10:15 a.m. Pathologist disputes defense findings
Forensic pathologist Michael Baden countered testimony from defense forensic expert Vincent DiMaio, who said there was no injury to Kathleen Savio's diaphragm.

Baden said there was clear bruising to the right side Savio's diaphragm and that such hemorrhaging could be caused by a strong blow to the body, "or it could be caused by a bear hug, a very strong bear hug squeezing the body just below the rib cage."

He also disputed DiMaio's opinions that Savio's injuries were caused by a fall, saying the only way the multiple bruises to the front of her body and the cut to the back of her head could be explained by a fall would be if there were multiple falls. He said the injuries were more indicative of a struggle.

Baden said he also disagreed with the defense forensic experts regarding the abrasion on her left buttock. DiMaio and another forensic expert for the state, Jeffrey Jentzen, said the apparent injury was not an abrasion, but was dry skin often seen on deceased individuals.

But Baden said it is clear the outer layer of skin had been scraped away.

11 a.m. Other doctors missed diaphragm injuries
On cross examination, forensic pathologist Michael Baden acknowledged he was the first to notice what he believed were injuries to Kathleen Savio's diaphragm, despite the fact that two prior forensic pathologists, Dr. Bryan Mitchell and Dr. Larry Blum, made no mention of the injuries in their autopsy reports.

"I did research on the diaphragm. I spend more time on the diaphragm - particularly as they relate to lung and heart disease - then other pathologists. So I may have looked longer at it."

Baden said he considered the other doctors to be skilled pathologists and he did not think it a "big deal" that they missed the hemorraghing to the diaphragm.

11:30 a.m. Judge inquires about Girls Gone Wild
During cross-examination, pathologist Michael Baden said he was assisted at Kathleen Savio's autopsy by Steph Watts, who at the time was a producer for Fox News' Greta Van Susteren show.

"At the request of the family, I was doing a private autopsy at the request of the family. The family asked that Steph Watts, who was a producer for Fox, be present," Baden said.

"He does have training as one of the producers for Girls Gone Wild?" Meczyk asked.

"I have no knowledge of that," Baden said.

"You were also aware that Mr. Watts tried to peddle this tape to Girls Gone Wild?" Meczyk said.

"This is the first time I'm hearing that," Baden said. "Obviously that would be totally improper if that were done."

The prosecution then objected, and during a discussion outside the presence of the jury, prosecutors argued that while Watts did have a telephone number for Girls Gone Wild, there was no evidence he called them to peddle the Savio autopsy tape.

Judge Edward Burmila said he was unclear about what the program was about.

"Earlier in the trial, I admitted my ignorance about what 'chirping' was, and I'm not sure that was a good thing," he said. "Now I think it's a very good thing to expose my ignorance of what Girls Gone Wild is."

The judge's comments prompted a roar of laughter in the courtroom. He later sustained the state's objection.

Joel Brodsky could make Mother Teresa appear slimy.  I don't predict after KC Anthony's trial, but I can only hope for the worse for DP.  He is as slimy as they come and puts the mark of shame on anybody in law enforcement.

JOLIET, Ill. — A judge sent jurors home after they heard the last testimony at Drew Peterson’s murder trial on Thursday, saying they will return after Labor Day to hear closing arguments.

The state called just two witnesses, both forensic pathologists, in a one-day rebuttal as they entered the last evidence against the former suburban Chicago police officer.

One challenge for prosecutors will be to convince jurors that Savio — whose death was initially ruled an accident — was, in fact, murdered. Both sides called pathologists to support their opposing contentions.

The challenge for the defense will be to discredit the hearsay. Several witnesses testified that Drew Peterson repeatedly threatened Savio, once by allegedly breaking into her home and telling her at knifepoint he could kill her and make it look accidental.

Among the testimony Lopez may have to account for is that of divorce lawyer Harry Smith. He told jurors how Stacy Peterson asked, days before she vanished, if she could extort her husband by threatening to tell police he killed Savio. The defense hoped to blunt Stacy Peterson’s credibility, but some observers said Smith’s testimony merely stressed to jurors that his fourth wife was convinced Peterson killed his third wife.

Drew Peterson’s judge on Friday rejected several attempts by defense attorneys to alter the standard legal instructions given to jurors before they begin deliberating.

The rulings by Judge Edward Burmila came before Peterson’s attorneys are expected to make a last-ditch request for Burmila to throw out the murder charges against the Bolingbrook cop because of a lack of evidence.
 
Burmila earlier this week rejected that request from Peterson’s defense team, ruling prosecutors have presented enough evidence for jurors to conceivably find Peterson guilty of murdering his third wife, Kathleen Savio.

How long the closing arguments can be and what measures will be taken to protect the integrity of the jury were not disclosed, CBS 2’s Mike Puccinelli reports.
 
Will County State’s Attorney James Glasgow had no comment when he was asked about whether jurors would be sequestered.

He was clearly pleased, however, that Judge Edward Burmila rejected a defense request to throw out the case for lack of evidence.

The defense team, meanwhile, walked out feeling confident because the jury will hear a special instruction regarding the use of “hearsay” testimony.

Prosecutor Chris Koch will give the state's closing argument, with State's Attorney James Glasgow providing the final words as he rebuts Lopez's remarks to jurors. Koch — a no-nonsense lawyer who has handled several of the trial's trickiest witnesses — declined to discuss his closing but offered a possible preview of his remarks in routine motions before the court Friday.

In essence, he will tell jurors that accumulated evidence will show that no one else besides Peterson had the motive or means to kill Savio. If jurors use their common sense, prosecutors will say, they'll find that they can convict him even without DNA, fingerprints or witnesses tying him to the death scene.

"The circumstantial evidence isn't just one piece of evidence, but all taken together," Koch said. "If you look at testimony from expert witnesses, it's not consistent with accidental slip and fall."

Peterson, 58, is charged with killing Savio, 40, who was found drowned in a dry bathtub March 1, 2004. The death initially was ruled accidental, but officials reopened Savio's case after Peterson's fourth wife, Stacy, disappeared in 2007.

He has not been charged in Stacy Peterson's disappearance, though he remains a suspect. He denies wrongdoing in both cases.

Yet before prosecutors argue that Drew Peterson was responsible for Savio's death, they will face an unusual obstacle: They first have to convince jurors that she was murdered.

Prosecutors say authorities did not properly investigate her death until Stacy vanished. The claim prompted a courtroom battle between paid pathologists during the trial, with state experts testifying that Savio had been killed and defense experts insisting her death was consistent with a fall, even though she had significant bruising on the front of her body and a gash on the back of her head.
