A friend of Stacy Peterson took the witness stand Friday afternoon in Drew Peterson’s murder prepared to talk about statements Stacy Peterson made to him before she disappeared.

But Judge Edward Burmila barred his testimony from the trial, ruling it unreliable.
 
Burmila had late in the morning said Scott Rossetto could testify, in spite of attempts by Peterson’s lawyers to keep him off the stand. But the judge warned prosecutors against mentioning the unsolved 2007 disappearance of Peterson’s fourth wife, Stacy, which prompted Rossetto to come forward to police.
 
But then only a couple questions into his testimony Friday afternoon, Rossetto said he had a discussion with Stacy Peterson on Oct. 25, 2007.
 
Defense attorneys immediately objected, saying they’d been told the conversation was on Oct. 22, 2007.
 
The defense had already slammed Rossetto’s stories as constantly changing, and after a long argument among the attorneys, Burmila banned him from testifying.

I certainly hope not, but it seems the Three Stooges are alive and well impersonating the prosecution in Will County.

CHICAGO — With no physical evidence tying Drew Peterson to the death of his third wife and so much of the case hinging on what she said before she died and what his next wife said before she vanished, it was a certainty that his trial would be unlike anything ever seen in Illinois and perhaps in the country.

But nobody expected what unfolded in the first three weeks of the trial: prosecutors made a series of blunders that prompted the judge to consider at least three defense motions for a mistrial and has some legal experts wondering just how much trust is left.

“If the jury can’t trust the prosecution, everything after that fails,” said Daniel Coyne, a professor at Chicago Kent School of Law and a former criminal defense lawyer, adding that it is not a big leap for jurors who don’t trust prosecutors not to trust the witnesses they call to testify. “The judge has told the jury on a number of occasions that the prosecutor has done something wrong ... (If) they transfer that wrongness to the witnesses, that is very dangerous.”

It’s particularly important for prosecutors to connect with jurors in a trial such as Peterson’s, which relies heavily on what the former suburban Chicago police officer’s ex-wife, Kathleen Savio, told others before — as the prosecution alleges — he killed her and left her body in a bath tub in 2004.

10 a.m. Judge allows hit man testimony
Judge Edward Burmila will allow testimony about Drew Peterson's alleged attempt to hire a hit man to kill his wife because it shows the former Bolingbrook police sergeant's possible intent. The prosecution, however, cannot argue that Peterson tried to put a hit on his third wife, Kathleen Savio, only that the testimony show he wanted her dead, Burmila said.

The ruling clears the way for Jeff Pachter to take the stand at some point this week. Pachter, who once worked with Peterson at his side job as cable outfitter, is expected to testify that the former Bolingbrook police sergeant offered him $25,000 to hire a hit man to kill Savio in late 2003, just a few months before her death.

The prosecution initially had been chastised for mentioning the possible hit man testimony during opening statements because the state had not notified the defense of its plans to use it. Last week, Burmila ruled that the prosecution did not understand the law and therefore could file a late notice to have the witness testify.

Medical examiner Mary Case said that it was her opinion that a fall in the tub would not have rendered Kathleen Savio unconscious.


Rapid acceleration of the brain within the skull can cause a diffuse brain injury resulting in concussions, loss of consciousness or death. These injuries are common in car accidents.

In Savio's case, she could not have fallen fast enough to cause her to hit her head hard enough to knock herself out, Case said.

"It's not the type of force we would see from a standing position, falling in a tub and striking the head," she said. "That is not enough significant force to produce a diffuse brain injury."

An Illinois State Police trooper involved in the original investigation into the death of Drew Peterson's third wife is expected to testify at the former police officer's murder trial.

Bryan Falat is expected to tell jurors Wednesday he had suspicions Kathleen Savio's death was a homicide even though the lead investigator believed it was an accident.

Falat has said at pre-trial hearings that he had concerns about how the investigation was being conducted. The issue of a botched investigation is important for prosecutors to explain to jurors why there's no physical evidence.

Peterson has pleaded not guilty to first-degree murder in Savio's 2004 death. Her body was exhumed and her death reclassified from an accident to a homicide only after Peterson's fourth wife, Stacy Peterson, went missing in 2007.

A witness testified at Drew Peterson's murder trial Wednesday that the former Illinois police officer offered him $25,000 to hire a hit man to kill his third wife just three months before she was found dead.
 
Prosecutors allege Peterson, now 58, ended up killing Kathleen Savio himself because he feared a settlement after their divorce would ruin him. They presented the hit-man testimony in a bid to establish that Peterson had thought seriously about her murder in advance.
 
Jeff Pachter told the jury that during a late-night ride in Peterson's squad car, the then-Bolingbrook police sergeant asked him to find a hit man. Savio was found dead in a bathtub in her suburban Chicago home with a gash on the back of her head three months later, in March 2004.
