investigators that night that Savio's death was likely an accident.

As the Drew Peterson trial entered its second week, prosecutors were in the unusual position of calling and attacking a former state police investigator who disagrees with the basic premise of their case — that Savio's death was a homicide. A coroner's jury working off the original investigation concluded it was an accident.

On Tuesday, prosecutors tried to pick apart Deel's policing skills and questioned what he didn't do during the Savio investigation. Prosecutors also called to the stand an assistant coroner who testified he had suspicions that Savio had been murdered, though he did not voice them for years.

After Peterson's fourth wife, Stacy, vanished in 2007, authorities exhumed Savio's body, performed a second autopsy and declared her death a homicide. Peterson, a former Bolingbrook police sergeant, is on trial in Savio's death. He is the sole suspect in Stacy's disappearance but has not been charged.

Not only is there no physical evidence tying Peterson to Savio's death, prosecutors must convince jurors that her drowning was a murder. That push began Tuesday and is expected to continue Wednesday, when another crime scene investigator and the pathologist who performed the second autopsy may be called to testify.

Defense attorneys tried to burnish Deel's reputation Tuesday, asking him about his extensive criminal investigation experience gained from 26 years with the Illinois State Police.

Deel said he processed more than 500 crime scenes, investigated about 50 drownings while serving on a police marine unit and investigated about 10 murders in his career. But his career took another turn after Stacy Peterson disappeared, and prosecutors asked that he never process another crime scene in Will County.

He was then reassigned to patrol.

9:40 a.m. Judge won't strike cop's testimony
The trial resumed this morning with Judge Edward Burmila's ruling that prosecutors did err by withholding information about Bolingbrook Police Lt. James Coughlin's testimony Tuesday.

Burmila denied the request to strike the testimony or admonish the state in front of the jury but will allow the defense to call the FBIagent who took the statement in question from Coughlin.

Coughlin testified Tuesday that he bumped into Drew Peterson in February 2004, and Peterson told him his life would be easier if Kathleen Savio was dead.

An FBI report noted that Coughlin told federal agents he saw Peterson in court before the alleged conversation. The defense seized on the FBI report, showing other court records that proved Peterson did not appear in court as part of his divorce proceedings in February 2004.

But Coughlin testified he told prosecutors that the FBI account was inaccurate, something the state never shared with the defense.

Peterson attorney Lisa Lopez said the failure of the state to reveal Coughlin's statement about the inaccuracy is a violation of basic pre-trial rules.

10:05 Cop, coroner, Savio friends to testify
Retired Illinois State Police Sgt. Patrick Collins is the first witness on the stand today. Other witnesses scheduled to testify for the prosecution today include Will County Coroner Patrick O’Neil, Kathleen Savio’s friend Kristin Anderson and Savio’s Joliet Junior College classmate Mary Parks.

Parks testified at a pretrial hearing that Savio told her that Drew Peterson "could kill her and no one would know" and that Peterson entered Savio's home, pinned her down by her throat and asked, "Why don't you just die?"

Anderson has also previously testified that Savio told her she feared Peterson would kill her.

Collins worked the Kathleen Savio crime scene with state police investigator Robert Deel in 2004.

Collins testified during a 2010 hearing that Deel told him Savio’s death was an accident.

"I relied on that particular night and case very heavily on investigator Deel because that was my first homicide," Collins testified in 2010. "I did ask him should we collect anything. He basically informed me that it appeared to be accidental."

10:30 Officer recounts interview with Peterson
Retired Illinois State Police Sgt. Patrick Collins testified that when he interviewed Drew Peterson about Kathleen Savio's death and asked if he would realize any financial benefit from her death, Peterson said they shared ownership of Savio's home, valued at $300,000.

"At that time he stated, 'Oh, I guess now I'll get the whole value of the house,’" Collins said.

Collins also said that when asked about his relationship with Savio at the time of her death, Peterson said it "was going pretty good."

11 a.m. Drew coached Stacy through interview
Retired Illinois State Police Sgt. Patrick Collins said that when he and Trooper Brian Falat arrived at Drew Peterson's home to interview Stacy Peterson about Kathleen Savio’s death, the defendant asked to be allowed to sit in with them.

"On our way to the basement, Drew asked me personally, he said Stacy was real shaken, still real nervous about the event that had occurred and asked me if he could sit in on the interview — some professional courtesy," Collins said. He added that he had never before allowed a suspect to sit in on the interview of a witness.

During the interview, Drew Peterson sat "very close" to Stacy Peterson, and at one point coached her through her answer about what she did the Saturday before Savio was discovered, Collins testified.

"There was one particular question where he did have to refresh her memory," Collins recalled. "He leaned over to Stacy and said, 'You remember what you cooked for breakfast.' He said, 'bacon' or 'sausage' and that was it."

4 p.m. 'Critical' ruling in Peterson case
In a ruling that State’s Attorney James Glasgow said would be "critical" to the Drew Peterson case, Judge Edward Burmila said he is not bound at all by a prior judge’s rulings on what hearsay statements can be heard by jurors.

The ruling, following a shouted argument by Glasgow, opens the door to more than a dozen hearsay statements previously barred by the prior Judge Stephen White.

Burmila will now rule on each of the statements individually as prosecutors seek to admit them.

Kristin Anderson returned to the stand and resumed testifying, telling the jury about a conversation she had in Kathleen Savio’s bedroom about Drew Peterson.

She said Savio told her that "Drew had broken in to her house dressed in a SWAT uniform, held a knife to her throat and told her, 'I could kill you and make it look like an accident.'"

Savio also showed her a knife she kept "between the mattresses" of her bed for protection, Anderson testified.

Judge Edward Burmila asked that the jury be removed after Kristin Anderson broke into tears just before she was going to testify to a hearsay statement from Kathleen Savio.

A deputy handed her tissues and Anderson began sobbing as she left the courtroom to compose herself.

Anderson is expected to testify that Savio told her Drew Peterson could kill Savio and make it look like an accident.

A DuPage County judge has ordered the Oak Brook Board of Fire and Police Commissioners to better explain its reasoning for firing the son of Drew Peterson.

Judge Terence M. Sheen issued the written statement Tuesday requiring the Oak Brook board to provide further detail as to why it fired former Oak Brook police officer Stephen Peterson, according to a statement from the Village of Oak Brook.
 
The Oak Brook Board of Fire and Police Commissioners fired Peterson in February 2011 for allegedly violating a state statute and several Oak Brook police conduct regulations for accepting weapons and funds from his father, according to the release. The board also questioned his rationale for not immediately disclosing the information to Illinois State Police.

Today’s witnesses are expected to include pathologist Larry Blum, Will County Coroner Patrick O'Neil, and Kathleen Savio's friend Mary Parks, who previously said Savio told her Peterson had threatened to kill her.

Blum, who was hired by the state, has testified previously that the Savio death scene was "very, very pristine," with no water splashed out of the tub and none of the bottles surrounding it knocked over. The positioning of her arms and legs also indicated she had not slipped in the tub, he said.

"She's so far out of the usual pattern as what one sees," Blum said of Savio's injuries at a pretrial hearing. "Most of the time when people do fall in tubs and drown, you might have a little cut over their eye, you might have a bruised ear.

"But not all these injuries at once from a fall, that's just hard to believe."

Mary Parks, a registered nurse who attended nursing classes with Kathleen Savio in the fall of 2003, recalled seeing Savio in a lab wearing a fleece jacket with the collar zipped up around her neck.

"She was. . . She looked as if she was in shock," Parks said, trying to maintain her composure. "Before she said anything, she unzipped her top. I saw red marks on her neck.

"She told me that, the evening before, she was coming down the stairs and her husband came into the house and he grabbed her by the neck and pinned her down. She said her husband at that point said to her, 'Why don't you just die?' "

Parks said she frequently walked Savio to her car after school, and on one occasion Savio told her how Peterson threatened her.

"Kathy told me that her husband, Drew Peterson, told her that he could kill her and make her disappear," Parks testified.

Drew Peterson's son Kris Peterson came into court shortly before 1:30 p.m. and sat in the gallery behind his father. Drew turned in his chair and spoke to his son, who was dressed in a black polo shirt and khacki pants, for several minutes.

Kris Peterson, 18, is a potential witness in the case and so could not stay to watch the proceedings. His mother is Kathleen Savio.

12:05 p.m. Witness admonished by judge
The trial recessed until 1:15 p.m. for lunch after the cross examination of Mary Parks.

Parks admitted she misspoke when she said she was taking a pharmacology class with Kathleen Savio in fall 2003 when Savio told her about the threats and showed her the marks on her neck.

She said she actually took the class the year prior, but stood by her testimony that Savio's remarks came just months before her death.

After several contentious back-and-forth questions with defense attorney Steve Greenberg, Parks was admonished by the judge that she was not to ask questions, only answer them.

Much of the cross-examination centered on differences between her testimony and her statements to a state police investigator in 2008, which do not record her making any mention of Peterson's alleged threats.

"I am not responsible for what she wrote in her report," Parks said. "I was not given an opportunity to review it for accuracy."

Parks will take the stand when the trial resumes for re-direct this afternoon.
