12:05 p.m. Pay no influence on expert's opinion
Pathologist Jeffrey Jentzen said the fact that he's being paid by the defense does not have any influence on his conclusions.

He strongly disagreed with the state's expert witness, forensic pathologist Mary Case, who said that if Savio was knocked unconscious there would have been evident brain damage.

“She's wrong,” Jentzen said of Case. “I vehemently disagree with that opinion.... She would have had loss of consciousness without any visible injury to the brain tissue.”

Jentzen said his the most reasonable conclusion is that Savio's death was an accident.

“She was in a bathtub, she slipped and fell, she struck the left side of her body and her head violently against the side of the tub,” he said. “She sustained a head injury, she was rendered unconscious and in an unconscious state she slipped under (water) and drowned.”

Judge Edward Burmila released the jury for lunch, and the trial will reconvene at 1:15 p.m.

A prosecution witness testified earlier that it was impossible for Savio to get an injury on the back of her head and bruises on her front from one fall.

Drew Peterson's defense team plans to put forensic experts, his son with Savio on stand

Former Bolingbrook police Sgt. Drew Peterson has always insisted he had nothing to do with the death of his third wife or the disappearance of his fourth.

On Monday, the man who notoriously tried to make his case while joking on the "Today" show began trying to convince a jury of seven men and five women that his third wife, Kathleen Savio, accidentally drowned in her bathtub.

Defense attorneys said they will put on two of their expert forensic witnesses Tuesday to testify that Savio's 2004 death was an accident, which is how authorities initially classified it.

The Peterson family drama may crescendo in court Wednesday, when Thomas Peterson, Drew's son with Savio, is expected to give testimony alleging that his adoptive mother, Stacy, was lying when she told a pastor that Drew Peterson killed Savio and coached her to lie about it.

Thomas Peterson will one day terribly regret testifying on behalf of DP.  His mother obviously tried to shield her sons from the abuse and threats she received from their father.  The only reason I can think of for Thomas to do this is that he has been brainwashed by his sperm donor father.  How will he live with himself when the truth finally comes out?  And I have always firmly believed that no lie lasts a lifetime.

If she hit "hits first," wouldn't that have slowed down her downward momentum lessening the impact to the head.  I still don't get how a smooth surface would cause a laceration to her head.  Blunt force trauma, maybe, but not a laceration.

5:40 p.m. -- Defense rolls out a pair of Illinois State Police officers -- Robin Queen and Cpt. Bridget Bertrand -- who separately interviewed Savio friend Kristin Anderson.

Queen testifies only that during her interview with Anderson that there was no mention of a knife in regards to Savio.

Bertrand testifies about a March 10, 2004 phone call that Anderson allegedly made to Illinois State Police headquarters. In her investigation five years later, Bertrand said she couldn't find anyone who recalled that phone call with Anderson. Records she obtained showed 17 officers were working in the headquarters that day. None recalled Anderson calling.

Records, however, show Anderson called three times.

On Cross, Glasgow quickly pointed out that Anderson was expecting officers to remember a brief conversation with someone five years later

Drew Peterson's defense team offered jurors its theory of how his third wife died, calling a pair of noted forensic pathologists Tuesday who testified that Kathleen Savio drowned in her bathtub after slipping and hitting her head.

Peterson's attorneys brought in well-known forensic pathologist Dr. Vincent DiMaio, who has written several widely used pathology textbooks, and Dr. Jeffrey Jentzen, director of autopsy and forensic services at the University of Michigan's medical school, to rebut two state-paid expert pathologists who told jurors that Savio's 2004 death was a homicide.

In a case built on circumstantial evidence and hearsay, the explanation of how Savio ended up dead in the tub — whether she was attacked or simply fell — is critical. The case may hang on how jurors view the dueling experts.

9:30 a.m. Attorney can testify about talk with Stacy
Judge Edward Burmila ruled that defense attorneys can call Wheaton family attorney Harry Smith to testify that Stacy Peterson asked him about extorting money from Drew Peterson in her planned divorce by threatening to tell police what she knew about Kathleen Savio’s death.

But the judge said if the defense calls Smith his entire 8.5-minute coversation with Stacy Peterson is admissable. The defense hasn't yet said whether they will call Smith.

10:09 a.m. -- Defense moves to bar prosecution from using complete May 2012 statement from Tom Peterson, calling it a "disclosure violation."

Illinois State Police interviewed Tom Peterson in May of this year in Pennsylvania, where he attends college.

Burmila is asking prosecutors why they didn't disclose report of interview to defense and how defense knew of interview. He tables motion to bar interview to move things along.

9:32 a.m. -- We're in a brief recess in this morning's proceedings.  
There's apparently a May 2012 statement from#Drew Peterson's son, Tom Peterson, that Will County State's Attorney James Glasgow thought was submitted to court but wasn't.

The defense team just learned of this statement minutes before proceedings started and want some time to review it.

Once again, Judge Edward Burmila seems unhappy with the prosecution.

10:30 a.m. No sign of struggle, investigator says
Former Illinois State Police Sgt. Patrick Collins is the first defense witness of the day.

Collins, who was one of the investigators who responded to Kathleen Savio's home after her death in 2004, testified weeks ago as a prosecution witness.

Defense attorney Steve Greenberg is leading him through a series of questions about the appearance of Savio's home the night her body was discovered.

Collins said he saw no signs of a disturbance, struggle or anything unusual in the home.

Collins, who retired in 2008, said he didn't recall seeing bags placed over Savio's hands, but said he asked the evidence technician, Sgt. Robert Deel, to cover her hands in case there was any evidence on them.

"I asked Sgt. Deel to take fingernail samplings, based on the chance that it there was some kind of struggle, she might have something on her hands," Collins said. "Going back to my earlier testimony, it was my first homicide, so it was a learning experience for me. I was assuming that was what they did."
