WASHINGTON, Sept. 16 (UPI) -- How could former Illinois police officer Drew Peterson be convicted in large part on hearsay evidence -- the words of someone who was not in court but reported by a third party -- when the Constitution gives any defendant the right to confront his accuser?
 
Specifically, the Sixth Amendment gives the defendant the right "to be confronted with the witnesses against him" so a defense lawyer can cross examine those witnesses and juries can evaluate witness statements in deciding guilt or innocence.
 
Fairly or not, jurors in Peterson's trial said hearsay statements by his third and fourth wives -- one murdered and the other presumed dead -- weighed heavily in their guilty verdict.
 
The answer, of course, is that the protections of the confrontation clause aren't absolute.
 
State law and U.S. Supreme Court precedent allow for exceptions, and with Peterson defense lawyers vowing to appeal, the high court may be the ultimate arbiter of whether his conviction was constitutional and should be upheld.

Defense attorney Steve Greenberg lashes out at former boss after he's fired from legal team

Defense attorney Steve Greenberg is giving his former boss until Tuesday afternoon to issue a public retraction and apology for what he said are "defamatory" statements meant to deflect responsibility for their client's conviction on first-degree murder charges.
 
In his 15-page letter shared with the media, the former Drew Peterson attorney lashed out at Joel Brodsky, accusing him of leading the legal team like a dictator and fabricating lies to make himself looking better.
 
Greenberg was fired just days after Peterson was convicted of in the drowning death of his third wife, Kathleen Savio.
 
Greenberg wrote that Brodsky "made one of the greatest mistakes in the history of jurisprudence" when he put Savio's divorce attorney, Harry Smith, on the stand. It was that testimony that jurors later said convinced them to return a guilty verdict.

In a letter shown to the Chicago Sun-Times, Peterson contends Greenberg mishandled his part of the defense and then rips him for attending a post-trial event for Will County State’s Attorney James Glasgow.

In his letter, Peterson accused Greenberg of criticizing the decision to call Smith simply as an excuse to get more publicity for himself.
 
He chastised Greenberg, an attorney since 1986, for attending a Sept. 19 event for Glasgow, who is running for re-election as the county’s top prosecutor. Glasgow personally led the team that prosecuted Peterson.

That appearance, Peterson wrote, “can only project to the public that Mr. Greenberg is in favor of my conviction and approving of everything the state’s attorney has done to convict me.”
 
In his letter to the Illinois Attorney Registration and Disciplinary Commission, Peterson asks the agency to investigate Greenberg’s actions.
 
An attorney for the commission wouldn’t comment on whether Peterson had asked for an investigation.
 
Peterson faces a maximum 60-year prison term when he is sentenced on Nov. 26.

Already divided, the Drew Peterson defense team has become even more fractured, as one attorney has quit the case and another has accused leader Joel Brodsky of sending wildly inappropriate emails, including one that suggested the lawyer should shoot himself.

The infighting has spun so far out of control since the retired Bolingbrook police sergeant's conviction this month that even defense team member Joseph Lopez — who is known for wearing hot pink socks to court and famously proclaiming that the framers of the U.S. Constitution "would barf" on the evidence against Peterson — called the situation over-the-top.

"I've never seen anything like it," Lopez said. "Obviously there's a lovers' quarrel going on. I don't want any part of it."

Lopez and attorney Ralph Meczyk confirmed Monday that Darryl Goldberg, who handled much of the scientific and medical-related testimony, quit the case. Goldberg rarely participated in the Peterson team's twice-daily trial media conferences and often seemed unamused by his co-counsels' behavior outside the courtroom.

Maybe the defense team can make an appearance with Jerry Springer?  Or, can you imagine them on Dr. Phil?  "How's that working for you Mr. Brodsky?"  


Kidding aside, aren't these supposed to be professionals?   Somewhere lost in their egos was the murder of a young woman named Kathleen and in Stacy's upcoming case.   And like it or not, Drew Peterson as with others accused of crimes should have legal representation.  I hope these defense attorneys aren't trying to orchestrate something that could affect Kathleen Savio's case decision or even Stacy's case.  This  kind of infighting has probably been going on for years and years on both prosecution and defense teams, but it looks like more of it is out in the open.  The airing of dirty linen in public.  JMHO

The judge in the Drew Peterson murder trial came up with reasons to deny the press and public from seeing email exchanges between him and the attorneys on the case.

Judge Edward Burmila shared his thoughts on keeping the email conversations secret during a brief hearing Tuesday morning.

At least three media outlets—including Patch—have requested the email traded between Burmila, Peterson's attorneys and prosecutors. The requests were made under the Illinois Freedom of Information Act.

Prior to Peterson's July murder trial, which ended in his conviction on Sept. 6, Judge Burmila instructed prosecutors and defense attorneys to hash out issues in the case via email. Burmila employed his email idea in hopes of speeding along the trial, which lasted more than a month.

The requests were made to the Will County State's Attorney's Office. Assistant State's Attorney Marie Czech appealed to Burmila on Tuesday for clarifcation on whether to provide the email to the press or to deny the requests.

Off the bat, Burmila said "98 percent" of the conversations should be off limits since they discuss legal matters filed under seal by court order. Burmila did not say how much longer those documents will remain under seal now that the trial is over.

Burmila said other email cannot be seen by the public because the conversations reference the October 2007 disappearance of Peterson's fourth wife, Stacy Peterson.

Stacy Peterson remains missing and no one has been charged in connection with her disappearance. Burmila said the mystery surrounding Stacy's whereabouts is an "ongoing criminal investigation," and any email messages touching on the situation are confidential.

"So those are out," the judge said.

Peterson attorney Joel Brodsky—the only member of the convicted wife-killer's dwindling defense team to show up for the hearing—voiced his opposition to releasing the email.

After the hearing, Brodsky slipped out a back door. A courthouse source said Brodsky admitted he was fleeing because he did not want to have to answer to the media.

Peterson faces sentencing for the murder of his third wife, Kathleen Savio, on Nov. 26.

Drew Peterson's lead attorney asked a Will County judge today to postpone the Bolingbrook police sergeant's November sentencing because squabbles among defense team members have prevented him from finishing a critical post-trial motion.

"We want to make sure we do a sufficient job," attorney Joel Brodsky said, adding recent events have been "pointing us away from what's important."

Brodsky requested that he be given until Nov. 30 to file a motion for a new trial. That would mean pushing sentencing back to mid-December or early January, he said.

Peterson faces up to 60 years in prison after being convicted of murdering his third wife, Kathleen Savio. The sentencing was originally set for Nov. 26.

The judge told Brodsky that he had already given the defense a generous extension to complete the motion. However, he will consider a request for a delay next month.

The defense has fallen behind schedule, in part, because Peterson recently fired attorney Steve Greenberg, who handled most of the team's motions. Greenberg, who had won several key arguments during the trial, was dismissed after getting into a public feud with Brodsky after the verdict.

CHICAGO (CBS) – The pathologist who ruled Kathleen Savio was the victim of a homicide after authorities reopened their investigation into her death said being skeptical was the key to determining it was no simple accident.

CBS 2’s Mike Puccinelli reports Dr. Larry Blum’s testimony at Drew Peterson’s murder trial this summer was a key factor in the jury’s decision to convict Peterson of killing his third wife.

Blum performed the second autopsy on Savio’s body, three and a half years after a coroner’s jury determined her 2004 death to be an accident.

His autopsy ruled Savio’s death was a homicide. On the last page of his report, Blum wrote, “The cause of the death of Kathleen Savio was drowning. The manner of the death was homicide.”

espite the passage of time and the decomposed state of Savio’s body, Blum was able to determine that Savio’s injuries were consistent with murder. He pointed to injuries to both the front and back of her head and body.

“[A] fall to the back in the tub would produce injuries to the back, not to the front,” he said.

Those weren’t the only injuries that Blum said weren’t consistent with a slip and fall.

“The hemorrhage in the chest muscles, which indicated a forceful drowning over the sink, over the toilet, [or] over the bathtub,” he said.

However, during the first autopsy, the original pathologist in the case determined the injury pattern could have been caused by an accidental fall.

Blum said such a statement was unusual, because that doctor wasn’t asked to rule on the manner of death. Blum said the original pathologist likely was pressured into ruling Savio’s death was an accident.

“I don’t believe he put it in there on his own. I think he was asked to make a statement,” Blum said.

He said the initial investigators appeared to do their work with blinders on, and he said contradicting the initial Illinois State Police investigation wasn’t easy.
There were many things, many red flags that should go up in this case,” Blum said. “They were down.”

Asked if he believed that, if the initial investigation had been done more thoroughly that perhaps Drew’s missing fourth wife, Stacy Peterson, would still be around, Blum said that’s absolutely possible.

JOLIET — The post-trial drama with Drew Peterson’s lawyers continued Thursday.

Attorney Steve Greenberg, who Peterson “fired” from his defense team, had filed a motion to withdraw as one of the former Bolingbrook cop’s lawyers.
 
But after a lengthy conference with Peterson Thursday morning, Greenberg asked that the motion be postponed to Nov. 16.
 
“I love Drew, Drew loves me,” Greenberg said in the hallway outside the courtroom after the appearance before Judge Edward Burmila.
 
Peterson “asked me not to say anything,” Greenberg said. “I find it difficult to bite my tongue, but that’s what I’ll do.
 
“I think my letter spoke for how I feel.”

Lead Peterson defense attorney Joel Brodsky, who was not at the hearing, said he spoke to Peterson afterward.
 
“The reason for the continuance of Mr. Greenberg’s motion is so Mr. Peterson can have a confrontation with Mr. Greenberg where all attorney-client privileges are in place,” Brodsky said. “Nothing else has changed.”
 
Brodsky would not elaborate.

Greenberg, who spent about a half-hour talking with Peterson Thursday morning before the court appearance, declined to comment on Brodsky’s remark.

Greenberg simply smiled when asked if he told Peterson the only way he'd stay on the case is if Brodsky was gone.

Peterson "asked me not to comment, so I'm not going to comment," said Greenberg, who bit his lower lip and added, "See me biting my lip?"

Greenberg and Peterson were in court Thursday so Greenberg could file a motion to withdraw from the case. But prior to the hearing, Greenberg and Peterson engaged in a lengthy conversation in a courtroom jury box, then retired to a back room to talk even more.

When they emerged, Judge Edward Burmila postponed Greenberg's motion to withdraw until Nov. 16.

Not long after the trial, Brodsky filed a motion from Peterson "terminating" Greenberg as his attorney. But the filing apparently has no legal standing, and the matter only came up in court Thursday after Greenberg filed a motion to withdraw.

It's unclear which attorney Peterson will stick with as he crafts his appeal.

Brodsky, who did not appear in Will County court Thursday, released a statement saying Peterson asked for more time so he could have a "confrontation with Mr. Greenberg where all attorney client privileges are in place" and that "nothing else has changed."

Greenberg declined to comment outside court, but another defense team lawyer seemed to contradict Brodsky, saying Peterson may want Greenberg, an accomplished appellate lawyer, on his team.

"We might get the band back together and go on a mission from God," said defense attorney Joseph Lopez, quoting from "The Blues Brothers."

The case is scheduled to resume Nov. 16. Peterson's sentencing is set for Nov. 26.

Lawyer: New trial sought for Drew Peterson

The Drew Peterson saga took another bizarre turn Tuesday, as an outside attorney filed a motion seeking to overturn the former Bolingbrook police officer’s murder conviction claiming his lawyers flubbed the case.

John Paul Carroll, of Naperville, said he filed the motion in Will County Court on Tuesday afternoon seeking a new trial for Peterson. Carroll said Peterson did not get adequate legal representation during the trial that led to his conviction for the March 2004 murder of his third wife, Kathleen Savio.
 
Carroll said that’s why he, and not lead Peterson defense attorney Joel Brodsky, filed the motion.

But Brodsky balked at the notion and said Carroll was not authorized to act on his client’s behalf.
 
Carroll, also a former cop, was called in to consult with Peterson about his police pension, Brodsky said. Stephen Peterson, Drew Peterson’s son, has been trying to contact Carroll to reconnect with him since then, but has been ignored, Brodsky said.
 
Brodsky said he was aware that Peterson was meeting with Carroll, but that it was only about his pension. Peterson has said in three face-to-face meetings and at least eight phone conversations that Carroll was only brought in as a consultant, Brodsky said.
 
“I spoke to Drew today. Drew reiterated to me that this is absolutely unauthorized. (Carroll) has no authority to file it,” Brodsky said. “He is boggled. That’s Drew’s word, ‘boggled’ as to how he did this.”

Brodsky said he had heard about the motion Carroll filed about 4 p.m., but had not yet seen it. A hearing is scheduled for Friday morning, the attorneys said.
 
“The filing should be stricken. It’s absolute insanity,” Brodsky said. “It’s bizarre beyond belief. It’s so unbelievable, I don’t know what to say. I’m speechless.”
