Peterson judge to meet with lawyer about Savio statements

Before she turned up dead, Drew Peterson’s third wife confided in her attorney that she expected her husband to kill her and she didn’t want him to profit from her death.
A Will County judge was hearing arguments Wednesday on whether the testimony from attorney Harry Smith, who represented Kathleen Savio, constituted a violation of attorney-client privilege. Smith, however, disagrees and says he has more information that he’s withholding because it would break the privileged silence between attorneys and their clients.
Smith said Savio made many statements such as, “He’s going to kill me. He’s going to make it look like an accident.” Smith said Savio repeatedly told him she didn’t want Peterson to benefit from her death.
“Kathy wanted me to make sure that her death, if unresolved, did not go without repurcussions for Drew,” Smith said before a Will County courtroom.

Burmila said he would meet privately with Smith, at another time, to hear what sort of additional information he’s withholding and decide whether it should be revealed publicly.

Burmila also rejected Peterson’s motion about prosecutors’ alleged lack of evidence, and told them to raise objections and seek a directed verdict.

In addition to limiting Smith’s testimony, court records show Peterson’s lawyers want the Will County state’s attorney’s office to give them a witness list and identify what hearsay evidence they plan to present. Prosecutors have filed their responses under seal.
An Illinois appellate court’s April ruling that prosecutors can use hearsay evidence finally cleared the way for Peterson’s long-delayed trial to begin. He’s been held in the Will County jail since his arrest in May 2009.

(MCT) — Divorce attorney Harry Smith may be able to testify that Drew Peterson's third wife confided to him that Peterson would kill her, a Will County judge ruled Wednesday, but only after the judge questions Smith alone about information he has so far withheld from authorities.
Smith, who represented Peterson's third wife, Kathleen Savio, was called to testify Wednesday in a hearing over whether Savio had waived the attorney-client privilege before her 2004 death.
Attorneys for Peterson, a former Bolingbrook police sergeant charged with drowning Savio, had sought to bar Smith from testifying on the grounds that the privilege was still intact.
Judge Edward Burmila ruled the privilege had been waived but said he was concerned Smith hadn't shared information that could be helpful to Peterson. Smith testified that he believed some information was still privileged.
"What reason should there be to hold back any information," Burmila said.
He told the attorneys he would question Smith privately and then rule whether Smith must also testify about the so-far-undisclosed information. Burmila said if he decides Smith must testify completely and he refuses, the judge might bar all of Smith's testimony.
The judge also ruled that the jury for next month's trial will be culled from a panel assembled almost three years ago and ordered to avoid Peterson media coverage. Defense attorneys had sought to have a new group of potential jurors assembled.
Eight motions were argued Wednesday, with Burmila clearing the courtroom for arguments over whether statements from the Rev. Neil Schori will be allowed.
Prosecutors plan to call Schori to testify that Peterson's missing fourth wife, Stacy, told him she saw Peterson return home late, dressed in black and carrying a bag of women's clothing shortly before Savio was found dead.
Burmila is expected to rule on that issue next week.

A judge Thursday said he will order Kathleen Savio's divorce attorney to testify in former Bolingbrook police sergeant Drew Peterson's trial.
Peterson is charged with killing Savio, his third wife, who was found dead in a bathtub in 2004. As preparations continue for the July murder trial, Peterson's attorneys wanted to bar testimony from Savio's attorney Harry Smith.
Will County Circuit Judge Edward Burmila met with Smith last week to question the divorce attorney before deciding whether he can testify in the trial.
Smith said he shouldn't have to testify conversations he had with Savio and Stacy Peterson, who went missing in 2007. Burmila ruled Thursday Smith will have to.
Defense attorneys say Smith violated attorney-client privilege when he testified at an evidentiary hearing about conversations with Savio and Stacy Peterson. Smith maintains Stacy Peterson told him Peterson was angry because he thought she'd revealed he killed Savio.

I am all for nailing this POS butt to the wall, but I must admit I am having a difficult time with the attorney and the pastor testifying. But it does sound as if this Judge knows what he is doing and possibly they will still be able to hold certain conversations inviolate.

Sister, this article has some additional information that seems to clarify the testimony from the pastor and divorce lawyer that might be admitted by the judge. I guess we'll have to wait and see.

One is considered a clear victory for prosecutors: Stacy's Peterson's pastor will be allowed to testify as long as the state can prove Rev. Neil Schori's testimony is relevant. Peterson's attorneys were hoping to get Schori's statements thrown out based on marital privilege.
"We are very pleased with the judge's ruling today with regards to the application of the husband-wife privilege. He ruled that not all actions are communicative, and the ones that are not meant to be communication can be admissible in a trial," said Will County State's Attorney James Glasgow.
If allowed, Schori is expected to tell a jury that Drew Peterson's fourth and missing wife, Stacy, told him that she saw the former Bolingbrook cop return home the night his third wife Kathleen Savio was found dead dressed in black and carrying a bag of women's clothing.
Defense attorneys doubt prosecutors will prove Schori's testimony is relevant.
"I am pretty confident that speculative and guesswork is not going to be allowed into evidence, and if that's the case then we will not be hearing much from Rev. Schori," said Drew Peterson's Attorney Joel Brodsky.
But attorneys will be hearing testimony from Kathleen Savio's divorce attorney. While prosecutors want to use Harry Smith as a witness to testify about how Savio told him she feared Peterson would kill her, Judge Burmilla said he will first question Smith, outside the presence of a jury, on other conversations Savio had with her attorney before she died.
"There's an indication there that there's gonna be some testimony if he's compelled to testify what his client told him, that she admitted to some of the allegations that she denied later, which would affect her credibility," said Drew Peterson's attorney Joe Lopez.

Peterson wins right to access Savio evidence

June 25, 2012 (WLS) -- Drew Peterson's defense attorneys have won the right to access evidence of his ex-wife Kathleen Savio's past into his murder trial next month.

On Monday, a judge ruled both the defense and prosecutors can have access to two previous expunged court files.
Sources tell ABC7 that the two court filings are of misdemeanor battery cases filed against Savio in 2002.
According to published reports, the charges were filed by Peterson, and Savio was acquitted in both cases.

Drew Peterson’s jury may not see the “murder weapon” Will County prosecutors say he used to kill Kathleen Savio: her bathtub.
Judge Edward Burmila barred prosecutors from introducing the bathtub as evidence in Peterson’s trial for now, even though prosecutors argued jurors need to see and touch the spot where Savio drowned in 2004.
“The bathtub is now essentially the murder weapon,” Assistant State’s Attorney John Connor said, describing the tub as Savio’s “final resting place.”
Burmila left open the possibility of allowing prosecutors to bring the actual tub into the courtroom, depending on the testimony offered by Peterson’s expert witnesses.
Defense attorney Joe Lopez objected, contending prosecutors simply wanted the tub ushered into the courtroom for “dramatic effect.”
Jurors wouldn’t get an accurate picture of how Savio drowned in the bathtub without seeing it in the Bolingbrook home where she died during nasty divorce proceedings from Peterson.
“The jury is deprived of seeing how the tub really looked,” Lopez said.
After prosecutors offered to reinstall the tub in Savio’s former house, Burmila balked, saying he wouldn’t impose on the current owners, who have no involvement in the case.
Prosecutors wanted jurors to be able to examine the bathtub — and even touch it — in an apparent effort to bolster testimony from their experts that Savio didn’t accidentally drown in the tub after slipping and falling.

Last week, In Session senior producer Grace Wong and I were driving through the Bolingbrook, Illinois, neighborhood where Drew Peterson once lived with his third wife, Kathleen Savio, and his fourth wife, Stacy Peterson. The two homes are about a mile apart.
It was a scorcher of a day; we had arrived in Illinois a few hours earlier and headed directly to Bolingbrook from the airport.
Drew Peterson’s house is on a quiet cul-de-sac. His son, Stephen, 33, now lives in the home his father once shared with Stacy and their two children, Anthony, who's now nine, and Lacy, seven, as well as his father’s two sons from his marriage to Savio, Thomas, 19, and Kris, 17. Stephen, a divorced father, is raising his half brothers and sister, and his own daughter, who is three.
Stephen and the children moved into Peterson’s house after Peterson’s May 2009 arrest and indictment for the murder of Savio. According to Stephen, the neighbors were considerate and took down memorials and signs from their front lawns that honored Anthony and Lacy's missing mother. There have been no dust-ups with the neighbors; it’s apparently been congenial and quiet for the past few years -- a contrast to the weeks and months after Stacy went missing in October 2007. Thomas is now enrolled at the University of Pennsylvania and Kris is heading to college in the fall.
We knocked on the door, initially to notify Stephen that we were going to take some photos of the exterior of the home. We were a bit surprised when he stepped outside, leaving the children in the house, to talk to us on the front porch.

Stephen Peterson, Drew Peterson's son from a previous marriage, issued a statement Monday on behalf of his siblings, noting that they are staying with him.
"All of the children of Drew Peterson fully support their father and know that he is innocent of the charges against him. We know him better than anyone else in the world and we know he is not guilty," Stephen Peterson said.
Drew Peterson wanted his children to stay with his adult son, said Reem Odeh, the law partner of Joel Brodsky, Peterson's attorney, who has worked on Peterson's behalf.
After Peterson's arrest, the state's Department of Children and Family Services turned his children over to "relatives" they would not identify. The child welfare agency also investigated Stephen Peterson's home, Odeh said.

Drew Peterson, charged in the death of his third wife and suspected in the disappearance of his fourth, soon might face another legal battle: a custody fight.

Stephen Peterson, Drew Peterson's son from a previous marriage, issued a statement Monday on behalf of his siblings, noting that they are staying with him.
"All of the children of Drew Peterson fully support their father and know that he is innocent of the charges against him. We know him better than anyone else in the world and we know he is not guilty," Stephen Peterson said.
Drew Peterson wanted his children to stay with his adult son, said Reem Odeh, the law partner of Joel Brodsky, Peterson's attorney, who has worked on Peterson's behalf.
After Peterson's arrest, the state's Department of Children and Family Services turned his children over to "relatives" they would not identify. The child welfare agency also investigated Stephen Peterson's home, Odeh said.

I remember this being in the news. And I remember when it was announced that Stephen was gettting divorced. I just don't understand how Stephen's ex would allow him to have custody of their child unless Stephen is a chip off the ole block and lied to get it. Those poor kids.

A lawyer for Drew Peterson said Sunday that Will County investigators tried to stiff the couple that bought Kathleen Savio’s Bolingbrook home after removing the bathtub, carpeting and other items from the house.
Joel Brodsky said in an email that Rodolfo Hernandez, who lives in the house where Peterson’s third wife, Savio, was found dead in 2004, had to hire a lawyer to get reimbursement for the items that were taken.
“And all they payed (sic) him for was the value of the tub and faucet, not for any labor of a plubmer (sic) to have to re-install the tub (the most expensive part),” Brodsky wrote in an email. “He told me he is made (sic) at the cops because they mislead (sic) him about being paid, and now he won’t do anything without a court order.”
No one answered the door at the Hernandez home Monday afternoon, and the family’s phone number is unlisted.
Charles B. Pelkie, spokesman for the Will County state’s attorney’s office, said Monday that Brodsky’s email was simply an attempt to “stir up controversy,” that the office and the state police have been communicating directly with Hernandez on the investigation, not an attorney, and have made sure he was fully compensated for his time and trouble.
