2:40 p.m. Savio friend avoided Peterson
Mary Parks retook the stand and explained to defense attorney Steve Greenberg why she didn’t go to Kathleen Savio’s wake or funeral.

"I did not want to come face-to-face with her husband," she said, adding that she didn’t know anyone in Savio’s family.

Parks acknowledged that she did not send a condolence card.

With her testimony complete, prosecutors are next expected to call Dr. Larry Blum, who performed the second autopsy on Savio after her body was exhumed in 2007.

The two sides haven't yet resolved some issues regarding his testimony, so Judge Edward Burmila gave them some time to reach an agreement. If they can't agree, he said the rest of the day likely would be taken up with motions.

2:20 p.m. Witness breaks down on the stand
The judge asked jurors to be taken from the courtroom after Mary Parks grew emotional on the witness stand. State’s Attorney James Glasgow had asked Parks about Kathleen Savio's statement that Peterson had entered her home and grabbed her neck.

When defense attorney Steve Greenberg started his cross-examination, Parks began crying and Judge Edward Burmila asked jurors to be removed and then told Parks to into the hall and compose herself.

3 p.m. Peterson's son takes name off lawsuit
Drew Peterson's son Kris Peterson has signed a release of his claims against his father, a move that effectively ends a pending wrongful death lawsuit filed by Kathleen Savio's family on behalf of her estate, said Drew Peterson's defense attorney Joel Brodsky.

Kris Peterson, who turned 18 on Wednesday, was in the courtroom speaking to his father this afternoon before testimony resumed after lunch.

The Savio family attorney, Martin Glink, said it's an "open question" whether the wrongful death case can proceed in civil court without Kris Peterson, who is Savio’s son.

"If that's true (that Kris wants out of the case), I guess the question is: Who's controlling him?" Glink said.

A status hearing in the case is set for September.

The Peterson murder trial has adjourned for today. Attorneys for both sides will now argue motions before Judge Edward Burmila regarding the next witness, Dr. Larry Blum, who performed the second autopsy on Savio after her body was exhumed in 2007.

August 9, 3:43 p.m. Judge Burmila says divorce attorney Harry Smith can not testify about previous divorce negotiations or what Kathleen Savio was expected to get in the divorce.

"I think to allow Harry Smith to testify to what issues were before the divorce court, is a complete distraction, and does not resolve if she was murdered," he said.

Drew and Kathleen Peterson were legally divorced but there was a pending court hearing scheduled for April 2004, to divide marital assets. Kathleen Savio was found dead just a few weeks before on March 1.

9:40 a.m. Witness list: Cop, boyfriend, mistress
Today’s witness list includes Kathleen Savio’s boyfriend Steve Maniaci, her sister Susan Doman, former Bolingbrook police Sgt. Teresa Kernc and Drew Peterson’s former mistress Susan McCauley.

Kernc took a police report from Savio about Peterson threatening her with a knife. Kernc testified at a hearing in 2010 that Savio did not want the detail about the knife included in the report because she was worried it would cost Peterson his job.

When interviewed by Kernc, Peterson denied attacking Savio, said she had invited him over to her home and alleged that Savio exposed herself to him and asked if he "missed this."

McCauley, Peterson's former mistress who worked as a bartender at his Montgomery bar, testified during a pretrial hearing about a conversation she had with Peterson at a 2004 Bolingbrook bowling alley after Savio's death.

McCauley testified that Peterson told her his boys would be fine and that Savio was "crazy." He allegedly told her Savio drowned in her bathtub after taking antidepressants and drinking wine, saying a wine glass was found on the tub.

Prosecutors sought during that 2010 pretrial hearing to use the statement as an example of Peterson telling different stories about how Savio died.

10 a.m. Savio boyfriend didn't see abrasions
Kathleen Savio’s boyfriend Steve Maniaci testified that he reunited with Savio in December 2001 after a Christmas party, and the two began seeing each other several times a week.

He said he knew Savio's marriage was "not good."

Maniaci said that on Feb. 27, 2004, the Friday before Savio's body was found, the couple went to Naperville for dinner and drinks, then returned to her home where they had sex.

Maniaci said he did not notice any of the abrasions that were later found on her arms and buttock when her body was discovered.

The trial has recessed for lunch. Kathleen Savio's boyfriend is done testifying. The next scheduled witness is Savio's sister Susan Doman.

10:45 a.m. 'She told me Kathy was dead'
Kathleen Savio's boyfriend Steve Maniaci said he and Savio had an argument on Saturday Feb. 28, 2004, because she was upset with him for not coming over to her home.

He did not speak to her the following day, and was unable to reach her on the phone Monday.

That Monday evening, he got a call from Savio's neighbor saying that Drew Peterson was at the home with a locksmith, and they were preparing to enter Savio's home.

Maniaci said he called the neighbor back a little while later.

"She told me Kathy was dead," he said.

Maniaci drove to Savio's home, where he saw Peterson standing near the street.

"(He) was underneath the streetlight, seemed to be writing a report," Maniaci said. " I went up to him and asked him what the hell happened. He said he didn't know. I said, 'Drew I hope you didn't have anything to do with this.' He said he did not. There was a little bit of small talk and then I said, 'Boy, this sure worked out well for you.' He said she would have lost anyway during the divorce."

Kathleen Savio’s sister Susan Doman told jurors that Savio told her several times about an alleged attack by Drew Peterson inside her home.

Doman said her sister told her she was in the basement when Peterson held a knife to her throat.

"He told her he could kill her and make it look like an accident," Savio testified. "She was terrified."

2:45 p.m. Pace of trial frustrates jurors
With the trial continuing to move at what the judge has previously called a "glacial pace," some jurors have begun to get irritated.

Some jurors began to groan after the judge dismissed them from the courtroom over the latest objection, this time brought by prosecutors during the cross-examination of Kathleen Savio's sister Susan Doman.

Judge Edward Burmila sustained the objection, brought the jurors back and the testimony has resumed.

Susan McCauley, who worked at a bar owned by Drew Peterson, testified about seeing Peterson at a Bolingbrook fundraiser after Kathleen Savio died.

McCauley said she gave Peterson a hug and asked how his boys were.

"Oh they’ll be fine, she was crazy," Peterson said of his ex-wife, according to McCauley.

"He said she was on antidepressants…and that she was drinking wine, that there was a wine glass found by the bathtub."

"I said to him, basically, ‘You must have a lucky horseshoe placed somewhere,’" she said. "Now you don’t have to pay child support — you get the house.

"He laughed it off and made a couple jokes."

McCauley is Peterson’s former mistress — a detail that jurors were not allowed to hear.

2:55 p.m. Savio's sister signed book, movie deal
Kathleen Savio’s sister Susan Doman testified that she signed a book and movie deal that guaranteed her $30,000 if a film was made, specified that she be portrayed in a "positive" light and allowed the story to be "fictionalized" to make it more colorful.

Defense attorney Joseph Lopez asked if she now has a financial motive in seeing Drew Peterson convicted so her the book will be released.

"No," Doman replied. "This book is about domestic violence."

"This book is about you being paid," Lopez replied.

"No," Doman said.

JOLIET, Ill., Aug. 11 (UPI) -- So far in Drew Peterson's trial in Illinois for the murder of his third wife the only mention of his fourth wife's disappearance has come from the defense.

Joel Brodsky, one of the former Bolingbrook police officer's lawyers, made the reference in his opening statement, the Chicago Sun-Times reported.

"Stacy Cales Peterson is missing for some unknown reason," Brodsky said.

During testimony from Savio's friends, defense lawyers have questioned them on why they did not pursue their suspicions. On Wednesday, Judge Edward Burmila ruled that Joseph Lopez had opened the door when he grilled Kristin Anderson about her testimony that Savio had told her Peterson threatened her while wearing a SWAT uniform, saying he could kill her and make it look like an accident.

Will County State's Attorney Jim Glasgow decided, apparently for strategic reasons, not to walk through the door, at least not yet. Stacy Peterson's family hopes the disappearance will come up, the Sun-Times reported.

Drew Peterson trial: Prosecutors to call forensic pathologist
August 14, 2012

Prosecutors in the Drew Peterson murder trial this week will attempt to clear the first hurdle in their case — convincing jurors that the former Bolingbrook police sergeant's third wife was murdered.

Kathleen Savio, 40, was found drowned in her Bolingbrook bathtub in 2004. A coroner's jury ruled her death an accident, but her body was exhumed in 2007 not long after Peterson's fourth wife, Stacy, vanished. Prosecutors believe Peterson, 58, killed Stacy, but he has not been charged.

Peterson's trial in Savio's death is scheduled to resume Tuesday, the start of the third week of testimony in the case.

This week, prosecutors plan to call Dr. Larry Blum, a forensic pathologist from Rockford who has performed more than 9,000 autopsies, to testify about the 2007 Savio autopsy. Blum ruled that Savio's death was a homicide based on the pattern of injuries he found on her body.

Dr. Larry Blum will have to explain how he was able to conclude that Savio’s death was a homicide three years after her death.
 
The Rev. Neil Schori may also testify this week. Schori will answer questions about what Peterson’s missing fourth wife, Stacy, told him about Peterson on the night Savio died. He has said she told him Peterson came home late, wearing all black, and was carrying a bag of women’s clothing.
 
The jury may also get the chance to read a portion of a letter that Savio wrote to then-Will County, Illinois, prosecutor, Elizabeth Fragale, complaining about abuse she said she endured at the hands of Peterson.

9:30 a.m. Pathologist: No toxins found in Savio
The first witness this morning is forensic pathologist Christopher Long, who told jurors his lab was contacted to perform tests for toxic drugs and other substances on samples taken from Kathleen Savio in 2004.

Long said his lab tested Savio's liver — where toxins are most likely to be found in the greatest concentration — and found nothing.

"We ran it twice, and they (the tests) were both negative."

Dr. Christopher Long is the first witness this morning and is expected to testify about Kathleen Savio’s 2004 and 2007 toxicology results.

Other potential witnesses today include Candice Aiken, Stacy Peterson's aunt; Donna Badalamenti, a friend of Aiken's; Scott Rossetto, a friend of Stacy Peterson; and Illinois State Police investigator Bryan Falat.

Aiken and Badalamenti testified at a hearing in 2010 about statements Drew Peterson allegedly made about how he could kill someone and make it look accidental and also a reference to killing himself if his marriage to Stacy did not work out.

Scott Rossetto, a friend who traded raunchy text messages with Stacy shortly before she disappeared in 2007, testified at a pretrial hearing that Drew Peterson coaxed her into providing a false alibi for the weekend of Savio's death.

Falat testified at a hearing in 2010 that Drew and Stacy Peterson appeared to be lying in interviews with state police after Savio's death. But Falat said his concerns were ignored.

"Quite honestly, I was sort of disgusted with" how the investigation was handled, Falat said in 2010.

Stacy Peterson appeared "scripted" and often looked to Drew Peterson when she was unsure of an answer, Falat testified previously.

10:10 a.m. Pointed questions from defense
Cross examination by defense attorney Darryl Goldberg quickly became testy as Goldberg tried to draw out testimony that the forensic pathologist has testified almost exclusively on behalf of prosecutors for most of his career.

Dr. Christopher Long repeatedly tried to explain his answers, prompting a sharp comment from the defense attorney.

"Doctor, maybe it's the way I'm asking the questions, but the answer is 'yes,' or 'no,'" Goldberg snapped, prompting an objection from prosecutors.

Judge Edward Burmila overruled the objection.

"The defense is entitled to a yes or no answer," Burmila said to Long. "The state will have an opportunity to redirect your testimony if they choose."

9:55 a.m. Savio tested for toxins again in '07
PathologistChristopher Long said his lab was asked to retest samples from Kathleen Savio in November 2007, and traces of methadone, amphetamines and the base compound found in aspirin were found.

But Long said such results are common when testing older tissue, because those chemicals are the natural byproduct of decomposition.

After further testing, the lab again determined Savio's liver did not contain any drugs or other toxins that caused or contributed to her death.
